[0:00:02] welcome everyone i'm now calling this meeting to order please stand with us we led in prayer of alderman gallagher please then remain standing for the pledge of allegiance led by alderman payne heavenly father lord thank you for allowing us to be here tonight lord i want to pray for our nation as we go through struggles that are going on in charlottesville lord i pray that you would heal our hearts help us to love each other heal our nation lord we ask you to be with our board tonight lord and to help us make good decisions in everything we do in your name we pray i pledge allegiance of america and to the republic for which it stands one nation under god indivisible with liberty and justice okay first on our agenda this evening is approval of minutes uh for two recent meetings first one august 1 2017. mr mayor i remember we approved the minutes for the regular meeting of august 1st 2017 within the addition to deletions of recreations exactly you have a motion baller in pain second baltimore brooks is there any discussion next is our motion for the august 8th special meeting mr mayor i move we approve the minutes for the special meeting on august 8th we have a motion volume of pain second baller and gallagher is there any discussion hearing none roll call yes alderman kelly yes yes waterman payne yes gallagher yes

[0:02:03] yes okay that motion series next on our agenda is our 2018 budget hearing so is there a motion to open we'll just open the floor for the hearing neck position again so we'll need to close uh public meeting before you open the budget hearings very much got motion modern kelly second water mattel all in favor say aye hi i'll post say no nice habit motion carries now is there a motion to open the public hearing it's a move motion monitoring pain second volume and gallagher all in favor say aye aye all posts say no i was having motion carries okay is there anyone in the audience who would like to speak regarding the proposed budget that's been posted on the city website are there any um comments maybe have chris going through just the highlights sure budget again oh there's it didn't know about them there have been two special meetings to uh there were public meetings for a workshop and also another meeting for um me laying out the uh the basics of my proposal to the board but now city administrator chris wilson if you'll hit the highlights yeah mayor um no property tax increase no increase in sanitation fees no increase in utility water rates the budget does absorb the grant share of 12 new firemen and the six police officers there is the city-wide employee raise as we discussed is in there one new

[0:04:04] dispatcher we went back after the budget department meeting and we were able to add one dispatcher position to it 1.5 million dedicated for street overlay you know the big reduction in tourism park expenditures which plays out again in the 6 million issuance which again has no impact on our debt service schedule 97 000 or fy 18 and you've all got the updated um by department which is also what's posted on the website that version of it questions for mr wilson or any other comments or questions from the board sales tax number's still the same we're still stopping we've uh projected a 150 000 increase from 1365 to 13 8. um you will see at the end of fy 17 the spike because of the two months we had first quarter that included the tanker money that is no longer what's being received but we are seeing still enough to encouraging signs to bring it up a little bit even without tanker and again as chris noted uh main priorities there my presentation on july 6 was with the priorities of infrastructure improvement as well as employee raises so most of this is uh you know the cuts that were involved uh you know were uh done to you know free up money to uh give the employee raises and also to increase the amount of allocation of infrastructure improvement in our city which we will we should get our finalized employee health insurance numbers back around august 25th we we've built in an increase in that budget now that we expect to be able to reduce after our numbers come back so um

[0:06:07] we kind of budgeted for a doomsday scenario on the increase but talking with our broker and sigma we look like we would scale that back a little bit so the budget you have before you prior to the september adoption will probably have less on the insurance line and again just to recap there is a proposed bond in the budget this board has been extremely aggressive the last four years and paying down city debt so we believe we can do the bond and still continue to reduce debt uh even with the 6 million proposed bond the projections are the debt would be decreased in 2021 of an additional 10 billion dollars so with that proposal 85 of that is for infrastructure improvement we have several projects that we receive 80 funding from the mpo program the city still has to provide 20 of that so what we did is remove that this budget proposal removes that from the operational budget uh puts it in the fund to free up money further operational allocations um so 85 that proposed bond is for infrastructure approved that's a 12-year issuance any other discussion hearing none is there a motion to close the public hearing a second we have a motion volume brooks the second ballroom wheeler all in favor say aye aye all opposed say no eyes have it motion carries the uh fy 18 budget hearing is now closed is there a motion to reopen the public meeting the motion of honoring brooke second ballroom and hale all in favor say aye all right i'll oppose say no i have a motion carries the uh public meeting is now in session next on the

