[0:00:01] welcome everyone i'm now calling this speaking to order please stand with us i will be led prayer by alderman gallagher please remain standing after that with the pledge of allegiance led by alderman scott ferguson heavenly father lord we come before you tonight to ask you to be a part of our meeting lord lord i pray uh that as halloween approaches that you would uh watch out over our citizens and specifically our children lord and uh we just pray for a hedge protection around each and every one of them we pray amen i pledge allegiance to the flag of the united states of america and to the republic for which it stands one nation under god indivisible with liberty and justice first on our agenda this evening is the approval of minutes for october 4 16 meeting and the october 7 16 meeting so if we can one at a time i'll accept a motion for the first off for the october 4 meeting mr mayor remember we approve the minutes for the regular meeting of october 4th 2016 with any additions deletions or corrections second okay we have a motion by alderman payne second by alderman brooks is there any discussion for the october 4 meeting michael i'm gonna start right now i don't know the last couple of meetings it sounds different to me can everyone can y'all hear me okay is it okay okay just i don't know what it is but the last two meetings it sounds different but if we're talking here we're good all right on october seven minutes mr move we approve the minutes for the special meeting of october 7th 2016 within the addition solutions of corrections second we have a motion balance second motor

[0:02:03] and kelly is there any discussion yes okay that motion carries all right next on agenda is bid acceptance for rasco road extension mr dan cordell thank you mayor we received bids on october 7th for the rasco road extension um we're recommending the award in the amount of 745 631.87 cents to men's corps llc out of memphis we've tabulated the bids they're they're they're correct we would like to request approval for the award and approval for the mayor to execute contracts we have a motion alderman brooks second alarm and kelly uh is there any discussion what's timeline i think it's 120 uh calendar days uh we'll have to give some legacy during the weather so you're probably looking at may of next year for construction to be complete move as mayor jim we have all the right of way in hand now there was some right of way we needed to give we thought might happen in between the board and give over those perceived all that's in hand then we'll use in hand with the developers so we're ready to go so before next school year sounds good good yes sir well we'll we'll conservatively say june july 9. yeah construction beginning in december that's a big deal that's a big deal so has this one doesn't work for us

[0:04:06] beforehand and again i don't think there's we talked about this for so long but just as a recap quickly this is huge for the city you know from a public safety standpoint our fire station uh that is that um you know sweeney right there at rasco is cut off you know from the homes that we service fire and ems from the homes we service further east from there so this will be a tremendous help for our city from a public safety standpoint also from a transportation standpoint none of us have to be told that any time you can stay off goodman road going east and west it's a big deal so now this will give us an east and west corridor that goes all the way from highway 51 on the west side all the way to getwell this is a huge deal for our city as long as we keep trucks on we spend money we're going to take care of it any other discussion our questions for mr cornell yes authorization to renew our health insurance as we talked about last board meeting um except we're at renewal time policy date january 1 enrollment starts early november so we have to make a decision about our health insurance we received a 12 increase from our current carrier blue cross blue shield so mr chris wilson has been actively reviewing that meeting with uh with our broker you know looking at all options to see what we can do to get the best value for our employees and our taxpayers and some will uh turn it over to chris wilson now let him explain the details to you uh mayor boards you've got a sheet in front of you it's not entitled

[0:06:07] however it's um but you see the deductibles and you see the breakdown you'll see the current plan as is with blue cross blue shield and that's the plan the mayor alluded to blue cross blue shield held the line at 12 increase across the board that would be an additional 250 000 plus to the city to cover the employees insurance not to mention the employees going into their own pocket 12 to come up with their payments for family child or spouse plan after talking and working this over internally and with our with our broker service we have two options that look to be the best and of those two generally the um the opinion and recommendation is to move the cross blue shield to cygnus as mayor mentioned last board meeting the cigna has a couple of parts to it which are different the sigma plan that we are looking at moving to is methodist network whereas right now we're you know primarily a baptist network but given methodist footprint in desoto county and talking to several department heads and seeing our history with baptist we don't believe that would be a deal breaker from where we stand for as far as the health provided to our employees the cigna option 2 that you see basically if you look at the 2 000 deductible where you see the 163 employees and right now it's 438 a month premium that is our primary plan that is the plan that is provided to all city employees they have the option of buying up to a three thousand dollar deductible or the thousand dollar deductible depending on it and that was a plan that we put in years ago to offer the employees a choice on deductible you'll see also to the further right the increase or decrease in the monthly premium the city will save seven dollars a month from where we are right now on that plan which will be a substantial saving to the city on what we pay for the employees insurance not to mention you see house tiered

