[0:00:21] once again we thank you for the opportunity to be here tonight lord lord we pray for our nation and our world lord we pray that uh you would help us to have an end to this deadly virus that's been going around we just pray that you could help us with the solutions uh lord we thank you for everything you've done here to the flag of the united states of america to the republic for which it under stands indivisible with liberty and justice for all first on the agenda this evening is uh the approval of minutes from the january 19 2014 [Music] mr mayor will be performance of the regular meeting of january 19 2021 we have motion pain second alderman brooks is there any discussion hearing none roll yes that motion carries next on the agenda is a resolution to men title 13 section 13 7c 2 and that's our off street parking ordinance this is the issue that mr tucker brought to our attention of seasons in the audience with us and we as promised went back and discuss this and look for a way to you know to kind of boil that down make it more clear without jeopardizing any negatives to our property values in our residential neighborhoods so nick would you kind of walk us through that

[0:02:23] nick uh did some work on that added the added some language and i feel like we got a pretty good solution uh to accomplish both of those guys what we did is uh authorized or revised it to allow for 7 13-7 c2a exceptions to allow for a utility trailer that is 10 feet or less to be parked on the driveway assuming that the trailer is empty has nothing in it so the that will no longer is also tempting from the street so that will no longer be a violation so we also took out the work major as far as recreational goes uh recreational so just you know recreational equipment but if there's a utility trailer that is 10 feet or less it does not have anything in it and it's parked within the driveway driveway from the driveway this can be discrete that'll no longer be a violation of the code as written um i think that was also great because i've been about if he was okay with that solution as well and so that's [Music] what we're proposing is for the change of the ordinance it'll still keep in place if you can't have um the trailer cannot still be parked in the guard or the street one possible second we have a motion of alderman brook the second alderman is there a discussion so the main difference is and i guess this goes for every other trailers now they still have 320 feet the difference was that utility trailer had to be 20 feet off the street correct the tongue 15 feet so now like utility trailer that's empty it's less than 10 feet that the trailer itself is less than 10 but the trailer has to be less than 10

[0:04:26] feet from i mean 10 feet at least from the street which to me makes a lot of sense you're still you're staying with a 20 feet but you're requiring um if it's empty where it's not going to have materials in there that are you know both cluttered and also with block traffic that kind of thing so we accomplish that goal of specifying that it has to be an empty trailer and it still has to be 10 feet off the street and then limiting the length to 10 feet is also going to you know make sure that you don't have large commercial trailers it's definitely as mr tucker explained it's definitely going to be one you know that's used for personal use like a lawnmower atv that kind of thing but it does have to be empty and uh does not work very very good i just agree with it but anyway i think it's good i think it's good i think it accomplishes the goal and still prevents our streets from being cluttered and prevented from being a you know a negative look you know that would be detrimental to property banks this may not be the same though on the rvs i think there's a sex forty i don't know about that but i think that would just be a common sense uh an [Music] um but it would just be a from a practical standpoint you know we would understand that if someone is just you know taking a few minutes to load their uh i i've never no one's ever brought that to my attention to the problem anyway you know uh

[0:06:56] um yeah and again that's what i'm saying though i think it would be kind of more like a common sense practical kind of thing does it take five days to load up to go out of town i would think that that would be a little bit excessive so i would think the ordinance we have in place would be enforced if it's an excessive amount of time you know a few hours i mean they're going to you know use common sense and i certainly understand that someone needs some time to load the recreational vehicle before they travel but if y'all think that there needs to be i've never heard of that before and i would just my opinion i just share that if someone i think five days excessive if you got a rv sitting there for five days and that's you know that's kind of what the ordinance is there for to prevent that anybody um uh with this in the seven days

