[0:00:00] welcome everyone i'm not calling this meeting to order please stand with us i will be led in prayer by alderman gallagher please remain standing after that for the pledge of allegiance heavenly father lord we thank you for delivering us all here safely tonight lord we pray that you would watch over our city and keep it safe lord and that you would give us wisdom as we go throughout our city business in your name we pray amen i pledge allegiance to the flag of the united states of america and to the republic for which it stands one nation under god indivisible with liberty and justice for all okay thanks everyone for uh hanging there with the weather for us today i know it's kind of iffy if we're going to have this meeting tonight it all worked out so i appreciate the cooperation and everyone uh making or doing the extra effort to get here first on the agenda this evening is approval of minutes for the january 2nd 2018 meeting mr mayor we approve the minutes of the regular meeting of january 2nd 2018 with any additions deletions or corrections second we have a motion balancing second moment kelly is there any discussion hearing none roll call yes conor mckelly yes yes okay that motion carries next on the agenda is the bankplus amphitheater concert promoter contract award just an update for our board i still have not gotten the signed contract back live nation uh is as you authorized we deal with them their attorneys or their legal team is still looking over the contract we expect to have that soon i did follow up with them today actually uh saying explain to them that we want the signed contract before we move forward into

[0:02:02] you know an actual inspection of the facility uh and any and look at any other date so they understand that again i don't have any reason to think there's any concern i just think it's been a you know weather issue and a time in the issue but but as soon as i have that i'll bring that back at the next meeting live nation will be in south haven on january 23rd uh they want to be here to do a physical inspection of the amphitheater um so i hope to have that kind uh have that signed contract before then i'll continue to follow up and push for that next on the agenda's work authorization for an investigation the foundation of the south haven multi-purpose arena as you all will recall we've had discussion about the arena floor not being level you know when the when the facility was first built there was a plan of having western sports there having rodeos and you know livestock shows that kind of thing so that's the reason that the floor is not level we realize now that you know we can eliminate the oval shape and have a square or rectangular facility it gives us a lot more flexibility with doing more things there obviously with volleyball coming there if we have the floor level we could um continue to do some of the things that were so controversial you know a couple months ago with the flea markets gun shows and other things like that so it is my recommendation to you that we do spend the money and level that floor the first have been doing that is we need to have an engineering design done you know to make sure that there's no problems underneath the foundation and to make sure that we design that appropriately so in the packet you'll find that there's a with civ a contract with civil link to do that i'm looking for the fourteen thousand dollars and that's to design the leveling of the floor so is there a motion to open that up for further discussion

[0:04:05] absolutely got a motion from alderman gallagher second involvement brooks any discussion so this is just to put the plan together correct what it will need how much it'll actually cost to do it and all that stuff exactly and also in addition to that to make sure that there's no uh foundation problems you know we need to check the drainage and make sure that there's no issues there uh that's things that haven't been looked into since the arena was built so before you start spending you know a few hundred thousand dollars on uh you know before we want to make exactly any other discussion how exactly will they do that are they gonna if things go as we projected are they going to backfill it with dirt and then what they will do and um i did an inspection with wes and uh and dan cordell recently what they'll do if you can visualize or recall what it looks like on the inside they'll bust the rail out so they have to knock some concrete out to get rid of the rail uh then at that point they will um they'll be appropriate seams put in you know so that so the concrete's laid properly then they will do a back fill i think it's with limestone because i don't think it's all dirt i think it's limestone backfill and then at that point they'll overlay it with concrete to level it out it's about 10 inches now it's a 10 inch gap from the from the oval to the exterior but answer your question back fill the limestone and then overlay after that any other discussion hearing none all in favor say all opposed say no eyes have it motion carries all right next on the agenda's utilities department agreement with tyler technology a couple agreements

[0:06:11] tonight the first ones with tyler technology this will be for chris shelton to sign into the program through tyler technology the health utilities department of the billing and servicing of the for the city residents it's also a purchase of software so the purchase of software though is ancillary to the actual professional service being of being provided by tyler so you can approve the software purchase with a finding that is ancillary to this professional service being provided review the contract or the quote made a couple of suggestions and revisions they agreed to those chris shelton and ray lev as well and his recommendation tonight or authorize chris shelton to sign this quote um with tyler technologies for the billing and um either here i can answer questions you'll have mr mayor i'll make that motion second we have a motion of alderman payne second baltimore gallagher is there any discussion hearing none all in favor say aye aye all posts say no i just have a question carries next on the agenda utilities department agreement with comcast there's actually three separate agreements uh with comcast for uh 150 approximately 50 a month to provide internet services at the water towers and stations to allow assistance with the scada systems for the utility department this is needed to help with the city's reading of the meters or reading of the issues going on with the particular department so tonight you see the authorization for the mayor to sign all three agreements for the different water stations towers either ray rock can answer any questions this is your standard compass business agreement that since its agreement requiring experience reminding the board needed to approve second we have a motion by alderman brooks second ballerman payne is there any discussion none all in favor say aye all right