[0:08:09] for the 2000 and 1000 deductible where there are initial savings monthly savings from seven dollars a month to the city to forty one dollars forty two dollars really for the employee on their the most expensive plan the thousand dollar deductible for the family plan the trade-offs are of course losing baptist as a network going to methodist and seeing a modest increase in our copay from 15 to 25 and the prescription plan where we're currently at 10 25 50 under three tiers going to a 10 30 60. but again after reviewing that and seeing our options we believe feel strongly this is in fact the best skill for the city and our employees so any questions i'll make that motion exactly we have a motion of honor with flores second bottom in ferguson is there any discussion one thing i would like to point out we looked at a study um kaiser foundation which does a lot everything is you know with health insurance everything everyone's got to study and kaiser foundation is one of the foremost experts in health insurance and just so you know in 2016 the average employee contribution to their own plan uh from a select survey of employers was 1 237 a year on average what the employee pays for their own coverage and that comes out the single coverage premium on average is 6 800 a year 567 a month whereas ours will be 431 if this plan is adopted and as we said should the employee accept 2 000 deductible plan there's no cost to the employee that's you know continue that that margin is getting thinner every year we've talked about um it's it's going to be good to actually drop decrease i don't know how many plans are actually seen now again we've had to make some changes the copay goes up the prescriptions changed a little bit but as stated this is this is our best option

[0:10:14] and everything else was equal prescription plan was equal without digging too much in the formulary you know we scratched the surface on it um i did look through the you know your ear nose and throat your people are pretty much going to be part of both networks anyway soda down the medical the physicians lane folks are on this plan i'm methodist but you know you get into it it's really cost driven at this point for taxpayers and for our employees the what's the savings for the city to go to this plan i mean it's it's like seven thousand seven dollars twelve eighty four times four hundred for the city yes okay in other words funds that the city was funding for their own for the employees health insurance goes from 438 to 431 so yes there is a initial savings upfront for the city on health insurance okay any other any other discussion about health insurance hundred pound or 250 pounds right here i mean that's where that's at some point if you're talking about sticking without with blue cross the budget needs another 250 000 just for the employees only not to mention their cost for their dependent care coverage and their family coverage in those places and the core issues of the policy very little has changed i mean it's basically the same thing you know when you talk about going just a few dollars difference on a co-pay or prescription drug that's a minor you know looking at the big scheme of things with health insurance in our country in 2016 that those are minor issues so and this is the sheet that you have in your hand you'll see in the far right column most

[0:12:16] of them even on the dependents for the families they're all taking a decrease in premium as well so i feel like we're fortunate to have an option i think it's a good option and any increase in those co-pays is offset by decreasing the premium you know and we'll give it a year to see how assuming it's accepted but you know we re-evaluate every year and we evaluate every month really looking at our claims and as you know we you know it's been uh we've had a tough year so and i will add one more thing as i said in our department head meeting this morning we understand the fact that it's inconvenient to have to change it you know to get a new id card things like that um but when you're looking at when you're looking at the big picture you know saving you know 250 000 or more it's well worth we just we want our employees understand that we understand it's inconvenient for that but when you when you talk about the amount of financial savings both to the city and to the families and the dependents it becomes an easy decision so we were conscious of that fact we had to do something that made financial sense and to get the best value for our employees and our taxpayers so that's kind of how we got to this point and they have options have options same options to go to standard deductibles 2000 you can go up to 3000 lower premiums or if you like the lower deductible you can go down a thousand dollars and buy that so it's you know good options for the employees as well okay any other discussion comments questions thank you chris for these numbers yeah so holland insurance reps are here for any questions um you know we'll be ready to open enrollment and move on when will that start no no no problem yeah so we're again and it's it's crunch time with insurance that's part of the thing you know we're going to look at possibly trying to get