[0:09:24] oh something like that how long i think they give you at least seven days to fix the problem well if you didn't want to follow something like that as easy as it just moved in or probably a 24-48 hour turnaround for them to get it removed um and the only thing i can think of that would be a negative effect of this is how we're going to improve one way together you know there's one who have already or is here case on the is but he's just talking about it i mean we do use a common sense approach with it i mean it's usually clear when you're getting ready for vacation yeah and like what you're saying i mean you're just setting it up for people to gain to gain your rates anyway uh are you did you want to change anything tonight automatically you want to make a motion carving hoops you know we can revisit it but i'm not i don't think it's an issue i think that uh i think i know that our code officers you know they're they're uh they're instructed to do their job and do it in a common sense practical manner and like caller payne said even if there's something there they're going to get a a notice or a warning burst so i don't see a need to make a change i mean that's something we can keep our ears and eyes open if something changes or we see it becomes more of a problem in the future but um you know we'll keep watching that but i don't like i said i've never seen that before it's not been an issue from my experience okay so we'll just keep our eyes and ears on that and then

[0:11:27] we'll go is there any other discussion about this okay yes yes okay and that motion carries next on the agenda is a resolution for home bank for home-based business ordinance is this a resolution will amendment will add an ordinance um for home-based business uh provided checklist um to home-based business and this uh resolution of this ordinance is based off that checklist with a couple of minor amendments to it um it'll still obviously allow home-based business but the main focus is not allowing an unreasonable amount of traffic to occur they're not changing the appearance of the home uh not allowing for a reasonable store a lot of storage to develop in business the same things that are basically requiring the checklist and then pass that but this is just putting it in an ordinance format um so tonight i'll just do an authorization for this that go into effect in regard to home-based businesses again it does not affect one of the home-based businesses that are currently existing under that checklist it's just giving more key to that checklist of making it an ordinance as opposed to the checklist that was passed out um and acknowledging the reality of the increasing numbers across the city second we have a motion of alderman kelly second baltimore wheeler [Music] yes now motion carries next on the agenda is a mou uh between our south haven fire department and the mississippi department of health yeah this is what you use obviously to mayor said with the

[0:13:30] fire department and the department of health summarize it once and this allows the fire department to get reimbursed for personnel calls associated with a lot of our firefighters and our paramedics who never uh assist the department of health i reviewed it and chief gag was reviewed he's good with the technical requirements the legal requirements are for good as well so tonight authorization through the mayor or she's got used to sign this agreement as required and here to answer any questions second promotional brooks second alderman payne is there any discussion hearing mountain roll call yes emotion cares next on the agenda is a resolution for budget amendment mr chris wilson so this is some good news um mississippi's fema act um there's formula generated by the state which sends money to cities and counties based on population share of overall sales tax in the state and when it was derived by the state they were just estimating certain numbers so we had a baseline estimate budget um just doubles that then year two and just graduated up so um wheeler is there a discussion i think we can find a responsibility a few parties

[0:15:36] down the streets i mean it's a great thing again i praise the legislature for 2018 for the you know for the construction modernization act i mean this is something that was long overdue you know mississippi was only one of seven states that uh did not allow their state to collect internet sales tax so they did it was a tremendous thing it was very well done the formula that they determine how much money each city gets so it's fair benefits every city whether you're a big city like south haven or a small town uh this thing this this bill is benefiting everybody allowing more money to get our streets in better condition so it's just a tremendous thing but not a joke you know we have like three years in advance not knowing what the future holds but we keep prioritizing the streets so we're not surprised every year we know what streets need to be resurfaced so we already had streets that were slated for 2022 that when this happens we'll just move those up this year any other discussion security roll call please yes that motion carries next one agenda is a resolution for the south african police department surplus progress experiment about the resolution therefore stays out there they're certainly property we've got a motion bombing brook second honorary kelly is there any discussion hearing none roll call yes that motion carries next on this jet is a resolution for the purchase of vehicles for our salvation police department mr mayor will be about the resolution of the mayor and the board of baltimore the city of south haven authorized the