[0:08:14] all opposed say no eyes have it motion carries the next on the agenda is the utilities department agreement with ideal chemical this is the agreement with hydrochemical for the third and final renewal we went to bid in this 2016. so we had a contract from 16 to 17 70 to 18 and 18 to 19 this is the last renewal period ida chemical has agreed to renew the chemicals at the same exact price as they've been the last two years and they bid it on uh so tonight you need authorization for the mayor to sign this renewal second amendment to the renewal with uh ideal chemical for one more year for the police department to purchase chemicals um and then next door i'm going to bid on this again this is too soft what's that is this right is this going in the water is that what you're doing yeah yes that's all the chemicals for these i think all the jungles we need so it's a big i'll make that motion second we have a motion ballroom in flores second ballroom and pain is there any discussion hearing none all in favor say aye aye all posts say no i just have a motion carries okay next on the agenda is a tax exempt resolution for cenex corporation i'll get that real quick mayor um just about going back number seven that's what the board everybody everywhere the minutes will reflect that there was a finding and it was the purchase of software was ancillary professional services just so the board's aware of that so that was your motion yes back to uh number 10 on taxpayer resolution from senex corporation at the december meeting you approve the uh taxes and resolution based on this council can be based on the advice or the approval from the center council since that time it's been submitted to the mississippi department of revenue they also approved it as well so tonight i just need final approval for the resolution for the tax-exempt um personal and real property for sales corporation and authorize the mayor's assignment resolution and submit to the

[0:10:16] city department revenue so i moved second we have a motion ballroom in flores second volume in pain is there any discussion hearing known yes okay that motion carries next on the agenda is a resolution to men the city handbook basically chris wilson's here with us basically what this is is to clarify language about siege property namely city cell phones just to go on record for the minutes and video to remind everyone that a a city cell phone is owned by the city of south haven an employee has no right to expect any privacy with a city's cell phone so we wanted to clarify that that includes not only returning the phone if you're no longer an employee for the city but it also means that you turn over any passcodes or anything like that to allow the city immediate access to anything that may be on that phone so again just to summarize a city phone or city property the property must be returned to the city at the end of employment without any expectation of privacy anything else chris what he said yeah absolutely it's the clarification uh is needed because of a real life situation that we recently experienced so it it is my recommendation that we approve this mr martin luther adopt the resolution of the city of south america to attend the city of handbook as president of the state brooks second ballroom and gallagher is there any discussion are we allowing them to have to put codes on the phones uh certainly i mean they would want to

[0:12:19] put codes on the phone just in case we're lost you know because there are some some information that we wouldn't want a stranger to have so i don't care i just was curious so how do we record are we going to record those codes that way we know what they are well we haven't but we basically what we run into we want to make sure we understand or that the employees understand that uh that they will basically unlock the phone before they leave correct okay but chris would you add to that yeah i mean it would become your your outside of the policy would become almost a theft situation if it were to take your phone or not unlock it at that point and we didn't have access to them certain departments have sense of information they may have on it investigatory information on their phone on the civic phone that you want to lock on there anyway what this is doing is basically saying upon resignation or leaving you will unlock the phone for inspection upon the time you leave what happens if it's there's an accident and we have an employee who unfortunately may just die on the job how do we get access to those folks i mean that's what we're going to start doing is possibly getting with each employee to get their codes and we'll have it not that we access it like that right no but departments that access okay we can get the information this just uh takes a longer amount of time okay as we can safeguard the city in rare instances right we don't have any ongoing issues no no i just was like you know that could that could happen any other discussion hearing none roll call yes okay and that motion carries next on the agenda is a resolution for surplus firearms for our sergeants that recently retired strokes and ultra-mary chief pearl peter mayor board uh we've got a resolution uh in front of you where we're requesting to give sergeant jeff scroggs his duty weapon upon his retirement this this month he served 23 years with the city and

