[0:00:03] [Music] i uh know [Music] welcome everyone i'm now calling this meeting to order uh before we stand and have our prayer this evening we're going to go ahead and stand before our prayer or we have a moment of silence now the city lost one of our valuable team members this weekend uh cliff mr cliff wilkins uh was with us since 2007 which is a utility service tech um a great employee for us and a great man so we lost him saturday so we stand before we do the prayer and then remain standing for the pledge uh if you will you know have a moment of silence albert gallagher is going to lead us in prayer and ultimate pain will lead us into play so please stand with me for a moment your blessings

[0:12:10] compliance now give them time to get in compliance yes and this was from our ordinance committee meeting we had citizens that came to us and requested you know that we looked take another look at it and i think it was a good compromise and then we were able to you know allow some of this with current supply chain issues a lot of a lot of companies are stocked out so they're trying to buy in advance but if we do it this way and keep in the back of the building have a screen you know it takes away the negative of being you know an eyesore for us for the city so i commend the board and everybody and everybody to work on this whitney i think this is a big compromise any other comments or discussions hearing on roll call please yes yes yes yes yes that motion carries next on the agenda's resolution amending ordinance title 9 chapter 1 section 9-13 if this or russia's recall last year passing over not allowed to sell eagles and yards and residents and also uh on commercial lots of rock cargo ships this place as well as police for this ordinance um so just a simple amendment that any other discussion

[0:20:55] exact contract once uh comes in for right concrete is there any discussion hearing none all in favor say hi all right can you say no i just have it but she carries next on the agenda is the resolution to clean private property mr mayor should we get doctor resolution granting authority to include preferred property as presented on the state we have motion and pain second water with kelly is there any discussion hearing none is there anyone in the audience that has a financial interest in any of the properties without you hearing or seeing none roll call please yes yes yes yes yes that motion carries next on the agenda is our planning agenda this whitney cook our first application we have is the tax incentive request and approval of the west end district uh specifically it's 9175 mill branch this is there's an existing building on site the lady miss patrice williams also uh aka rockwell properties incorporated is proposing to completely remove and remove that building uh and putting a new structure there specifically for a nursery school from infants uh to two-year-olds what you see right there is the building you're proposing to take down she has submitted all of her documentation to us and this includes um her description and improvements and that's totally out about 316 221 when she wants to invest on the property um she's also submitted her site design her

[0:22:58] elevations of what she's proposing to do and at this point in time i've submitted everything over to nick we've also spoken with edie in terms of getting the tax freeze process at least started so what we want to do now is get approval for her and move forward with the demo with the rebuild and we of course will come back showing that everything that was proposed has been completed so we can put the incentives in place for her she said she's in the audience as bailey wants to discuss what the building is about and why she's choosing her invest here but she's really excited and she's ready to get going we have a motion to approve i have won the hard foods the second alderman kelly and uh just where's mrs williams i just want to thank you for investing in our original business district that's very important to our city and so we're really excited that you're stepping up and doing that and good luck i wish you all the best any other discussion about it more hearing than a roll call please yes yes that motion carries so the second application we've got uh is a request to subdivide or resub-divide lot over south lake commercial subdivision this is specifically the walmart rock right now it encompasses 19.35 acres the applicant

[0:25:01] is going to carve out a half acre in the northeast corner of the existing lot basically it's parking lot at this point in time they're wanting to carve it out for a um quick service restaurant or uh fast casual is what they like to call it um you'll see on the next applications for panda express we did point out some concerns that i think everybody here has and that is the traffic congestion at that intersection and even more specifically at the south prescott intersection so before we decided to put this up for a vote even at the planning commission level we did put a contingency on all their applications that they have to do a traffic analysis of what it is existing and what the impact will be with their structure there and their traffic uh and we indicated to them that there was even a slight increase that we would not be uh in favor of it uh right now they have a plan uh of approach that they've been working with our engineers in terms of doing some re-striping and possible re-signalization timing and they're having to work through mdot as well as us those improvements have to be put in place before we will permit the building and basically we have to show that there is either no difference in what the existing traffic flow is now or there's an improvement they've agreed with that contingency and uh with that stipulation we voted i submitted for approval to planning commission and they did that unanimously for approval this is going to go in the northeast corner of the walmart parking lot yeah and diagonal particularly in the corner of the wall it technically is a lot of times you'll see some trucks parked there um so yeah that's the location uh what you see highlighted here another thing that has to happen when you do a revision to a subdivision all the adjacent property owners have to sign off on you um that is going to be a very large hurdle for them because there's a lot of quick service restaurants over there that may

