[0:00:01] welcome everyone i'm now calling this meeting to order please stand with us uh for our uh indication they'll be led by armin gallagher and then please remain standing for the pledge of allegiance that will be led by alderman ferguson heavenly father lord we thank you for this night that you've given us lord and we pray that you would be with us and give us direction in our meeting lord lord we uh thank you for the season that it is lord we are especially grateful for the country that you've given us lord for everything that you do for us lord lord i pray that you would uh be with our country and recon reconcile it together lord and help us to love each other in your name we pray amen i pledge allegiance to the flag of the united states of america and to the republic for which it stands one nation under god indivisible with liberty and justice for all first learner agendas this evening is approval of minutes for the november 1st 2016 meeting mr may i'm going to approve the minutes for the regular meeting of november 1st 2016 within the addition stations or corrections exactly we have a motion ballroom in pain second alderman brooks is there any discussion appearing done roll call yes okay and that motion carries next on our agenda is an mou with desoto county for our nrcs state line road bridge project mr nick manley this is the mou it's an amended mou with the county for the state line road bridge project this memo you mou was

[0:02:04] entered into previously last year and mou will allow this the city will take the lead now as far as construction goes in inspection uh the county will be invoiced by nrcs our city invoice by nrcs nrcs will um i mean by the contractor and those bills will be paid by the county which will be then reimbursed by nrcs as part of the grant um we had to admit the mou to make that arrangement since we'd already done it so the county has approved this mou for you tonight for approval with for the same mou in the um nrcs grant or or the grant calls for the grant that they'll be giving us is an amount of approximately about 188 302 the remainder will be split between the city and the county for the cost including the land acquisition needed to for the state line road bridge project we'll make that motion there say that's the construction the projected construction cost that will not include the land acquisition along with the engineering inspection so uh it'll be 117 acre construction which nrcs will pay the 88 000 350 give or take a couple hundred dollars for that and you'll have um inspection engineering and planning acquisition calls which will be split 50 50 50 between the county and the city so any other discussion hearing none we're all calling martin brett yes carmen kelly jeff otterman yes yes no motion carries next on our agenda is a resolution for amendment of city code

[0:04:06] of ordinances title nine chapter one section nine and ten which deals with truck routes this was discussed in the last board meeting this uh resolution will amend the ordinance um to further clarify and expand the existing truck routes of the city uh you guys know that last meeting as the city's around we need to make this ordinance more consistent with the growth and with the truck routes and the resolution incites the authorities and the reasoning for it i'll be happy to answer any questions you may have regarding this you know go into effect one month from passage returned to the statute so we go into effect whole middle of december i'll make that motion second we have a motion bottom in flores second by alderman kell excuse me kelly is there any discussion go ahead go ahead sir excuse me is there a reason for stopping at two lane on state line road i mean they go all the way across to 61 ally there steve turtle no so there's no particular reason why we didn't include that uh we could very easily include that to go to 301 which would uh be a state routing 61 as well right are roads handles uh the the the biggest reason i didn't necessarily open that up is because of the hills uh in the wintertime if we have any ice we've had trucks get stuck in there so i didn't necessarily want to just open that up is that an enforced area now though yes well and i know that we have had complaints about in that area with the truck speeding you know you get into the resident you know when you get past tulane you start getting into north creek and the other subdivisions there so you you're getting up into a residential area before you get to 61 and we have had uh complaints from the you know the homeowners in that area with the with

[0:06:08] the truck traffic but uh but probably questions right um anyway that's that's uh what little i know about it i received those uh contacts but um but i mean it's yeah it's up for revision that's why we send it out if someone you know we want to take some more time and you know look at you know just making sure that it was in the forced area so you see what i'm talking about when you get past tulane you're getting into residential i don't i don't know that that could would be desirable yeah not necessarily but yeah but certainly see your point tony was 61 makes a lot of sense and we could monitor it again i mean we need to go back and we did we think that we updated this one to bring us current but obviously if we see that uh there's problems there that we could you know go back and make another amendment to any other suggestions or comments i've had indigestion over this one since it started enough to talk to the chief about it and i talked to the mayor also um about possibly going why it didn't go all the way down the long road and the explanation to me i i don't see any more liabilities than what we're already doing but i mean i guess you could further explain that to me the big reason i kind of wanted that open is we have a lot of truck traffic on especially on the weekends it comes through some wood 18 wheelers coming through residential neighborhoods because they're trying to get around truck routes i talked to bradley this evening he thinks if we leave it as is that he'll give me a sign down there i think it's some wood lane and uh malone plainly stating don't turn in here and this will be

