[0:00:02] good evening everyone i'm now calling this meeting to order please stand with us we'll be led in prayer by alderman gallagher please remain standing for the pledge of allegiance that will be led by alderman ferguson heavenly father lord we love you and we thank you for the chance to gather here tonight lord we thank you for watching over our city through the storms this morning lord lord we thank you for your love and we pray that we can show others love like you've shown to us in your name we pray amen i pledge allegiance to the flag of the united states of america and to the republic for which it stands one nation under god indivisible with liberty and justice for all first on the agenda this evening is the approval of minutes for the um january 17 2017 meeting mr ring our move we have for the minutes of a regular meeting of january 17th 2017 with any additions deletions or corrections second we have a motion by alderman payne a second alderman brooks is there any discussion any other discussion hearing on roll call yes yes okay in that motion carries next on our agenda's resolutions requesting donations from the city mr nick manley these are a couple of resolutions tonight for donations we can handle all as one motion and each resolution will affect i mean we'll reflect a motion in a second like that one motion but it's for 51 south foundation american cancer

[0:04:07] it used to be done by the individual counties there was a grant this past year and fema mima has done the plan and it's been a dollar it's being considered by every entity in desoto county including the county and also most of the counties in the northern half of the state tonight merely just authorization advertised for the plan we'll advertise it in on our website along putting an ad in the set of times and the plan it will provide the website link for the plan how they can view the plan and make any comments they want to plan and also the next meeting on february 21st speak about the plan any questions concerns they may have it's been worked uh my understanding is each entity has reviewed and is okay with it it's quite a lengthy document hundreds of pages long but tonight just the first step of authorizing the advertisement for the plan so the public can comment on the plan second we have a motion by alderman ferguson second of all in pain is there any discussion hearing none all in favor say aye all opposed say no i just haven't motion carries all right next on the agenda is resolution to surplus property of public works department yes this is just a resolution in surplus the property is listed it's um some old strop signs old lights old lights old vehicles authorization to surplus in accordance 1725-25 so moved second we have a motion monument flores second waterman hail is there any discussion hearing none roll call harder yes yes okay that motion carries as well next on our agenda is the resolution of surplus property in our information technology and

[0:06:10] emergency communications department saying most the resolution to surplus property is no longer needed in accordance with i'll make 17-25-25 motion again we have a motion by arm and kelly second by ottoman ferguson is there any discussion hearing none roll call yes yes okay and that motion carries as well next is a resolution for interlocal agreement with the nesbitt water association this uh resolution will allow for the city to enter into an interlocutor water association uh it's a obviously a water a non-profit water entity under the statute pursuing this 1 the city can enter into these type of agreements which will allow the city to upgrade the lines in the water district and then once we upgrade those lines it'll increase the fire protection in that area it's for three different subdivisions i think del wood subdivision um oak subdivision on the bailey road area and allow for uh upgrade of the fire lines or upgrade the water lines which are owned and operated by desert water at the same time we'll grab the necessary water lines we need to provide out or provide better fire protection in an area i've talked with the attorney for the desert water association and we've gone back and forth and i think we've come to an agreement that we've the city has been with my understanding he was still checking with his client to make sure that they were good with it i talked to him last week i have not confirmed that they are wanting that they are good with this agreement however i think they will be based on our conversations so tonight my thought would be just to pass the resolution allowing for the city to sign relying on the american times in our local agreement it also authorized the city to go to bid on the project we'll still go to bed on the project um and then in the event that there are future changes made to the agreement i'll just have to come

