[0:00:00] welcome everyone i'm now calling this meeting to order please stand with us we'll be led in prayer of honorable gallagher please remain standing for the pledge of allegiance heavenly father we come to you tonight thank you for the ability to meet here tonight lord we thank you for the birth of our savior jesus christ who occurred during this time lord we ask that you would be with families who are struggling lord who are without loved ones lord and i ask for protection over of sick family members that are out there today we ask you to keep your hand over our city in jesus name to the flag of the united states of america to the republic for which it stands one nation under god indivisible with liberty and justice we're going to get started i just want to remind everybody before we get going looks like everybody spread out pretty well but let's be safe you know obviously with this time of year as it is with any virus or any infectious disease this is a time that a virus thrives on this the you know the darkness the weather everybody you know having to go back inside again so i'm just encouraging everyone you know to be smart just use common sense spread out when you're leaving the building please don't all go together everybody just again just spread out to be safe first on the agenda is our approval of minutes for december 1st 2020 meeting mr may i move we appreciate the breakthrough of december 1st 2020 with the university of education for attraction we have a motion monitoring pain second harvard boots is there any discussion hearing none roll call yes

[0:02:06] that motion carries next on the agenda's a request by entergy for a utility easement on both the north and south side of starlanding road or the extension of overhead power lines this is what you could uh yes sir my office was approached in august of this year by a consultant for entergy they're looking at extending their overhead power lines down star landing road initially they came to us on just the north side and if you'll see on the map that's up on the screen now it would encroach on where the future fire station is set to go so we did ask them to go to the south side um once we got it located on the south side we did find that one of the overhead power poles they were proposing would also interfere with an entrance into our water plant that would be under construction we did ask them to ship that they did that as well uh so once those changes were made they have come to the city uh with an offer um a four thousand dollars in consideration they praise value for a 24 wide easement in the locations you see right here on both city properties we've looked at it does meet our needs it doesn't encourage any further on any development we have coming our recommendation is to approve it at this time is there any discussion so is this the only place in the city where they're going to to extend lines yeah they have a lot of line expansion under discussion right now uh this one they know i guess a little further along in this area you know you've got a future widening project at some point in time with star landing they're trying to get their utilities in line for that this is one of the areas that they knew for sure they were ready to acquire their easements but there is expansion all over the city i know they've been looking at just different alternatives just trying to con you know connectivity from where the substations are over there but nothing sets down i think they're looking at different alternatives and talking to homeowners just to see where the impacts are but i don't think anything's been set in stone i haven't heard anything uh

[0:04:08] they've talked to us quite a bit uh sweden's obviously been looked at but they're yeah there's there's nothing obviously with the growth of the southeastern part of our city you know for there to be added with power it's going to have to be some changes made so like you said we have been in multiple meetings with energy and we're trying to you know help the city get this accomplished with power in the most aesthetically pleasing uh way possible and also the way that it doesn't disrupt you know private property owners uh it can be challenging and there are there are going to be some challenging things in the near future but um that one that you're talking about i can't remember if that was uh was that interesting we sure that was it did we ever find out it was entertaining okay yeah and as nick told us you know they do have when they have an easement they don't you know generally contact us for permission they can go do what they got to do so so as a city we don't have the authority or we don't know about everything that they do but please just like you did that night you know if you have a someone that contacts you is concerned about working there near their property we can always find out there by who it is and they've been very receptive to our request to make sure that if there's any property that's disrupted that they go back and that they make it right you know where they miss mess the yard up with the you know whatever the grass or fence or anything like that so always make us aware because they've been like so they've been very receptive and this one whitney i didn't have a question with this one too so we know that the fire station is on the north side and then uh and then the uh adjustments with utilities on the south side so you're 100 confident that these coals are not going to interfere with because we've got a lot of stuff we're going to be doing in that area not only with the fire station but also the utilities so are you you're comfortable with where the polls will be yes sir i got with uh both sibling and with the utility department got their footprints of where their improvements were going to be done we got the fire department got their footprints uh did a layover of the overhead power lines did

