[0:00:03] welcome everyone i'm not calling this meeting to order please stand with us i will be led in prayer for baltimore gallagher please remain standing uh for the pledge of allegiance led to alderman payne and before we do both i like to have a moment of silence we lost a good friend recently josh bearden was the was a contractor for the city that blc that maintained the grounds and manicured right-of-ways for the city he's a southaven a guy you lived his whole life here and a good friend to a lot of the people i know that work for the city including myself and we just like to have a moment of silence you know in remembrance of josh heavenly father lord we come before you once again to ask for your wisdom and our meetings lord we ask you to watch over the residents of our city lord keep us safe during this independence day holiday lord i want to thank you for the miracle that you performed last week at mmo with steve lord we thank you that uh you set that situation up lord and that you saved steve from certain death lord we just thank you and give you praise for that your name we pray i pledge allegiance to the flag of the united states of america and to the republic for which it stands one nation under god indivisible with liberty and justice for all first on the agenda this evening is approval of minutes

[0:02:04] for the june 18 2019 meeting mr mayor move we approve the minutes of the regular meeting of june 18 2019 with any additions deletions or corrections second we have a motion modern painting second brooks is there any discussion hearing none roll call yes yes that motion carries next on the agenda is resolution for sanitation assessment mr nick manley this resolution just authorizes the sanitation assessment for those that have been paid under 21-19-1 destroying the 19-2 authorizes replaces the lien or as a tag expense some move second we have a motion baltimore brooks second ballroom at gallagher is there a discussion among the report hearing none is there anyone in the audience that has a financial interest in any of the properties it would like to speak here you are seeing none wrong yes yes yes yes yes that motion carries next on the agenda is a resolution to amend ordinance title 10 chapter 1 section 10 through 7. this ordinance was discussed in the last meeting about requiring those lots are 10 acres or more to mow the earth to maintain and maintain the 200 acres between 200 yards perimeter around the property it'll amend the current ordinance that required the entire eight entire ten acres or more for those properties so just amends that to allow for um the reality that only 200 feet 200 yards can

[0:04:08] be maintained with those 10 acre parcels and it'll go into effect 30 days from passage uh mr mermaid we adopt the resolution mayor board of baltimore city of south haven to amend the city of southend quota of the code ordinances title 10 chapter 1 section 10-7 as presented second we have a motion of alderman brooks second ballroom in pain is there any discussion hearing none roll call yes next on the agenda is also the ordinance that i brought up to the board at the last meeting regarding some of the public disturbances that we've had with rental occupancies at some of the events center and also in residential neighborhoods so this is the resolution adding the ordinance for authority of the city to revoke a certificate of occupancy according to what's specified there which is generally two incidents where there's violations of the occupant occupancy code in a two-year period mr mayor i'll make that much second we have a motion ball around pain second volume and hoots is there any discussion next on our agenda is the recommendation by our police department for a record rotation removal captain mark little if you please come forward captain a little if you will just

[0:06:13] greet the board on the issue please sir after we learned in 2017 that mr eddie spencer gossett eddie stewart gossett and taffy gossip were all indicted by soto county grand jury chief pearl at the time asked me to keep up with it and keep you posted on the outcome of all the cases what we found was that the eddie eddie stewart gossip which is a we call it eddie senior and taffy guys both played for those uh charges of tax evasion counts one and two of the indictment were remanded to the file eddie spencer guy said who we refer to as eddie junior pled to a non-adjudication sentence uh on november 30th and 17. and so his was not a conviction so to speak so we just maintained that he had a probationary period if he effectively went through the probation without any other issues this would drop off his record we later learned in february of 2019 that he was indicted again in 17th district circuit court on the charge of investment by the state and mississippi tax commission and he pled to both the previous charge from 2017 and the new charge on 19 on june 12 of this year so therefore all three of them that are listed on the license and the business license here are all convicted felons and by the wording on our policy record it distinctly says that no owners managers nor drivers shall be allowed to participate on record rotation lists if they have been convicted of a felony okay i appreciate that if you would stay with me would you step over to your left we do have a request and i don't know if it's senior or junior but we have a

