[0:00:00] thank you for being with us tonight everyone will stand uh pastor cory nephili cleared you've got this church he's going to lead us in prayer this evening and please remain standing for the pledge of allegiance and honor mccain is going to lead us in the pledge tonight father we thank you for the opportunity to be able to gather here we thank you for what we celebrate over this special weekend the resurrection of our lord jesus christ thank you for our city thank you for the leaders that are here we're so grateful for their leadership we pray god you'll give them wisdom we pray that you'll allow them to guide us as a community that will be pleasing to you help us to make wise decisions that will be profitable we would see great growth and success pray for your blessings upon us in jesus name amen amen nation under god indivisible with liberty and justice first on the agenda this evening is the approval of minutes for the march 20 2018 meeting mr mayor moves we approve the minutes for the regular meeting of march 20th 2018 with any additions deletion or corrections we have a motion made by alderman payne second ballroom and brooks is there any discussion hearing none roll call yes kelly yes yes okay that motion carries next on the agenda is the freeport tax exemption for logitech incorporated mr nick manley this next mayor is the freeport tax exemption for logitech incorporated uh been approved by the decedent council and

[0:02:02] approved by city county court supervisors and uh for their goods and transit on this decode [Music] we have a motion bomber in florida second ballroom and gallagher is there any discussion nick did they say why this came so late they were going to be out of town unfortunately about this meeting and they say our project didn't take up till yesterday right so i will add this evening you know we it's not uncommon to have these on the agenda but i recently in a local county government discussion it was brought to my attention the attention of other elected officials in the county that there is a group uh other elected officials not naming names but that are circulating information that's not correct you know these exemptions like this it's not a you know everyone wants or some people misperceive that that city and county is giving away all the tax revenue that's not true and what it generally amounts to in most situations all this this does not exempt all taxes so there's a large portion of the taxes that are still the city and county still receives that up front it usually equates to an area of about 68 percent that we're getting so when you hear exemption that does not mean that the city and county has given away all our revenue the total is usually about 68 so when you hear that on the street know that or do further research on it a lot of times these situations are expansions when these companies could go elsewhere and when i say elsewhere i'm not just talking about other cities throughout mississippi i'm talking about they have other locations in a plan that are throughout the country so if we're on the list and we have a chance to get them in mississippi it's not a matter of um you know do you give it or not it's a matter of either you give them an

[0:04:03] incentive or they're going somewhere else so uh alderman flores is that is that fair to say we have one of the autoflora sits in on those meetings for us with the county so would you add to that well yeah and the the other thing is every time they ask for an exemption we make sure that that the majority of their employees come from this area to soto county that they give to community foundations in this area so they're giving way back more to the community than we're giving that then they really have to but that's that's what we're doing you know i mean i don't know about the people in the audience but um 68 is always better than zero to me that's been an easy business decision for me so anyway i just want to bring that out we these are on the agenda frequently but we don't get into detailed discussions so i just thought it was a good time to just update everyone on that fact any other discussion i will add we would have lost a major company in this city had we not given us some of those exemptions here recently and it's not detailed it's not for retail either right yeah and you see a lot of them when they list their destinations we're one in the mix you know so we're not able to accommodate they go to go to the next one on the list so okay thank you alderman flores any other discussions hearing none roll home yes okay that motion carries next on the agenda is a contract amendment with amd mars and the southampton firewire this is a 90-day contract amendment with a b mars which is the ability entity for the taliban fire department of ambulance services the nine days will begin on april 28th and it'll allow the fire department to further review the billing needs and other options alternatives possibly um in that realm of for billing so tonight just the authorization for chief scalia to sign it for the nine-day extension effect of

[0:06:05] april 28th and that'll give hopefully enough time for them to reinvite what they with the fire department reevaluate how they want to proceed after that 90 days second we have a motion balancing kelly second ballroom and wheeler is there any discussion hearing none all in favor say aye aye any opposed say no eyes have it motion carries next on the agenda as a resolution for the establishment of a new business district uh encompassing the church road and i-55 interchange area mr mayor with without the resolution mayor board of autonomous southeast designating the metropolitan district authorizing economic incentives for qualified businesses in the metropolitan district district center second we have a motion baltimore brook second alderman payne is there any discussion i'll add just as a quick update we've talked about this before uh the residents of our city know that uh three three four years ago we created the first business districts in the history of the city of south haven business districts are used throughout the united states but they were new to south haven so we've tried to you know spend a little bit of time educating them upon which the purpose and we created the west end business district years ago and that was strictly to regenerate interest back into the original business district of our city to try to incentivize business to come back that is working slowly but it is working the snowden district is also a special area that has high real estate values we create the snowden district as well and this will be the third district the metropolitan district is what we propose naming it uh the reason we have chosen that name with the help of uh christie faulkner uh whitney others uh we feel like that