[0:08:12] back and from the board uh do a new resolution to pass it but i'm optimistic that the next week we'll be good with it so we can get moving on the project as opposed to delaying it to the next board meeting so tonight just authorization for the resolution and uh if anything changes with the agreement i'll bring it back in front of the board mr i hope we adopt the resolution of city south haven authorizing enter local with mesa water associations presented on the state second have a motion by alderman brooks and payne is there any discussion if there are changes well and we need to come back and do a new resolution that makes this one move right correct and so just that resolution would just be what no would note that recently but my hope is that we'll have an agreement but they'll i'll get confirmation they're good with agreement this week have it signed this week and that will move forward next week as opposed to two weeks from now because the bidding process will take 30 to 45 days thank you any other discussion hearing none roll call yes otter kelly yes yes okay that motion carries next on our agenda is authorization to seek bids for a lease purchase agreement for police vehicles this authorization will allow for chris wilson to seek the bids for at least purchase under the state law uh it's handled the way the state laws written you have to seek two bits or two quotes so if this will give chris the opportunity to go see quotes or bid however you want to refer to it for the best least purchased financing option that we can find to purchase police vehicles um and that will this once those are brought back in will then be brought from the board for the board to officially award that to the branch institution that gives the best deal to the city let me get motion i'll second it

[0:12:17] next on our agenda is a resolution for our senate local and private tourism tax bill as has has been heavily discussed uh board you're aware that senator david parker along with senator kevin blackwell and senator chris massey have co-authored a bill that's been presented to the senate uh that will ask for a three-year extension of our tourism restaurant tourism tax the thing that is different as we talked about briefly there has been language added that adds an indirect referendum and so in order for them to proceed with that they need a resolution from uh from us from this board uh stating that that is the intent of the city of south haven mr mayor i'll make that motion nice we have a motion by alderman gallagher second baltimore ferguson is there any discussion this is replacing the motion we had earlier is that correct correct the first one that we did late last year was a basically a uh a general resolution requesting an extension of the tourism tax uh but did not uh contain the indirect repealer not repealer but referendum language so um basically adding that is basically it okay thank you is there any other discussion hearing none roll call yes kelly yes yes now motion carries all right next on our agenda is a resolution for assessments mr nick manley again this is just a resolution for the sanitation assessments for those who have not paid sanitation fees and to collect those to the the center county tank floor i'll make that motion

[0:16:23] i'll make that motion exactly we have a motion bottom in flores second alderman brooks is there any discussion yes okay that motion carries next on our agenda's authorization for our south haven fire department application for the safer grant real quick on number 15 on the first effects uh sound we'll need a motion to allow you to sign that as well okay two separate yes okay sorry i should make that more clear i'll make that motion a second again we have motion modern flores second alderman brooks is there any discussion hearing none all in favor say excuse me let's go with a roll call for a contract roll call please yes otter kelly yes yes yes okay and that motion carries now we're um to 16 which is authorization for southampton fire department application for the safer grant yes this is just authorizing the fire department to plot for the grant paul keith thornton he's here obviously to answer any questions you may have but in my conversations with him it's a very extensive process um tonight though just the authorization to apply for the grant in the event the grant is received uh or awarded to the city will come the fire department will come back to the board to authorize the acceptance of the grant at that time but i think it's due by february 10th so tonight the occupation for them to apply for it we have a motion ballerman hale the second baltimore payne is there any discussion mayor do you remind me we have chief george come up and explain to the audience what the safer brand is sure chief thornton would you explain the cypre grant for us

[0:18:31] uh mayor board the safer grant is a it's a homeland security federal grant that allows for fire departments to apply and hopefully be awarded for granting personnel to help with our response needs it's called the staffing and adequate fire and emergency response grant in the past it has paid 100 of salaries for personnel for two years they changed the rules on the grant this year the grant is for a three year period of time there is a cost sharing now of 25 for the first two years for the city and a 65 cost for the third year and then the fourth year you do not have to retain those personnel but our hopes is that those personnel would come on board and help staff for the future station blind we're asking for 12 personnel and the performance period would be for fy18 through fy21 thank you yes sir okay is there any any discussion hearing none all in favor say aye aye all opposed say no nice habit motion carries next on our agenda is our planning agenda miss whitney cook yes sir your first application is a subdivision application for cherry hill phase two uh you'll see the master plan up there and this is the property on the south side of the newly constructed rasco road or the one under construction uh just east of sweeney uh the second page if we could just go up one this is the section uh it's concerning it's 5.55 acres there's two stub outs from the original