[0:21:50] little confused about that so the bottom line is they're requesting that amount of money that we had an amount in there was the crest even under 9 000 again okay so they were uh in the middle of the budget year uh they're now requesting a donation donations [Music] i think the supervisors it seemed to me like they were actually bringing in someone and i didn't think that was it they're gonna have look in the books make sure that everything was different a which is an incredible but i think he says i guess my question is was it a miscommunication therefore was it a

[0:23:52] misunderstanding right i mean this part of it was uh it wasn't just the city of south haven they had reached out to resolve the communities thank you to the house of greats for the other communities as well well i think that's a big deal i agree with you but here's my point of view if you're getting a new fundraising mother you better make sure that you know was and in all fairness i did say this at the last meeting we had this discussion they have sent reports to us updated but that's not a request as we all know we require that someone submit that information during budget approval time for all contributions we did not get that but what i'm saying is we did get the update uh whoever's helping manage their books you know to help them not get in the same uh tight spot that they were in before okay so i guess you know here we are is there does anyone want to make a motion to approve a 9 000 donation to the house of grace yeah we got a motion with the paintings for a second is there any other discussion just emotionally um that all the other communities and

[0:26:00] organizations are donating per the original agreement so i guess when that donation was given in the summer they were and i don't know all the details but someone with the county was going to help them with their books and they were going to report to all the people that helped them financially get out of that fine and they have done that but what ranking for us to talk about is uh sending us the financials excuse me that we would request from anybody else invited time for a terrible contribution well i mean well we can but the only thing i would tell you is we've already taken but once and eventually uh table you're somewhat pending would you come up and tell me what exactly what i just don't want to miss trying to take so they claim they emailed to andrea um in july we can find the record of doing that so we reached back out and they sent us something right transmitted down exactly what we talked about that when surprises came up last year it was a lifeline one time nine thousand dollar donation here you go save us for good um their organization says no that was meant for handling and they did send an application in after you know we do have an application instead of so we did not receive any other

[0:28:05] detailed financial statements so they're basically applications grants we have no record they're sitting in that request they probably thought that they said well i mean again they said when their presentation was check with the county on the organization this we just don't have anyone here it's not practical for us to go look at every kind of non-profit organization and ask i think that's a fair request so are you suggesting that we table it until they provide that or at this point i mean yeah well let's just let's don't get off track too much so you're what is your motion to get on uh motion is to approve the donation thousand dollars pending they deliver uh their financials and which meet the criteria that we've already agreed on that other entities are that they have sound financials named and that other entities are still donating matching yeah matching the i think it was a percentage i don't know what the percentage was there's a large number of different uh jurisdictions all over mississippi that have citizens that use the service but my point on this is you know this isn't our money to give away for taxpayers we set a budget every year in order to

[0:30:06] do that i don't think there's a single person that would uh have anything negative to stay in this house of grace for what they do but at the same time we have a process for reason um the carbon employers are trying to work we allow this now it's just going to open the floodgates for anyone to come in like oh can't help us out there there's no we would have no reason to tell them if it were my and i got a 9 000 lifeline i would make sure a double sure that my documents were in uh in their remainder before the timeline was set and they claimed to help them out and get them out of the hole maybe the communication was between mr russell and the prophet joseph grace as far as the misunderstanding that this was going to be a yearly thing versus this was a one-time they were very admirable okay so we don't get too far off track so you're i'm going to rephrase your motion because it's not right so if i'm understanding you you're saying that you make a motion through the 9 000 if it's with the same parameters that

