[0:04:20] thank you so much [Applause] thank you so much kristy will yeah okay next on the agenda we have a presentation by christy house and joey luke to the south american fire department to honor their father jerry mccormick and if you would like to come forward at this time please do so we brought some sure and our parents jerry lynn and barbara in 1975 and drove straight down 51 highway from frasier daddy said look up girls

[0:06:26] this is our new home it was a sign that had a big magnolia on it said welcome to saturn population 18 000. dad and mom were looking for a safe community affordable housing and excellent public education for their two small children we found that in the colonial hills subdivision for the last 46 years we have loved southaven and southaven has loved us today my sister and i would like to express our sincere gratitude to south asian ems for giving us something that no amount of money can and that was extra time because of my sister and the south haven police fire and bms we got 20 more days with our father his grandchildren and great-grandchildren got one more face time we got one more visit and i was lucky enough to get the last five and a half hours of terminal with city if you're familiar with what that is it's before your earthly body transitions and during that time my dad had a list he knew what was happening to him he knew what had happened to him and he had a list and he went down the list there's a painter in the back of my truck you that's james there's a tree down at the lake called jeff pay my hunting teams i mean how minor it was or how major it was and then i asked him how do i pay your insurance and he started writing

[0:08:30] off all of his credit card numbers just as sharp as attack so for that we are very thankful i think my sister wants to say it i don't have too much to say other than on the night of september 5th um our world changes and um i'm the calm one of the family usually but that poor 9-1-1 dispatcher if she's listening she and the first one to roll up in my yard was the salvation police department and while ems was on its way and they took over they assured me that he was in good hands and they went over and beyond what a police officer should do i had a household and ems and our little house was just bursting at the scene and i was hysterical well the police officer was like he went to the refrigerator got him in a drink of water got me a bottle of water he said where's your room you need to pack a bag to like um through unplugging things those kind of things i can focus on my day i don't have to worry about that but to say that police are just protectors is an understatement and just to say that ems is just transport business completely they are not they are god's servants here and i am forever indebted me a little bit more time so thank you so what we have done is we have made a donation in honor and memory of our father to the south heavenly fire department

[0:10:36] and hopefully that will give another family the experience that we have even how far-fetched it is none of us know when our time comes especially when it's a sudden heart attack like that and we grateful uh thankful or not words to describe that so can we get a picture okay we brought one of my dad's living sisters his sister-in-law my cousins and two of his grandsons and before we do i just would like to say on behalf of the city of south haven that we're sorry for your loss we appreciate you taking the time to come share your appreciation to our first responders as you state most people don't understand all the circumstances that they get involved in they do an incredible job for the citizens of the city so just once you know we appreciate you coming forward and and we appreciate the donation that money will be used uh wisely by our fire department so this is a very unusual evening this is not the normal thing that we experience in board meetings but it's super special and i thank you for that [Applause] to do it quick thank you so much

[0:13:05] the next on the agenda is um we'd like a motion to accept the donation um it's our motion to do that we're going to motion by alderman uh pain second longer flores if there's no discussion rail calls please yes okay and that motion carries next on the agenda's authorization to seek bids for water treatment chemicals for our utilities department mr would we um through a motion of alderman payne's second waterman hoots is there any discussion hearing none i'll ever say i i say no i just have motion carries based on the agenda's acceptance of a new quoting process for employees have a short-term disability option uh recently um melanie dresdale our human resources director worked alongside of our insurance broker to find another option for our employees obviously short-term disability covers a gap you know a short window when someone is disabled and unable to work after they've exhausted you know other um employee benefits just to again just protect that loss of income so it's just another uh know the special amenity that our employees can have so obviously we have a highly rated insurance company we wouldn't have selected that company and that is uh we have much modern gallagher st walterman wheeler is there any other discussion hearing on roll call yes

