[0:04:05] southampton fire department presentation by laura electric thank you i am laura and i'm the executive director for the muscular dystrophy association and i'm here tonight to thank everyone for supporting our organization mayor and alderman thank you for allowing the south haven fire department to go out and fill the boot for the persons that live with the muscle disease i would also like to thank the south haven fire department for going above and beyond their normal call of duty to stand outside for countless hours to collect donations from the generous citizens who filled the boots with over ten thousand sixty-two dollars i'm proud to present the mayor and the citizens of south haven with a plaque to display at city hall representing their generosity and kindness to help others in need it's an honor also for me to announce that the south haven fire department raised the third highest amount in the state of mississippi and is the winner of the 2017 bronze axe award so if i can have the mayor come down if i can have the fire chief and the feel the boot coordinators come up to receive the plaque this is this is for you okay and this is for city hall so you can take that here and then we will give these gentlemen okay thank you thank you [Applause] okay thank you again and uh appreciate

[0:06:12] our fire department for their efforts with that this is our our first year back to participate and becoming third and the state is a pretty incredible effort so i appreciate it i appreciate everyone okay next on the agenda's resolution by the city to support the initiatives and opportunities to engage in world health organization age-friendly cities this is just a warm resolution to as mayor noted for the world health organization for friendly cities tonight just authorization for the mayor to sign the resolution in support of this organization and assisting the city of south haven with age friendly activities within the city mrs brandman will adopt the resolution the city of south africa will support initiatives and opportunities to engage in world health organization age friendly cities and communities network and authorize the mayor to sign as president on the state thank you for the motion ballroom and brooks second volume and kelly is there any discussion just adding to that most of the things in support of that the city is already doing now there's not anything else that's going to you know require resources that have not already been allocated to the quality of life in our city it's just merely stating that our goals are in line with theirs and we support their organization any other discussion hearing none roll call yes kelly yes yes yes okay that motion carries next on the agent is a resolution for our record rotation this is just the annual resolution for the record rotation with the entities listed as part of the resolution they've been vetted and reviewed by the

[0:08:14] southampton police department and tonight the authorization for the mayor designed the resolution and um moving forward for 2018 with these record companies yeah i think the year is wrong down here oh so strike that just know the resolution will know 2018 on the title of the resolution mr mayor will be adopted adopt the resolution of the mayor and board of aldermen establishing the record rotation for the city of south haven for 2018 pursuant to police record rotation policy and allow the major sign second we have a motion balance second volume in flores is there any discussion nothing's changed saying same companies i think so yes any other discussion hearing none roll call yes gallagher yes yes okay that motion carries all right next on the agenda is a resolution for ordinance for a city's obligation for streets and gated neighborhood and procedures for uh the erection of such gates we've had some discussion evidently there's been a lot of misunderstanding about a specific subdivision in our city miscommunication uh the current process we do not have an ordinance that addresses that has been handled as a planning issue in the past the first start to that is to bring a petition that that indicates all of the uh residents or the homeowners in a specific neighborhood or in favor or at least 75 percent of that and so we've been waiting on that and i've communicated that with this specific subdivision we've still not received the petition so this proposed ordinance is not to change anything as far as that process goes but just to clarify for

[0:10:16] future situations for subdivisions that we want to gate that proposal is also in line with state law you know as it relates to closing down public roads you know the ownership of the actual roads in the subdivision so that's what is on there for um my suggestion to the board tonight uh since there's been some perception that we're only passing this ordinance uh to address one specific situation uh my recommendation is to table this tonight and uh to wait until after this specific issue is addressed and then uh revisit the ordinance after that but i'll um if i can get a motion we'll open up the floor to discuss the details i'll make the all right let's open the floor for just a minute you got a motion by alderman gallagher is there a second discussion got a second baltimore brooks okay is there any discussion just a quick question will tabling the motion or passing the ordinance either way change any of the negotiation for the [Music] for the gate and that we're talking about uh no ultimately um that's a great question ultimately it's this board's decision you know i mean you know we can have an ordinance to clarify that but uh ultimately now there is no ordinance now so it would be ultimately your decision the new ordinance also allows to correct me city attorney but the new ordinance does also allow the board to consider transportation issues public safety issues before approving a long gate so answer your question no it will not have an impact other than it would make this specific subdivision feel like they've been given a fair opportunity to finish the process with the rules as they are now and it's in line with state laws again like mayor mentioned earlier it's 100 in line with all the state falls the orbit says and the only thing that i would suggest