[0:08:09] enforced that might work like i said i'm kind of with ronnie while we just didn't go to the city limit the city limit but i'm good if we can get that sign up there and the traffic slows down i mean you don't come through that neighborhood anymore well again i mean basically with the you know with the truck traffic your your roads and your residential areas you know you wanna you know that's that's a negative for the residential areas when you have the truck traffic and not just going through the neighborhood but you know they don't they don't want that at the entrances either but then the wear and tear on your roads but but no going from get well to um i mean it obviously makes sense from get well because you have all the you know the truck traffic coming out of memphis going right there and getting that need to get back on the interstate highway i mean excuse me interstate 55 um but i don't know chief do you see any you have any reservations about extending it to back east to milan that's kind of why we put it out just to tell us if y'all had your options well we're widening and get well and that's going to compensate pretty much for those trucks to make those turns but still we're still talking about a single-laying road just like this morning we had a rearing collision there to tie traffic up for hours i can't imagine what's going to happen if the truck gets off the side of the road which has happened before and i think the chief will back that up and i have concerns about that i don't even know how they're making these turns to get into my neighborhood to be honest with you well i was just thinking the same thing when you come out of memphis on malone through those trees and how thin that is how are they even getting through there they're coming from lamar and they're coming from the warehouses in the malone road area in memphis airport park area right there shelby that's right now why would you just go on one more block to get away well that you have to take i took that up with him a few times when i was a police officer and issued citations when they came to the neighborhood but the problem with the big thing the neighborhood is is they cut corners they can't help those

[0:10:12] trailers they're tearing up people's yards and you know if i don't see it for myself i'm living right there on the corner and i see them come through weekly and they're lost they're trying to get around that no truck route but they face one going the direction they're traveling they cannot go west and they're trying to find a way around it i know that's what they're doing instead of actually following a designated truck route they're gonna get them for their location but but yes if we can get a sign there and and they decide on their own to use get well to get the state line i don't see a problem here i just don't know that that's going to stop the ones coming from lamar well they're going to i think they're coming from lamar from shelby county they'll go straight down get well but i mean i again i'm gonna crystal ball but that doesn't make sense to me maybe they haven't been because of the construction i think that's a big part of yourself and once it's done it's gonna be jesus truck around anyway they were they were doing it way before the construction they did i think part of it is the school down at the end it may have something might be you know another point especially during the morning but you know after it gets wiped out that may not even maybe that's what i was telling you when you know i thought that they were turning around because the way it is now when you get west of galway on state line that was a no truck route so now we've amended that for it where that's open now so now they would have to have a need to turn around they can continue westward on the interstate 55. i understood that but i mean if you think we need to do it now i mean we can go back and re-evaluate well i'm willing to to go ahead and and keep it as is pass this on it's as its fans okay if we can get that signed and see what kind of traffic if it absolutely stops or traffic okay so you want to go ahead and then just reevaluate it if it's not if the sign doesn't stop the problem

[0:12:13] right we can amend it right okay any other discussion and alderman hail are you comfortable with that about 61. okay okay any other discussion hearing none roll call yes okay that motion carries our next letter agenda's agreement with the southampton police and petty votes this is uh just it's a ring on the state contract prize for the um post machine for the southern police department authority to sign the agreement ferguson second ballroom and gallagher is there any discussion hearing non-roll call yes now motion carries next on our agenda is an agreement with atnt for our south haven police record management you may recall we also approved an agreement with att last year this is an amended agreement with atnt that will redefine the scope of the project for our record management software for the police department it's being entered into each individual city we've talked with atnt and um chris shelton the idea department worked with them to ensure combined compatibility with the software and i think we've got as good as we're going to get it as far as assurances and with the contract as well it's a five-year contract that will be consistent with the other cities and

[0:14:15] allow for record management service and allow and that'll be the next time mlu also allow for greater sharing of information between different police and law enforcement agencies so tonight we just need an authorization to sign the uh agreement her for the mayor or shelton to sign the agreement and um with atnt so we can proceed forward with switching over from uh hexagon to the 18t of that record management service that motion there so we have motion pain second harm in ferguson is there any discussion hearing none roll call yes that motion carries next on our agenda mou with intradex for public safety system data sharing and this is what i just referred to it's the mou with interdecks that allow for us to use our information to share with other entities we'll still own the information but it allows us to share information that's the review for to look at other information also from other law enforcement agencies um regarding crimes and police software police issues that may come up in the field this is the mou is with interdex but it'll be entered into with all the other entities not only in the county but minor champions in the nation to allow for greater efficiencies in reviewing and sharing information when it comes to law enforcement agencies we have a motion baltimore ferguson second ballroom and hail is there any discussion the information we're sharing is in order to be able to help us apprehend criminals that commit crimes in other states or get both it's just something it's going to help