[0:06:10] the adjustments needed so we didn't interfere with either one of those make sure we were on the same page everybody's fine so with this design right here it does not encroach on any of our new development thank you any other discussion any other questions okay uh do we have one do we have a question already okay sorry if there's no other discussion uh yes yes yes yes that motion carries next on the agenda's budget amendment for our current budget chris wilson [Music] so this budget takes into consideration two different items one being the first is that the buying issuance and prior your transfer cash balance utilities line you can find the automatic is there any discussion hearing none roll call yes yes the motion carries next on the agenda is a resolution for a sole source purchase in our utilities department i'm very hungry it's just the resolution of purchase for salesforce is the only um

[0:08:28] measure online to sell and or produce units we have a motion bottle and gallery our second monitor wheeler is there any discussion hearing none roll call yes that emotion carries next on the agendas of free and lives agreement with the spectra of laboratories this is uh similar to the agreement we did with medline in the previously communicated theory of i spectrum you as part of the agreement provide an investment project the project has been less than 25 million dollars on the third anniversary uh started commercial operations along with bigger than 200 new jobs um but with our anniversary as part of this commitment the spectrum really granted one third um taxes and also the employees investment um they'll be reduced uh bmw reducing programming basis working violent coming back until ninety percent through the top agreement and more investment um so um is there any discussion

[0:10:48] appearing down roll call yes yes the motion carries next on the agenda is a contract with argo entertainment this is a very same contract for very small contractors who've gone over the past but if you like work during the delightful city event margot will be responsible for all entertainment fireworks we'll set up um promotions um and then the city uh this authority mississippi code 173-1 will take part over 9.5 for these services uh i think they've been focused on a new job in the past i think they do other cities as well so authorization for the mayor to sign margot and for the invoice hearing that all in favor say hi any opposed say no i just haven't legislated next on the agenda's resolution for for the surplus of major tim allred's firearm major all-round is retiring on december 31st of this year um before we get into that i'd just like to say a quick thing i don't get a chance to to talk to uh major allred before the end but major i'll read the start with the city of south haven on may 16 1989 uh so he's been with us many many years and uh you know held many positions in our police department and uh you know come all the way up you know to the role of major you know that's at the top so he has a very important position with our city and it's been many years with us so i just want to say tonight what i'll be saying to him soon that we appreciate

[0:12:50] you know all the sacrifices that that tim has given us you know there have been many many days i'm sure that you know that he saw things that uh that are not pleasant you know he's seen a lot of tough things but he put himself in some dangerous situations you know he's had many holidays where he wasn't with his family uh because he was serving the city so i just uh you know wanted to say thanks to tim uh for the many years of service we we greatly appreciate that and and i know chief's with us tonight i know chief's going missing we're all going to miss him but we thank major albert for his service and that's what this is about tonight uh just a little small gesture for us to you know give give him his phone so that i would recommend if y'all will someone make a motion to do it we have a motion wheeler second of all from flores is our discussion hearing non-roll yes emotion carries next on the agenda is a resolution for uh final cut air conditioners tax exemption this was previously approved by the board for hot air house convention four-year personal property tax one million seven hundred and eighty-four seven 786 uh at this time the mississippi park revenues also approved this night authorization for the mayor's time resolution and final higher tax edition we have motion uh alderman flores second of all wheeler is there any discussion hearing yes that motion carries next on the agenda is the resolution for liens this is just authorized to be filed by

[0:16:55] the lord can be prepared uh it just works more efficiently like that you know nine out of ten things that uh that a citizen wants to speak about usually we can resolve that if they just contact the city we solve a lot of problems in a hurry so we we think it's the best way to be efficient with everyone's time when we have a citizen's agenda without knowing the topic we've experienced situations where the meetings uh really not useful you know because the first time that is brought to the attention and we find ourselves going back and in some cases you know recanting public discussions that happen you know from many many meetings ago and it's just uh just to be real frank it's just not efficient for the city and it's not really fair you know for the city so i think this is a better way to do it that way it helps us be prepared it helps us to manage the time better helps us answer questions quicker and it also preserves what i love is giving the citizens a chance to speak i love that i don't ever want to take that away public board meetings as our city attorney has reminded us they're not public hearings all the time there's certain segments of that by state law or public hearings but they're a time for the city to do business they're not hearing so we want to be careful how we do that while yet again still preserving the right and the chance for citizens to be able to speak so with that being said i just want to update everyone that we have made a change to how we're doing it but we have a citizen that registered to speak tonight and it's um it's mr eric triset uh regarding our parking ordinance so mr gisette would you please come forward at this time is eric trisette with us tonight okay i guess i guess he decided not to come um but just to update the board hopefully he'll come at the next meeting basically uh he did contact my office uh