[0:08:15] request for the citizens agenda for any gossip with gossip record service will you please come forward you represent yeah yes sir i represent the llc okay um gossip body shop and record service llc and i'd like to speak on behalf of the llc yes sir um eddie spencer gossett was not convicted until june 12th he surrendered his managing membership interest in the llc prior to june 12th on june 8th the llc is the owner under the policy the amendment to the policy of 2-5 19 to this year to page six section six sub-section f clearly states that it's owned by the individual's partnership or the parent corporation the legal entity llc is the legal entity mr god said since he's been convicted has not been involved managing driving and is no longer even part of the ownership interest so he's not in violation of the policy the llc is not a violation of the policy the sole member is misty austin can you have documentation to show that in case the board wants you to see i'm certain i think it'll be a hard sell because of the many years that the gossip family has been in business i think it's going to be a hard sell to say that the gossips are not involved in this business operation but anyway information i'm not representing with regard to the body shop i'm representing with regards to the record services foreign at this time

[0:10:27] just open up the floor for discussion somebody make a motion please to discuss you know i've got emotional gallagher the second bargain kelly uh i'll bear say uh any opposed say no eyes have it emoji carry so we'll open this up for board discussion to ask questions i'm just curious how long misty's been on the llc the operating agreement is may 8 2018. i think it's got our signature on the operating agreement in may 2010 the data formation of the llc so um and just to clarify are you telling us tonight that the three persons named uh with the felonies are not managers they're not managers any they have anything to do with the record service the member manager is mystic awesome and she's the owner operator she is the owner of the llc limited liability corporation correct when is the last time that any of the three served in any of those three capacities

[0:12:29] uh it would have been june 8th when uh this year spencer surrendered his membership interest and i don't look at matters to the board but i mean that definitely shows that it was a strategic move to not violate the policy if they were performing in any of these roles as late as june of this year and they were convicted on june 12. i mean it's i think it's pretty apparent that they have been actively involved in the record service i think certainly nowhere until june 8th yeah at least eddie spencer guys they don't want to violate the policy so be surrendered to membership and has not been involved managing the same thing would happen if you had a driver is convicted of a felony you let them go and you take them off the company that's happened i believe to other companies thank you any discussion among the board i'd like to hear what you um say what's your fault i i just got the operating agreement i mean based on um what uh mr godzill's attorney's attorney which attorney's saying it would on the technical legal technical side there would be no interest there would be no ownership interest by um baby spencer gossip on baseline withdrawal um as of june 8 2018 the way this is written there was a 50 share member i'm just reading this as i go something there's a 50 share membership i'm assuming he revoked his interest in pursuant to the operating agreement what was that section transfer of ownership yeah it's my understanding an llc is basically almost the same thing as a sole ownership except you you create a limited liability it's different from a corporation so any any notes any bills anything like that are still going to be

[0:14:32] in either like if if they took out a loan with the loan being gossip it'd be an llc or would it be in whoever's name took out the loan it'd be an llc name i mean i don't want to speak for that but the usual way that works is if i have an llc llc is not nick million's name it'd be in mainly llc name and that's basically done and not to get to a law class that's done to protect the individual um from liability yes as far as taxes and everything else you're still filing as a you're not filing it as an llc necessary according to our policy captain little how would we know um mr guilders indicated that uh that the three persons are no longer in any of these capacities as designated by our policy how do we know that they wouldn't be tomorrow i mean we know the llc won't change there would be a documentation to change the llc however how would we know someone who has spent their a large portion of their career in the record business how would we know that they're not driving a record tomorrow you know we wouldn't unless they showed up on the scene um i don't know if it means anything but when you have the city of south haven tax license it's under eddie gossett junior's name and gossip record service and not an llc that's how they're listed as a business with us okay so llc is not on our record no sir well not to my knowledge because this is the way the privilege patch is and also i don't know if this makes her a new owner so to speak but under our same policy the new owner has to be in business for two years before they can get on the list okay but well if it's an llc as opposed to can we flip forward to the business permit an llc would have been a bit just just so we can get on the same page your point llc would have been in business for two years so

[0:16:34] there would be a continuation of the llc um for two years i'm not i'm not saying that i'm just saying that that that part of the policy i don't know when it was yeah that would be made up but since we're talking about entities there is a difference in entities who is the entity that's on the record rotation uh that i don't have that there's a business permit can we see the business permit can we flip four cameras yes sir towards the very back probably last two or three pages okay on the business permit it indicates gossip's wrecker service it does not indicate the llc okay so as of now gosset's record service is the um is the entity that is on a record rotation so it's not the llc are those i think it's i think it's clear that that's just a move to uh you know to not violate the record policy but i think it's a clear implied incent of our policy that we do not want someone on the rotation that's convicted of a felony that's why it's written and the other thing that's important to note and correct me i'm not the attorney here nick correct me if i say something out of turn but the record rotation is not a city ordinance that's something that is a policy that our police chief