[0:16:17] you know chris would probably explain it better but my understanding is when you pull someone over you'll be able to have more information through other other agencies as opposed to just do ours right now we're just allowed to run locals correct today with the software we we have today in the mobile cop software that runs the police cars when a police officer runs a query here today of course he gets the driver's license and tag information from around the country but as far as local arrest and report history we only get that from our own county when we move to this new software we'll have the capability then because it's the same software vendor that makes the software that runs in the cars that we're moving to for the rms will then be able to share i know like i think oklahoma state police are one of the ones on there if we stop someone today and one of our officers is dealing with a suspicious person they get to have access to intel that wouldn't normally be available to them and the same thing if they're dealing with someone that we've dealt with here and they make the stop there to be available and it's not just available in the dispatch center but to an officer in the field through his mobile computer is the majority of the cities in the u.s on this using the software are they part of this agreement uh no sir not not majority but it is it is agency spread all around but it's agencies that have this particular vendor for their records management system and it'll be reciprocal they see whatever yes sir okay and you're not giving up the rights they don't have the right to share information that's still all we don't you sell your information to public records and still come to the city so you couldn't you know tulsa oklahoma couldn't share information without consent and it'd still come through the city for public records requests and we still have the capability if we say we're working a high profile case or an ongoing investigation we we have the availability to lock that information so it's not shared thank you is there any other discussion hearing none roll call

[0:18:22] yes okay that motion carries thank you chris all right next on our agenda is a resolution for setting court days in municipal court just pursuing our ordinance uh we need to pass this resolution to accept the court day since we've added the holiday court so we'll have court on monday wednesdays and fridays and this resolution just allows for that to be set by the governing department of the city mr mayor let me adopt the resolution of mayor board of baltimore the city of south haven amending today is a municipal court second we have a motion for brooks second baltimore flores is there any discussion yes okay that motion carries next on our agenda is the sole source for our south american police department this is a sole source of southampton police department for um with a megat and it is for a simulator for police training the one we're having now is not operational it's owned or in conjunction with the post office and it can't no one will get it working right so we're requesting tonight to authorize the purchase of a sole source to be in conjunction with our software and they provide the salesforce letter for this police simulator equipment and service reception we have a motion gallagher second bottom in ferguson is there any discussion just so the board knows this is a fats machine that's uh replacing its final arms training machines why they call it pass if you get a chance when they get this one working do yourself a favor go watch

[0:22:29] audience that would like to comment about any of the properties on the list hearing or seeing none roll call yes yes okay that motion carries next on our agenda's bank depository to authorize advertisement and bid for the bank that holds city funds on their board every two years per state law we have to bid out our banking services and this is seeking authorization to do just that this will carry us through january 2017 to january 2019. i'll make that motion second so we'll we'll vote on this by the end of the year is that correct yeah we'll bring a recommendation back thank you any other discussion hearing none all in favor say aye aye all opposed say no eyes have it motion carries next on our agenda is the siemens annual savings report mayor board you will recall that in 2012 the city can previously contract with siemens to do a energy savings performance program for the city in the city facilities county schools in the county the cbb also participated as many cities the program was authorized under state statutes and was run by the mississippi development authority in 2012 the city issued one after bid for financing this project for 2.5 million dollars to buy

[0:24:32] all the new lights do new hvac and upgrade the city's energy systems each year they send us their annual check on the savings and just brief update but also to seek to authorize the mayor to sign the document send it back to seem as giving the cities their acknowledgement of the report uh for year two siemens is reporting the average actual savings for the year over 230 000 seven forty one um last year year one was two hundred twenty four thousand four fifty eight and um so and those both are roughly forty thousand more in savings than their contract guaranteed so basically we're looking at their contract guaranteed 3.4 million savings over a 15-year period and we're ahead of that right now and of course the details are in on their uh their data how they their um how they analyze and their baseline all the savings are based on the baseline that they did back in 2012 2013 uh on the greenhouse gases and everything else and from propane to the likes of hvac and those savings are based off that baseline so that's their metric so you need to make a motion for ferguson is there any discussion i will let uh the city know that in the mayor's office when i'm talking on the phone or at my computer and i'm really really still i do my part to save the city money sitting in the dark so thank you siemens yeah bradley's here for any questions about the operational side of it and uh as is mr shelton uh it's been as you know when you go back to the executive session we've all heard the comments about the temperature and