[0:14:18] these policy years lined up differently too so we're not lagging in where you guys have to approve a budget and then we have to come back a month or two later with what the true numbers so we're going to continue to work on that okay anything else tearing down they're all calm yes thank you chris our next one on our agenda is the mdot mou to nick manley this is the mou with mdot obviously uh it's mou for that is required under the federal laws for reporting of delays in certain accidents in the city and be done by our dispatch department and in coordination with our planning department uh made a couple of changes to it that mdot accepted it says that we'll use our best efforts as opposed to making it mandatory on this but uh that being said it is required um born like all brands having to say through the same mou based on new federal guidelines for receiving federal money uh certainly seeing the motion to authorize the mayor to sign mou with mdot for the um reporting of state designated routes under certain state doesn't any routes of delays and accidents i'll make that motion thank you we have a motion balancing second volume was there any discussion if you're curious about the routes us u.s 51 uh horn lake road within south haven state line road from foreign lake road and get war road airways from church the tennessee state line get well road from church the tennessee state line and church road within the city corporate limits so those roads will have to be reported so it's not every road it's just those roads who's responsible for keeping up with that statistic you're saying i.t and the

[0:16:22] police department the planning dispatch this passage they'll work together to coordinate that with mdot and right so that way certain notifications can be given if there's delays the way i read this i mean pretty much just about anything that comes up it's going to have to be reported they said accidents going to take 12 12 minutes or longer right is it right is there an accident that doesn't take 12 minutes no all right but we've got the best effort you got the best efforts in there and if you want our money self-stop you gotta yeah i mean if you won't get continued to get federal money efforts so to kind of give us some leeway hopefully some grace while we're getting used to this any other discussion hearing none roll call yes okay that motion carries next on our agenda is a resolution granting court warehouse at the lorem tax exemption to remington arms company this is the resolution of creating a freeport warehouse to remain clean arms they will be leasing a warehouse and then this part of that will be another company will have about 60 employees in that warehouse the economic council has reviewed this and has recommended for approval tonight and i don't know if they might hear not tonight to answer questions but it wasn't recommended they will be creating one job but the applications has been releasing they'll be also under a lease having um 60 jobs through the lease

[0:18:23] absolutely assuming so i'll make that motion second we have a motion baller in florida second bottom and kelly is there any discussion this is a existing building already yes any other discussion hearing none we're all calling autumn yes to accept an in-kind donation from curb appeal tree services this is just has been our minutes a curvature curb appeal tree service has a good out has uh offered and i think the mayor has spoken with them has offered to do some trimming of trees at salsier park um right here next to us and as a donation and so we can accept donations as long as this municipal function obviously maintaining our parks is a municipal function so tonight is the approval to accept the donation from them was from the curb tree curb appeals tree service to allow for the trimming of trees at the park and i guess i'll coordinate with our parks department and public works around that work that will be done so move they'll only be trimming when we allow them to trim they won't just be doing it on their own yeah i'm assuming we'll have somebody from the mayor's office parks office that will take you if we want right all they're wanting to do is raise the canopy cut the undergrowth to open up you know the park and we will verify verify insurance

[0:22:29] granting authority to clean private property mr mayor adopt a resolution granting authority to clean private property is presented in the state thank you thank you very much we have a motion autumn in pain second of all kelly first of all is there any discussion among the board hearing none is there anyone in the audience who would like to speak regarding any of the properties hearing or seeing none rojo yes okay and that motion carries our next on our agenda is our planning agenda whitney is sick tonight she's not available our planning director she did send me a report on the one item that's on there i'll be happy to read that if necessary but planning agenda one is application by brave baby for a conditional use permit to allow operating establishment to be located at 230 goodman road on the north side of goodman road east of airways boulevard and then would you like me to read whitney's report sure they're good with it right are they good with it yeah she's going to make a recommendation but i was going to just read the full proposal to recommend it i'll do it quickly plan a planning item on the agenda is a request for conditional use permit until our hair braiding shop our zoning code requires that these facilities be located a minimum of a half mile in each direction from an existing facility which is why they are under a conditional use permit this proposed location is 230 given road which is a multi-story office building behind the sea spiral on goodman road and zone planned commercial we did a windows survey of the surrounding area to determine where the closest one was located it was at swinney road in goodman nearly a mile to the east since