[0:16:26] licensed dealer mr mayor would we adopt the resolution mayor board of aldermen declaring surplus property in the police department disposing of according to state law second we have a motion bomber in pain second baltimore kelly is there any discussion hearing none roll call yes next on the agenda's authorization for our fire department to apply for the afg grant this is our deputy chief soon to be our fire chief uh mr danny scalia just give them a hand fireform is requesting authorization to apply for the 2018 afg grant specifically for a source capture exhaust extraction system this is a exhaust removable systems that we're looking to install in station three on elmore and station four get well we did a couple of preliminary appraisals just get an idea of what the cost would be how it would impact our current budget and they both came in to about 97 to 98 000 as a total for the two stations there's a ten percent match for city so this would cost us maybe ten thousand dollars we authorize the southern fire department to apply for the efg grant second we have a motion ballroom and brooks second ballroom in flores is there any discussion hearing none all in favor say aye aye all posts say no eyes have it

[0:18:29] motion carries thank you sir thank you all right next on the agenda is our planning agenda miss whitney cook yes sir we just have one application and it is uh in southern community church for a conditional use permit to allow reader boards to sign on their property you'll see it's directly across from the tanger outlet it's going to be on the southeast corner of plum point avenue and airways boulevard there are some stipulations for the reader boards on the height of lettering and the color that they can portray on it they had some questions on that with the design criteria but have corrected that since the planning commission that being said we're asking for approval tonight mr mayhem will be provided number one on the planning agenda we have a motion bottom in pain second ballroom and brooks is there any discussion thank you next on the agenda mayor's report just to update you on a few things we do need to make decisions on two of the trips the washington dc trip it's the congressional briefing trip that officials from the county and all the cities in desoto county go as a group to talk to our legislators in washington uh that trip is coming up unfortunately that trip is the same week as spring fest this year so it creates somewhat of a problem i may not attend either because of that i have some events that i need to be here for for spring fest so i just want to open that up for discussion to see if we do want you know me to go or if anyone else would like to go either with or in place of me is there a motion to open that up for discussion so moved

[0:20:30] second got a motion of alderman brooks second ballroom in flores floor is open for discussion comments i can't go i can't go this year i've got commitments for my i've only got limited vacation and i've kind of have that committed for a couple things i might be able to go back to need to double check okay please i mentioned this at the last meeting the um the uh desoto county economic council this conflict was unavoidable that was the only week they could get the hotel where the greg volley stays in so that's why the conflict normally it's not this week anyways did you say arnold gallagher that you were interested in going yeah i think i can do it yes okay what you could do tonight is authorized if you're interested in going tonight go ahead and authorize those people to travel and that way you don't have to you can jump after tonight we don't mean to get in front of three weeks where forward the way that's calendar falls so health rise travel for those people who are interested if you don't go you do have the operation to go i'll make that question okay authorization of travel in case we decide to go maybe alderman brooks second bottom of the gallery but that's for william brooks mayor darren muscle white joel gallagher and possibly raymond flores yeah does that need to be that specific you need to name the name so you've got this space yeah so you would want to name those three plus the mayor operation to go doesn't mean you have to go if you have authorization okay i'll make that move well we have a motion in a second is there any other discussion hearing none all in favor say all folks say no i just have it motion

[0:22:33] care we do still need to make a decision um so by friday by the end of the week we really need to let them know um so if y'all i'll reach out to you guys let me know if you can and we'll make a final decision okay thank you same thing on the we talked about the icsc conference in las vegas that's a retail uh conference it's one of the largest retail conferences in the united states we have not gone in several years uh with the things that are developing in our city right now it's an ideal time for us to go again i think that we do need to do that we did not specifically budget for that however we can make some adjustments with the hotel tourism fund or other areas to go if y'all want to do that it's my recommendation that if we don't go this year then we at least uh plan on doing that next year um but i think the last time we talked about oliver and payne you felt like it was important to do this year you it's very important okay so um i've made plans in my schedule to go so uh but again we need to the planning is a little detailed you have to become a member of the conference before you can we can book the trip and uh we need it in may we need to start we need to get busy with this you get you'll get a list of hotels you'll get at a reduced rate that are part of the conference and the sooner you know the better so um we'll need to authorize travel but obviously again we'll need to decide as soon as we can who is going to go is there anyone that knows for certain that they can go what are the dates that's the 20th may 20th through the 23rd i can't i will not be going on the 20th i'll have to leave that monday morning the 21st so if you want to travel with me we can we can schedule our early morning flight on the 21st are you going to try and go this year