[0:34:22] is there any discussion good job any other discussion hearing none all in favor say i i can your post say no i just have it but she cares all right next on the agenda is um we have mr robert lee long with us good to see you sir uh you're gonna give us an update on this uh historic desoto foundation and desoto county museum very well miss mary ward thank you all so much for having us here i want to brief you on something that excites me as a long-range goal even though southaven is a younger city we have a lot of things that go back to our native american times have even begun so one of our dreams has been many of you know what this is it was spent by our acres area over that direction we're thrilled with the fact that on the corner creation that that mr ritual going into this over there actually creates any other home in this other county so south asian county has bragging rights that it may have on the early instructions beyond that which really excites me is that was the site that chile wrote which means red box and chickasaws a little learning exercise there was the sign of a chickasaw train so i hope and i was very impressed when i was a journalist and hopefully i look a little more relaxed and younger my wife thinks so but i reported on what you all did for jacob so what we would do if we would love to have a marker there on chill oklahoma we would have to kind of get permission for any kind of archaeological thing to see there excellent after all these years mr roger quartz and i was talking about

[0:36:25] a couple of years ago there is off street parking so there would not be any kind of liability people marking on the streets but the most wonderful thing is if you look at it it's been there all around that sunken road that is part of the chickasaw trip and there are some old maps that show a major chickasaw training position right there as you know goes all the way up into memphis but i love just incidentally we moved to the south heaven area so i can truly say album i am thrilled we're like moving the state's third largest city that we have a chance to document this whole chickasaw tree you all have been thankful and family partners with us for 18 years and we have wonderful things i love what you've done here we've got an empty showcase that i'm ready to bring up here we have blueprints in san david's founding way back in the late 50s those were our attacks that we could put out alone and have a traffic civic we are a county-wide museum the escalation but it is i can't any kind of ease

[0:42:59] your chase edition section j and basically what they're doing you see it highlighted in red there on the back side of that property it kind of goes to a point up against nail road um there is an agreement between the developer and property under behind there at some point in time that that property would be squared off so lock four could be five behind it could take that property uh they didn't work out a deal between the developer and that property owner so the plaque that you should have yeah right there there's a triangular piece on the back side of that that is the property that we're going to subdivide out with the intentions of grading that over to the property owner lot 455. the stipulation we put on that is right now um we can either put something in warranty but they have to be sold together uh but we finalized uh the approval that they will have to merge the two lots together so it is clear entitled uh the developer and property don't agree to that submitting commission voted you know in favor of it number three incredible martial arts second alarm with wheeler i do have a question um obviously that was brought to their attention that they're going to have a hive i mean eventually that's going to be a profound corner right there no this is this is down this is it um bustleton drive right now but eventually nail road probably extended through so my question is they're aware that as far as the maintenance of the property this is not going to be like an ag piece of property for the grass pros now both of them are single family residential lots applied for this subdivision so what you'll see on that side will just be an extension of that fence right could they understand that they will be responsible for the maintenance yes they're what the plan is is he's going to take down his back fence and he's going to incorporate it back into his backyard so he'll be mowing it just like he would invite this background okay thank you any other discussion hearing none rocco yes

[0:45:09] that motion carries the next application is subdivision application for 4.54 acres north of rasco basically at the end of coventry drive if you're familiar with where the old skate park used to be there's a road just to the east of that coventry drop uh it goes up and extends to the north approximately five six seven hundred feet and then it just steps out into a beast property the vacant piece of property is what is under proposal for development uh it's r9 zone which keeps it at 9 000 square foot minimums and what the applicant has proposed is to take that stub out extend it into a code 10 additional lots ranging in size for about 11 000 square feet up to below half an acre the discussion came uh up with the planning commission on the square footage of the houses so they took an average of caretail houses which set at 1700 square feet that's the stipulation planning commission put on there the other stipulation we just found out over the past few months that not only do subdivisions but also sections of existing subdivisions that are now new must have the community mailboxes um so one of the stipulations placed on this is they've got to provide common open space on one of the lots preferably i think it was like 10 to provide that community open space um right there it'll be on the left hand side the really odd shape one taking out that corner piece down there and actually providing common open space there to put the mailboxes on that location and finally uh the applicant had come in with it named the samaya subdivision uh this is the natural extension of coventry drama carriage hills estates so we're requesting that they take the next alphabet letter um that follows suit and carriage hills which would be carriage hills section g and then um changing the lots from seven to seven ninety through one eight hundred uh to conform with care chips but it is compliant with uh zoning and subdivision regulations so it's recommended for approval with those changes mr mayor many okay we have a motion motor with kelly