[0:08:10] agenda is a contract with rsi for the information technology and emergency communications department this is just a renewal the contract with rsi it's for rough 400 something dollars very inexpensive contract but since it is a contract and have it on our minutes for approval uh it'll help with the phone systems and the caller id of phone or the city's phone systems it's just a renewal of what we've used in the past and recommend approval by the board for the mayor to sign or chris shelton either one i'll make that motion approve the contract is presented second we have a motion baller in hell second bottom and brooks is there any discussion hearing none roll call ultimate yes elder mckelley yes yes yes okay that motion carries next on the agenda is a resolution to seek authorization to bid for the church road overlay which is a resurfacing of church road between highway 51 and i-55 this is where i move we adopt a resolution authorizing the city of south haven to go for bid for the church road resurfacing project we have a motion in pain second bottom and kelly is there any discussion and again this is one of those that we did uh require i mean acquire npo funding so um the city pays 20 percent uh federal government pays eighty percent no matter what time frame we want this thing done before the first frost hits we plan to um have it done in october what will we do how soon are we going to

[0:10:15] have to go out for bonds i mean as far as the payment on getting that because since the bond is uh is this part is is going to be the payment uh how's that going to work i mean we have to do it pretty quick before any of this work can start or can we start doing some of this stuff before we end up issuing the bonds and no the uh the co-op on this project is only a couple hundred thousand dollars so it is in the bond but from a cash flow standpoint no it's not something we hold it up okay chris you want to speak on that any other it is in the the 20 co-op is in the proposed bond for this project but it's only i think it's 237 thousand dollars depending on what the board does and how you know the six-month issuance comes into play in the budget adoption in september um we would do the intent resolution immediately thereafter possibly even the same nights about the budget adoption and looking at it probably november date yeah we try to get it validated in september october with the november closing date but from a cash flow perspective we're you have 8 million dollars in surplus 237 000 we can you know from a couple weeks or whatever it's finished okay is there any other discussion about the church road resurfacing project hearing none roll call yes alderman kelly yes alderman hill yes yes and the motion carries next on the agenda's resolution for the information technology and emergency communications department surplus of property this resolution just surpluses property from the i.t department in accordance with 17 25 25. i think there's just two items

[0:12:24] second we have a motion balance a second volume in pain is there any discussion hearing nothing roll call yes alderman kelly yes otterman hale yes yes yes okay that motion carries next on the agenda is a resolution to join desoto county for an attorney general opinion we had talked about this in the past a couple meetings ago the legislature passed a law that will go into effect january 1 of 2018 which will require reverse bids for commodity purchases over 50 000 does not apply construction or professional service contracts that being said there was a confusion between quite a few i mean multiple counties multiple cities uh that uh will this apply to local government as well based on the jurisdictional oversight of the personal review board and that's not to get too technical all that being said is the county wrote for an aeg opinion december county representing in may asking does this apply to local entities the reversal auction requirement has set forth january 1018 the attorney general opined back in june saying yes what we interpret it does that being said there's still questions among numerous cities and numerous counties across the state on how this actually will work from the standpoint of whoever sees it how can you opt out based on a board that may not have jurisdictional oversight of a local entity as opposed to the state the county is going in the process or has in the process of getting it request reconsideration to that ag opinion submitted back to the attorney general with the goal being sent in mid-september at this juncture numerous there should be numerous cities and numerous counties

