[0:00:00] welcome everyone i'm now calling this meeting to order please stand with us we'll be led in prayer by alderman gallagher and then please remain standing for pledge of allegiance uh alderman's come first heavenly father lord we thank you for this time of year we thank you for new beginnings lord we thank you for your love to us lord we thank you that you came down and saved us lord we pray that you would be with us and watch over us and give us wisdom in your name we pray amen amen i pledge allegiance to the flag of the united states of america and to the republic for which it stands one nation under god indivisible with liberty and justice thrall first on the agenda this evening is approval of minutes for the january 3rd 2017 meeting mr mayor move we approve the minutes of the regular meeting of january 3rd 2017 with any additions deletions or corrections we have a motion bottom in pain second by alderman hill is there any discussion yes no motion carries the next on our agenda is a resolution for our depository institution mr chris wilson mayor board as you know this was table the last board meeting um we were part by law to bid our repository we received three bids bankplus first tennessee and bankfort south i sent each of you've got the package you had information um first tennessee proposed a variable rate based on the upper end of the fed fund rate which today is 0.75 minus 20 basis points will get us to their proposed rate of 0.55 which is variable depending on the upper range of

[0:02:02] the fed fund and bank plus rate came in at 0.22 so we talked about i know nick contacted the ag i talked to the state auditor about the variable bid it's a valid bid it would meet our needs it's just the amount of variable bid based on the fed fund rate as opposed to a fixed rate chris what's the difference in interest that we'd be looking at actually chris what's the difference in interest that we'd be looking at well initially you talked about .55 to 0.22 so more than double initially now with any increase in the fund rate which essentially documentation analysts believe there could be a potential for two more increases in fed fund rates it's not guaranteed but um you're talking initial rate of 0.55 to 0.22 on the 0.22 do we get paid interest on all of our money yeah that's another thing but first tennessee is your first five million is exempt from interest so you're earning interest on everything above five million whereas in bank plus it's on all the lines but again the difference in the variable rate does exceed that initial five million of interest-free should the right stay the same products right any other discussion don't make that motion kelly any other discussion who are we making the motion for first tennessee i i just want i have a comment if if i may have a floor go ahead sorry i think

[0:04:08] i understand what i understand the upside of it i really do but i think there's not something to be said that that when we have a deposit depository institution that has stepped up to the city in a big way financially and um that for us to leave them at the first chance we get to be a really bad taste in my mouth well i would say that we are required to seek these bits opportunity you know i get it i know by law we have to do it but we established a partnership with them and so now this will be i mean that i mean we you know we had a long-standing relationship prior to us moving to bankplus and they've been great to work with it's been a good relationship but you know from the data that we have available on my end it's that great difference in the potential from what the fed is saying and what they're looking at the data it's i mean it is a very valid rate solderman flores you're suggesting that no i mean the relationship we had with the current carrier to me is more valid than the potential upside because it's potential upside it is upside right now but we're also losing we're losing interest on five million dollars well i don't think i think that um we just follow state law as far as uh lowest and best is that right nick or how do you interpret that no it's the behind i mean yeah the highest in this well in this case would be the the best would be the highest uh interest or revenue under the state law the interest rate has to be the primary consideration or under the ag opinions regardless so you can consider other factors but interest rate must be the primary consideration un under the applicable ag opinions regarding this

[0:06:09] so you have a variable rate right now that's higher than a fixed rate at this at this juncture as chris pointed out i don't know how you uh i don't no one has a crystal ball to determine what happens to an interest over the next year as chris noted all the indications that everything being the same everything nothing crazy happening that rate would continue to increase but there's no way can anybody up here guarantee anybody guarantee that no so you've got a variable rate and a fixed rate at this point all the credit credit wrong the variable rate would produce more money on this day today yes so by law we should take the very worry at this point at this juncture on today's date yes now can anybody tell you 30 days now it's a better rate how much trouble i'm changing over that's not fun i mean it's so much so much revenue you know from the state sends a lot of their revenues electronically we deal a lot of online so um i mean you know we did two years ago something we did two years ago how long the process takes three four months yeah but in this case and again the interesting thing about the timing of this when this bid came in it would have been point 30 because the upper end of the fed fund was 0.5 right so it would have been 0.30 to 22. in that case you're talking about a little bit closer a little bit you know you take in the you know the time resources what we have to do to change but in this case an initial 0.55 to 0.22 it's just well in the indication yeah i mean and i know and again all the data that we were able to get from the fed reserve and everything else talking about the potential for the next two years and again like nick said you're it's a variable rate you know anything can uh often does and will and does happen and there's no no projections there whatsoever there's plenty of projections that show