[0:18:58] code enforcement was just enforcing the codes it was a parking issue uh that our people did the right thing by our ordinance and so there's nothing that that i you know had the authority to change uh so that's why we invited him to come speak to you uh but anyway obviously didn't show up so uh at the next meeting just you'll know he comes at that time and there was nobody else that uh after that that's registered so we'll move on planning agendas next uh miss whitney cook i guess our first application is sustainable development construction uh to redesign approximately 29 acres on the other side of starland road west of marshall east drive from actually okay we'll do the zoning hearing first so uh with me just saying that we're gonna have a chance to do it by hearing so would somebody make a motion to open a public hearing regarding a zoning chain on it second bottom and kelly all in favor say hi all right you opposed say no uh motion carries um so the zoning hearing is now open so uh do you want to run down it and then we'll allow anyone in the audience that has a question uh the hearing is open so anyone that has a question uh please stand up and we'll uh we'll acknowledge you and hear you as i stated approximately it's probably 28.5 acres uh it's on the north side of store landing road west of marshall louise drive you'll see in the highlight areas on the ariel right there it's um several pieces of property uh they run really deep they're very narrow so it took a combination of all of them to combine to make this development uh one of the things we have to ensure the comprehensive plan is that whatever comes into play here is considered low density residential so it puts under 2.2 dwelling units per acre

[0:21:00] that's a little less than a half an acre for each one to comply that's minus open spaces what the applicant has designed it for our 20 000 plus square foot box which is going to meet that low density residential there's 29 lots there's a single access off star landing road with the secondary point of access which will carry off the wheelbarrow and all the way to star landing it is being proposed in two phases it does have an open space wet pond um for aesthetics on the interior it does have tension along starling road there's an additional pond open space in the second phase they have set the minimums for the heat sport footage at 2300 and however after speaking to the developer from the applicant um the plans he intends to build here are between 2 500 2600 square foot minimums um we've submitted the street names to the emergency services department for concurrence they have agreed to the street views on this um and again we needed to uh ensure that not only it was in compliance with the comprehensive plan but also with the surrounding area uh to the north of it you have lakes of nicholas which is a mixture of high density and low density housing um what directly is directly adjacent to this one is your low density housing the twenty thousand thirty thousand square feet uh so it does comply with the surrounding neighborhoods uh and with both of those items in mind we recommended approval to the planning commission and it was voted unanimously in favor of the club mr mayor i'll make a motion that we approve item number one on the planning agenda as presented here we have motion bottom and gallagher to approve item one second monitoring kelly is there anyone in the audience that wanted to uh to speak in the hearing and then we'll close the period it's called roll call well i think the uh motion is second here is there anyone in the audience would like to speak okay hearing or seeing none uh now is there a motion to close the public here we got a motion modern employer second

[0:23:02] modern wheeler all beverages any opposed say no i just have a motion carries the public hearing is closed now we have a motion by honorable gallagher and a second honor to kelly uh to approve item one for any other discussion about hearing none real yes okay that motion carries item number two is the subdivision application that will follow up with phase one of the pud that we just approved um it is the access off of star landing which will uh incorporate 19.211 acres of that said pud again minimum square footage of the lives is 20 000. um right now it looks like the average life size for this section is 22 310. again the heated square footage is set at 2300 for the pud uh with a proposed build out between 25 and 2600 for the heated uh it does comply with all of our requirements the only comment we didn't have is as we stated before charlotte road does have plans for expansion um and so we want to get them in contact with the designers and the consultants like that so that we have a proper right-of-way necessary for that widely when it comes that was agreed upon by the developer and planning commission as well uh with that in mind we go to the united states mr we have a motion on item two baltimore gallagher second alderman wheeler carrying down a roll yes that motion carries our third item is uh again an amendment to an existing pud but it will be rezoning a portion of property to