[0:20:33] phase into this phase all the roads and infrastructure have been put in place obviously rasco road we have a joint agreement that's already under construction it is compliant with the overall pud with the open space the minimum square footages and the house designs so we recommend approval unanimously by the planning commission mr mayor will we approve of item number one on the planning agenda second bill of motion by our obtained second volume and flores is there any discussion on item one about it the roundabout's actually in phase one um but yes it's there how is still on the south side of the newly extended race all of this will be on the south side this whole pud will carry you from essentially where the fire station is and connect over to where central park is all on the south side any other discussion hearing none all in favor say aye aye all opposed say no i just haven't motion carries on one uh your second your second application is for cherry tree south phase two uh this particular section of this pud is going to be 9.59 acres and it's nestled on the interior of the existing subdivision it'll have access obviously through the existing streets from well road but construction entrance and where you'll see all the main traffic flowing through is off star landing road this is where a road will be designed to go permanently but since we're skipping over a section and going up north into the property this is where our construction access will go into so we won't be damaging roads that we just newly overlaid uh it's compliant with the square footages and the house sizes that are around it it's part of like i said the cherry tree phase cherry tree plant unit development and it was voted unanimously in favor of by the planning commission second

[0:22:36] we have a motion by alderman brooks second ballroom in flores is there any discussion hearing none all in favor say aye aye all both say no eyes have it motion carries on too item number three is uh request for subdivision for approximately 11.953 acres for the church red marketplace section b subdivision uh this will be on the south side of church road east of w ross parkway there's two lots involved one will be the hard corner it is considered lot three and it will encompass 0.983 acres and the remainder of the acreage will go into a lot 2 which is 10.97 acres church road has been widened right away has been dedicated right away has been dedicated to w ross parkway of course we have a project working on church roads there's no improvements to be done with this one they are showing a shared access easement between the two lots so we don't have several curb cuts going down the road to congest the traffic there uh the only thing we asked them to do and we didn't have time to get um up for the docket to show tonight which they have done the corrections were adjustments on the setbacks they had eight foot setback which is not correct we require five we have a 50 foot sitting up front and they go to 20 foot so we had them correct them uh and we've got those documents and we'll get those for recording but what you see up there i had some revisions that had to be done we do have that in-house now so planning commission voted with those comments to approve it mr mayor i'll make a motion to approve item number three on the planning agenda second we have a motion baltimore ferguson second by alderman kelly is there any discussion hearing none all in favor say all right all opposed say no eyes have it motion carries all three and the final item is what you will see

[0:24:39] going on the corner lot it is a burger king quick service restaurant there have been several changes that were recommended by the planning commission unfortunately we didn't have time to get the color renderings up to uh the the computer system so they brought in some renderings for you what we essentially asked them to do was add some more stone work on to break up the building a little bit more we added um some extra landscaping especially on the streetscape design we asked him to bring in the decorative acorn lighting uh we asked him to put bronze canopies in instead of the galvanizer exposed metal color they did concede to all of that we do have the changes in house but they were coming from all different directions from different people working on the project so we couldn't get it up for tonight's meeting but they have met those requirements and with those requirements uh in-house we're recommending approval mr move we approve item number four item number four on the planning agenda a second we have a motion by alderman payne second of all gallagher is there any discussion any idea of time frame any other time frame as soon as we will let them move dirt they are working through the process right now to get the lane disturbance permit so you'll see some dirt moving here pretty soon i spoke to them before the meeting started to let them know that we do appreciate things being filed concurrently so while they're working on the land disturbance permit in the dirt work they're gonna go submit their building design um i think they'd like to be under construction and finish you know sometime in the summer so they want to be pretty quick it's a nice looking burger king any other discussion hearing not all in favor say aye aye all opposed say no eyes have it motion carries thank you all right next on our agenda is uh