[0:26:34] everything but savings are there um yes based on the baseline uh that they proposed but um it's a little thanks but it's with the water usage and it's of course the hvac upgrades were needed okay any other discussion here you know i don't ever say i i'll oppose say no i just have it motion carries okay next on agenda's resolution to clean private property mr mayor as we adopt the resolution granting authority to clean private property as presented on this state second we have a motion monitoring brooks second bonnerman kelly is there any discussion among the board hearing none is there anyone in the audience that would like to speak regarding any of the properties hearing or saying no roll call yes yes yes no motion carries all right next on our agenda is our planning agenda miss whitney cook i guess our first application we have a request for conditional use permit for a hair braiding facility and boutique it's 1793 and 1799 main street for location you're going to be on the south side of state line road just east of 51 at an existing retail facility for our additional use requirements um this type of facility cannot be located within a half mile of an existing one we did do a windows survey to determine the distance compliance closest one being sweden given road a newly approved one established at goodman road just east of airways both obviously outside the half mile radius rule that being said the conditional use request was

[0:28:36] recommended for a one year permit with a four-year extension mr mayor i proved that we made the motion that we've provided number one as you've been sending on this night second on item one we have a motion bottom and kelly second volume in pain is there any discussion this is just strictly for hair braiding and and accessories not any type of beauty salon type we did explain to the um the applicant and the different types of uses that could be classified and what they have to compete with uh hair braiding competes strictly with that so we made sure that they understood that's the only type of service that could be there and that they could sell products um so at that point if they want to extend that into something else they'll have to come back and amend the conditional use is there any other discussion on item one yes okay motion carries online item number two we have a conditionally used permit request for 8625 highway 51 north uh for uh indoor recreational facility uh for location purposes you're going to be on the um it's actually where the old victor victory church is it's in the basement and that's going to be on the southwest corner of mississippi valley and highway 51. um they require requesting to do what's called an escape room venue we've had one come through before it's defined as a physical adventure game where players are locked in a room and have the use of elements in the room to solve a series of puzzles and escape within a set time limit is it located as we said in the existing retail facility it does have shared access and parking the hours of operation were some concern

[0:30:38] and they submitted thursday three to ten friday three to twelve saturday um 8 30 to 12 a.m for the applicant's business plan the menu will donate 10 percent of the proceeds to a non-profit organization we felt like the traffic circulation was fine there was no alcohol permit requested for it so it will be a non-um drinking facility obviously they've become really popular in this area stapley's location is well suited for this type of development sees the venue as a positive for the residents in the community around there that being said staff and the planning commission voted for a one-year conditional use permit and a four-year extension to be renewed annually we have a motion by alderman hale a second bottom and kelly is there any discussion so you said that's the basement of the like the old cowboy corner you probably don't remember that i don't remember that but i have heard city hall used to be there at one point in time it is the victory church now and if you go to the side you'll see a door and entrance to um below um the natural crate it goes down to the basement area so that's this the only other question i had they may not be in control of it but that parking lot is some pretty bad shape behind this building we've uh the back of it has had some some big issues that property management company were very familiar with um and they're actually in our proceedings across the street as we speak so we will be addressing the rear of the building they've been doing a lot of work on the building itself and that so i don't just didn't want to take away from what they're trying to do over there sure any other discussion i'm on them too hearing nothing roll call yes yes okay that motion carries all right next on our agendas an update