[0:25:04] incorporate this into that so i'm guessing we need to kind of do them once again okay we have a motion block in florida's second order gallery to open uh a public hearing prior to three uh all papers down all right any opposed say no i was having motion carries public hearing is now open regarding item three so if anyone in the audience would like to speak regard regarding this something change uh please stand okay this uh amendment to the pod is there is 81 acres sitting to the north of the existing budd it actually is directly adjacent to getwell road and then carries a little west into the property i think there's a boundary survey in the application that you can see online um anyhow what the proposal to do is to add uh one commercial out parcel along the furniture get well road um they are also proposing to add um additional office space into area a1 um and add the farmers market with the dog park into this area as well which is a shift from where the farmer's market was at the south end additionally they're adding four sections or five sections of um the same lot sizes the same square footage and the same cottage homes um that's already proposed throughout the development uh so it's basically going to be an infield development of the existing um design of the houses you've got conservation side which is overall the tula home area with the trailway this is now going to connect with that and do the half acre lots with those minimum square footages you have the cottages that have front road access and you have the cottages that have rear life access all of those will be incorporated into this 81 acres along with that dark park the farmers market and the additional office space it is compliant with the surrounding area it is compliant with the comprehensive plan which is calling for mixed use for this area so with both of those in mind

[0:27:06] uh plenty commissioned and documentedly for favor of amending it and activism okay so there's any anyone in the audience would like to speak regarding this change hearing or seeing none uh is there emotion these are moisture clothes okay we've got a motion bottom floors to close the public hearing second second of all in favor say i'm fine any proposed say no i just have a question kerry's uh public hearing is now closed uh now is there a motion to approve like three on the planning attendance tonight second we've got a motion monitor fluoresce second monitor pain three discussion on the board hearing none real call questions yes yes yes yes okay that motion carries i didn't have the one did you want me to handle the railroad contract if you want to keep that under the mayor's report go ahead and do it now will you okay um we have an addendum to extend the service contract between the city of south america engineering concerning railroad extension if you'll remember some time back as one of our lka projects which is a cost sharing effort we have with bot and the federal highway this project we actually pulled off of construction um money so we could focus our our monies on gatlin road south at this time and so we could distribute evenly with the rest of the counties so our agreement was that we would get it designed and handled all the way down to what we call shell frame which means we can put it on the shelf and when we grid it back out it's ready for construction within that time period we were not able to finish a few items on it including environmental public meetings because totally we were unable to have those meetings uh we have office review sit bills the middle of mats and deeds in our final submittal plans and proposals to mdot this is at no extra cost to the city everything's already contained incorporated in this is just a one-year

[0:29:08] extension to finalize these details so we can get formalized with d.o.t and set it on the shelf and get ready for construction whenever we find this um so i have to get permission i'm asking permission for the mayor to sign up on this extension of the contract we have motion water with florida second of all with gallagher he's reading another discussion and just to add to that um you know heard me update before uh with mpo claiming a lot of changes limitations we've had to really uh do some shifting with priorities uh the general south providing project is our number one priority uh this is the number one in the county right now with the mto fund so we had to make some sacrifices you know hernando we were a good teammate a couple years ago with everybody joined and gave up some of their projects to allow hernando to get the mcavel exchange on 269 which we all think that she was going to use for you know for hernando for the entire county and help south dakota citizens too so uh so with that sacrifice we had to give up nail you know but it's still on our it's still on our plan but we're just kind of moving back and forth two years okay is there any other discussion about that very done roll call please yes yes good that motion carries thank you