[0:26:41] mayor's report just a couple quick things uh first of all on uh we need board action on something that's developed fairly quickly board you all are aware that with our mpo applications we've applied for an overlay project for church road which would put a new resurface on church road which is extremely needed from highway 51 to pepper chase and we've been a been approved for that so basically we need to design uh that project and because it's less than 150 000 for design work we can do what they call small purchase design and construction and so i'm asking for a motion tonight to accept civil link as the engineering firm that does the design and construction second you have a motion by alderman gallagher second baltimore brooks is there any discussion yes okay and that motion carries uh the next thing i want to update the board on tonight obviously we have a street improvement budget and plan that we execute each year to improve the conditions of our city streets we've done well with that uh we've placed over five million dollars the last three uh last three years in doing that it has been a challenge we have as you all know we've had some subdivisions that when the housing market declined bonds were called but they were not adequate you know to put the final lift of asphalt on some of these streets we've uh fought hard you know we've thought really hard to try to catch up we've done a really good job with that however you know i'm unfortunate i've got to report to you we're not out of the woods yet the weather in january wreaked havoc on a lot of our city streets we have some streets that were not on our

[0:28:42] list for our 2017 budget you know we use a million dollars a year for that but we have some that are basically it's the cherry blossom and then some of the side streets it's a large entrance street coming off of college road and with the recent icy weather in january it was already a critical streak and now it's uh it's considered a lost street and so are the other five surrounding streets so basically i'm not asking for board action tonight i just want you to be thinking about how we want to do that um it looks like we're going to have a deficit of about 400 000 so if we want to do those straights this year you know that's the situation we're in the others that are on the list i've emailed you guys the list so you can look at that a lot of those are arterial streets that are also in critical condition and as you know we prioritize the streets based on the street rating the condition of the street and also the volume of traffic on it so there's two large projects for rasco and this is the section of rasco that's between airways and greenberg parkway and then uh extending further east from granger parkway to sweeney um you know we have many schools in that area and the roads are in horrible condition so we had rasco on there unfortunately that eats up a lot of the budget because it is a large arterial street i don't recommend you know moving rasco back i think that's again due to the volume of traffic i think we need to keep that on there but alderman flores can also tell you we both inspected the streets at cherry blossom and uh they're they're in horrendous condition it's just uh it's have a fear that it's halting development you know they're trying to build homes there the housing market's coming back and i have a fear that we're going to halt development just because the condition of the streets i know they're having trouble selling homes for the streets in that type condition but again no board action requested tonight

[0:30:44] if you would look over that list i've sent you and let's put our heads together and see if we can you know come up with a solution to that essentially and that's all i have this evening uh next on our agenda is our citizens agenda we do have one person that signed up miss graciela victhorne please come forward i know you all missed me that's all thank you happy new year happy new year to you well the reason i gosh it's pretty powerful the reason i'm here tonight because i want to respond to what you said last meeting about the penny tax and now i see you just wanted to go by the wayside and just circumvent the process down there so you know um what showed it to me is the fact that you probably not used to anybody saying no to you and the fact that are you talking about me yeah okay yeah in that respect i think so i mean you're a very successful businessman and you're used to running your own business so you know when somebody in jackson says no it upsets you and it was quite a display i was thinking the thing is attaches to taxes that tax i think you all should have known last year that this tax will probably go away and i think you did what you were supposed to do you all built a senior center addition you improve whatever you did and i think that is sufficient now from my understanding the parks make plenty of money so if the parks play make plenty of money why do we need an added to it you know jackson is trying to pass another couple of taxes what are we gonna when is that gonna end you know a penny here a penny there some of us you know are not making six figure salaries or social security so we just need to see that some of these things need to be done i live on a budget