[0:08:07] the churchill 55 area is going to be will become more of a central location there's a lot of pending development in that area we feel like that it will have architectural design that's unlike anywhere else in the city with higher high-rise buildings not high-rise rises you would see in a larger city but higher buildings and more of a metro appearance uh to create a bunch of um business energy and culture in that part of the city so we we foresee a lot of things happening in that area so we felt like that you know that the metro district would be a good name for that again as it relates to the incentives uh and nick manley would would back me up on this uh for his advice the state state law does require that you're going to give economic incentives to a potential business that you have to be consistent and it has to be in a certain geographical area so that's the purpose we have a few businesses that are wanting to come there now they are requesting some incentives so for us to be able to do that we do need to define the geographic boundaries of that district also with the district it fits into our comprehensive city plan you know to let potential developers know like what we're looking for in that area what we want that to become and i'll say it again we're looking for things that the city doesn't have southaven has been blessed to have tremendous economic development but we've grown very fast and uh very haphazardly for lack of a better word we need to be a little more cautious and that we have quality development so creating this district allows us to make that clear you know two potential developers on what we're looking for in that area is that fairly sad whitney that's well said okay and so basically that's the purpose like a lot of people say well what's a business district you know we've never had that here before and um again that's just kind of the purpose to bring things to southaven that we've never had before things that you'll see that are like i said that are common in other parts of

[0:10:08] the country that will help us help us grow economically mr mayor will that district include airways maybe going north up towards uh the town central it does there should be a map there's a map on there there are some other there's some potential having this district there are some potential grants that we could get unlike a new grant from the state it's a little too premature to go into a lot of detail about that but we didn't close that area the area that's on the just north of um or right around the nail road airways area um there's some potential um state money that could be available uh in that area so we did include that area in this district as well and then it goes on the other side also on the west side of the interstate as well any other discussion hearing non-roll call yes okay that motion carries next on the agenda is our planning agenda i guess our first application we've got is just a minor subdivision and this is going to be east of get well on the south side of college road it's a parcel of land approximately 72 acres the applicant is wanting to take um two lots uh five acres and three acres leave the remaining um acreage and the larger parcel um they've given us the 53 feet of right away needed for college road if and when we need to widen it or do improvements to it which is required for the comprehensive plan um on the transportation side to have a minor subdivision you have to be agriculturally designed no more than three lots so it does fit the profile of that and so it's met on both regulations we're recommending approval

[0:12:11] mr mayor i recommend approval i'll make a motion to recommend approval for item number one on the planning agenda second we have a motion balance flores second alderman brooks on item one is there any discussion hearing none all in favor say aye aye any opposed say no i just have a motion carries online number two is revision to the existing plum point subdivision area h lots one through five um long title just to tell you it's about parcels in front of tanker um what they're wanting to do is do a lot line shift between lots three four and five two better square off lots four and five and take away the l shape design on it there is an existing gasoline easement that is live on this so keeping that in play all the other utility easements are vacated at this point and are going to be shifted to the new lot lines that being said nothing else changes on it we're recommending approval so thank you we have a motion baltimore gallagher second ballroom and kelly is there any discussion on item two hearing none all in favor say out all right i'll post say no i just have it motion carries on item two okay item three and you see the red line michael can you go back one second uh to the aerial photo please uh what you have the area question we're talking about is the one that's red line right here this is going to be uh the northernmost out parcel south of the main entrance into tiger outlet there's a proposed two-bay building here uh it will encompass starbucks and at t they've gone through site plan approval obviously we did the adjustments to the subdivision uh they did submit a stone veneer and efus design to it they did have some split based block on the back which we immediately asked them to