[0:31:11] all right next on the agendas uh is the mayor's report um i just want to update a few things uh speaking of gentleman would talk about that first uh the gilbert south lightning project has been in process for five years now we made that application 2015 and that is to widen get well between church truck and star landing road uh it's a desperate situation it's a bottleneck there that's horrific and so it is uh it has been approved and uh it's in the right-of-way uh final stages of right-of-way pretty same design right away so we hope to have a meeting uh with mdot we'll be assisting with that in january and then the latest update is we expect that to be under construction by the mid-2004 so that that's a big deal for the city it's our number one it's just as far as looking at the uh objectively looking at the traffic flows and the difference it'll make is tremendous the question that would come up after you know when 269 open it tremendously increased the traffic on get well and that is a project that i understand the county has been working on with their npo funding as well so we're hoping that the county will work with that as well too you know to get that sour part of it you know from 269 up to starland so anyway the good news after five years uh that should be in their way it should be under construction in 2012. then moving on uh fire station number five got on our capital improvement plan fire station number five is in that plan um it has been in the process of design with a2h and it's my understanding that um within the next ten days they're gonna have that ready to be set up to get a bid so then you know we'll know the exact numbers on that and i'll be able to go ahead and start moving forward with fire station number five as we saw earlier in our meeting that location is in the s-curve on the star landing road just uh just when we asked of the evidence so that's been a long time coming i know

[0:33:14] the city has been planning that for many many years it was delayed when the housing crisis happened because it ought to develop in that area but now as you see on our planet agenda 9th with all the houses that are being built in that area is crucial that we get fire station number five and again we expect that we get fire station number five that our class rating will go from a three to a two which is going to make us uh if not the highest i think it makes us one of two two or three we're the highest rated fire station state of mississippi so that's that translates to many causes as far as citizens on a residential fire insurance rating can't help some but the bigger deal is on commercial fire insurance rating going uh going from one class to another save a large amount of money in a commercial for commercial insurance which again makes our city more attractive for development next just a couple most of the projects that we have going i can spend a whole lot of time with that we have a lot of things going on the park project soccer is uh is on schedule we did get to sign it down i would believe it is you know it took we got it down soon enough to where we're going to have the plane surface in the spring we'll have a soccer season in the spring the pavilion and you know bathrooms offices concessions that facility is under construction on the schedule and the lighting was just uh tested last week so the light the lights are up and are functional so we're about about ready to play soccer you know like really expand soccer in our city which is going to be tremendous for us um alongside of that uh with the capital improvement project the apparel project and artificial target they have not wasted any time there i encourage everyone to take a ride through there really looks great they have have the planned surface down on complex a and b at um excuse me at c at snow b and d are

[0:35:18] in the near future we expect that in february uh all the surface of snow will be done so that's they made great progress there uh grain brick the same thing i think we've got two fields in greenbrook that already have the final surface on them and then the other uh the subsurface work is being done on all the other fields too so uh greenwork is on schedule as well so that project will be huge for us and again just to remind everybody it's not just about having turf it's a it's a business decision with the city when you combine the lost revenues from a rain out and also the reduction in maintenance costs it's about a half a billion dollar turnaround in the city so i believe the board made a great decision with that project street resurfacing you all know that we made an agreement with lehman roberts that they would bring all of their crews not all their crews they would give southaven designated crews because many cities halted their stream improvement because of the coveted loss of revenue again it's a good thing to be in south haven because this board has been committed to infrastructure improvement in our streets we spent a lot more money on the streets uh than in the past and it continues to go up our streets are getting in better condition but with that agreement believe that robertson agreed to do all of our streets in the fall uh if we would uh you know have them give them a one-year extension and we did that and the report tonight is they're almost done they've done an enormous amount of streets uh there's uh two streets that have to be what we call reclaim uh rascal and college road we realized that the the layman roberts contract that was not in there so in february in early 2021 but all the other streets of the weather will operate they're going to be done with all the streets on our 2021 list uh this year so anyway it's uh it's always nice you know for someone to uh you know to drive on a new street and uh so i think that's a that's