[0:12:17] actually there is one thing that i think is relevant uh that we may want to change is when you have a petition that's sent in obviously in any neighborhood all the residents are not going to agree right and that's the situation in every one of them my suggestion would uh would for it to be some type of super majority not just a 51 in the past the procedures have been three out of four 75 my suggestion would be to make it more is it now 50 nick is it just a majority in the proposed ordinance i think so so we could i could i could change that if i need to but if they if the board wanted to adopt that tonight that's their call we could just put that in the motion that we're changing that part of it well what i would do is i could i could revise the ordinance and um once again the table have that change in there of setting up the 75 as opposed to majority okay and i'll need to go back and see where it all says that in the ordinance to do that correctly so you can you can make that motion like authorizing recommending any ordinance containing a 75 percent you'd still come back and pass the same ordinance i mean there's no harm in doing both if you want to okay but that would be my only other suggestion uh as alderman gallagher stated the only thing is there's nothing extra in there it's just in line with state law basically it's not restricting anyone from having gates if the majority of the their homeowners want the gates the guts of the issue are that if you want to have full-time restricted access to the public it becomes a practice three but but if you just want gates you can put gates up as long as you still allow full access then the ordinance still allows you know still allows for a community to have gates if they want gates you know to slow the traffic and which is effective you know even though it's not uh fully private you know having the gates there would still accomplish um you know the goal of uh slowing the traffic through the neighborhood but it's um floor open for discussion uh

[0:14:21] and i'll take a motion if y'all want to you know that that's my only suggestion about tape on it is i don't want there to be any perception that there's been a rush to pass this ordinance to have one effect or another on the existing community that's talking about it because that's not true there is no rush to pass any ordinance all this is done is to clarify it for the future so um you know that's that's that's a boring call i'll make the most of the thing has already been made that was the open discussion okay so we have a motion by alderman flores the table the second alderman gallagher any other discussion i would like the super majority to put in in the proposed resolution what would you as 75 or what percentage i mean that's three quarters yeah okay and again there there have been some divisions in our city in the past that uh they don't agree on that and they've had some pretty heated uh homeowners association meetings about that some people want the gate some people do not uh that's why i think it is i agree with you i think it's important that you have a super majority of some time okay so we had a motion a second and the other discussion to the table hearing none all in favor say aye aye any opposed say no eyes have it motion carries that issue will be taken okay next on the agenda is our planning agenda mrs whitney cook yes sir we have some design review elevations for buildings we spoke about at the last border pilgrimage meeting uh the first one we've got is an application by 814 development this is a child care facility that is proposed to be located just south of the getwell church road intersection on the southeast corner it will face get well it will utilize an existing ingress egress that is just south of the bank there on the hard corner we have had them make some adjustments to the elevations we have those

[0:16:24] submitted later late this afternoon but they have been submitted they do have their decorative lighting they do have some amendments to the actual building it was done in a residential style we did have some concerns with where the play areas and the spray splash pad spray pads were in close proximity to the rosebury subdivision so they did ship those out of the way and get those away from the actual residential properties and with those changes the planning commission voted unanimously in favor of it mr mary i make a motion that we approve item one on the planning agenda tonight as presented second we have a motion involvement flores second ballroom and is there any discussion on item one hearing none all in favor say out all right all opposed say no eyes have it motion carries item number two we have a new prototype for wendy's quick service restaurant this was that secret site that was going on the new wendy's subdivision at church adventure just some minor changes we had to this which was one take the cream storefront and make it either anodized metal or bronze we asked them to tone down the red where the windy sun was they had two logo colors there one was extremely bright red one was a lower level red we had some changes to the landscaping we did confirm with mdot again that there was some encroachments with their design with their curb cuts and things like that we did confirm with mdot that uh we had no issues with that uh they didn't make the necessary changes as with all new developments we asked them to come through with some decorative lighting obviously this is a more modern building so the decorative acorn lightings are going to fit we've asked them to come back with some proposals for some decorative lighting that's more modern for their design so they're submitting those this week uh it's the last thing we're waiting on um but we've looked this is the only prototype very attractive buildings plenty of commission voted yesterday with those minor changes are there going to be any uh sidewalks