[0:14:27] joining in the request reconsideration it's my understanding that everybody every city in this other county will that southern county itself will there's other cities and counties across the state that have already passed a resolution joining it simply just requesting guidance from the standpoint of does this apply and if this applies how do these other issues which seem to be inconsistent with the oversight of a board in the state when it comes to local entities all that being said that one into more details we've been here all night talking about it um tonight we just need a resolution authorizing the city to join in that opinion uh along with the county i think the city of all branch city foreign lake i don't know about overnight but i think they're going to be considering at some point uh and along with them requesting uh the reconsideration what would happen is if your resolution passed tonight would just go along be attached to the uh request reconsideration by decedent county as it relates to the diverse auction requirements for commodities quebec january 118. it will not affect those commodities on state contract it would just affect the ones so if you're wanting to buy a pipe and it's all said contract is a reverse auction requirement which uh seems to and it may you know there may be it may work out fine but right now there seems to be confusion on cities and counties how they could actually work as well as the specifications in dbao deviating from those specs in that type of context and the jurisdictional review of opting out of it so i have happy answering questions you have mr mayor i'm going to adopt the resolution of the mayor board of aldermen the city of south haven regarding house bill 1166 house bill 1109 the 2017 regular session as presented second we have a motion ballroom in brook second ballroom in flores is there any discussion is this really just for support yeah it's just what i mean and i said if it goes into effect it i mean obviously

[0:16:29] we'll follow the state law because of the effect it's just from multiple entity global entities just have questions on the process of it because there's seems to be some confusion on how it actually will work once it's implemented like i said no one's going to not follow it whatever i'm following it's just a couple of questions that are out there and the county has done a good job of articulating those questions in their request reconsideration or descender county has a good job articulating those questions and tony's heading this up he's tony wrote for the original opinion attending nowhack and he's writing for wreaking three uh request reconsideration adam so they said that training general will look at it we'll just get their thoughts and then we'll implement it however we need is there any other discussion hearing none roll yes okay that motion carries next on our gen is a resolution to allow for signatures for the central stone grove park's multi-use trail this will allow for the lpa coordinator whitney or and or the mayor whoever is the appropriate person to sign appraisal contracts and establish values for the properties that are needed as part of the multi-use trail that's we're working with mdot right now trying to get all of their comments addressed and all the issues with getting those contracts in place so we can get the appraisals establish the values then come back to the board with um authorization to make to purchase those parcels at that time but this will start the process of allowing signatures on certain contracts for the appraisals and establishing those values tonight with this resolution we have a motion monument gallagher

[0:18:36] second baltimore kelly is there any discussion is there any specific areas that seem to be trump or slowdown let me see if i can summarize six years for two minutes i mean it you can talk about that executive session itself because that's underlying acquisition um uh so that's that i wouldn't get i wouldn't get particular personal values until we make actual offers at that point yeah i wasn't intended to do that but i can't share this with you that there were some issues with the path environmental issues that required mdot steps we've had to go through i've been lots of changes throughout a six six year period but it's a six-year-old project so and again for those that don't remember since it's been discussed for so long this is a 10 foot wide multi-use trail it will connect central and snowden parks it can be used for bikes running walking it'll go from central parkland to oklahoma southbound tulahama to the soto central parkway then we'll go eastbound to getwell and then northbound on getwell up to uh stoughton park so it ties in with our greenprint 2040 plan to make our city more pedestrian friendly which will you know eventually tie in with the memphis metro that in the future going from snowden further east you know there will be a tie-in to the parks on church road and holland branch from snowden so this is just another leg of that and again this is one of the pride the transportation projects it's a co-op so the city does have to provide this was a grant an mdot grant but we still have to provide our part of it is there any other discussion hearing none roll call yes okay that motion carries next one again

[0:20:42] is the resolution to clean private property mr maryland without the authorities to clean private properties presented on the state we have a motion baltimore brook second bottom and hail is perfect for any discussion among the board hearing none is there any any uh one in the audience that has a uh interest in the properties that would like to speak okay okay is there any discussion uh regarding any of the properties on the condemnation list or to claim their private property hearing none roll call yes yeah that motion carries nothing on the planning agenda with me okay we'll move past that mayor's report just want to update you on one thing this big for the city of south haven most of you have heard us talk about this before but in 2015 the our engineering consultant dan cordell in civil link we participated in a plan to analyze all 11 1100 plus streets in the city to be more efficient with our street improvement money we started payment met what's called a pavement management plan and in this plan it rates all streets based on four categories loss critical