[0:32:46] and i think you all should budget the things that need to be done by priority and that's it if you have the money you do i don't borrow money to do many things so i i just really want you to consider that that is not fair i appreciate your comments and you're actually asking me to this as you know is a very lengthy detailed discussion this guy i can't cram that into third let me let me speak please i can't cram that into a three-minute but but i will address uh your comments first of all um i'm trying not to laugh about i can assure you i'm used to being told no i've been in a sales career for 25 years i i'm used to being told no but the issue is not darren musselwhite i've not been told no this board voted unanimously and passed a resolution to send to jacksonville legislators to respect that and to go to work for us so it has nothing to do with darren muscle white being told no no i know every person i finished please not finish and i want you to have plenty of time to talk with all due respect let me answer your questions but every person up here who's been elected by the all the people in the city of south haven voted unanimously to ask for that tax to be extended and we were told no as a group not darren musselwhite now to make a real long discussion short i'm going to try to help you understand this a tax i don't think well i'm not going to say i don't think i know there's no one sitting up here that does not is not in favor of low taxes low debt efficiency in government and i can i can assure you i stand behind every budget we've done the last three and a half years it and thank you but it's a very efficient budget but as it relates to the penny for your parks tax um you know that i prepared a q a i don't know how many people you know i thought that in 2013 i thought one of the biggest things that our city needed was transparency so it's been a big priority of mine to be transparent well i spent a sunday afternoon after i got out of church i set on in my backyard on my uh porch

[0:34:50] and i wrote the q a when my family's doing other things i spent my whole day i wrote a q a myself and the reason i did that was to answer the questions that you have and everyone else has i've learned that few people including our legislators have even bothered to read that so it's proven to me that transparency is not a big as big an issue as it was presented to me in 2013 but anyway all the questions that you just asked or in that q a is posted on the website but i'll specifically because i like you so much i'm gonna i'm gonna answer your question directly and the answer to that is this and this is an economics lesson i hope that you'll forgive me but i'm gonna try to consolidate and make it real concise for a city to thrive economically you have to make your city economically attractive when you make your city economically attractive it brings more customers to the businesses here it makes the property values go up it brings more money to the general fund which allows these people to budget in the general fund budget a way to provide amenities throughout the city we talk about these roads hey when we have more money that comes in from out of town it gives us more money to improve our street conditions to improve our fire department our police department all of our departments so whether or not you ever use a park or you care about a penny tax you reap the benefits of the investment in your city of having parks because it's no doubt it's not debatable i know some people don't understand this you ask any recruiter any economic development person they'll tell you that the things that people look for when they're considering bringing jobs and business to your city is fun things to do recreation quality of life so parks do that now more specifically about the money the penny tax provides last year was 1 million 882 000 that money comes largely from people that do not live in south haven it's not a doubt some people in our legislature fail to accept that but when you're in a tri-state area and we also have the data

[0:36:54] we know that the teams the softball teams the baseball teams the concerts at the amphitheater we know where these people come from because they register in advance so we know that a large amount of the people that are coming here are from out of state also we're in a tri-state area i mean you can throw a rock to tennessee from here and almost if you got a really good arm you can almost throw it to arkansas but these people eat in our restaurants if you don't believe that don't take my word for it just go on a saturday night and walk around the parking lot check the tags so the bottom line is this an enormous amount of this money is paid by people that do not live in this city so if you let me finish i'm not saying anything when you you complain about a tax but if you you complain about a penny okay you take this penny away it's one percent it's a penny on a dollar for a 25 tab it's a quarter you pay a court when you go out you spend 25 it's a quarter some people don't pick up a quarter in the parking lot when they drop it so i'm just explaining to you that when this money comes from out of state if that money if that goes away that's 1.9 million that goes away and then 100 percent of that burden goes back on your own people now your question and i'm not going to speak to you but i know some people have said well why don't we why don't we just quit building parking proof we can do that we can cut that's not that the point the point is that marky obviously told me somebody's told me that all the over and over it's people are still coming in here and still spending money at the rest right are we going to quit don't we want to make our city better and keep making it you don't need that extra one percent that's what i'm saying of course we do if we don't take that one percent then that goes back on the general fund budget which which puts the burden back on you it goes back on a property tax burden so why help somebody please in this room help me understand why that's so hard to understand why would you turn away money that comes like 55-60 percent i'm sorry you know this discussion is not going