[0:18:39] created but there's nothing in the law that dictates that the city must have a record rotation like our city could have one record service and contact them every time there there's nothing that it's a privilege is what i'm saying it's a privilege to be on the record rotation it's not a it's not a legal obligation it's not something that uh that is an ordinance um so it was created just to um again correct me if i speak out a term but to involve all of our local businesses that's why you have a rotation is to bring our businesses in let them you know share the needs of the city with erector service but there's no legal obligation there's no there's no ordinance that requires anybody to be on this and so my point and again it's not my cause a board's call but my point is that you have three convicted felons they're obviously they're they're doing what's smart they have their attorney here i have no reason to doubt what he's saying is correct from a legal perspective they formed an llc or made changes to the llc but the bottom line doesn't indicate llc is gauss's record service which would include all and i think it's a pretty tough argument to make for mr gilder or mr gossett to say that the gossips have not been involved in any three of those capacities that are in our in our handbook they've been a driver they've been a manager um so it's my opinion that they violated the policy so we're basically just voting to either to accept your vote the recommendation by your police department is to remove them from the records what they want us to do because it's their option and they're calling to make the well the police is asking the board they're asking you tonight they're making a recommendation to you to remove uh this uh entity from the uh representation if i may respond yes sir uh the policy requires the board to approve a suspension under the policy so it would be a board decision there's a separate business license for the body shop part of the business but they're both owned by the llc

[0:20:42] and when there's a call made out on the record call list there's a call someone has to answer the call and has to be there within 20 minutes you can identify who's on the phone whether it's eddie eddie senior or tactic gossip you can also identify who shows up so it would be easy to check whether anybody is actually functioning those capacities if i'm wrong about the record rotation well i mean i've known i've known them for a long time i'd probably recognize their voice not sure every time i would obviously i would recognize if they showed up as a driver and one other question too mr giller is um so the only who's is there just a sole member of the llc now is that misty yes okay is misty here misty's not here all right who is here uh eddie why is eddie here if he's no longer representing llc uh misty is at the doctor with their child so he's obviously involved or he wouldn't be here he intended to be here he's actually the one that's charged with the criminal violation and was served with right but he's serving representing the llc why is he here he's here to speak on his his own behalf and i'm here to speak for him okay i just think it shows that he's obviously still involved in the business for me personally it has nothing to do with when the llc got changed over when was the crime committed when he was still involved that's a good point too that's my point yeah the policy clearly says they're convicted of a felony but he was convicted of a felony which occurred at a previous date when he was involved but yeah but just to be consistent with your policy you would you couldn't if the police couldn't do anything until the actual conviction would have happened so that's it yes you're saying there's not a violation until there's a conviction yeah there's no violation until there is a conviction yeah that makes sense i don't want me that the police didn't know they just they couldn't bring anything to you until there was a conviction so domestic governor's point mr little it's there's been no violation until there is a conviction well i mean it's clearly and i don't mean any disrespect to anybody i

[0:22:43] appreciate you coming forward and uh and obviously it's a tactical move it's a smart move uh but i think it's pretty clear i think everybody in this room knows that that um eddie senior and eddie jr have been involved in the record business and i think it's a violation of policy but i'll shut up i'm done talking is there any other discussion among the board nick do you have any kind of recommendation i don't know i mean the wrong way the police make a recommendation i mean to answer your question the llc that sits right now is owned by the member who is not there's no telling as the owner of the llc the member right now so the policy violation would have occurred before or after attracting my dates i don't have all the dates on this but policy violation wouldn't have occurred until there was a conviction or a plea of a plea deal if you will so uh but still going backwards there i mean we can act until there was a conviction but since there was a conviction technically they were operating out of context well there after the conviction there was been the membership changed to the mayor's point where there was no uh it was just the llc number dropped off one state on one dropped off so there would have been at that point once they dropped off there would have been no owner of the policy of the llc who technically was uh convicted of any felony the question becomes to mr mark's point to mr fielder and the mayor's point i think other people's point of are they operating or running it and that's i can't i don't know i can't answer that well that's that's the question i would continue to ask like i mentioned about the driver how do we know because you're not listed as an llc member does not there's no that doesn't prove that you're not a manager of the company with it being his wife i mean we're