[0:27:02] not want more competition there but that is a stipulation in our ordinance that has to be met to record it uh but yes it will be in that northeast corner uh there are no more ingress egresses uh on to south crest they're using all the existing drives uh and again none of this will happen if we cannot get that level of service or traffic control down or improve or to remain the same with them on site they have done a traffic study uh they approached it the first time and we tried to basically tell us of a level of service fee which level of services it's just like grades at school abcdef um being a good one i was like i'm really gonna need you to go back and check out again uh they did uh they conceded to the fact that it was easily you know a level dbf um they they came back and said that they thought they would have little to no impact uh resetting a little impact is enough to make us say no to this um so then they refreshed us and said well if indot would do this if you have to do this to your life to make it better i said that's not our responsibility at this point you need to be doing the improvements for us and then show us that those improvements will improve it or at least keep it the same as what it's at and that's what we left it with them they understand that they feel like they can get that done um they've been working with a link from our side with their traffic engineers and they have come up with a plan i'm not going to say that citylink has approved that plan said yes that's perfect that works but all the approvals tonight are contingent on that so approving i mean if they can't achieve what we need them to achieve with the traffic improvements this won't happen it's a contingency on the report it's a contingency on the boat that we've had [Music]

[0:29:04] uh changes and some re-striking uh specifically at that intersection [Music] make the adjustments and show us that it is not improved or remaining the same then the approval goes away is there a reason that we wouldn't wait until that's done of course because they kept well i mean that's why i told them they kept pushing i i held them off the four months concerning the private sector and the traffic analysis that they said we want to go and get this through as far as we can i said we understand that anything i bring up to the board is going to be contingent on that they said they understood that they i guess to keep panda express on board with one in this location thing i just show some forward movement with the city no i don't like the motion painting the contingencies [Music] they can't meet that criteria so we have we have a motion of the aurora paint the second volume of wheeler discussions i i do believe that's a lot of it um and in speaking within the planning commission that the owner of penn express can then explain the thing i said you know there's so many other places you can go why are we stuck on the parking lot at walmart but apparently they're

[0:31:05] affiliated and have a deal cut with walmart on a lot of their size and this is something they do constantly um and i said i don't know if you ever had an intersection like that and show the walmarts but this one's special and we're not going to make it worse aesthetically i like the idea because i actually i think it will soften it traffic on that side is probably maybe a little less than it is right there on the other side i think i i agree and that's what i told myself i think it'll soften what's already there um and uh and they have brought up a couple of good points and one of them being that we feel like the majority of our traffic is going to be traffic that's already in place there and that could very well be true but until you show me on paper and traffic analysis before and after i'm not going to guess that because again i'm not a traffic engineer and you need to show that to us because what we don't want to do is make that intersection worse i can squeeze it yes they've got good i mean i'm not it's a it's a really good cycling they're very good at separating out their drive-throughs versus their sit-down uh it was a very good layout there and they also have a shared parking agreement with walmart for the adjacent five thousand parking stations it seems to be that's their that's what they do they're they're buying out corners inside walmart's parking lot i guess walmart can see the fact they don't need that much parking anymore um and then they just saw cut out the asphalt and go from there they irrigate it they turn into a green hillside they'll hold up there's that there's a heavy landscape to it it's beautiful building up the design reviews next to usual building beautiful and second uh we literally didn't have anything to say about it yes yes yes

[0:33:10] yes that motion periods number three is the design review again it does have a contingency placed on it it was also placed on the site plan so uh any approvals tonight we'll have that contingency of the traffic analysis and the stipulations but it cannot get worse you see their buildings all the materials we're aesthetically pleasing to the planning commission i did fall compliant to what we require we had some adjustments to the size of landscaping um and we had them shift you'll see a very small strip of landscaping between them and southwest parkway wanted to increase that they agreed to all of that they got the decorative gliding in and they're irrigating it with all those stipulations they agreed to all of them painting commission voting meaninglessly would that contingencies there are bike racks yes sir if you're riding a bike in the walmart parking lot southwest parkway you are beyond me beyonce [Music] yes that motion carries based on our agenda is our mayor's report um we'll try to move kind of quickly but rasco road you know the reclamation project was stalled we actually made an adjustment there with contractors but that that is done so it's really nice the areas that were we're having sub-surface failures have all been rebuilt there are some sections that still are going to need some potholes fixed but