[0:22:49] excuse me lost lost critical fair and good and it also provides a virtual tour where we have technology where you can actually ride the street so we get a call from someone about their street we actually go turn around to our desktop and we can actually ride that street take a look at the street conditions this is a pioneer this is new for the state of mississippi and for that our planning director whitney cook did make application with mml about this plan and we were awarded the 2017 excellence award for planning and economic development so i'd like to thank um dan cordell and civilian for all our help in doing this we've already implemented this project from 2015 which again has enabled us to be more efficient with our tax dollars in addition to just doing a resurfacing with an asphalt overlay this plant now provides us with seal coating so you can seal coat a road for about 38 of the cost of asphalt so it's allowed us to hit more streets with a shorter amount of money so we're very proud of that and i'm very appreciative to our engineering consultant civil link next on our agenda is our citizens agenda we have one person that's signed up mr donnie chambliss is a board rep for the soda family theater donnie would you come forward please sir good afternoon and good evening ladies and gentlemen it's good to be here and to see each one of you appreciate you adding me to your agenda what a great meeting uh great to hear about the award from civil link good job there great to hear that the multi-use trail is in the works looking forward to that tonight i'm here before you as a representative of desoto family theater where i serve on the board of directors there many of you are familiar with our work uh what you may not know is our total impact in the 60 plus shows that we've put on throughout the years is somewhere in the 67 million dollar range and what you may not know is we are a 501 c 3 non-profit organization that simply would not exist

[0:24:52] without two very key important contributors the city of south haven and this man who is standing here with me now mr matt lipscomb who i'm going to ask to speak to you and tell you a little bit more about the soda family theater why i bring you a handout good evening good evening i don't know about y'all but i'm excited to be here and i i relish these opportunities some of you heard me speak before about why we should be proud to live in the community that we do and the state that we do so i get the chance to do that again not just with the autumn of the mayor but with the other people in the room so i'm excited about this the first thing that i wanted to do tonight and i asked the primary reason i asked to be here is i wanted to thank you for what you have done to enable desoto family theater to operate to the level that it has please understand there is no way that we could have accomplished what i'm going to tell you about tonight without the support that you've given us these i think 10 years now so thank you first of all when you walk out here tonight and your wife asks you what did you hear tonight from matt well first of all i really believed he was very sincere and his thanks to us because i am regardless hear me regardless of what you choose to do with with what you've supported us with in the in the past and what you choose to do in the future please understand we greatly appreciate what you've done for us in the past now having said that i want to tell you that i think and i want to share why i think this that you've made a very good and wise investment in us in the past and i want you to understand that we think we've been good stewards of what you have invested so let me breeze through some of that as quickly as i can uh the first thing is you know i i'm one of these guys that likes to to read the good news not the bad boobs i don't know about you guys and anytime this south haven does something that goes beyond south haven and has national beyond the regional recognition we should be proud of that man when snowden grove came about and we're bringing in the world series and all that i got excited about that i'm sure you all got excited about that so when you travel and you have to tell

[0:26:54] people where you're from that's one of the things that if they know they may tell you about that oh yeah i know about what you do at snowden grove but i'm here to tell you and i'm going to show you this tonight that one of the things that's out that south haven is known for outside of this community is the sota family theater in north mississippi there's a theater awards organization they get together as 460 people at a dress-up dinner at the landers center with entertainment from the shows that are judged each year in the 15 years that we've been doing that the soda family theater has won two-thirds of the eligible awards of all the theaters that are there not just a majority but two-thirds in all the other theaters split and split the other third and every organization has the same amount of judges and yet all those impartial judges from various leaders have chosen southaven's desoto family theater winning two-thirds of those awards including 13 of 15 best overall performances uh pat howard how many people know who pat halloran is he ran the orpheum theater for quite a while he came to see our les mis production he's sitting next to me at one point he says where did you find these people i said they're local he goes don't believe it i'm telling you they're local he said what did you pay them he said nothing not one thing we don't have to we've been good stewards of the money that you've given us we don't have to pay our actors and pat said that night he says matt i'm going to tell you that's the finest community theater production i have ever seen now pat travels the country scouting for things to come to the orphan what not but he felt in his view that was the finest community theater production right here in south haven mississippi was something that you funded that would he would not have been able to say that had you not done that pat is very well traveled and respected in theater industry and he talks about us a lot uh we had 1067 volunteers last year that helped us in our efforts every school in the desoto county school system including south haven has received aid from us whether it be technical training coaching scholarships there's at least there's dozens of scholarships every year that goes to the entire school system i don't know how