[0:15:12] yes that motion carries next on the agenda is a resolution for liens just the assessments mr mayor moved out the resolution of the mayor board of baldwin in the city south haven adjudicating the cost of clean property imposing a penalty and imposing bleeding at the same against property we have motion mueller in pain second waller mcgallagher is there a discussion among the lord hearing nine is there anyone in the audience that has a financial interest in any of the properties that would like to speak hearing or seeing none roll call please yes yes that motion carries next time the agenda is a contract with perfect gain perfect game is an organization that is coordinates youth baseball and softball as you all know the city of south haven for many years has operated with the affiliation with youtube usa and at this point it's the recommendation of the parks department um scotty baker and myself that we that we changed that to perfect game we believe perfect game is going to fit the needs of our kids better as far as better organization of the events they bring some other amenities with technology that are going to improve the baseball and softball experience for our kids and perfect game also does not expire at age 14. it goes all the way through age 18 so it's our recommendation that we make this change we've got a motion waterman flores second modern wheeler is there any discussion is this a new service that we're using or is this just a different memory yeah it's a different company they're

[0:17:14] not new perfect game has been in existence for how many years west probably five to seven uh early oh is it that long okay they've previously specialized in the recruitment of high school athletes so they've been they start out as a specialty for ages 15 through 18 but they have expanded now throughout their operating areas to start just as we've had previously so all the way to age you know seven or eight when we start competitive sports so now this one group will be able to guide us from age from the beginning of the player's career at age seven all the way through uh age 18. how does a money stack uh nothing changes uh with that we did coordinate in the contract there were some requests made that's all in the contract there is uh one event that is becomes a national event with them where they bring in athletes from from all over uh we've not done that before because like i said it's always in at age 14 here so now this national event will do all ages which will bring a greater tourism benefit and offer more opportunities for the kids uh that's one of the only things different but nick you want to speak to the specific details of anything that may be different you know one thing is basically this is exciting and use the fields they're gonna bring teams in to play at that stone and also they didn't negate the fact that we're still most dizzy and we don't really control the facilities at all it doesn't allow the main thing is letting them uh utilize it our permission to bring in those things um like the factory um

[0:19:32] county banker will still be um it changes nothing without contract with scotty baker the perfect game as alderman flores stated is a well-established baseball organization and it brings a lot of benefits you know to the kids like i said for more age groups also helps tremendously with uh recruiting with high school this will also allow us to bring some tournaments for the older age groups that we've not had here since the exploration of county mac baseball american legion many many years ago it's going us going way back so we've really not had that in south haven so now with perfect game we'll have that opportunity to bring in 17 18 year old tournaments begin which is again big for our kids getting exposure without having to travel so far now before this most of our south haven athletes have to travel to you know atlanta st louis nashville you know for exposure for competitive tournaments at that age past 14 so now this will give us an opportunity to bring it home so we think it's going to be a win-win for us they do and and they bring a technology that uh enhances the experience for the parents and grandparents like they uh they you know with the statistics and uh you know the live uh you know game changer type events where the people can track what's going on in the game remotely a grandparent wants to you know see that so they do bring some things that uh that are you know more advanced from a technology standpoint still as nick mentioned we did make it clear that we don't relinquish any of the rights to the park you know the park is the city of southam park we make the decisions with the park nothing has changed there it's just the organization that this tournament up

[0:21:46] and just to elaborate on that just quickly is you know the the days of um you know keeping a paper scorebook in the dugout uh are pretty much gone you know now it's all done electronically and not only that but statistics for the kids a lot of the kids get into you know just they're keeping their um you know their their statistics whether it be batting pitching feeling whatever and so they have a technology that makes it fun for the kids to kind of see where they stack up and then also even uh you know the big phase now is radar guns everybody wants to see how hard the pitcher is growing so now it brings some technology where radar gun capability can be there at the park as well okay any other just again as far as the city uh changes nothing for us just you know brings us with a group that we feel like can provide some better options but it's it's what we think is the best of the city moving forward okay any other discussion experience yes yes that motion carries next on the agenda is a change order for a term bid contract for public works and utilities mr dane cordell they just finished their first year by the things the first year in a possible five-year term contract denied the board approval to extend that contract for another year it does have across the board index increase from the national cbi study buddies we can mount it to a 5.8 percent increase for the past year so we would adjust that but extend time for another fiscal year