[0:14:13] remove and carry on the stone and the evil to the back they had submitted initially a set of colors that was not real conducive to what was behind it and the planning commission saw this kind of bland we asked them to come back with a couple of different options we went to pictures with color samples nobody was okay with those options either so we walked them all and found two colors that were very conducive to the stone they're proposing which is used a lot in the tiger outlet right now provides a little bit more contrast they did agree to that and the planning commission to govern those two colors uh and they did agree to carry the wayne scott area stone around we did increase the landscape escaping they agreed to all of that as well um and once those changes were made and those revisions were put in our general amendments then they recommended approval so that's what we're coming to you with three mr mayor but we're providing number three on the planning agenda no motion ballroom in pain second alderman brooks is there any discussion on item three super many sidewalks no uh if we can have mike oh we have the bikes in there what we have not done on the church road corridor on airways those aren't really part of the bike the pedestrian path areas one thing we have found is you really don't want to encourage arterial street pedestrian pads um so those are not part of that and we also haven't carry the sidewalk down the front of tanger either so this being an out parcel on the front it's already been built out of a county piece field and it would kind of lead to nowhere um the bikes wouldn't be a bad idea because obviously you can go across at the stop lights and cross into the parking lot so we can obviously ask them to put bike racks on like we have been doing but i think from a sidewalk standpoint it's not matching with a comprehensive design for it saying so i don't know that would make sense to put them there but i can certainly add bike racks in there that smells good those are cheap especially if it's starbucks it is starbucks i don't know if i'm supposed to say that but yes that's what it is people like to write you blew that one already i'm sorry whitney i got a question is this going

[0:16:17] to be facing will the storefront be airways we'll be facing it's i mean this the way this out parcel says it's got visibility from all four sides and we basically made them aware of that all four sides need to be conducive to what a street design would look like um but the main entrance to both will be facing airways they will have no direct access to airways they will be utilizing the existing access point to the north which is the main entrance and then in the overall site plan with the mall there was a southern entrance that was already approved and you kind of see where it goes into the gravel now there's a drive there that will become a permanent drive but there will not be there will be no curb cuts directly for the partials okay so but you have to you have to go into the tanker mall again you have to enter through the hangar mall site to get into it and we have you know just like with the chick-fil-a discussion with queuing uh we're very well aware of it in the site plan design we have made it to where their queuing line already called for around eight to ten spots but the way the building's designed you could fit approximately 12 cars in a lead around the queuing lanes so it's sufficient in slot three right yes it is out parcel two but lot three which was a little confusing during the planning capacity but yes it is line three is there any other discussion on item three hearing none all better say all right all opposed say no i just have it motion carries on three thank you okay next on the agenda is uh mayor's report got a few things i want to update everyone on uh first of all i want to read a proclamation i think we um do we have a guest here i think we have a special guest here we do have gas back here is there a gust of gopher here oh my goodness you are okay mayor before you read the apocalypse

[0:18:24] i'll say i'm robert leslie i'm public affairs director for atmos energy the gas company here in south end of sonoma county and i'd like to introduce all of you all to our newest employee gus the gopher uh gus this is a big month april is national safe digging month and this is one of the ways that we are trying to encourage folks to remember to call 8-1-1 before you dig now you will be seeing a lot of gus i'll explain that in just a minute but first of all thank you southaven and desoto county i believe i was here a couple of years ago giving you all a certificate for being one of our better cities as far as calling eight one one you know an outstanding record here in south haven of doing that safety is the highest priority for atlas energy and i know for you all too and so we really appreciate the job you do but we can always do better shad sims i know you all know shad he's back here our manager for this area we were looking at some numbers and still even with your great record about two atlas energy lines are hit every week and in a third of those cases is because somebody did not call 8-1-1 so during the month of april we are out but we're doing a big push major campaign uh gus is available now if you all if you don't know of events that are going to have a lot of kids uh he's a huge hit with kids and you're also going to see a social media campaign gus has his own 30-second commercial because you're going to see a lot of on facebook and on youtube during the month of april we've got a campaign that's going on i'm not sure how all the facebook stuff works but when you log on to facebook it's very likely if you live in south haven you're going to see a lot of gusts this month so i just wanted to introduce them and say thank you all for the great job you do already and let's do even better thank you mr leslie for being here and uh just be careful on your way out man so here's our proclamation uh for the