[0:24:46] gonna bring tax records in is he is he enjoying the revenue of the marriage i mean i mean that's how we're splitting hair let's see you know how do we know that he can see not enjoying the revenue brought home to his household he's married to misty how is he is he not enjoying the revenue from the record service i mean it's hard to say that he's not involved in the record business and how do we know he's not a manager how would how would you prove that he's not a manager or a driver we have reasons in the past he's been a manager or a driver we know that so how would you prove what's changed how would you show that he's not a manager or a driver he's just not involved with the record service but how do we know that uh i'm sure the record service has come up on the list since the date of this this has occurred it would be easy enough to verify who the drivers are they have to meet with the police officer they have to wait for the police officer on the scene before they can take them but a manager is not necessarily on the scene correct the manager would answer the phone call how do we know the exact manager well the police have alleged the violation if they had them on the phone call do you believe do you believe any senior or junior is a manager yes sir okay have they been on a phone call since june i don't twelve i don't make those calls mr gillard what i'm saying is you know i drive by there every day when i come to work i come in that way i know there's two businesses there i've seen is up to earlier this week eddie junior standing outside you know who's dealing with the people who come in and pay for the rare fees and pick their cars up i don't know that because i'm not there either i have to think that they will probably be involved nick was the mayor right in saying that this record rotation exists at the will and pleasure of the board yeah there's nothing that requires you to have a rotation it's just a uh it's a pilot it's a thing that it was done i think a couple years ago just to have something in writing from the police department that would provide some guidance but there's no i'm not aware of any statute

[0:26:48] or ag opinion or anything that requires a record rotation i think it's just something that's been done from the standpoint of providing certain requirements and licenses that had to be met just their minds comparing apples to apples went through the list but there's nothing that requires it it's kind of at the okay and i don't see the whim of the board it's the will and pleasure of the board from the mayor's first point earlier it is the board's call on how it works at ultimately now the police make recommendations but the board is the one who actually makes the call i don't guess there's any kind of probation or anything like that we could have to monitor anything or anything it is important to note that in 2014 the police chief at that time zoo 14 15 y'all correct me please uh the gossips were suspended from the rotation in the past for for not for uh driving a record without insurance which is another violation so that's important to note that this is not the first time that our police has recommended their removal the police recommended a one-year suspension and we changed it to two months mr mayor i made the motion to approve the recommendation by the police department to remove gossip from the record rotation okay we have a motion by arm and kelly is our second second no second ballroom gallagher any more discussion hearing none roll call yes no yes that motion carries thank you and we did have uh is there any other comments we did have you on the citizens agenda there any other any other comments that you or your client would like to make i'll be done at this time okay thank you sir

[0:28:50] okay next on the agenda uh is a resolution to claim private property it's america without the resolution training apart and playing private properties second we have a motion volume brook second ballroom in pain is there any discussion among the board hearing none is there any discussion from anyone that has a financial interest in any of the properties hearing or seeing none rojo yes yes okay that motion carries next on the agenda is our planning agenda that's whitney cook uh yes sir for our first item we have a subdivision application approval for the brambles section h this is going to be on the east side of getwell road north college road this section contains 18 lots approximately 7.38 acres lots ranging in size from 12 little over 12 000 to right at 17 000 square feet this will have a single point of access on the college road um so this will put up with the only soul access on college road uh carries into existing sections uh the middle of the heated square footage was it set at 2000 however the house plans are shown anywhere uh 2107 and above um they have a 50-foot right-of-way throughout the roads except for the entrance where there's a median design to match the ones on get well and um the only thing that the planning commission requested is there's an old historical smokestack on property if you've ever driven down a college where you can see it stands right up they didn't want to see that torn down so they asked for them to utilize that brick as part of the entrance sign for the college road portion that was agreed upon everything else is compliant with bulk regulations for the pud and the ordinance and we recommended virgil mr mayor i'll make a recommendation we approve item number one on the planning agenda united presented a second we have a motion involvement plural second volume and wheeler is there any discussion on item one

[0:30:55] hearing none roll call yes yes yes that motion carries item number two we have a subdivision application for the forced uh single-family residential portion of silo square uh this portion is going to be actually off of tulahama um it will be at the first cove to the north a little portion of it down future may boulevard and extending just past where the cove area is these are what's considered the conservation area of the pud that was approved in 2018 it's 35 lots on 36 acres um you will have a wrap around a conservation area around the coast that has trailways in it that was approved with the pud you also have a portion of the new urban greenway multi-use trail down may boulevard which is a 10-foot wide multi-use trail it was approved with the original pud lots are ranging in size from 15 000 square feet and upwards of half acre and minimum heated square footage was set at 2300 there are stuck outs to the future development areas it is compliant with what the pud was approved as so we're recommending approval there um but no comment is this area cube it's ah it's well i don't i don't have a master plan probably maybe area q if we can get up to okay right there if you look at the first cove going north off of tula home right there um you'll see a little green space that's the portion we're talking about right there you have a detention pond up here then you have the conservation area wrapping it and those are the trails yeah the trails are what you see coming through the conservation area there and they'll interconnect as they go mr mayor make a recommendation let me approve item number two on planning data as presented tonight second on item two we have a motion bottom in flores second ballroom in pain is there any discussion