[0:23:55] wheeler is there any discussion hearing none roll call yes that motion care thank you thanks on the agenda as a resolution to clean private property is there any discussion among the board hearing none is there anyone in the audience that has a financial interest in any of the properties i would like to speak hearing or seeing none real call police yes that motion carries next on the agenda is our planning agenda uh yes our first application uh is a subdivision applications for revised first commercial and adapter appliances subdivisions specifically lost eight through ten it's gonna be on the west side of highway 51 south the first commercial drive older subdivision it's right on the edge of where the c4 transitions into industrial the lots you see highlighted there in red uh there's a gentleman who wants to buy all three of us merged a lot and a build facility there i'm not sure what the facility is as of yet um but that's what this application is for us to merge those get those lot lines and the easements out from in between and make one large lot for development planning conditions are unanimously in favor of it with acknowledgement that will have to vacate those utility easements areas even if they're vacant and then we'll re-record second on item one we have motion alderman hoops the second volume and pain is

[0:25:57] there in discussion hearing none roll call yes that motion carries our second application is a subdivision application to revise an existing sub edition again uh this will be in the smoking farms section uh which is going to get driven in get well it is going to be south where the cbs pharmacy is more specifically known as the chick-fil-a lot we've done a really good job about stacking and keeping all of the drive-through out of the ingress ingress private drive behind the side as well as get well however they want to do an expansion of their parking lot area kind of carry it further to the west so what you see highlighted there there's one large lot where you see the word south haven that's lock five they're requesting to add an additional 0.5 acres into the chick-fil-a lot and what that will do is actually give them expansion of their parking give them a little bit more stacking area and then they will stub out two more entry points into the drive that will be behind that one of our stipulations we asked for when this came across my desk is that that ingredient behind them that new private drive would have to be built either before or during their construction so that they would be completed and utilized at the same time they conceded that so the planning commissions went by we have motion alignment two arm and fluoresce second ball arm and wheeler is there any discussion on this line this subdivision is any other discussion on items

[0:28:02] you're done roll call yes yes the motion carries the next three items i have kind of combined together the stipulations that we have on our shadow board are all the same um but i think if it's okay with you together all right so what i've got are three applications by mr associates llc there were three phases of the timeline subdivision um this was an overall preview and approved back in 2018 this makes use development uh what we're specifically dealing with here is the media district what you see highlighted there in green is the first phase uh there's an additional aerial photo in there which shows phase three and phase four space there's the second phase we're approving uh and there's one more there's three phases um so what this is is your overlay district uh it was stipulated in the pud that all of this substitution had an eighteen hundred square foot needed uh for the homes and there was some additional stimulation that were previously discussed and were discussed further with the applicants those were specifically that pg text along with plaques and along with the staff report report must address care shelter garages we wanted to change up some of the elevations so that it was in the front load garage just a little variety to the houseplants over there they did agree with that so we are having them uh look and see what lots carriage lugs can fit on it takes a different width than a lot of blondes are but we're going to designate those for carriage lugs so that it's not an option to put the front loads on there to give more diversity to that they're going to submit those elevation plans to us it was also required that a tree planted in every front yard three and a half inch caliper which is our minimum size and we need to put that on the flat as well as the covenant so in the case that they sell off some of these lot that stipulation is still in play that will give us a better screenscape we have the sidewalks going down both sides so it

[0:30:03] will kind of bring up the area we also have a situation where a lot of our hoas and collecting their dues have not been enough money to maintain the open space in the property um gates or their fencing or their landscaping or anything like that so we did ask them to put together a business summary and put some hoa um comments in their covenants that allow us to look that on a yearly basis so that they can determine if it needs to go up if it needs to go down but just to give the city a little bit more security that what needs to be maintained doesn't fall on us that it is maintained by the subdivision in their amounts or sufficient enough to cover that we also have a stipulation which was discussed at the previous meeting about you know real properties that we have in the city so in discussions with this board the mayor as well as nick we came up with a just standard statement that we really want all new submissions to come in for protection reasons from the city and then the residents around there and in in quotations the comment that we wanted was developer annual ratio is not allowing third party rentals um the applicants did concede to all of these you will find well i didn't actually have time to do these in here on all the flats they have put a general note stating all of this is a common open space the response would be the builders to properly maintain a drain they've got discrete trees put on there and they also have the rental home comet on their class and we also have a copy of the covenants that will be recorded with all of it where it does state uh in article two section two delegation abuse that pursuant to it consistently once we have these documents in hand um we've recommended approval let's say that coverage all the concerns for us what what what's this going to leave they break that [Music]