[0:28:56] many at south haven but i remember one year we were given our scholarships at uh at the southern family theater we had four winners from south haven high school that year um the orpheum awards which is the top theater performers in the high schools in the mid-south we have had a representative either for best actor or best actress every year that they've done it and won it three to seven years we have 11 people that are in professional work today on broadway on television the next marvel superhero that you're going to see is somebody that performed in the sutter family theater olivia hope that's going to be announced and you'll see that before long in the audience dan layman who many of you know donald wronski who's our ceo dan put his son on a boat to be an entertainer on a cruise ship he's going to see uh uh 40 different cities in 10 months donna's daughter actually performs on a cruise ship daniel mueller works on broadway has done that on many many shows up there he is a south haven resident came back he's coming back and has shared what he has learned with many of our people and taught them he also is giving back to the south haven community um i i'm the co-ceo of lipscomb and pitts i have personally hired 11 people from the theater because i think that what the people learn at the soto family theater has made them better employees they come to work they come on time they don't miss their cues they know the show must go on and they're going to entertain you while they're talking to you so it's a good it's a good place to hire people um you say well you've got all these wonderful things going on and you gotta say why can't you support yourselves why do you have to have our money if any of you have ever heard the term patron of the arts they exist because ballet's opera symphonies theaters if we sold if we sold every single ticket to every show we could not make ends meet without what you do and what other sponsors and patrons do you sell every ticket didn't cover the expenses that's why it's so critical what you do and we cannot do it to the level that we've been doing it without your support i know i'm limited on time so i'm going

[0:31:00] to try to cut some of this uh the reach of the economic impact there was a study done that of 183 communities on on arts groups like our theater what is the economic impact that's a pretty broad spectrum 183 different communities and it's a one-to-one relationship so whatever we spend they say there'll be at least that amount of money spent in the community so when people come down here we had 11 peop we had 11 states represented in one of our shows that we did we had 13 000 people see it it was high school musical 13 000 people saw that show and you know they're going to buy gas here they're going to eat here if you're coming from 11 states you're going to stay in a hotel here now you have tanger but it's a big economic impact so you might not care anything about the art so much you know there was a movie not too long ago the guy said show me the money show me the money well the desoto family theater is generating a lot of dollars for south haven they're going to eat on goodman road or they're going to eat on church road when they come here it began because we believed at the time there was no family-friendly theater in the mid-south area all the memphis theaters had gone to where they were doing things were not appropriate in our view were not appropriate and we decided that there should be god honoring family friendly theater in this region and we and you all had a vision at the time when we did it and you helped us fund that we think we've been good stewards we think you've been a good made a good investment regardless what you do please understand we we're very grateful for what you have done but we would also ask that you not cut our budget at least any more than what you're cutting a percentage of everybody else because we are making a difference not just with providing jobs not just by putting people on stages and television and places all over the world now or certainly all of the united states but also providing people that are working for me and for you and for others here so thank you for what you've done we hope that you continue to partner with us in the way that you have i think it's