[0:32:57] and these are front loaded it says that yeah these are the front load the rear loaded ones are in the darker yellow and the orange uh and the gentleman mr grindel was in the audience and he did ask me to give you a quick update on everybody's been waiting on those new buildings going up the three story ones uh that will start construction next week um so you'll see some some activity over there finishing up some chickens and moving right over there so he's just wanted to kind of make you guys aware looks like it's almost done yes it's looking good we've run into a little landscape issues but we're fixing that early next week uh but the plan is f is what are they what's the schedule on the they were wanting to open up they may have to push that back a couple days but our still our buildings are still on the bottom borders and uh wood right above the first floors are still being fabricated now so that's what we've been waiting on for the past few weeks there was no reason for us to put the foundations in before the still is ready this still is probably getting close to being done so they're going to start the foundation next week in hopes that we have the foundations done right at the time the still's ready to erect zach there should be a lot of activity coming next week is there anything else on uh two any other discussion on two hearing none royal call yes how motion carries item number three um per nick's request i'm just making you aware of the fact that we're starting condemnation procedures on the home you see in the pictures there's numerous pictures there we have sent notification to the property owner he did contact me yesterday um and he is requesting it to just put up some windows and some doors and kind of fix it up and dwell back in there i

[0:34:59] informed him that it was in this kind of show by sending the pictures so i have agreed to meet with him on monday with fire marshall and uh building official to see if they will appease his request i seriously doubt that but i didn't inform him that you know either way a timeline had to be put forth to either demolish it or picks it up uh and the hearing was august 6. he's receptive to it uh he's saying he hopes it doesn't have to be torn down but quite frankly it's a home attached to a travel trailer and i don't even know how they're attached but it's it's caving in so the recommendation has already been to condemn it and remove a fire marshal and building official but they are going to go back out and meet and just try to answer his questions but anyways nick just thought it'd be best to like make you aware that we're starting that procedure in case you have any questions okay next on our agenda is our mayor's report i just want to update you on a few things tonight our arena floor project this part part of our parks enhancement and expansion plan is almost completed and just to remind everyone that's the to level the floor that was originally built as a western sports arena so there was a two-tier elevation there now it will be one big arena which will make it more versatile for other things for multiple uses in addition to our volleyball plan so that's almost done next week uh that should be done now our spring fest pavement project which all are also aware of on the same plan that will pave the area where our spring fest barbecue has always been that's uh something we've been excited about um i know that it will make springfest much better to get out of the mud uh that is gonna be bid on august the second so as soon as that's bid obviously they'll be brought back before you to approve the bid then construction will be underway and obviously we will have that completed uh before spring fest at springfest event 2020.

[0:37:03] the snowden grove multi-use trail that we talked about over and over and over we received mpo federal co-op funding for that project and that will add sidewalks all the way through snowden grove park especially excited about the fact that we'll be able to get pedestrians off of snowden lane after the concert is very dangerous so these trails will be you know on sunset loop they'll be down snowden lane uh and then also down uh down uh to the to the uh piontar alley that turns into framing lane towards the tennis center we're excited about that that'll be used by many many people and again it goes uh takes a step forward and helping make our city more pedestrian friendly uh which we've been lacking in that area so that is um is ready to roll in about four weeks they'll be breaking ground out there so i'm going to have that under construction this year too next thing and i i sent everyone send the board members an email with a spreadsheet a lot as i've mentioned to you just so everyone knows some things happen after things happen daily in our city so we set the agenda on friday there's things that happen since then that's why it's not on the agenda but we did sell the getwell property that did close friday we netted uh two and a half million dollars for that that money has been uh received by the city and it will go into uh unassigned like our it's in our unassigned fund balance as we've talked about before we're way above our 12 percent of general fund goal which is important to us for bond ratings and financial stability but we're now i think close to seven million dollars above that um we are going to as we talked about previous meetings uh talk in detail about other things that we may want to do you know with that money needs that the city has but y'all this board has expressed in the past to me and i think you agree with me but i just want to open up discussion i think that