[0:32:27] we have a motion of audran wheeler to approve items three four and five and then the second dollar flores is there any other discussion hearing on wrong call please yes that motion carries our next application is subdivision approval for silas spoiler commercial this is going to be 2.38 acres on the south end of the development even further south and the actual silo you'll see the lot highlighted there hot and yellow i'm taking this property now it been purchased for a hotel site uh so this is the legal subdivision which will allow them to transfer ownership from the hotel or from brian hill to the hotel uh it does comply with commercial subdivision united states we have a motion by alderman flores a second baltimore gallery is there any discussion hearing none or alcohol yes that motion carries our next application is also inside of this work commercial on glock 22. this is coming on the southeast corner of maple levard and silas south uh this is up there in the mainstream area for the right there highlighted in yellow all of the lots that are east of that are already under construction as well as on the north side uh this is temporary for yet another mixed use

[0:34:29] building that falls in line with uh the ones that are already there it's 0.76 acres it does have shared access uh from the parking lot to the existing and also address on the silence it was compliant with the commercial subdivision regulations set for the ordinance and was recommended as is there any discussion hearing none roll call yes yes the motion carries the next application is the design review for that lot right there uh there's a set of elevations in your package that shows a mixed use building again with a loss on the top and you have the commercial office space on the bottom the only difference between this building and what's already out there is they did decide to add out of new orleans style modern fencing and canopy area along with the middle three tenant spaces and then used some form boards to make it have an age look to it um everything else the materials the signage is conducive to what's already out there on the property same with their lighting which most of it's already in place and their landscaping will match what's already out there so it was recommended approved um tonight second on automate we have a motion flores second ballerina gallagher is there any discussion are you known roll call yes the motion carries our next application is also highly square and it is specifically for a

[0:36:32] subdivision of application for lot 26b this is 0.952 so it's between the out parcel along get well and the dental office that's on the back side there's a lot in between the right and outside of the round down there again it's 0.952 acres it is compliant with the commercial development uh standard regulations that original ordinance it is set to be a commercial lot and we do have a design review submittal that comes after this one item number nine we have a motion of alderman flores second alderman payne is there a discussion hearing on a roll call yes yes that motion carries my last application is also in silence square it is the design review uh application for that log it wasn't a discussion right there uh we do have a restaurant by the belly acres who is requesting to come in and build a singleton building on that block 26 feet we'll see the sign um elevations just below that aerial photo if we can go up run that is the closed elevations we do have some adjustments to be made on it there's a lot of discussion about does it transition well from what they've got on the residential side up to the commercial side um one of the arguments and i think there's a good argument to this was that this is not on main street some middle so it does have the ability to take on a different look um and at this point you know it's either go big or go home when it comes to the design and they wanted to stand out there's a lot of things we liked about it we did have them break up the materials a little bit more we have them do some adjustments to their lighting and do some adjustments

[0:38:34] to the landscaping and we kind of break up the roof line a little bit more but in the end what you see there submitted is about 90 of what was approved uh the minor adjustments will not will not uh alter the elevations are looking there in the landscape you see right there broken up a little bit more um but in the end uh there was one notebook i just felt it was too modern looking um the rest of the planning commission did both configurations is this their first standalone restaurant to my knowledge the ones that they already have out there are attached multi-tenant buildings so this is their first shot students they do have and they also have parking in the back i forgot to point that out there's golf carts parking so a lot of outdoor seating there's an exterior firepit there's a cornhole yard area they've got out there lit [Music] [Applause] away from [Music] we have emotional item number 10 dollar with flores second bottom and gallagher to bring more discussions sure