[0:47:16] second monitor flores missouri discussion here i do have one question being that this is butting up against those environments right there are they planning on having a defense line or something some sort of barrier at this time now it's a straight subdivision so normally when that happens single-family residentials will normally put up their own lawn their own fence you can obviously stimulate that or you should do that if he means but it was not proposed with the straight subdivision would you are you would you want it all the way around uh required follow around you just stay in the west side and the north side's got the the school system right here the east side probably has existing an existing fence line from the street over from it um houses backing up there so we probably want to exclude the east side simplification maybe double it up into this replacing somebody's existing defense you get into property over the rights on the side but uh to the north and to the west we can certainly get a suggestion i just know that uh residents in coventry have asked if there'd be some better offenses or stuff just from people coming from that area i mean it's a stipulation we can put out there and let them um we're just going to with the stipulation that a six foot slightly fence um be installed around the west and the north perimeter of the overall subdivision my next question

[0:49:26] come 15 years from now or whatever whatever expenses or deteriorate or fall apart we'll be responsible that will be the product property owner um i'm um like i said our property maintenance code addresses dilapidating fences so if it does become an issue code enforcement can actually go out there to property owners so is there any other discussion on form hearing non-roll call yes that motion carries okay our final application is a single lock commercial subdivision lot on the northeast corner of church road and gatwell road it's 2.45 acres the developer actually purchased the entire 15 acre site we approved initial use on this site for a c-store with additional um retail space we also approved the design of it looking a lot like what's on the nail and gatwell road corner in the chop house area so all that's been approved this is just solidifying the boundaries of that lot so it is one single lot the only adjustment we had that was shown on a 15-foot streetscape for um landscaping and design and we had them increase that

[0:51:27] to the required point otherwise it was compliant and it was recommended for approval we have a motion volume of wheeler second volume and flores is there any discussion here you know the phone call yes thanks okay next on the agenda as our mayor's report first thing need a little bit of business that failed to make the agenda you all are aware of this issue on our street research and plan we have two streets in a conditioned budget we have to have a process called reclamation dan portel has he reviewed this with us in the past the reclamation is due to a poor sub subsurface so college road get well and really the main entrance to uh alexa nicholas yeah marshall louise is the first but i think anyway that section of road uh was overlaid about three years ago and it's already uh it's failing i mean the road is horrific and it's just again through the subsurface a lot of these roads were built back when the housing market was moving in the late 90s early 2000s and we the city didn't have eyes on the ground to check the thickness of the subsurface so we're paying the price for that now so anyway it's got to be redone it's got to be reclaimed we have the same situation that's only rasco west to lahoma before you get to the extended area from rasco we got some failures in there same thing there that street was built to be a subdivision collector street not an arterial road y'all may recall that

[0:53:29] about five years ago we extended rasco from swinging into oklahoma and so there's tremendously uh more tremendous amount of traffic on that road now and just in that short amount of time again it was resurfaced probably four or five years ago but in that short time the road's family was terrible and so these two roads have to be reclaimed uh when we did our contract with layman roberts it was about street resurfacing but there was no reclamation part in that contract so we're going to have to rebid that to get that done so what i'm asking you tonight is authorization to advertise to re-bid for a street reclamation contract yes yes yes yes okay that motion carries another um issue that came up since we set the agenda we have to we have to designate a hazard mitigation representative for our regional hazard mitigation plan and we've not done that so basically uh chief scallions is recommending that we name chris olsen who's the director of the summit county emergency management agency he's recommending that we designate him inside need of the approval to do that we have a motion ballroom brooks sacramento wheeler is there a discussion uh honorable foreign um