[0:24:32] we determined the distance requirements were met any commissioned voting nationally in favor of it this is not a beauty salon so there will be no washing stations or dryers on site we have a letter from the applicant and also the owner stating this the permit is recommended for one year with a four-year extension to be renewed annually at any point if the applicant fails to comply we'll have the right to pull the conditional use permit and shut the business down bolita put an aerial photo on the sign to lay out the facility in my report and the documents tonight which you can see there there that's it i think we approve item number one on the planning agenda second we have a motion pain second about alderman hail is there any discussion is in the lab is it in the last building or the first building on that drawing uh well 2 230 is a middle one part no no behind the cease fire which is the first one oh building three billion three okay just yeah it says behind c spire that's a weird setup there's three things here you see you can see it all kind of is there any other any other discussion [Music] yes okay that motion carries all right next on our agenda is the mayor's report just want to update everyone on a few things first of all hazard is a waste day and our city is october 22nd to be at the lander center

[0:26:36] so any citizens have things that normally would not go into the uh with normal sanitation pickup rubbish they can use this day to um eliminate those type items that's standard saturday okay and then i'd like to bring everyone up to date on a special award that the city recently received the government finance officers association recently awarded the city of south haven a certificate of achievement for excellence in financial reporting and this forgive my slang language but it's not a just a little you know ron rock kind of a war this is a big deal i mean cities don't normally get this this is very rare for a city to get this and this is a this is a huge deal for us to get this and i'd like to thank eddie mcelwain our chief financial officer and chris wilson for their role in this and not only that but also all of our department heads and everyone that since 2013 has gone back to a mentality of black and white by the book i mean everything that we've tried to incorporate since 2013 is even the little things that would give a small a small red mark on an audit you know those things are can be minor but even those things are gone now i mean we're doing things by the book we're doing the things that were that the people asked for in 2013 with the controversies that the city had in 2012 and before i just want to report to the people that the city getting award like this you know should be a comfort blanket i mean this is something that you should know that hey things have truly changed with the way the operations of the city are done and uh and again it's a big deal and um

[0:28:38] so if everyone will i don't see evie here tonight but um if you get a chance to you know just drop a little note to edie and uh and chris and tell them both that you appreciate what they do and and um and they are they're they're the immediate ones that have their hands on it they deserve credit but everyone deserves credit for you know complying with you know what they ask and just you know in every department doing things by the book again so um just very proud to be able to report that the city received that award is a huge deal for our city including just carpenter right including yes absolutely um a couple of things quickly uh we need things come up after friday but we do need authorization to advertise for the fy 16 amended budget uh chris told you about that last board meeting but if there's any other questions chris can come up but we just need to make that official that we authorize that all right if chris chris will come up procedural in nature throughout the year we amend the budget we did it so at the last one this is just authorization to state law mandates that we publish it amendments the exact same way that we ran the original so when you do the big resolution that we did and we've done this but we do this every year it's just authorizing the city go ahead and publish the amended budget i'll make that much contact okay we have a motion alderman flores second ballroom in ferguson is there any discussion about that yes okay that motion cares i do want to update the board on one issue and uh i apologize this has been sitting on my desk for a week or two we've had a lot going on in the city of south haven but there has been a request that was originated by desoto county to rename the interstate 55 bridge at the goodman road exit uh after

[0:30:41] our late state senator george guerrery and like i said the county has promoted that they talked to mdot to get that formally approved and with the approval requirements it requires a resolution on behalf of the city to agree to that i'm not asking you to do that tonight i just want you to be aware of the request and we'll put that on the agenda for the next board meeting i just want to give you time if you want to you know speak with any supervisors or you know do any research on your own before you're asked to do that but um but they they are waiting on that it's contingent upon the city of southaven approving that request to rename the bridge understand that uh senator guerri was did many things for the city that he was instrumental in actually getting the goodman road years ago getting the exit off i-55 at governor road he was instrumental in getting that done so i think that's why they you know chose that location for him he also uh was played a significant role after desert storm there were some troops that uh supposedly were they claimed that everyone was home that all the desoto county people are home after the war ended and um evidently there were still uh some group of desoto county um people that were not home yet and uh and senator greery was instrumental in helping get those those people home so he obviously has a much more decorated history than that uh the county can answer any other detailed questions about you know how the application began and what the status of it is but but they are waiting on a resolution from the city so if y'all consider that we'll put that on the agenda for the next board meeting okay and then last thing is i told you the last board meeting after we approved the tennis expansion and then we will be planning a groundbreaking ceremony um the city is going to have a groundbreaking ceremony for the tennis expansion eight new courts in the pavilion bathrooms they're gonna be built just to the west of the existing tennis building and tennis