[0:08:11] it going up multiple times through 2019. but it's still it still rests on the fomc and what they think so that's all i want to do worst case scenario is the rate goes down right but worst case scenario the rate goes down but we're not the city itself is not going to lose any money other than the interest that we're not going to gain well if it goes down below what it is now or the potential for your other bid is when you have to say the loss potential loss minus the bid you got on the table with 0.22 which again there's no indications that it's going down but so does a decision have to be made tonight sounds like we've got a lot more questions and we need to we we have to i mean it's been dead if the events have been submitted we need to move one way or another is it your legal opinion nick that we're forced to accept first tennessee i don't know i don't think you're legally forced except for tennessee um i think no there's no i don't think you're forced to accept them at all i think if you take interest rates i think you could make uh findings either way if a variable rate um and to address auburn flores's concerns you have issues with it it could go down um uh but to augment hell's point you you could have it where it goes continues to go up and the data we have right now that is available to us on this date would suggest that it would continue to increase that we have tonight shows that it is higher but are you legally forced to accept furnace first tennessee i don't think you are i think you can accept a bankplus bid with the understanding being that you're quoting quote mitigating risk of a variable rate it should be so it's it's i mean you know we've looked into it we've talked with the auditor's office

[0:10:13] with ag's office it's it's just kind of the legal answer is you have the discretion but the only risk would be is that if the rates actually go down below what bait pluses it is it's the potential of a loss of potential earnings should the fed lower the rate but again i mean they held it at zero to 25 for the last few years and then it went up 25 to 50. uh then it went to 50 to 75 so they are they're they're the fed is stepping it up in those in those increments with future projections i i i agree with chris that i think the rate's going to go up i do i think the fed is tired of giving my free money but the decision arrests on how much if you want to take on risk you want to be risk averse that's it that's what it comes to because there's risk but generally when we're talking about risk we're talking about risk of losing money we're we're not at the risk of losing money there is that potential yeah it's there it's not a great potential but it's there risk of losing our how are we the investment or risky no this is this is your this is your interest on this interest that we may have we're not gonna yeah right stability is always the key with you're just losing potential revenue yes if you the point if the interest rate of the fed fund interest rate drops to 0.41 then then you would be you give me a one you give up opportunity costs of of 0.1 for interest on that over the bank over the base plus that's so that's that's the risk anything below 0.22 it actually doesn't need to be 0.41 it could be you could drop down to 0.5 because we're not getting interest on 5 million dollars therefore be a different variable on

[0:12:14] that but everything that we were presented is higher than what we're at now so you're still because the rates went up and the banks built that into their bids and the assumption of those rates so bank plus up their rate yeah okay they just didn't do a variable they did it fixed yeah and i think that there's a 0.22 probably it's really any way you look at it because it's a lower rate but it's not more of the money so first tennessee just came in with a higher rate but on 5 million less but their rate over less money still is more than bank pluses rate at all at this point so much so that your your suggestion is to go with first sentences that we have available including the huge headache that it is for you and your department to switch over it's not it's it's andrea looking at me like don't you dare uh i mean it's it's it's all of us yeah i mean but i mean it's it's just it's a business decision i mean it's what the board policy would be we executed i said what i needed to say okay we had just a back up we had a motion by alderman hale and ottoman kelly you made the second is that correct a second honor and kelly is there any other discussion and the motion was to accept first tennessee as the new depository institution okay is there any other discussion hearing none roll call ottoman yes otterman kelly yes carmen hale yes yes okay and that motion carries next on our agenda is our budget amendment chris will handle that for us as well this was um this is in effect bringing committed funds from 16 over to 17.

[0:14:17] if you recall the tail end of fy 16 the police and actually public works were in the process of bidding out for vehicles and the budget year ended the bids came in after that the vehicles and police became available so that's why those funds were already committed at the end of 16 so that money was locked away anyway you did you had to use it once it's committed you had to use it for that purpose for the next year and that's what this budget does i'll make that motion second we have a motion ballroom in florida second ballroom in ferguson is there any discussion hearing none roll call amendment with baptist memorial hospital mr nick manley this lease was previously entered into a fabulous memorial hospital for to use the roof at the hospital for certain police equipment it has since expired um at this current juncture we do not are not utilizing it for much of anything however uh there is at some point possible plans to reutilize this space uh four types of police equipment so tonight uh baptist has sent the lease back to us to review i've made a couple of changes which baptist has been sent to as it relates to the insurance we need to carry and the identification clauses to uh component mississippi law madness has approved and signed it does not just need an authorization for the mayor to sign it as well and it'll be a a one-year-old term which will automatically renew every year unless either party gives the notice uh at the time to cancel the lease second we have a motion bottom and gallagher second ballroom and brooks is there any discussion hearing none all in favor say aye aye