[0:35:12] they weren't failures significant enough to have to rebuild the road there so we'll those will be done as a follow-up in case we want to ask you a question about that our street resurfacing schedule will start for eplot 22 we'll start next week i did send everyone a list of the streets we all have that materials have gone up just like everything else in our world right now so we did have to make some adjustments there are some streets that we would like to have done this year that we've moved back to next year all these are prioritized based on the condition of the road and also traffic volume so it makes sense you know if you got if you can't do two you know you go with the road that uh that services more vehicles and so uh it's purely objective that's how it's done so if anybody asks you why you know this one got moved back it's wine if they say we've seen the condition of it the answer is yes we have and we're aware of the condition of the roads and um and the one that took that place is worse than that one i can assure you i'd be glad to ride you out there and show you that so but anyway the good news is you know we do have a good budget for our streets and i appreciate the board support and having an aggressive infrastructure improvement plan it's so important that your streets are in good condition and so that work will start to start next week and hopefully you know if the weather you know cooperates in october maybe part of november we can knock some of these out before the end of the year again if someone asks it's very rare that we're not done with all of them by late april or early may so um so we don't get to them before the weather gets bad in 2021 most of them will be resurfaced before before may of 22. food truck friday for the first time ever is this friday october 8th um 10 o'clock in the morning till 3 p.m at the south haven arena and

[0:37:17] the springfest haven parking lot at stone grove park like everything you know when you do something new a lot of the food truck vendors are excited about it but they have prior commitments so we're not going to have as many you know on day one as we eventually will have we hope to have you know a couple our plans to have a couple at each location uh but just uh just to ask for everyone's patience it is gonna take a little bit of time to ramp it up uh because like i said um christie's got a lot of responses back a lot of excitement but a lot of them already had commitments for that day so as the fridays go on you're gonna start to see more options and when that happens we'll start to put that on the city website to let everybody know who's there and what location they are as well so anyway it's exciting to get got to start somewhere we're starting this friday um you may have noticed became the building that we uh we had a little construction project going on out front evidently the roof drain when the building was renovated was not tied uh time to escape the building properly so we had some water leaks in the building so what we're doing is correcting that to pump the water from the roof to drain it out to the west parking lot so that project that's what that's that's what's going on out there two other little things you know last meeting we talked about the tri-state contact agency agreement um this is something that um all the cities are are talking about it and i don't want to ask for a vote on this tonight because i think that it's been partly rushed because and i didn't know this and i hope i'm saying this correctly but the arkansas state legislature doesn't meet every year like tennessee mississippi so that was the reason that they were in a hurry you know because they didn't want to be delayed at home of the year because if this compact agency is formed you'll have to have approval by the state legislatures of all three states

[0:39:20] so they want to try to go ahead and get this ready where it could be presented to arkansas this year so you have to wait another year that's the reason for the rush it's not like somebody's trying to cram crab anything down you know his throat um but obviously there needs to be more discussion the uh the soviet county board of supervisors uh talked about it yesterday and they still had a ton of questions you know in the past um things is the understatement of the century to say that north mississippi and memphis haven't always worked well together um there have been lots of uh arrangements that you know that did not go well and there's been some trust issues and so i think that still applies to some people so i think there's still a lot of questions that need to be answered before we vote on this but i did want to just update you on that and answer any questions if y'all had since the last meeting if you thought about it have any following questions from me i wanted to try to answer those for you and if not then that's the update we'll just wait until everybody has a chance to have their questions answered uh anna holtzclaw is the director of reason smart in memphis and she uh what i'm going to try to do is tap her in front of all the boards and let her explain in the details of what's what's i wouldn't even be talking about this i would i would mix this already uh if it's if it weren't for john nations who is the director of the uh the bi-state contract agency in st louis the things that they did in my opinion are things that have never been done in our uh regional contracts before like again like i was telling you last time about having a subdivided board where even if something's approved by the full board it still is not approved until every to all three states also approve it so all those safety precautions are put in there to make sure that some of the things that happened in the past don't happen with this like it it

[0:41:22] has to be something that's good for everybody or it's not for this organization so that that's one of the main things that everybody seems to have an objection to is they're worried that hey you know some federal money is going to come down and it's going to all benefit you know tennessee and arkansas mississippi or vice versa or whatever so this what they did in st louis was special and it did that to make sure that everybody benefited from it and so i feel much more comfortable to experiment with this finding out a little bit more about it for that reason but anyway let's let's let a little more time go by and let anna get the chance to meet with all the boards and answer the questions and then i'll come back and ask for a quote um one last thing when we were talking about this in the council government meeting the discussion came up again about the metropolitan planning organization has an annual fee that the county has always paid um and last year the county uh asked that the cities share that fee based on population per round a share based on population and the timing of it was kind of bad i think it was like right after we set the budget and coincidentally as we set the budget again but anyway they're asking us to and we don't have to vote on this tonight but i just wanted to inform you about it and then we can in the near future photo and again but basically the fee is 185 314 a year and all the cities and county benefit y'all know that we've benefited from a lot of npo money federal money for transportation projects so if you break it down bases my mass if you break it down based on population of that 185 000 314 south haven's share will be 25 066 and then again they would break it down you know for the county uh hernandez wallace horne like southampton