[0:32:44] courts we're going to have a groundbreaking ceremony that will be on november 16th at 4 pm the reason that date was chosen we were contacted the possibility of having a high profile tennis program that would participate and that was the date that they had given us so i'm here i'm going to announce tonight that for all the tennis experts in the room that tennis pro is obviously an extremely high profile tennis player uh his name is john eisner so he will be that he will be in south haven mississippi on november 16th to help us uh do the groundbreaking for our new tennis expansion but um but this uh john eisner is currently ranked 27th in the world according to the atp and holds the record for most aces in a grand slam event with 113 during the 2010 wimbledon tournament eisner originally from greensboro north carolina played collegiately at the university of georgia and recently partnered with jack stock to win the devil's title at the shanghai rolex masters tournament so this is a pretty big deal to have this guy in southam mississippi so november 16th uh 4 pm please count and join us for groundbreaking of our new tennis center at stone garage that's all i have this evening um next on our agenda is our citizens agenda and uh tonight we have uh two people have signed up first of all mr stewart davidson with chick-fil-a could you please come forward good evening mayor uh today i i i really am here i'd like to remove chick-fil-a from the equation i'm strictly here as a business owner and i'd like you know just some clarification i'm very much in favor of getting as much money to the city through taxes what have you as possible penny for the parks whatever you know we can do to bring more revenue into the city my concern is a year ago i can't really

[0:34:46] tell you i knew what a transient vendor's license was and then after the tiger mall opened up we served nine we sold 19 days between thanksgiving and the end of the year and again please if we don't sell a tank or i'm removing chick-fil-a from the equation but my concern is the way i understand even the rewriting of that ordinance is you know i guess where i'm coming from is i think we really need to provide a food service or food services other than necessarily trucks to our customers that we want to attract the southeast i mean in the past they had to go to the gulf shores or foley alabama here we've got a beautiful center here we have tour buses that bring groups in from out of town and you know for someone that really avoids crowds you know i'll go shopping i want to shop there but once i'm there i'm there and then if i get hungry i get nauseous i leave i'm not coming back and my concern is i can't tell you how many i wish i had a dime for every customer that's come up and asked us at the chick-fil-a are there any other food establishments here and to them food establishments isn't pretzels cookies and popcorn so we direct them down to the to the trucks but if we're going to be attracting people if we want this tour buses to continue to bring groups in you know we've got to be able to you know afford them someplace to eat some liquors if the zollies are on the border anybody that would be willing to come in and sell food because also if they leave because they're hungry if they don't come back it's lost revenue as far as sales for the shops there you want to keep those customers at the mall as long as you can and uh right now and then i have hot water pretzels cookies and vending machines and that's that's just not working for them so it's a businessman i want the taxes to go to the city and you know i understand if we can't do it because our six months is something

[0:36:49] we've got to try and make it a lot easier for people who want to sell there you know just to take care of our customers i'd like to share some information i appreciate you coming tonight and and that certainly makes sense uh i want to share something with you it's almost unfair that you didn't know this before you were here tonight but one of the reasons uh with tanger and just to back up a little bit to share a little history there when the tanker development was approved it was presented to these people up here that not only the 70 plus stores would be in the development in phase one but there would also be out parcels that included restaurants sit down restaurants and you know more casual dining as well so that was sold to the city and when we agreed to participate in the tourism rebate program the city committed 30 of the 150 million project of our future sales taxes to that so it's we're estimated to take us five to six years we've given all of our sales taxes to the tanker development so that development could occur uh with that that amount well i mean that amounts to about 34 million dollars is what the city gave pledge to that project based on the assumption that there would be out parcels with restaurants well then after that was done and was it 2 4 was it 14 we did that okay so then after 14 summer 15 comes around developer comes back to us and explains that we need to change our requirements for the strip center of the out parcels and the whole selling feature of that was food we need more we need to be more flexible so we can bring more food there because we don't have food at tanker that's what was sold to these people up here in the summer of 2015. so again these people voted yes to allow that variance without exception so we could bring food to tanger because we know exactly what you said i mean if a shopper is hungry they're not going to stay and spend money they're going to leave and go eat so it's best for the city you make that point extremely well it's best for the city that the people