[0:33:02] another good feel good story many of you have come to our theater i've seen you in there i hope you had a good experience and we need you so i'm asking you to please continue to do what you've done and if you don't thanks for what you've already done thank you guys do you have any questions anything else that we can answer while we're here the only thing i would add is you may not know but our offices are in the west end so thank you for helping us keep the lights on in the west end thank you i did have the only other question i had and again i want to thank matt for coming forward he did a great job explaining that i think everyone including me and the rest of the board um you know i hate to use the expression but preaching the choir we y'all did an incredible job there's no doubt about that and you know i appreciate the numbers but we know what you do we know you do a great job and we're proud to have you in the city you know we're we're like everyone else and our budget hasn't been finalized yet but uh as you know and donna you you especially know that we face some tough decisions this year you know we've had we've had some funding sources taken away and some of the cuts that are state cuts you know we we have people coming to us uh not you but others that come to us and and they're asking us to you know to take care of um you know cuts of the state game you know and that's it's tough for a city you know when when a good organization is hurt by a state cut and then they try to lay that burden on a city it makes it very complicated so what was wrapped up in a nice little smooth package tonight for the fy 18 budget is something that probably has about 100 hours in it for me and it's something that um you know we put a lot of time in it the board also puts a lot of time in it it's complicated you know to set priorities and uh we have to look at everything you know we're looking at you know turning down emergency dispatchers you know that uh you know for some of the things that have been in our budget and i say all that to let you know how difficult our decision isn't setting a budget but we value the theater we

[0:35:04] appreciate what you do and so i appreciate you coming forward i did my question that i said i was going to ask a question i did a lot of talking but my question is uh and matt and i discussed this i believe about four years ago um i just have a question like why why you guys are not getting you know the same support that you get from the city of south haven from us from some of the other cities the county state i know that the state has an organization that does provide some funding but uh sometimes old south haven feels like everybody's on we feel like he gets a little heavy you know we just would like we'd love we don't mind carrying our share of the weight and we know it's operating inside the city limits of south haven but still the ratio doesn't make any sense help me understand why nobody else is helping you thank you so much for asking the question i was going through the list that's what i cut because i knew i had a time limitation but thanks for giving the opportunity to address that when you and i talked at that time we were a good bit smaller than we are today okay and it took i mean i invested a lot more than i used to invest had to to make up the gap here's what we have done we took that to heart and we already know from horn lake that they are going to give us a significant amount of money not what y'all do but significant i mean one that makes a big difference like what a full sponsor of a show would give we met with olive branch and they have made they said they're going it's not a verbal i mean it's a verbal commitment oh and again a significant amount of money not quite what horn lake is doing but pretty significant also i've talked to the desoto county supervisors the ones that i know especially and they have advised me on how to approach them and what i should ask for and that money is more significant okay but even when we add that up nope i can't speak i don't know that we're going to get a nickel from hernan i'll just say that i'll be transparent with you i don't think it's going to happen at least not now but we have done that now you told us to do it and quite frankly you you should have done that because when we started out we were pretty comfortable we had what you were doing we had what some of the rest of us were doing and but man the expenses got so much even if you hadn't asked us to do it we had to do it the

[0:37:08] other thing we've done dan what have we done from six sponsors to 15 now this year yes we've gone from 2012 we because matt put me on the board to do this job i have gone on and asked where we've had not only six sponsors in the past in 2012 have grown up to 100 to 15. the average donation has gone from 3 000 in those sponsors to 7 000 so we're getting more sponsors and increasing the value we've gone from 34 businesses supporting and making ads in our program to now 54 entities helping us and donny and i have started this year going out to see all the mayor all the aldermen and different cities to say help us understand how we can help the community and grow and participate not only not directly just getting more money but directly contributing back to the city and saying what do you need us to do to help you help us in your school systems and your public school education that can help people find their career not only on stage but behind the scenes my daughter for example is one of those 11. she is now professional sound designer she's working at lander center helping to put in a new sound system for the river kings that's part of what we're trying to help people do not find necessarily a stage career but a community support career so i if i've answered that question we were that's my job it's coming and we're working on it and we'll make sure that with our vision i mean we'd like to that all that i just said you said man that's great what do you need us for all that does is pretty much keep us about where we are that's it with with everything we don't have the same some of our expenses uh have gone up that we don't have any control over just like you know like when you when we talked about all the cuts we're going to have the finish of the park thing i mean we knew how serious this was going to be and that's why we started then we realized you may have to do something i get that and we should share in that i understand that but i hope that you don't cut as many more percentage than you cut anybody else because we're trying to be good stewards guys we really are we're not dependent solely on you where we're doing but you're back now about ten percent of what we do you used to be a higher