[0:43:25] but just be thinking about that they've asked us if we would share those dues so in the near future again i'll ask you for a formal thought on that 25 06. and the total is 185 343 so is there any discussion about any questions for me about that well in the budget we do have a capital improvements line yeah we could take it out of there or or we could wait and if there's um if we see a potential surplus throughout the year you know we can just do a budget amendment you know a lot of times you know we'll find out that our sales tax revenue is higher than we projected if we see a trend like that and we could just do a straight up budget again i think it was the timing of it we had just set the budget and then and in the council governors meeting there were some other mayors that actually questioned the timing of it and so that's what kind of altered that you know and so yeah this board voted not to do that last year [Music] um the npo that's a great question mpo has been an extremely valuable organization so it's a federalist federal money that's allocated to metropolitan areas so memphis the mpo is the memphis planning organization so that federal money goes to the entire memphis metro and then uh all the cities and counties make applications for projects like we like whitney would help with this so we

[0:45:27] submit a project and we show traffic counts and the need and so you make an application to the to the npo on what you want how much money then it's awarded based on the merit it's you know the traffic count is justified um an example that is the gap worldwide project that's about to happen south of uh church road to starland that's nine and a half billion dollars and so it's an 80 20 plan so that we get 80 percent of that as being funded by federal dollars so it's huge like it's it's things yes yeah and we made applications for that project a long time ago was it 15 weeks so we we made application in 2015 for that and then there's a limited amount of money so the the area has to make do give and take like like i'll give you a good example that two years ago uh fernando uh had a chance to get the mackerel road interchange on 269 and so all the cities came together and we agreed that that's that's big that will help fernando so much and it will help our entire county so we put some of our projects on hold and uh so fernando got the vacant bill project with a limited amount of money now ours is the next one that's based on the traffic counts that has the most merit so the get little project now has been funded but you basically make application then it's you're either awarded it or not then when you get awarded the project there has to be enough money to make it happen and in this case it is good so some others that have happened uh we had a plan through the church road between i-55 and highway 51 or resurfaced i think in 2016. that was a significant amount of money um that was mpo money um [Music] projects

[0:47:39] so it is really valuable to all of us um for projects that are too big for us like we can't you know a 10 million dollar project we don't you know cities don't have a budget for that i mean and somebody said why is the federal government paying money for city road properties and the answer is real simple because we pay taxes so some of that money should be allocated back you know back to the cities and that's what it's for but the fee i think the issue with the fee is it's kind of a structure with npo based on counties so like you know every county in the memphis metro is kind of like the um the representative and then we're again obviously a subdivision of desoto county um it's just a it's just a philosophical i mean you know we pay a lot we've had a large amount of money to the county there's no doubt about that 21 million dollars goes to the county that's generated inside the city of south haven you know i guess it's just a philosophical thing if you think they should pay their policies i do give the i commend the county you know lately you know there have been some projects that um that they're doing that will benefit the city you know we did a three-way partnership on the lander center roads since you're new to the board but that project where swinney dead ends at star landing if you can envision that for a second so if you're if you take a bird's eye view of that then on the south side mackenville comes north and they just are barely offset and so there's some tremendous value to the county and everybody as a whole to connect those two roads because then you would have another access to 269 from south haven it also would benefit hernando greatly with economic development because

[0:49:41] consumers can get south and get to hernando quicker so the county there's a there's a piece of that but since that most of it is in the county but there's a piece of that that is in south haven but the county has stepped up to pay for that so i commend them for that so there's you know there's some things that we work well we didn't work well again um anyway it's just a you know i think that main thing and again i put words in the board member's mouth but i think the main thing from what i heard last year is you know we want to see more investment back into the cities from the county we put a lot of money in you know into their budget i mean that's just a fact the numbers don't lie we understand that we have joint things that we share in the judicial system um you know that we had the parent part of that but anyway it's just a philosophical thing you know should we have to share that or should that be paid for the money that is generated so y'all be thinking about that and then in the near future we'll revisit that okay that's all i have to say is there any other anything that i said any questions for me about that or anything else we'll move on on the agenda is our personnel doctor mr mayor we have a personal document that's presented on the scene good motion water and pain second of all is there any discussion hearing none or yes yes yes that motion carries next on the agenda is our city attorney's legal update two items that came in uh like the first item um it's just an authorization for outcome variants under our facility policy for this household we have motion water in pain second