[0:18:28] down church road no i don't have any plans for down church road like i said this is right out of that interchange slope off so i definitely didn't want to kind of put them right there but going down denture if we want to look at adding them that way so we can maybe get some traffic down to the landers and back i think that's something we can actually ask for if you'd like to add that in is there a motion problem too to prove on to i'll make that motion as presented a second do you want to add that you want the side boxes yes yes and bike racks yeah i like it i got those in there okay alderman gallagher made the most did you sing i mean excuse me on item two uh any other discussion like mike right any other discussion hearing none all in favor say aye aye all posts say no i just have it motion carries on two item number three is the multi-tenant building uh it is a c store on the corner and then you have two bays of retail this is going to be your hard corner on the southwest section of state line and get well you'll see the materials to the side there should be a color elevation if you'll scroll down one more maybe two more uh anyhow we did ask for a few matter changes especially since it's a hard corner it's a major entryway into the cities we wanted the landscaping to be a little bit more conducive to an entry point um we did have a couple of minor changes on the building but all together it came in very conducive to what we like and what we asked for they already had a lot of the materials put in place that we asked for they already had a lot of landscaping we had as for the decorative

[0:20:31] lighting they put in place so there wasn't a whole lot of changes we did ask them to raise the parapet on the back side since it's pretty well visible for both state line and get well we didn't want to see the back of the building uh in the back of the roof line so we had them raise the parapet uh and add some more decorative lighting in there like i said and kind of increase the corner the actual hard corner with some landscaping they've appeased those conditions and so we're recommending approval mr mayor i believe we approve of three seconds have a motion by wheeler second ballroom in flores is there any discussion on three yeah well on the right side of that site layout is that correct on the right side well the long portion of the building is going to be facing out okay good that's what i'm saying any other discussion hearing none all in favor say hi all right all opposed say no eyes have it motion carries on three item number four is a request by north quite christian school for a conditional use permit to allow a reader board on a monument based sign at their existing location at 7 400 yet well um they did come in and request a variance because right now our site ordinance allows for reader boards and commercial zones and office zones it is currently an agricultural zone it went through board of adjustments hearing it was branded the variants based on public needs safety issues weather alerts amber alerts things like that felt it was a safety issue and just a good public access sign with that they went into the conditional use permit application it is compliant we require the amber lighting a certain size um lettering it has to be secondary to the primary signage uh and the overall sign meets the the criteria for a permanent sign so with that would recommend approval which way i recommend we approve it next second okay we have a motion involvement

[0:22:35] wheeler second of all kelly is there any discussion hearing none all in favor say aye aye aye all opposed say no i just have it motion carries on four number five it's a scrivener's era and what that is is it doesn't require a formal process because it's not a subdivision application but it's a minor adjustment to an existing platted subdivision this is rasco farm section b this is not the signature page what uh chaser clerks notified us that the chronological order or the number of lots did not match up with the overall pud we tried to go down there and just change the order and put in the numbers they wanted and just hand it off because it was not the signature page but they said they could not do it without a board approval for a scrivener's era on changing of the numbers that is literally all it is is instead of you know 1 through 10 it's 10 through 20 just to keep chronologically ordered with section a into section b into section c um so with that we just need board approval to make that amendment at the chancellor clerk's office and basically take this part of the mylars out and insert the new page that's where i move my movement approval number five on planning agenda second we have a motion balance brooks second ballroom wheeler is there any discussion on five hearing none all of ever say aye aye all opposed say no i just have it motion carries thank you okay next on the agenda's mayor's report just want to update you uh regarding a few things um if i get some help from ip can we get the uh city entrance signed uh okay i told you i would give you an update on where we've been we're not done with this finally but i just wanted to give you an update from urban ark this again would be the sun it's on interstate 55

[0:24:37] at the southern entrance to our city there's a piece of land there that we're talking with the property owners now trying to get an easement uh that's elevated on a hill so the terrain is is ideal for giving good exposure to the sun our purpose for this is to beautify our city and just to make a statement on the interstate that we're proud of south haven and just to kind of show our attention to detail and how we do things right in south haven so this sign would be elevated where you'd have high visibility uh it would be it will have landscaping lights uh you can see that it does have a little section you know landscaping just in uh in the brick bed right there uh it'll be um again elevated uh illuminated at night where you can see the sun but that's kind of where we are now uh we're gonna take a design and uh make another sign that's at the corner of northwest driving state line it's a municipal sign that kind of guides everyone off of uh state line you know to the court to city hall police we're going to do that but it would be structured with the same family of design you know with the limestone same color brick same coloring uh scheme so um but anyway that's where we are now we're not done but just wanted to kind of let everybody take a look at that and um and and share your thoughts on it if there's something you don't like about it i'd love to know that as well looks good we're going to adjust the size of it depending on where they are like the one on the interstate will have to be large you know because you'll want uh visibility but then we hope to eventually take this same sun and down scale it for like uh intersections like for example uh star landing in 51 you make it put one there and kind of curve it with the intersection so you would scale that down make it shorter but the one on the interstate would obviously be the biggest one whitney do we get any dimensions on the one on the interstate not yet um until we work out the exact i mean they need the exact location so they can determine if we need to