[0:39:06] immediately we should go ahead and fix state line road state line road between interstate 55 east to tulahoma is in horrific condition it's embarrassing for our city we've tried to get federal co-op funding for that in any other state options that are out there but all that funding has already been obligated to other projects so it's not available we could still wait on that but they work in like four year cycles and as you know we can't wait four years to fix the road so it's my recommendation tonight that we add up money out of our fund balance and we go and we immediately start repairing state line road what that would do is like i said it would take care of the portion on the east side uh there's also major problems on the far west end of our city on state line so from highway 301 back to horn lake road that section is mostly two-lane there's a little area that goes three lane in front of north creek subdivision and golf course but most of it's two-lane but it's in bad condition so i think that we should do both segments at the same we have the money to do it it was estimated about 1.7 million mr cornell is going back and tweaking those numbers to make sure that it's accurate but it's my recommendation to you that you will will have it on the next meeting but it's my recommendation to do a budget amendment and roll that money into our street improvement schedule we do not have to bid it again we've already bid to get lehman roberts as our contractor so there's no other bidding that has to be done we just have to put it on the list but it's going to be my recommendation i'd like to hear from you tonight uh if you will agree to do that and um and we'll just do a budget amendment to relevance okay so is that make the motion second okay we have motion and pain we have two seconds by hoots and kelly and uh is there any other discussion look i'm all in favor of it and since we have the excess funds i think it's a great idea we have got to address old dominion right on that road because

[0:41:08] it's accelerated the destruction of that road big time it has the the and that's a great uh thing to bring up the only thing we can probably talk about this in more detail later but the challenge is it's a truck route and how do you how do you monitor who's on it who's not because we have obviously we have old dominions in tennessee but we have many industrial areas that are on the state line airways corridor and they have to use state line road so i don't mind those because of the warehouses but when old dominion turns south onto airways to turn right on the state line to get on the interstate yeah that's an issue but how do we stop i've had discussions with previous police chiefs about that and no one has told me a way that we can enforce that so do you know i don't know can we put a bond on captain little major already another thing to consider is the crux is that a lot of your old dominion employees all eat lunch on state long road that's how they i understand that but the cars aren't destroying the roads well exactly but i don't but again you know i get you don't misunderstand me i get your concern i share it but how do you know which truck is it a truck remote dominion or is it a truck from one of our airways businesses that's destroyed they're both destroying the roads i'm saying they're not but i think you can look back and see the acceleration of the destruction of the roads because there's more yeah more volume there's no doubt you're not i agree with you there's more but i just don't know i mean unless y'all tell me how do you how do you know which truck is coming from i mean obviously you have an old dominion but we can't how do you stop an old dominion truck from being on a state line i don't know how you do that can uh you we upgrade how we put it down there and make it a thicker or to stand heavier weights in that section between airways and interstate well that's something that we already they know it's a truck route so that's

[0:43:09] already taken into account um but yeah we'll we'll ask and see if we can find out if you know of anything share that with me i'll continue discussions on uh with our police department about trucks that will go down state line that are going to the warehouses in south haven get offline and get off on state lines yeah i don't know if there's a way that you can prevent trucks from coming in from the north on the state line if we can find an answer to that then but that's the question yeah what about that i know they've used the times no three traffic you know three trucks you know going they have to they're making the stop they can go down there in that street but if it's they're just you know transient they can well that's when it's not on a truck route no but stateline is a truck driving sector yeah whitney um when old dominion was coming through originally and we started expressing problems with the road being torn up and everything we got in touch with them in touch with the city of memphis and they agreed upon doing a loop route where if they were coming to enter old dominion they had to get up on shelby drive come down airways and enter it that way so they weren't on our roads but exiting it was coming on to our road on to state line road and getting on 55. so they did a loop thing i don't know if they're still agreeing to that and still doing it but we had memphis kind of come up with that type of agreement so we're only going to get 50 of the traffic yeah but there's still no enforcement mechanism obviously i don't know how i mean that was that's the agreed upon route that they put in their reports to get ultimate approved there but how if we can prove they're doing it or not i don't know yeah well we'll keep asking we'll see if we can figure out but no i i i appreciate you bringing that up honorable flores i share your concern and it is a good point alderman payne brings up a good point we with an old dominion opened there yeah i've had business owners that especially restaurants that have told me they've noticed a difference so it does bring some benefit um now whether that benefit outweighs the damage to the road i don't know but but we'll continue to research that you know and try to try to do what we can to enforce that okay is there any other any other