[0:32:40] from me on our mayor's report i want to tell you a little bit about small business saturday read the proclamation whereas the government of south haven mississippi celebrates our local small businesses and the contributions they make to our local economy and community according to the united states small business administration there are currently 28.8 million small businesses in the united states they represent more than 99.7 percent of all businesses with employees in the united states and are responsible for 63 percent of net jobs created over the past 20 years and whereas small businesses employ over 49 percent of all businesses with employees in the united states and whereas 89 percent of consumers in the united states agree that small businesses contribute positively to the local community by supplying jobs and generating tax revenue and whereas 87 percent of consumers in the united states agree that small businesses are critical to the overall economic health of the united states and whereas 93 percent of consumers in the united states agree that it's important for people to support the small businesses that they value in their community whereas south haven mississippi supports our local businesses that create jobs boost our local economy and preserve our neighborhoods and whereas advocacy groups as well as public and private organizations across the country have endorsed a saturday after thanksgiving a small business saturday now therefore i darren muscle white by the authority vested in me as mayor of the city of south haven mississippi hereby proclaim saturday november 26 2016 as small business saturday and urge the residents of our community and communities across the country to support small businesses and merchants on small business saturday and throughout the year a couple other updates don't everyone jump up and scream but goodman and get well will be done tomorrow if it's not already done they're trying to wrap up today and uh if not today uh it will be done

[0:34:44] by tomorrow if y'all want to hang me uh i think there's a big tree in the back yeah i'm going to get the news ready i'll meet you out there after the meeting tonight but anyway that's a much needed project just fyi for everyone that's here i've done my best to try to clarify this but sometimes facts don't circulate as quick as other other pieces of information but um this project although it's been painful will be big for us the main thing there well first of all let me tell you this they're not taking out the right turn lane okay all the things that you've read on social media they're not taking out the right turn lane all they're doing is taking out the island so now your vehicle will face up square up to the intersection which prevents drivers from having to look back at traffic which is we all know causes rearing collisions so this intersection design has been used throughout the state it's proven to uh to reduce the number of accidents so that's the purpose in doing that but the other big key is that it's going to add two left-hand turn lanes so as you all know or a lot of people know that's the hang-up a lot of times is people trying to turn the left so we had one left turn lane there before now we will have two we believe that that will help tremendously with the traffic flow at goodman and get well so all the pain that we've endured it's going to be much better and it if it's not done tonight it will be done tomorrow big news for our city this week y'all heard us talk about tennis expansion uh the tennis expansion project is part of our much larger park enhancement and expansion plan we have already started construction on eight additional courts that are at the current south haven tennis center uh due to the pine tower alley extension that'll now be a part of snowdrop park so it'll be the snowden grove tennis complex we're having a ground record ceremony tomorrow at four o'clock out there on the existing tennis courts

[0:36:48] expecting a large turnout of tennis officials from united states tennis association and officials throughout the state of mississippi as well as world ranked uh pro tennis player john isner so it'll be a big event for the city to encourage you to come out there and witness uh history of the first but it'll be the this will be the first official tennis program that the city has ever had even though we've had four courts now we'll go to 12 and we will have a formal tennis tennis program but four o'clock tomorrow snow to grow some of you may have noticed that uh the city entrance signs that we talked about many times have been installed seven of them are up now we're not done we've still got i believe eight of the locations that should be done by the week after thanksgiving so if you haven't noticed that you need to get out of the city every now and then and come back in and check out the signs as you come back in christmas banners i'd like to thank alderman payne for his suggestion in a in a recent uh meeting uh to bring back some christmas banners you know the city's had that before uh and uh so those were born and had to be retired but uh we had now with the help of uh with our planning director whitney cook we we've uh got some new banners on order so we hope to have those installed this christmas at uh on main street and then at key shopping locations on along the airways corridor near tanger and on the other the other retail centers that we have i told you last meeting about the bike and pedestrian lane project that the city has started i'm happy to inform you that the striping of that area that will go through clearington and greenbrier parkway and eventually tying into central park the striping will start this week so late this week we'll already have crews out there striking the bike rings other good news

[0:38:52] the rasco road extension project that we talked about extensively that is also underway i was out there today just uh watching just to check and see mr dan cordell told me they were starting but they are full-fledged in operation working on the rasco road extension as we speak so that's big news for us too okay i think that's all that i have uh tonight so next on our agenda is our citizens agenda and we actually did not have anyone that registered to uh to sign up for the agenda for this week is there anyone in the audience that wanted to speak with board approval okay and so we'll move on next on our agenda is our personnel docket mr mayor i believe we approve the personnel documents presented on this date second we have emotional brooks second by all arm and hail is there any discussion yes okay and that motion carries next on our agenda is our city attorney's legal update so two quick items that came up like yesterday today um first one is authorization to the mayor to sign uh the grant application for the south dakota police department for the du dui grant this is the ongoing grant the city gets uh annually basically and allows just official mayor to sign so we can get the proceeds from the grants of 303 488 dollars and 90 cents that will pay for salaries over time for the u5 officers so moved second we have a motion by alderman ferguson