[0:37:20] an important commitment that our cities made that's the update i'm happy about that the 2020 recount every year and i do that the first meeting in january just to take a step and look back at all the things that happen over a year you know whether it be our personal life our business life our city you know city work you don't realize how many things happen in a year you know kobe uh disrupted everybody's world there's been a lot of crazy things that have happened in 2020 we all know that but the good thing about my report tonight is with all the challenges our people in our city stepped up we were very resilient we were able to move on had to make some sacrifices here and there financially but our major projects we've been able to get those done uh so when i do that recap the first uh board meeting in january you're gonna be amazed you know how many things happen in 2020 so i'll i'll have that update prepared for you and we'll get through that then but anyway just tonight i just want to let you know that you know that our team in south haven has been extremely resilient uh we've been through all the challenges uh we've gotten a lot done for the city in 2020 so we should all be very happy about that because we wanted to hear a couple other little small not small things but not project related just fun things for the city that really morale boosters good for charity our southern lights project last thing i told you that y'all committed with the budget to funding additional displays and improving improving the lines to do the led lights and uh and the reporters our citizens have really enjoyed that it's our attendance to that event has been more than ever uh in eight years i've worked for the city so we've already surpassed the amount of revenue that all of it goes to the charities and uh last year the revenue was 42 000 and we've already passed that with 16

[0:39:22] days left so i think it's been a great event for us last thing um wow who would have ever thought that we would have had to cancel our christmas parade it's been a tradition since the early 70s in south haven and uh and thanks to alderman kelly he came up with an idea to have a drive through christmas parade and so and when i tell you that the first uh when he first brought that to my attention you know my questions to him and then as we started off talking about it all the other questions like what is this how's this going to work so it's just amazing that saturday night i was out there and watched dr kelly directing it and we had our police department put a float in it utilities would have floated and had so many people at the last minute that you know put the plugs together and it was just a great event i'm just telling you it was really nice and and i stood there by the exit where santa and mrs claus were and to see the kids rolling down the window waving center i mean what your goal was to put a smile on the face as you accomplished that and it was just awesome to see the kids you know looking out the window waving santa claus and with all the things that happened in 2020 and i've been able to have our traditional christmas parade it was just really a super event and again i just thank you alan and kelly that was a great idea i know you had to work with kane off in a short amount of time so i appreciate that and that's all i have tonight that's all on the mayor's report does anyone have any questions for me about any uh about any projects they're offending about anything else later any chance of us getting smaller snowflakes that we have on uh whitney had a lot to do with that i appreciate whitney's help umini does a great job helping us beautify our city

[0:41:26] the answer the question is what we did on those is they have to have a specific power source and so we're able to do that on the traffic signal mass arms so i think we have one all the mountains don't have one on we do and that's the western district area we have to um [Music] you know there is one thing tied to that that will help us add more in our capital improvement plan we have discussed as you all know changing the lights on main street between northwest drive and highway 51 to put decorative light bulbs which that's what you got to do you get the decorative holes and then you put those on there if you travel to a lot of the cities in their downtown area that have the decorative poles they'll put the snowflakes on every one of them that's what it really looks good when you look down the street you see the whole street lit up so that is our plan um the problem with that is it's about 300 000 to change the light poles in that area on main street um so in the adjustments we back that down the priority list but that's still alive and so i would just request that we keep that in mind and let's try to move forward with that project when funding allows and then we can have the snowflex fall down main street i think that would bring a tremendous effect there same thing as we move on in other parts of the city wherever you add the decorative holes you can put the stuff place so just as budget future budgeting allows i would hope that the city continues to do just what you're talking i think they look great too and along with that you know we did go with the uh wreaths around the south haven project the chain for help with that i've noticed that many citizens at their homes that have done that as well but we just thought it

[0:43:27] would look neat they just go you know simple classy just go with a green wreath and a red bow and along silo square and maybe boulevard it looks really nice and again back to having decorative poles you can do a lot more things when you have decorative lighting in your city but anyway i do thank the citizens and businesses for joining us in the chamber for helping promote the rest of south dakota sometimes any other questions or comments hearing none we'll move on uh next on our agenda is our personnel document mr mayor move we approve the personnel documents present on the statement yes that motion carries make sure that jenna's our city attorney's illegal on today uh first just want to know that v4 clerk certificate will be hearing through the minutes of foreign smith no actually just a note um code uh second uh december 31st the philosophy of the united nations recovery board wheeler is there any discussion okay all in favor say hi back in um for the soccer goals you know we see one did you know the amount of one hundred three thousand and fourteen dollars over our estimate um so it's a bsn store so press recommends uh okay next on our agenda is our utility