[0:20:26] city of south haven uh whereas each year mississippi's underground utility infrastructure is jeopardized by unintentional damage by those who fail to call to have underground lines located prior to digging undesired consequences such as service interruption damage to the environment personal injury and even death are potential results and whereas mississippi 811 incorporated promotes the national call before you date number 811 in an effort to reduce these damages designated by the sec in 2005 811 provides excavators and homeowners a simple number to reach their local one call center to request utility line locations at the intended dig site and whereas through education of safe digging practices excavators and homeowners can save time and money keeping south haven safe and connecting by making a simple call to 8-1-1 in advance of any digging project waiting the required amount of time respecting the marked lines by maintaining visual definition throughout the course of excavation and finally digging with care around the marks and whereas all parties agree that safe digging is a shared responsibility to know what's below call eight one one two working days before you dig now therefore i darren muscle white by the authority vested in me as mayor of the city of south haven mississippi hereby proclaim april 2018 as safe digging month and encourage excavators and homeowners throughout the city of south avenue to always call 811 before digging safe digging is no accident i've been informed another thing uh the silo square development is scheduled to have groundbreaking ceremony tomorrow at 11. i've been told that uh there's we've had a family emergency and that that is not going to occur is that correct whitney right as soon as we get a rescheduled date then we can get that out and i'll let you know as soon as i know okay so we will do that um next on the list just to update everyone uh we've talked in the past

[0:22:28] about uh during budget time about the importance of improving the streets throughout the city uh i've kept the board informed as we've been made aware of different streets throughout the city that the winner has wreaked havoc on it's an ongoing working document as the wintertime definitely changes our street conditions so each year as you all know we set aside a budget line in the annual budget for street improvement and this past year in our budget we raised that from 1 million to 1.5 million so we're definitely making a lot of progress getting our streets in better condition we're still behind in our recent bond there's some money in that bond that i believe and we've talked about could be used to help us catch up i believe that after catching up the first few years we can allocate a set budget line amount that stays consistent so we're not having to come back and catch up and again not to be critical of decisions of the past but we never really had before four years ago we never had a systematic plan to keep all 1100 streets in our city in good condition so one of my goals and y'all supported me on that and i appreciate that we started as simple as a spreadsheet you know in 2015 and tracking the streets what was done to them so we know what to expect in the future you know when it's going to be time for them to be treated again in an ideal world uh you touch your street once every seven years uh i will tell you that um that's tough to do i mean unless you want to allocate a much larger sum of money we have over 1100 streets in the city it's not realistic for us to touch them every seven years but i do think that we should work on the goals where we are hitting them every 10 to 12 years to keep our streets in better condition i tell you all that to say and i did email out the spreadsheet title board members so they could be prepared but i'm requesting and also sent you the capital improvement plan that we looked at back in uh you know budget time in september of last year

[0:24:32] and i'm recommending that we take uh two million dollars and use it on the streets that were denoted in green so that what i emailed you the ones that are in green that's what the extra money would be spent for and um we don't have to have a budget amendment i just wanted to open up the floor for discussion uh anyone has any concerns about that or or or the streets or any questions about it would just like to open up that floor or someone will make that motion mr i'll make that motion a second we have a motion baller obtained second by alderman brooks is there any discussion mayor how did we come up with the the streets there i mean i noticed it's not really equally divided it's kind of heavy in some wars and that kind of stuff how did you come up with that yeah it's not political at all and that's one thing i i will i said i wasn't but i will say that in the past it was very political how the streets i'm saying prior to 2013 i was very political how the streets were allocated this has nothing to do with wars this is a more scientific business-like approach it's based on street conditions in 2015 we hired a company to go do a gps rating of every street they rode every street in the city we paid about 40 grand for an engineering company to do that the reason we did it was to get an analysis of the conditions of all of our streets and so they're all rated based on good obviously being the best fair being second critical being third and lost being the worst so we rate these and the reason for these streaks are based on the condition of the street and also the volume you know so a lot of times when you're behind you know it makes more sense to um you know to treat an arterial road or one that's what would be called a collector street like palma hills drive in your ward that's why we came up with clone hills drive because more people in that subdivision are going to use the collector streets and your individual codes and your individual you know kind of kind of capillaries