[0:40:38] any other discussion hearing non-roll call please yes the motion carries on i just wanted to say that what you see here thank you for your comment investment we invest in a city that makes the city more attractive and again uh when you do when something new comes to a city a lot of people don't understand actually never seen it before and like arnold forest said if you don't have vision you don't understand that but i think it's quite evident now that the investment that the city has made economic developments uh in the south square and others have proven to be effective and uh you know ten items on the planning agenda most of which are solid square i think that's that's good evidence for that thanks for your time mayor didn't you tell us one time that uh retinol was some absolutely i mean everything is not contingent on one thing what i specifically say and this is in direct conversation uh in my recruiting efforts with a lot of businesses there's not one thing you know you know for someone to ridiculously say hey i've picked up shop and move because i love the look of your bridge you know that doesn't happen but it's the total package that you put together what's appealing to businesses now is and you may have heard me talk about it back as far as 2013 being from south haven knowing southaven we needed more entertainment value to see for years and years people in this city drive to overton square because you have restaurants on a combined area where you can walk to those uh now main street in memphis you know has been revitalized so you have the same effect there oxford mississippi has a town square

[0:42:40] with multiple restaurants where you go park one time to walk and we've never had an entertainment district in the city so all this goes together does the bridge matter absolutely the bridge matters because that connects it links commerce on both sides to get on a safe manner it makes it where you don't have to get back in your car so eventually you're going to have hotels on both sides people stay in a hotel they may go a concert at snowden they may visit belly acres or many of the other restaurants they're at silo so all these things do have an impact on whether somebody comes here or not and the the again the old saying the proofs in the pudding you know has belly acres been here before had georgia believe it here before uh no they have it but when silos square got off the ground the announcement of the bridge and actually a few of them did indicate that uh that the bridge made their lock that they were looking at more appealing so to some people the bridge did make a specific i mean a direct difference but in general it's a whole package that has been created here with a with a entertainment pedestrian friendly district and is shown to be huge for our city thank you for those questions we'll move on to the next on our agenda uh our mayor's report uh just to update on a few things spring fest everybody says what do you mean spring fest is october um we know that we got a calendar the reason we called it still spring fest it's been such a long ride hasn't it kristy faulkner from march of 2020 just before that we had a new spring fest pavement project completed for the first time we were going to have spring fest with no money and that's been so long coming we've we've had to work so hard to keep our tourism revenue we kept our tourism revenue we had a long range plan eventually you know pave that area and have that springfest area decorated like that with the landscaping and decorative poles and to get the tank

[0:44:43] barbecue teams out of mud and we finally made that happen you know we got the revenue we put it to good use we had it done had it completed right for a spring fest and then boom you know cove it hits we have to cancel springfest in 2020. well then as you all know we had discussions in this room about when are we going to when's it safe to get back out and do it again we talked about trying to do something in the fall same thing throughout the course of the year the cases start spiking again and then a lot of people don't know that spring fest doesn't just happen christy faulkner was in the audience would you raise your hand chris yeah the board knows you but everybody else may not well christy faulkner has been the uh the director of springfest for many years and what a lot of people don't understand is the amount of work that goes in to put that on uh it doesn't it doesn't start in april each year it starts in uh in mid december to have a late april event that's how much work's involved and uh so christie does an incredible job with that so back to december 2020 when christie starts getting the ball rolling um y'all may remember that for thanksgiving the cases started spiking here they were higher in december than they were at any time during the year last year so again you know we're having to make a tough decision so we throw the brakes on them again we can't have spring fest in april and so then we move in again you know the vaccinations hit this year uh people are starting to feel better uh about things about outdoor events and so we get the idea that we're gonna we're gonna have uh uh we're gonna have spring fest you know like they say come hell or high water we're gonna have an event outside this year and so we did so that's why we called it still spring fest and it did happen last week and uh we didn't get disappointed the rain showed up again we did have the pavement to you know keep us out of the mud and but it did hurt the uh you know the carnival operation but we had over 70 bbq teams and uh many uh uh alderman wheeler you know could tell us in more detail with that probably but um uh the uh the pandemic has affected