[0:39:10] percentage you could hear about ten percent of that the other thing that we want to do is this may be the time that i'll say it anyway we want you all to have the city to have a private performance if you want to christmas or whatever you do invite whoever you want to invite but a private performance for y'all every christmas time where it's it's simply for the city of south haven and it's yes we want to do that for y'all regardless what you do we want to do that for y'all but uh i hope we answered that question we're trying we really are we've got we've had consultants come in we've had we've gone to all the people that we know the sponsors the business the business community is rallying i'll say that but it's just keeping us about where we are now the good news for you where we are it's the tops in the region okay we are the tops in the region you should be proud of that it's here so but to get any better we're going to have to even do more than what we just told you and that's a big increase of what we did just four years ago four years ago you had you have more productions now than you did four or five years ago good question right we had four you were doing four every year for a while there's one five i think 2013 yeah but we're doing six now we're doing six and i'll admit to you raymond this is another part of the good stewardship thing the two we added are the types of shows that are not as grandiose as the les mis you saw it's ones that involve a whole lot of kids that all they have the answer to uncles this one's where you make some money on so we plugged in two shows that will help bridge that gap that's just that's the realism of the business part of it well we appreciate you being honest but we're doing everything we can guys and so we appreciate you doing what you can thanks for asking that question well again the question is just geared you know because even though you're opera you are having the shows inside the city limits of south haven it's an accounting facility and other people around the county participate i mean the theater if you've heard me speak recently about the value of parks and recreation you hear me talk about the opportunities it offers for youth and it's the same thing with your theater that some of the other recreational facilities all right in our community i mean it it can be a life changer you know i mean it provides scholarships things like that so we

[0:41:13] value what you do it's that's that's not where the question is coming from the question is purely financial it's just you know generally when when a municipality or a governmental entity provides money for an organization that's not directly tied to them it's designed to be like seed money to kind of get started so it can have an economic impact so we just want to see that cultivate and grow and we know that we have a lot of burdens on us as a city like i said the money we give to you uh competes with our operational money it's tough our primary job just like you is to run our operation and when we're having to make sacrifices in our operation to fund outside organizations regardless of how great they may be it gets tough and that's the reason i asked the question i would just love to see you know more private financial participation in your organization and then maybe some of the other uh municipalities that also benefit you know from the uh from their youth participants branch has it if you do welcome to olive rights material you open it up it's a two-page spread of scene from our beauty and the beast everybody claims we're theirs but you guys were were paying the line share and you should have challenged me when you did and we've had several conversations about that i just want to let you know that we've made inroads there now at least two other cities are going to give significant money the county says they are i hope they are and then but the business community is also rallying in a way that they haven't but even so we're just we're just right where we were we don't we don't want to go back on the quality because what we're doing we're very proud of and i know y'all are proud of it and we want to keep it there whatever you can do we will gratefully accept well we can't do it without you i just tell you that yeah well i appreciate y'all coming forward and and you know again i'll leave you with this i value what you do it's a great what y'all do is outstanding we're just trying to be good stewards of the taxpayers money that's why you're sitting in that chair and i get it thank you very much i appreciate y'all thank you for tonight thank you guys i wanted to add something really quick uh one of the things during the campaign season plus even outside the campaign i was at you know people were asked i know we're all asked all the time my kids don't play baseball or my kids don't play or athletic or they don't do this you know what there's nothing