[0:38:52] have a place to eat there but i tell you all this tonight to let you know that the city and there's no secret we've expressed our dissatisfaction with the development we want restaurants there that we were promised restaurants in 2014 and it's october 2016 and there are no restaurants there so i'm just telling you that to let you know that we i i won't speak for the board i have very little sympathy for that because they've not done what they told us that they were going to do and we we approved that deal which is a major deal nothing that size has ever been done by the city to commit that much money in the tourism rebate program first time the city of south haven's ever used that program and it was all sold to us that we're going to have restaurants well it's as you drive by you see there's dirt where the outer partials are so i would just my recommendation this board is that i don't have a lot of sympathy for that my suggestion would be to get busy building some restaurants and and as it relates to excuse me as it relates to the transient vendor ordinance um you understand when we do an ordinance it applies city-wide you know we can't create an ordinance that just we can't say well at tanger you can do this but if you go to you know if you go to the other this other corner in our street you know you want to put up you know a transient operation you can't do it we can't do that we gotta have an ordinance that fits the entire city so although it would make sense temporarily to do that at tanger it would not make sense to do it citywide because we don't want our city to look like manhattan you know i mean you know when you go to some of the streets of manhattan you know you're going to have vendors everywhere it's hard to even walk the streets because of all the transient vendors and that's i'm speaking for myself again but that's not something that i think is good for our city and the other thing it becomes a public safety issue when you put a multitude of transient vendors in that area at tanger you're blocking access we can't get if we have someone that needs immediate care we can't get there because it's full of vendors in the middle we don't that's why that's why the ordinance has been written like

[0:40:53] it is so i don't know that um and i'll stop talking a minute and let everyone else speak but i don't know of a way because i've thought about this a lot i've met with tanger about that and talked to our staff here about it you know to make sure that we do have it you know the most conducive way for business in our city but i don't know of a way that we can change it you know to allow that without causing larger problems i got a question uh mr davidson you don't have a truck you ha you were had a spot inside the mall itself correct it's like an adp it's it's it's a self-contained right yeah were you painting tango absolutely and like i said you know we were there like 19 days and it was over fifty thousand dollars i was like we make the least amount of money on concessions but we do it because it's a service uh so i i guess my thing is i understand mayor what you're saying um and i understand if we've used our six months but you know knowing that the holidays around the corner again you know if there's a way i don't know if someone from the city or whatever can you know approach some of the other um food establishments that might not realize you know i didn't know what a transit vendor's license was you know and it wasn't anything that took a lot of time to get it but you know to make provisions where there is food this year because you know it's just a year that uh potentially lost sales and yes the big problem is because i think our traders have vendor license it's you can have it for six months and then you have to do you have to reapply or do you just have to move locations no you don't move locations you you you the original i believe it's three months then you can get a three-month extension so it's six months all together okay and that's good whitney here because i think she knows this is better than anybody yeah that's why andreas said after after that six months how

[0:42:55] long they had to wait to really actually our ordinance rates that they have to vacate the city big city right that's this that's that six months period for the life of their until until for another second they say it's six months it's consecutive so i can't have a license and work one month take two months off come back for a month but if you buy a six month extent if you get a permit for six months you can come by the way i understand it you can work a month and then that's it if you want to go with six months and just utilize it one month because that's during holidays so you would have to pay the 250 and then the additional 100 what was it 25 so 275 dollars i i'm just really concerned because i know i i hear that more than can you tell me where coach is or consumer pandora's just can you tell me where we can eat you know you can direct them down to some food trucks but the food truck's gonna have the same issue you know as far as the transient vendor's license so you know i think i'm not sure what you can do other than people that you know haven't had one that can get one you know where we can salvage you know part of this holiday season mr davidson do you know are the food trucks pain that would come there do you know yeah supposedly uh tank tiger yes yeah i'm sure i'm sure that i don't know if there's different yeah they were saying but actually we realized that tanger was actually given two-year leases to some of these people before they realized that it's in violation of the ordinance instead instead of building the permanent right exactly we didn't sign a two-year we signed again for another year and that means it's fine we're not you know we're not breaching a contract if there's something there's ordinances that prevent us from doing that we were unaware of but um let me ask this if the mall was enclosed as in there was a roof on it would they be allowed would they still be i mean would it still be a transient vendor