[0:26:33] so to speak so that's how it became based on rating and traffic volume that's where we got to that is this a list that i know we have next year's list you know proposed lists and that kind of stuff were those things buffed up or these are just randomly anything past this year is just ones that we're aware of yeah they're what we do and like i said this that's why i call it a working document things change by the year sometimes by the months that's why i've always asked the board members when we have this you know uh don't throw me on the bus don't go and say yeah mayor said your street's gonna be done this you know this month because that can change but no the only one that that is good delivered to the contractors is the 18 list and then if there's no reservations in this these streets in green will be sent to them anything past that is still a working document can subject to change what was that study done it was done in 15 we did it at 15 and then rated all of them and then it's actually about due to do it again that's why yeah because as you know when you know a couple years go by that changes the situations but that's no secret playing catch-up and uh the other thing just to catch alderman hoots up since he is you know is not here during the whole term we had a problem in the city when the housing decline occurred in 2008 there were a lot of new subdivisions and most of them are on the southeast part of the city and a lot of new subdivisions where the developers went bankrupt and we did have bonds in place for those and just for everyone in the audience when a subdivision is being built they don't finish the street first they go in and put a sub layer and the reason we don't finish it is because you have heavy construction equipment on it and would be a waste of money you're damaging the street so they wait or we wait until they're 80 built out before we put the final layer of asphalt on there so what happened in the housing decline is we had all these subdivisions out there and south it was growing i

[0:28:34] mean yeah we were rocking and rolling in 2008 with residential growth so when these developers and home builders all started going bankrupt we called the bonds well when we called the bonds we realized that they were not priced appropriately like the bonds that we had even though we did collect the bond proceeds it was not enough money to put the final layer of asphalt the proceeds that we did get uh and i'm just speculating here i don't want to speak for prior administration but i'm thinking that they probably took that money knowing that uh that it wouldn't be since construction halted you know with with the decline they probably thought well instead of leaving this money in an escrow account somewhere until the subdivision is built since it proved to be almost a decade you know before the building market came back they took that money and spent it they spent on another city street so the reason that's a huge issue is it put just puts us in catch-up mode so now as the housing decline is over we're starting to see growth again and so now everyone once those streets done so what was about three two or three years ago we started being aggressive trying to catch up on our what we call fun called subdivisions so that's a good information from you because i know that a lot of residents in your ward ask why the money is spent on the southeastern part of the city and not in one of the older neighborhoods and more too the reason is believe it or not the streets are worse there than they are in ward 2. that's because they never got a final lift of asphalt so we've been playing catch-up that's why so much of the money has gone over there it's not fair to a homeowner that buys a home in the city and they never even get their street finished you know and i think the board we all agreed that that was not fair and uh that it was the right thing to do to catch these subdivisions up so we've been playing catch up and used a large amount of the money the last three years to take care of these people and we're about caught up we're getting there we've made a lot of progress mr mayor what on the capital improvement list did we did you take off something in order to

[0:30:36] come up with the two million dollars no we they're all of it it's not allocated the list that you got last october uh we didn't account for all of it we left some of it open for uh straight i think i even turned the street catch up was on there but we never really formally took any board action or did anything like that we just kind of left the door up because we didn't know you know what was going to happen and we're not using them at the end we don't use the money as much then the weather has to be warm consistently warm to be laying asphalt so that's why we didn't address that then you will see on the additional plan that was given to the budget we did have 250 000 in for the park streets at snowden so the 2 million includes that i just rolled all that into one there was like 1.7 that was listed uh as street ketchup and then i think 250 000 for those other streets i just combined those all together so 2 million would include those and they're noted in green on that updated spreadsheet is there any wiggle room left at all i got i'm cause i know a couple of lost streets over like in rascal farms that are just like you said that it was built subdivision was built out and these folks are driving through potholes right we actually have address rasco farms and actually one of those uh last year we did um well jordan meadows is one of the ones neighboring side of business we did um jordan meadows and then we have another street on jordan meadows it's absolutely a rip you almost in a four-wheel drive i wrote it the other day um you almost have to have a four-wheel drive even past it and that's on the list already now rascal farms we also whitney we also spent money i know the last two or three years there but we wait until it's 80 percent built out again we don't want to go late to asphalt have to redo it so at this time there's not any streets there that qualify for that but next year would be a different story um i did ride the um sunday actually i was just in the area and i rode through uh highlands of north creek that's in your ward too i would encourage you to