[0:16:21] all posts say no i just have it motion carries all right next on the agenda is a resolution for the surplus of one of our canines this uh is for a police dog uh the name seems weasel and weasel is at the end of his uh term or end of his usefulness as a police dog to be trained it's under state law uh authorizing the surplus of weasel to master sergeant jason scalar and mr stalhartner signed the release uh for the dog as well so the authorization to approve that so moved second we have a motion bottom in florence second baltimore ferguson is there any discussion i'd like to say that um officer weasel served the city of southampton well and he deserves a good retirement and i appreciate the opportunity to give this dog to his panther thank you thank you absolutely well said any other discussion hearing none roll call for surplus and transfer of police vehicles uh this resolutions as the mayor says resolution for the surplus and uh transfer police vehicles to the town of sumner the vehicles have no value to the city anymore as it has no transmission either vehicle um and the storage costs outweighed the or greater than the actual value of the city the town summoner is one to accept the vehicles they understand that they have no transmissions that the vehicles are not operational however they're willing to accept them and take those off our hands to save us the cost and they have signed the contract uh and signed their the acknowledgement of that those facts and their and so it's nice to resolution

[0:18:24] authorizing this uh transfer and for the mayor to sign the talent sumner agreement as well where they acknowledge these items don't want them considering vehicles i might get motion and sold for a dollar sec we have a motion ballerman ferguson second of all brooks is there any discussion hearing none roll call yes and that motion carries next one agenda's uh an appointment for our dakrua representative this is a current appointment it's donnie chambliss he serves 2013 which will be an authorization just to renew that appointment for another four years so moved second we have a motion model in flores second ballroom in pain is there any discussion yes no motion carries okay next on our agenda is a resolution for a sole source purchase with our south haven fire department this resolution was sole source a partial fire department from target solutions it's for the software for the training and the record keeping for our personnel uh chief thornton's here as well i'll give you specific questions but they provide the necessary letter um and the documentation required they're the only people who make this software that confines all these items in one and the observation the sole sources under 31 713 so that me approved and the purchases can be made for that software per individual for the southern fire department

[0:20:33] let's sing it we have emotional arm inhale second bottom and pain is there any discussion hearing none roll call fireman yes kelly yes yes yes no motion carries next on the agenda is a resolution the surplus property in our information technology and emergency communications department this resolution will surplus property pursuant to 17 25 25 of the mississippi code the properties are listed exhibit aids out it's no longer useful to the city or it's outdated and um it'll allow the i.t department to surplus those uh under pursuit mississippi law in the 17-25-25 mr mayor i mean we adopt the resolution mayor border wall in the city of south africa where it serves clutch property in the iit department a second no motion bomberman brooks second baltimore payne is there any discussion any other discussion hearing none roll call yes no motion carries okay next on our agenda is a recommendation for a bid award in our public parks department this as you call a previous meeting we've gone we've got we see called salt authorization go to bid for a 13 yard rear loader garbage truck we received two bids the low bid was from pros truck service and out of 131 130 531 dollars and tonight a new authorization to award

[0:22:36] that bid to cross truck service and talk with bradley and that money was in this year's budget for that vehicle and they are the low bid so authorization to accept the bid and for the mayor and or rally to sign any documentation needed to effectuate the intent and the contracts that may be required for the truck we'll make that motion second motion ballroom and gallagher second of all i'm in pain is there any discussion hearing none roll call yes and that motion carries okay next on agenda is a planning agenda the only item there which would relate that to me was the property in question at 1619 state line that's been discussed at a previous meeting it was discussed at last meeting the requirements have not been made it was a condemned property and the requirements that the property owner agreed to do by december 31st were not done at this point what's going to happen is another letter is going to go out to the property owner providing the proper order to come back to a public board meeting to discuss with you so just uh if you want to see more pictures of the property go look at it 16 19 state line but no action tonight just uh letting you know the letter did go out and we'll invite that person back you know for another hearing uh next on jenna's mayor's report i want to update you as you all know we went to uh mml last week in jackson we met with some of our legislators one of the biggest issues that's going on with the city right now is an extension of the city through parks tax this board passed unanimous resolution asking our

[0:24:38] representation to extend the tax for another three years which is common in the state of mississippi right now we have four legislators that have refused to do that and so at this point what we've been asked to do is put it back on for another referendum so i know that no one sitting up here is against a referendum we always want to hear with the majority of our people and do what the majority of our people want to do however we have some things to be concerned about we met with the local and private chairman mr manley barton and he indicated that last year these four legislators voted no to other tourism taxes throughout the state that had a referendum so exactly what they said they would support we were told that they would support it unanimously if the city had another referendum but after talking to local and private chairman he indicated that there's a lot of resentment in the house of representatives against these four people because they refused to support other tourism taxes that did have a referendum so my concern that i'm sharing with you tonight is even if we have another referendum and it passes we're still relying on these people to vote yes for it so they're having a hard time it's it's become apparent that some maybe are not being forthcoming when they said that they would support the tax again if it had another referendum but as proven by house bill 1507 looking up brandon last year steve hopkins ashley henley dana criswell and dan eubanks all voted no and that was with a representative so my question to you is how do we know they're going to support ours if they not support any of the others and i can tell you after talking to manly barton he has serious concerns about how they will vote so i'm just updating you on that give that some thought we'll talk about that later in another time that's all i have to say another uh nexon agenda is our citizens agenda we had miss kelly cannon signed up is kelly