[0:44:57] that was set up in the mall i mean would it be different a transit inventor would be someone that doesn't have a permanent how does it read they don't have a permanent location it's just if you have permanent business license i mean you can yes your question is yes because it's a business that's not permanent and i guess the question that i had been asked in the past too and i don't have an answer is you know we have a business permit from my store you know to get another business permit i mean any business food establishment is south davidson and soda county get another food permit off their store but then again it's still not permanent you know there would be then called you have to then have the bathroom and all the with the trash for me for something you have then you have to fill the actual business permit license but would that work if where you're situated like where we were situated and propose a bathroom yeah about 25 feet away from us so uh i mean depending on where you're you're located i don't know and i i don't know if there isn't an easy answer to it i just know there's a real there's a real need but as we said right now the people can be a transient vendor in tangerine integra mall as we sit here right now you can be a six month anyone can be a six month transient um so that hasn't changed uh and i'm saying that i really think you know we have to when they say we city what have you if we have to approach people because you know you're about three weeks away four weeks away from the start about that's what you're saying you're saying to make sure people know this so they can be set up out there if they can i mean yeah i don't know i don't know if the city can be the one to do that from the standpoint of soliciting businesses i mean soliciting different businesses that come there we've had a number of people approach us because once you get considerably in favor of one business over another issue but um we can i can look into it and get with mayor and andrea and whitney everybody to get with on that in the board but yeah i'd definitely

[0:46:59] looking to see what what you're saying look what we can do maybe or maybe uh tanker self you know uh lexi and jengar you know yeah because they're the ones that are coming up with the leases well the other question from the city's perspective is tanger has vacant spots for rent that are not in the transient area but actually renting right storefronts so why would someone not buy if you want to sell food there why would you not get another location to sell food i don't you know i'll tell you i it's a good question i don't know if they will lease those i know when they opened the mall right behind my store i know uh there were a couple places that like where lane bryant was i mean that was being used some store was using that for additional storage for their store um and they were willing to do it rather than let it sit vacant and not receive any revenue as a result of something i don't know if that's something tanger would entertain or not but i know tanker didn't give us you know our ours was was very easy to run into this because uh you know we they had one electricity so we weren't pouring coffee from you know one of those canteens you know we had like three curry machines there so you know if you wanted a coffee it was a fresh maroon they they gave us a store room that was probably 100 feet from our stand so we brought all the supplies there so we didn't have to go back and forth we had everything there but um and in the health department you had to have running water that i mean yeah that hot water you had to have a sanitizer sanitizer strip so you know i mean like a business i mean you you have to health department is there and especially that's a temporary health life that rari health permit so it's only good for the temporary is only good for one two weeks or a month and then they come back and you have to get an extension on that as well yeah because krispy kreme will use

[0:49:10] canteens where they'll make them for all their outlets but that's another thing to know you got cookies pretzels popcorn doughnuts so i mean it's still i think you're four groups there that's it which is fine with me major food that's it well and the other the other thing just uh just to give information to you like your case you know you have a store and then you're doing that as a second location well if that is allowed then think about any business in the city could do the same thing like if if i have a store in one part of town but i want to have a temporary location i don't want to go buy another location i want to set up a temporary so then you can imagine what that would look like eventually in the city if everyone said well you know if i'm if i'm selling a product don't get well but i'm not reaching the customers on state line then i'm going to go set up at state line into oklahoma or something like that so you it would just encourage transient vendors that are your existing people too and so you would create that throughout the city yeah i don't question where you're coming from whatsoever i'm just saying you know if you know what what we ultimately want to accomplish you know going about it the right way not trying to come in through a back door right i'm just saying if you know that we can have six month vendors under a transient vendor's license and you know it's legitimate business you know and it's uh you know that they're yeah it's nice if it's you know people around us where it's still you know south name into southern county but i'm not opposed to someone coming in from memphis whatever it's legitimate business not one of these uh stands that sell shrimp off of the truck or west avenue you know because i would want the liability of that either well i appreciate you coming forward we definitely understand it's and as i mentioned it's a problem that we don't have food there and it's uh it's one that we're well aware of and that to be honest with you we're a little disappointed you know in the development because we were all these people up here