[0:38:56] anywhere sir i'm telling you the facts and you don't like the fact it's i don't like taxes either but taxes are necessary for quality of life and you have to ultimately at the end of the day every person in the city has to ask themselves what kind of city do you want to live in we can cut all the taxes if you want it's not american anymore taxes we just need any added just like i said in jacksonville we're not adding one this tax has been in places i know that but you know but the next time something will be something else that's how it works so what is the next one here please don't generalize and put us in the same category as the federal government we're not the federal government i know you're not the federal government no we don't we're not having prep money we're not able to print money we have to actually have a budget and work within our budget so therefore we do so you know what that's the way your life is and you're all going to be right and i'm going to be wrong and whatever anybody thinks differently it's wrong no that's not true i'm trying to work you asked a question i'm providing you with factual information you know sir i might not have a degree in economics but i'm not stupid and you're not stupid you're a very brilliant woman i've talked to you many times and you understand this and the fact is just like my house if i fix my house i get better return on it okay that is the same principles what if you invest in your house and improve your home does that make the value go up i don't have the money to do everything that i want to what we deal with is tax but still it's the same idea so i just wanted to say something about that not happy about it it means a lot to me i know that i'm probably not going to convince you to change your opinion but i'm just being very honest with you it means a lot to me that you understand this it really does i want the people to understand you know what i still know what two and two makes it's still four that's not the new map it's still math that's how i learned you also understand if you take away one million eight hundred eighty two thousand uh money

[0:40:59] that's coming from this yes you get used to that money you had the the way greg davis wanted wanted to build a mansion for the senior center and i'm glad you all got smart enough and not spend that kind of money we've been very efficient with them exactly so that was accomplished parks would be free but see that's another that's another misconception here's the misconception and i know that uh a lot of this has been said by a small group of people in our city that no because i'm part of it so don't you know i this is well i don't agree with that group but we can agree to disagree i strongly disagree with that group because i understand that right you're going to make your city a better place you have to invest in your city never ever was this tax just about a senior center has been said if you go back and look at the facts look at the videos i don't know how you understood it but that's not the way it was presented it was presented as a park improvement project and there are many things on the list not just the senior center so to say that that's done and over with that that's not that's not true we have other things that we want to do to invest in our city do we want to stop i mean what do you want your city to be i want to make it more economically attractive make it better all that mall that's great you know what shopping is great except causes problems and i'm wondering really um tax revenue and jobs is a problem no it's not a problem a traffic problem between the kangaroo and uh and the lander center and we're aware of that we're aware of that but i mean but the benefits outweigh the problems i'm trying to explain to you the revenue the city will get after after the rebate program is paid off by tanger that's an additional 2 million a year i just told you we spent a million dollars a year on all the city streets 1100 streets throughout the city we work with one million dollars the tanger center alone brings down you for your way you'll handle them if you'll handle to help people in the business understand business you have to invest in your city to get returns on your