[0:32:37] ride through there one day those streets are horrific we do have one of those streets on the list this year but uh in the upcoming budget years we're going to need to address the highlands of north creek also a lot of the award not that we allocated that way but some of the money that was spent in ward 2 over the last two or three years was spent at north creek across state line road where the government horse is there were several streets in there that were really really bad and big streets too like a loop you know they had a lot of a lot of linear feet so we spent a lot of money there but we need to keep highlands granby lakes is another one in your ward that's on the list been on there a while we reviewed those they're in fair condition i know there's some people that would disagree with me but based on our again our study they're they're fair and there are streaks that are much worse than those uh that we need to get to first the long way to say they're prioritized based on traffic volume and street condition is there wiggle room yes our next budget meeting you give me more money i'll pay more streets good luck any other discussion okay like i said we don't have to do a budget amendment the money's in the bond fund so we will use that any questions that come up along the way uh please contact me i always send an email out to all the board members too asking to let me know if there's a street that that you're getting a lot of calls about or that you think needs to be on there so this is a daily i manage this list but it's a daily uh managed thing so if you have a street you want to talk about let me know but we'll definitely take a look at that okay and then along with that i want to go ahead and bring this to your attention as well the spreadsheet that i sent you has another tab on there for roads that's our arterial roads

[0:34:39] and we do have two big needs it is important to note this year on the what what is being suggested that we spend we'll take care of rasco the area of rascal between highway 51 and airways gets an enormous amount of traffic because of the school it's one that i recommend doing with bond money because it's too big to do with their normal street if we if we used our normal street program for that that would eat up about 40 percent of it doing one road it's very important that it be done but if we knock out rasco there's also another one that's an arterial road that's in green that deserves special attention that's a section of swingy road between church and star landing it's in critical condition wait another year we're basically rebuilding that road that one is in this list and then tula homa from central park to goodman uh it's horrific i mean we're about to build a beautiful multi-use trail and forgive me but i'm not building a multi-use trail next to a street that looks like that i mean we need to make that look nice right there when you come out of central park going southbound to goodman that section from central park to goodman is on this list too the two that i wanted to bring to your attention that are not on this list that are almost to emergency status i'll say that dan and whitney are exploring our mpo application list to see if there's some potential federal funding that we can get help for but state line road you know from the interstate back to it's just you know with all the truck traffic with all the you know distribution centers it just it gets worse by the day uh it just embarrasses me every time i ride down and i'm just embarrassed to be your mayor i'm going to be very honest with you we got to do something about that but we we priced it and it's a million and 37 thousand dollars so you can see working on a 1.5 million annual budget to do one street that you know takes up a significant part we're going to try to get funding for that the other one is the state line road on the west end going from highway 301 to horn

[0:36:43] lake road by the soccer park in north creek it's gotten in horrific condition over the last couple of years so those two there we have a problem so we've got to find a way to find some money for that and so i'll continue to update you on that but we're searching okay there's no more questions about the roads i'll move on to my last topic which is our uh 17 financial audit we recently got our audit numbers um we've got fantastic numbers again we've improved our net position by 7.4 million dollars our debt went down 7.7 million and we added another 800 000 to our unassigned fund balance not to speak uh municipal finance jargon unassigned fund balance means rainy day fund that means money that after uh all the incumbents are paid accounted for and all the payments are made that's the money that's left uh in your bank and the city has since 2013 raised that from 2.4 million to 7.7 billion and i commend this board for being committed to you know raising that balance and uh maintaining 12 percent that's another thing alderman hoots just to update you that that's not money that's just sitting there where all of it can be used we passed a resolution a few years ago to make a commitment to keep 12 percent of our general fund dollars in reserve which equates to about 5.2 billion so that's important for us not only for protection if we did have some type of catastrophe but also helps us get a better bond rating so it's very important that we maintain 5.2 so all that money is not sitting there you know to be used we want we want to maintain that 12 fund balance but it just shows that we have done well you know we we we were below 12 we got there now we're two and a half million above that so we have another two and a half million dollars uh that can be used um