[0:24:42] and next year or just this year um well initially i was just talking about we need to get in the routine and going again and start budgeting for that but um i do think it's important i think this year would be important to go and you know mr mayor you would mention uh for that possibly uh miss whitney cook and uh the chamber director karma kyle going do we need to make a motion for travel for them um as well that was the next thing i was going to bring up i don't know that the chamber budgeted for a trip like that they did not i would be more than willing to make the motion for us to pay for their travel as well at least the chamber directors anyway can we make that all in one motion neck or does that need to be too separate how we pay for it yeah you would want to make it one motion and and you would want to make a new your troops i guess you paying for your tourism fund you'd make a motion authorizing the tour of the fund to pay for that because it's promoting tourism industry within the city obviously so make a motion to authorize uh the use of those funds for that purpose under because that's what to be allowed for and then authorize who's going okay so we'll incorporate that with honor and painted honor and pain is suggesting we make a motion to or he's making that motion too yeah i'll make the motion to use our tourism fund to pay for um do we need to name the specific alderman that would work can we just say how about two all right if we say two and then planning director and chamber director you you would want to just based on past you won't be really specific on who would be going um under that line so okay i will not be going you can go okay why don't we do this and you know for certain you can't go for audrey kelly knows he can't go i can't automate flores knows he can't go so with someone just to make sure we're all clear here would you remake a motion alderman payne to authorize mayor alderman wheeler alderman gallagher

[0:26:45] alderman brooks planning director whitney cook and chamber commerce director director carmen kyle uh to travel to the conference [Laughter] i'll make the way that we use tours and funds to allow uh william brooks darren russell white joel gallagher and gerald wheeler to go to the ics i'm sorry apology i'm john david wheeler as well as playing director whitney cook and chamber director karma kyle based on fighting based on the appearance of funds in the findings you're promoting the industry within the city by visiting a commission center by a building i could not have said it actually you're an excellent attorney you are okay so we have a motion to do all that from uh alderman payne is our second and the second ballroom and gallagher is there any other discussion well let me add one more thing before we move on uh doing some research christy faulkner did some research on it uh it's tremendously less expensive if you become a member it's 100 membership fee and then your cost of registration is almost half of that of a non-member so for those going uh christy will help register you register you as a member and register you for the conference but again we need to move on that quick numbers again okay all right so that sounds good um any other discussion hearing non-roll call yes okay that motion carries last thing tonight um you all know that we're working on i-55 city entrance sign signs and um plane director whitney cook is uh working together with urban ark to design the sign obviously these signs are going to be

[0:28:47] present for many years they're going to be brick-based landscaping lights they'll be we want it to be a grand entrance when you come into the city on interstate 55 the design i don't want us to get paralyzed by you know tossing around with too many different ideas but i wouldn't like the board's input on the design we don't have that tonight but i'd like you to get with me and whitney i'd like y'all to be involved in that see the design share some input on your thoughts on it we do have one design that's it's very progressive it's uh looks really good but it's different and again knowing that we're going to stick a sign on the ground it's going to be there for a few decades i'd like to make sure it's one we like so i'm asking for your help at this time urban arc has they've already designed that one and they're going to design another one that um is more traditional and so we'll have two options if you want to add anything whitney am i saying that right yeah i think you've got it covered right now okay i just again i just want to make sure it's something that we're happy with for a long time but both of them look uh will look very nice and we'll have that other design soon but if you'll just if all of you will um at your convenience reach out to me i'll show you the design and i'd like to know what you think about and we want to get moving on that is again as soon as we can and that's all here are the locations for these signs uh we're working on that the uh the one we're going to do first is going to be on the uh the southern entrance to the city unfortunately when you enter the city you know around starlanding road there's not a lot of great options on the northbound side the federal transportation department will not allow you to put a sign on their property so that's what makes it challenging we got to get it off the interstate property but also find a place where it's visible so the most ideal location at this time is actually

[0:30:50] um to the west of the southbound lane but there's a hill uh when you when you're going northbound on 55 after you pass star landing there's a little hill that has an mdot indicator sign and that hill uh commands a lot of attention like when you're and so what we'll do is like tilt it towards the northbound traffic and we'll elevate it with landscaping lights as well so it'll be highly visible is that your opinion i mean we we've talked about several different locations but it gets very challenging because of the uh the grade uh on the northbound line we've looked everywhere on the east side and we couldn't find a level spot you got basically almost to the church road exit which puts you already well into the boundaries of the city so it didn't it negated the entrance signage so going to the west side was about the only option we've got some pretty good elevation over there it's wide open no trees so we feel like if we can put it in an angle it's and it's a big sign i mean we can make it as big and grandiose as we wanted so it should gain i mean you'll still be able to see it coming into the city so i mean it's our best options if it were on the northbound lane i would put it parallel the road but since it's on the other side i think it would be important to tilt it to face your northbound traffic but all of you can um you'll see the location if there's a when you're going northbound on 55 right if you pass starlanding road there's a there's a huge hill on the left and that's where we want to put it on the west side of the southbound lane would it not be just a little bit i mean how well would you be able to see it from the southbound traffic as far as would it be confusing for people thinking whenever they see it and they're traveling south that they're gonna go oh if they don't know the area no it'll be a one-sided sign so it'll be one-sided and tilt it again it'll be tilted towards the northbound traffic so the the southbound traffic will not even i mean they'll see the lighting obviously but they won't see the sign and again like whitney said you know you want it to be as close to the city limits as possible