[0:26:38] increase the height for visibility issues they have to take in uh to accord the speed and then we'll get the actual height and the dimensions of it so we should have that next time okay but you'll notice some of the details i did want it to be um i want it to be nice you know we're not just there looking to stick a sign up i mean you look at the attention detail on the limestone uh urban art does a great job you know with listening to suggestions and and uh putting it in a picture for us i'm a visible kind of guy i like to see it but they they tweaked it to what we've asked them to do you got the city seals on both sides of the the columns and then obviously we want to call attention to south haven and all you know in all caps primarily and then our current logo is top of mississippi we did uh remain conscious to the fact that you know somewhere in the future if someone decides they don't like our logo they want to change top of mississippi that's on a metal piece that can be changed so you wouldn't have to take the whole sign down if you decided you didn't want that anymore in the future there's one thing that uh we talked kind of tossed around the tops to the columns this kind of has the um look of a flat top but you can you can actually make it somewhat of a rooftop or a little downward um angle so that's something we may you know visit with them too but what do y'all think about that do y'all like the top or do you want to like you don't like it flatter do you want a little cap on it does it look classy yeah where are the lights going to be are they going to be shining up to the side are they going to be at those yeah they'd be like um well i'm assuming what we would do is do them like um landscaping lights where you put them in front of the brick on the ground where they're pointing up shining up onto the side with that you know we can make changes if needed but that's all i just wanted to expose that to you guys we talked about this a long time we've made a lot of progress recently

[0:28:40] so i wanted to update you with that we should know at the next board meeting we should uh have the final design there as well as the other signs that i'm telling you about and then we can uh go ahead and proceed y'all budgeted for this in the beautification line so we have the money there and so we hope to have this thing under construction and done in 2018. next on my list um to update you uh we do have some good news today in the state house of representatives the tourism tax bill came up for a vote and passed 84 to 19. so that's a positive step that will go down to the state senate for approval and then obviously the governor will have to sign it before it becomes law so that was a good step today for the city of south dakota recently just a quick update we had a an emergency type issue at pinehurst lake a there's a that's a private lake but their levy was in danger of a breach we have a public road college road that's just south of there our engineers did a great job dan cordell and civil link on alerting us to the fact that our public road was in danger so we made the decision to do an intentional breach to make it safe or it wouldn't take out a college road that turned out to be a great decision on their part because the day that the emergency breach was done the spillway collapsed that night so it was a good decision on dan cordell and civil links we appreciate that we will address some other ways to go back and recoup some of the money that's been paid there we don't have that prepared at this point just want to update you on that um another thing that i hope that you'll join me in feeling good i wouldn't say excited it's nothing to be excited about but something that will be good for our city is as we've grown you know our city has gotten much larger we faced more challenges with public safety we had a building a public building on

[0:30:43] the west side of our city that was vacated by the wynn job center in december so we have a public building that's not being used we do have plans of making another police station so we're going we're going to improve the police presence in that area it's the wind job center that's on highway 51 just in front of the arena we're going to make that a police station where we have squad cars there and just increase the police presence in that area we've had some targeted problems in that area that we need to address and uh police chief and i agree that uh that the number one way to deter crime is to have more police presence so that's our goal to change that building to the police west precinct and we hope to have that done when the building is renovated a little bit we hope that we'll have the police in there within 90 days so that's all that i have this evening next on the agenda is our citizens agenda we did not have anyone that signed up in advance but we opened up the floor if anyone in the audience would like to speak you're welcome to come forward at this time okay we have no one that wants to speak on the citizen's agenda uh next on our agenda is our personnel docket mr mayor i know that meeting uh the personnel daca is presented on the state second we have a motion balerman brooks second ballroom in pain is there any discussion very nun roll call yes okay that motion carries okay next on our agenda is um city attorneys legal update