[0:46:47] barbecue competitions so the fact that we have over 70 teams speaks you know speaks well of our city and speaks well at christie so christy we appreciate that but the biggest thing is uh you know we didn't have uh we didn't have concerts yet we are gonna have concerts again um again people ask one of the concerts coming back concerts are things that take anywhere from six to 18 months to line up um it was a perfect storm and a bad way for the city at the end of 2020 our contract with our previous promoter expired and even during 2020 they couldn't tell us when there'd be another concert at that time because it coveted so we're we're we have a gap uh with concerts but uh concerts will be back in 2022 and they're going to be back in a big way so in future spring fest you're going to see it get back to an even bigger event the third week in april so anyways great great event to have it still springfest another update again not to not to continue to bring bad news but the current labor i'm going to call it a crisis because it is a crisis we have a labor crisis in our country because of certain uh federal policies going on it affects all of us it affects the city of south haven it affects the contractors that do work for us so the update is our street resurfacing company contractors they have our list they're never as i tell them you're never waiting on me we give them the list in the street so they can get going i love to see them working in the fall you know if you get some of the streets done from this budget year in october october is a great weather month for payton streets the problem is uh they're facing the same labor problems everybody else is you know they they in addition to the cities they do state contracts they have you know do work on interstate systems state highways and so

[0:48:48] they're facing the the effects of the labor crisis just like we are and what that means to us is some of the streets may not get done in the spawn they've assured me by the end of the budget year all of our streets on our list will be done but anyway the negative report is that you're not going to see as many in the in the fall as we have hoped um many questions have come up over the years and this is resurfaced again so i wanted to update the board as a group so we can all talk about the same thing um this the wildwood subdivision uh is all is in the church in getwell area and that subdivision is a um is a subdivision that's zoned agricultural residential which is a zone that was placed on it by desoto county years before southaven annexed that property so the city of south haven annexed that property the zoning we uh we inherited the zone so to speak so if we don't change the zone it stays the same so wildwood the whole time it's been in south haven has been zoned agricultural residential uh ar can you hear me say that um so what that means is um you have people that are seeing things in that subdivision that are not in a true residential development there's things that are permitted not all these but just to give you an idea there's some businesses that can occur at a residence in an ar zone that can't happen in a regular uh r zone um there are also um activities that people like to do or like to have like certain uh you know animals poultry you know certain um farm type agricultural type animals are allowed in those zones that would not be allowed in a true residential zone then you have other fun things that people like to do like you know in a safe way like bonfires you know roasting marshmallows you know things like that that they kind of fit in on an agricultural setting that are not safe in a smaller light true residential zone so there's a lot of things that go on in that zone and so

[0:50:49] occasionally the last time i had been approached is five or six years ago but then i've been approached recently about it again about people asking why are these things permitted and so the reason i'm giving this update is to let everybody know the reason they're permitted is because they qualify in that zone it's not the same zone as a true r zone so in the ar zone there's things that are permitted and my team unless this board changes the zoning my team can't uh stop those things okay so and the bigger message is that uh that i'll remind everybody here is you know it's it's impossible with a situation like that when you inherit a zombie and some people bought their property there because they like that and then some people don't like it if you go into chain changing the zoning you're going to make a lot of people unhappy and so it's just a situation i want y'all to be aware of the issue it's not an issue where you know code enforcement is not doing their job that's not the case at all it's not the case that i'm not doing my job we are doing our job based on what the zoning is and so we've communicated that message with the the property owners that live there that don't like that so the next step for them is to approach you and if you want to change the zoning there what they will need to do is start with a petition is that correct whitney and so the ball is in their court but i want you all to know that we have addressed that we've answered all the questions uh and that's the situation uh with wildwood is there any are there any questions about that while we're talking about it okay um next thing i think i'm gonna move past that i think that's the majority of my update the last thing i want to call to attention tonight is we have a special department head that's worked with us for many years mr chris shelton is our information technology and emergency communications director chris started with the city in 1992 he started as an emergency dispatcher he