[0:32:52] if it's going to be a grand city entrance sign but i know everyone's seen those in others some other cities um not so much mississippi no offense mississippi but um in other states uh some cities do a fantastic job with um decorating their entrances and i think it would be important for south haven to do that and then on the uh on the the other side on the north side uh we have uh similar challenges when you come in you know the the mississippi state line is almost right at the state line exit so there's a few places that you could put one there so what we'd have to do is either put it just to the north of this building or we even discuss possibly incorporating it in on the roof of the one story section it would command a lot of visibility there so that's kind of what we're working with at this point and then the other one we talked about having a municipal center sign we're working with mdot right now to get permission there but it's at the end of northwest drive on main street where you would have a decorative sign there that would act as slimming field marquee would indicate that city halls this way courts this way police station library that kind of thing performing arts center center and then have a digital display board there and it would be this book with the same uh general theme and signature of the other side so they'd be consistent but that's where we are at this point but um if y'all will just reach out to me at your convenience like i said and let me show you the designs i'd like to hear your input that's all i have this evening i do well one other thing i want to acknowledge um the efforts of our city with the inclement weather our people did an incredible job we're still doing it uh police fire ems dispatchers a lot of people don't realize when we say that offices are closed that doesn't mean everybody's closed okay some people do some people do not close and uh and i want to thank all those that have joined me and you know looking at the weather all throughout the night

[0:34:54] making decisions taking care of our people in the city i've done an incredible job in addition to that our public works crews have done a phenomenal job making the roads as convenient as possible a special note to mr robert booth he's our street supervisor if you've not met robert booth i would encourage you to meet him he's one of our biggest assets for our city he is not afraid of hard work this guy is a guy that just brings solutions whatever the problem is he finds a solution so when you see robert booth please reach out to him and thank him for his efforts as well next on the agenda is our citizens agenda we did not have anyone that signed up this evening is there anyone in the audience who would like to speak seeing or hearing no one will move on next on the agenda is our personal pocket mr mayor move that we approve the personnel documents presented on the state the motion baller and brooks second bargaining kelly is there any discussion gary nunn roll call yes yes and that motion carries next on the agenda is our city attorney's legal update mr nick manley two items first item of the december board meeting you approved a ground lease agreement with regents bank there was a typo in the in the lease agreement where relating to the fact when we got the termination fee what extended tournament would be for the debate for the early termination fees um in the original lease it had december 31st 2019 for the first one it should have said december 30 first 2018 going down 2026. there's no motions or anything just making you aware of that and we're going there to the minutes tonight to reflect that correctly version um you've already approved the lease but that's just wanted to make you aware of that

[0:36:55] and uh it will be entered into the minutes for corrective dates uh this would have been signed and didn't affect the police it just was a typo as far as the dates determination fees and was a miscalculation buy their accounts i guess so anyway just an fyi let you know so it's in the minutes that's first thing second thing i have an agreement that got finalized today with a company called pro-tech between the city and pro-tech pro-tech will assist the city with backup of all our backup that back up our data with the city and also improve conclude backing up with lift stations so it'd be a company to provide all that backup for all this data and video for the city uh so tonight would need a motion it's uh sixteen hundred dollars a month under the lease terms i made a couple of changes to the lease we can cancel after two we can cancel for uh with for convenience 60 days notice um for the first two years we do that there is a 4900 penalty or not penalty of 4900 payment to make up for their investment in the project with us counseling for no calls after year two you can cancel with no calls and there's no payment for that for tonight we need authorization for chris shelton to sign the statement of work and the master service agreement he's looked at it and their concurrence and is needed by the city so tonight made a motion a second for that if the board has any questions chris or i can answer them i'll make that question second question chris is this off site uh back up yes sir we'll replace our current off-site factory system in just a correct one order that nick said it doesn't back up the lift stations it backs up actual workstations the current software we have only works on our servers uh we'll have a cost reduction from currently we pay anywhere from 2100 a