[0:51:16] to everybody just kind of show you the progress that was made you can tell there's been progress made obviously not what we felt was sufficient for december 31st nothing has been done further at this point the materials aren't there's there are materials on site um but i guess at this point i need to know if if the board would like me to move forward with a formal condemnation of the property um or do we want to make them aware that they have more time i just kind of need some direction from the board with us we gave them to the 31st of december just somebody first finished all the exterior yeah yeah just to help with the neighboring properties those are the people that are complaining um and december 31st was the deadline for that do we have any idea how many times they were out up until the 31st well before december 31st they were probably out a good solid two weeks about a week before they knew they were going to have to come here and put their argument to the board and about a week after that some volunteers come in and help uh we did see a lot of activity uh we had our code officers our fire marshal chief building inspection inspector went out there to kind of go over what the interior looked like um for better luck words it was it was really bad on the inside um but we gave them the list um i would say maybe a week to two weeks after we gave them the timeline they never went back out on site um constantly timeline they got here from us correct and they received all of those documents yes they received everything everything was done um like we would do a regular condemnation we sent them notice of a public hearing we posted notice on the site we sent the notice to their house over memphis we did everything in a formal condemnation procedure we just didn't condemn it because we decided to extend the time and let them have some time for improvement do we have to do all that again we will have to go through condemnation procedures again that's usually about a month and a half procedure we've got to ship all the notices out to them by fedex and collect all of our documents like we

[0:53:18] would beginning a site demo um and not that you should have but did you contact did you tell them that we were going to be oh yes yes they were made aware and i didn't want to send them any further notification to come and defend here until i knew what we were going to do if we're going to give them more time we'll bring them back and find out what's the fair time if we determine we're going to condemn it they're going to get another official notification from the city to come do you need from us tonight i just need to know which direction you want me to go i mean do you want me to start formal condemnation proceedings do you want me to ask them to come back and explain why they've ceased work and determine at that point if we want to give them more time or there needs to be no emotion correct man hey if you want no there's nothing no motion be made if you want to go to uh further condemnations just tell her to go further combinations and move forward i agree but this is just to go forward with the process where at least you can contact them and ask them oh they'll come back in front of this board i guarantee you uh we'll send them notice that we're basically like we're starting from scratch here's a hearing that's going to be in front of the word of aldermen on such and such day at six o'clock um to determine the condemnation procedures for this house you're welcome to attend but they haven't been in contact with you since this is where we are this is what we're doing working on they have not no they've not been up to date with us whatsoever not communicated with him i think this body has gone above and beyond allowing them more time and at this point we have to do what's best for for the neighboring properties the neighbors and what their goal what their plane is their goal was according then the last time they're here was to completely renovate this house on the exterior by december 31st and then to go inside and we were giving them six months until july first because we didn't want to tie up any next board to some action and they haven't done anything except for the first two weeks yep yeah we gave them we gave them a really good opportunity when were they here before it was the summer correct was the last time they were here was it

[0:55:21] i said before october it was in the august territory i've done three demos since they made even the august one i mean when we send out the condemnation procedure notices i mean they're going to come and defend a timeline here at this board i would imagine anyways um so i mean at that point if you determine that they're legitimately trying to fix it i mean we can reverse the condemnation just basically like we did well are they continually getting code enforcement violations are they oh it's been condemned on a exterior property list for years um so i mean it's it's it's condemned in that manner where you know the city goes out and cleans up the exterior the property mows it and all that it's just a totally different ball game we go and and talk about the structure itself so it is condemned and code enforcement monitors it we clean it up because she won't i mean we don't she doesn't clean it up um so it's on that list but this is that one step further costing the city money i was cleaning it up essentially yeah it was lost to taxes they had three years of taxes go by and she came back after that and bought it back so essentially we weren't getting paid for those three years but the assessment went through and she had to repay us for those three years so they've lost the property to taxes then they purchased it back they've been notified that we were gonna condemn the property came here and begged for time and have done nothing at this point there's no reasonable actions whatsoever i agree let's just move forward i'm not for condemning somebody's property they don't even live there though and if i'm the owner of that property or i'm an owner of a property that somebody says we're going to do this unless you do x i'm going to do x if i want to have anything to do with that property at this point they have it i'd really like to hear from her so getting her in here the only way to do that is to move forward with confirmation that i'm talking about i mean we can do you can do it one of two ways i mean she will show up at a condemnation hearing i mean i know that about because okay okay is there a motion to