[0:45:19] going the wrong way on the street and it's it's our understanding that these are illegal for them to be in the presidential neighborhood and we wanted to just express our concern that we don't want there it hurts property values it's a safety hazard as far as kids running around them and you can't see and we wanted to express our concern that uh we do not want them there did you record me i'm sorry toward me you sound like me speaking now i've said that many times about property values and things we've got to do to preserve our neighborhoods actually it is a violation uh records and those type commercial vehicles are not allowed in residential zones uh we do have a situation where we have five at one time spread throughout the city that respond they're on our record rotation for our southampton police department they do have to have a record during the nighttime hours to be able to respond within our time limits to motor vehicle accidents in the city they're designated with a special tag from the southland police department uh but other than that if these people are not on that rotation it is a violation now if this is the one that it was brought to my attention this morning actually whitney is this the same uh yes sir this is um without calling out the the company it's company who's not on our rotation um and they have been issued four tickets are already in the court system for it um he's defined by he keeps parking there but his hearing is on the 30th and he's hired an attorney so we've got him on four violations already in the court system now he you said there's two incidents that you're talking about what well there's one that parks on cyprus there's another that parks on greenbrook parkway okay yes we do have some pictures i'd like to pass around for the august to see i don't i mean they feel free to look at them but i don't know that's really necessary it's a violation

[0:47:21] and they've been given tickets so it's in the court it's in the court right now you know but to let you know it is a violation and we will enforce that so uh uh you know we do have to let the due process along take place in our municipal court did you say that it is okay for them to park there if they have the sticker and their own rotation there's five in the entire city that we have to allow with a south haven police department decal because they have to is it 20 minutes chief had to be on an accident scene in 20 minutes so it's not possible for them to leave a residence go to another lot get the record and respond within a 20-minute timeline so there there is an exception for five uh people that are on the south haven police department uh record rotation companies may or may find vehicles developed throughout the city we were done understanding that they had that before and the judge overruled and they couldn't do that either well there was some discussion in years past before this board and me um i i've been told about that but what we're doing now is we're we're taking the ordinance as it is now and that's what we're enforcing so whatever was said by a judge years ago we're applying our ordinance today so visit the ordinance no commercial vehicles will be parked in a residential area in that ordinance right that's correct how do they get to park even though they're on call you talk about the police department no i'm talking about the rollback trucks they're not that's why i'm telling you they already have violations they're in a court right now yeah but i'm i'm talking about other you're five people you talk about the ones that are on the police rotation again like i said uh there's no way for them to respond to the police now all of the companies that have that decal are on the official board approved record rotation with the city so uh they've all expressed an interest to cooperate with any neighbors if there's any concerns about that uh they've expressed to cooperate so if you have one that's on that rotation that's what we need to

[0:49:24] know about we can contact them and resolve that situation your people aren't on the rotation no and i can tell you this one took a little bit extra time normally to serve our officers and our police tried to help us at night could not catch the guy we ended up having to go to another city where the company was at and have the gentleman served on site there um so it did take a little extra time but it is in process he's been deemed guilty on a couple of them already uh he has hired an attorney and his hearing is on the 30th so this one is not one that's on the police foreign he's been given violent citations already correct okay but you're saying the one that is on the police rotation is legal to be there with one record is that correct that's during this that's during the nighttime hours correct okay but they shouldn't have three or four there you know it's one per company correct one that's our situation yeah once a year 18 000 households there's five spread throughout the city and again they've they've offered if there's any complaints uh about that uh we'll get with the police department try to resolve that issue but the ones that you're referring to are not on that list they've been given violations okay yeah and we will continue to enforce that well how do we determine which ones are only they'll have a decal they'll have a visible decal on the record itself okay and if we have problems with that who do we get in touch with code enforcement if there are ones that have a decal or is that what you're asking yes contact uh chief steve burke where can they park they park in the street no even the ones that know even the ones that have the decal they cannot be on the street they have to be on a hard surface off the street it's runway in the driveway right well as you can see with the pitchers they don't do that anyway so sorry i'm trying to explain to you these are not the ones that are on there okay these these are not on the police rotation these are ones that have
