[0:00:01] welcome everyone now calling this meeting to order please stand with us i will be led prayer by honorable gallagher please remain standing uh for the pledge of allegiance to be led by alderman scott ferguson heavenly father night lord we thank you for allowing us to meet together tonight lord we pray for wisdom in tonight's meeting lord lord we pray that we would always do your will first lord and not the wills of ourselves or other men these things we ask in jesus name amen amen i pledge allegiance to the flag of the united states of america and to the republic for which it stands one nation under god indivisible with liberty and justice for all first on our agenda this evening is the approval of minutes for the april 4 2017 me mr baraboo we approved the minutes of the regular meeting of april 4th 2017 with any additions deletions or corrections second we have a motion balancing second bargain kelly is there any discussion hearing none roll call yes kelly yes alderman hill yes yes yes okay and that motion carries we added something to our agenda tonight um chief pirtle is going to come forward we have several officers that just finished their uh training at the academy and we're very proud of him he's going to tell you about some great accomplishments that they you know that they achieved while at the academy so i'll now turn over to chief even the mayor board i have three officers here that we hired a few months ago they've been at the training academy they just graduated april the 6th and i'd like to bring them before you tonight introduce them to you and brag on them just a little bit i'm very proud to have them as members of our

[0:02:04] police department if i could introduce mary fight daniel lebeau and kevin croft uh while in the academy mary was chosen as the female section leader for the cadets there at the academy during training she also scored a 94 in firearms which was an honorable mention she scored 94.06 in academics and then scored a perfect 100 and took first place in the pt and then she was uh number three in a class of 64 with an overall academic score of 95.53 daniel lebeau was chosen as the platoon leader for the for the the class he was also chosen as class president uh and delivered the uh the class speech at the graduation uh he too scored a 94 in firearms which was again an honorable honorable mention he scored 85.50 in academics scored uh 99.6 and pt and took first place basically a couple of different individual portions of the pt and he had an overall academic score of 91.25 and then kevin croft he also scored a 94 in firearms which is an honorable mention again he scored 86.56 in academics and it scored a 93.16 in pt uh his overall score was a 90.18 so again uh very proud of their achievements in the academy i'm very proud that we have them on board and uh from uh

[0:04:09] what they did in academy it appears that they're they're definitely gonna be assets to our department should be shining stars thank you [Applause] outstanding congratulations we're proud to have you on our team all right next on our agenda this evening uh the budget amendment is something that we'll uh we're not going to discuss tonight there's a few more details that need to be worked out before we uh do that we'll try to do that at the uh the next meeting we'll move past that next on the agenda is a court work program mr nick manley this is the uh as you know the courts under our ordinance have the authority and there is a work program set up our work authorization program set up for certain instances when it may be necessary as opposed to paying a fine it allows for defendants to plead guilty and enter into a work program this work program tonight is being proposed i'm sorry as a supplement to the ordinance that'll be used by the courts for certain individuals or defendants who may be deemed or maybe appropriate for the work program by the uh the miss before judges um it's already establishing the ordinance the judges uh were wanting to have it on our minutes as well um so tonight i've made a couple revisions to it it'll also be released as i'll be that will be signed before anyone can enter into the program or do the program we're currently doing the program now but this will also amend the program a little bit and provide opportunities to work in certain departments which may help the city save money with with labor uh for community service that being said

[0:06:12] it'll be up to the department head discretion and they'll work with the courts in those instances but tonight just need authorization or approval in the minutes as noted as in the ordinance but this was just supplemented from the standpoint of the court from a practical standpoint as well i'll certainly make that an emotion second we have a motion bomber in ferguson second alderman brooks is there any discussion hearing none roll call autumn yes okay and then motion carries right next on the agenda is the resolution authorizing the mayor to execute and sign all documents regarding church road resurfacing mpo project mr whitney cook uh yes sir we actually um activated this project september 1st of 2015 went through preliminary design on it it is scheduled the overlay which is 51 to 55 on church road we'll do an overlay program for the mvo which is the 80 20 split um we're in the design and construction documents now and we just got the contract back we have to send that back to mdot for their concurrence on that one of the things they said they needed was us to reward our resolution where we gave the mayor permission to activate the project we need to add in the stipulations that he is authorized to sign any and all documentation associated with this project so what we're basically doing is amending that resolution uh in player i'm not amending it we're replacing it with the resolution you have uh in your hands now which authorizes there to sign any and all the documents so we can move forward [Music] we have a motion ballroom in florida second album and hail is there any discussion as everyone knows this is long overdue

[0:08:15] the condition of the church road between 55-51 it's horrendous now we've been uh looking for ways to move this up the list for the last three years and uh it'll be money well spent that's obviously a high traffic area for our city uh there is a lot of truck traffic there as well which has damaged the street so we're very proud that we're getting uh close to you know being under construction correct that problem any other discussion fairy nun roll call yes yes yes under that same project we now want to award a small purchase selection of civil link to do the ce and i on the church resurfacing they did our design work they're doing the construction documents for us when the construction starts we'll need engineering and inspections on site which is the second phase of it and so we are requesting tonight to use sibling and carry them over under small purchase to do that phase of it second motion made baltimore ferguson yes emotionally bonderman ferguson second volume in pain is there any discussion hearing none roll call yes spiderman kelly yes yes yes okay that motion carries next on our agenda's resolution to clean private property mr mary i'm going to adopt the resolution of granting authority to clean private property as presented on this stage we have a motion balance brooke second and kelly is there a discussion among the board hearing now is there any discussion from anyone that in the audience that has an interest in the properties

[0:10:20] hearing or seeing none roll call yes kelly yes yes okay and that motion carries next on our agenda is mayor's report just want to update you about a few events happening in our city obviously y'all know it's that time of year for south haven spring fest we'll be celebrating the anniversary of our incorporation as a city um 37 years of south haven the concerts uh there's better than ezra we'll be playing on friday night craig morgan's on saturday night and then the other uh same same type dual cooking contest that we had last year with kcbs and the memphis bbq network so we'll have a dual competition um and basically everything else is the same i'd like to thank christy faulkner again for all her work in getting springfest ready she does a great job it's just it's easy for her she just gets it done right it's not easy she works very very hard but anyway i appreciate all that christy does also we have um we have an arbor day celebration on april 25th at the snowden house um at 2 p.m that's just good moves excuse me they just changed that today you forgive me it's going to be monday the 24th okay 3 p.m okay monday the 24th at 3 p.m for that okay now one more event the desoto county beautiful event the 2017 spring cleanup is going to be between april 29 and may 6. the dumpster locations are conveniently located right lauder the desoto county environmental services will be directing that project and then lastly desoto county earth day is april 22nd at the courthouse in hernando that's from 9 a.m to 1 p.m and that's all i have this evening next on our agenda is our citizens agenda

[0:12:22] actually we had one person that signed up uh his questions have been answered already so he um is indicated that he will not be here tonight and uh no longer has a need to speak um next on our journalism personnel docket mr airmen we approve the personnel documents presented on the state second we have a motion by alderman payne second volume and excuse me motion bomber and brooks second baltimore pain any discussion [Music] yes okay that motion carries next on our agenda is our city attorney's legal update a couple of quick items uh the first is just to authorize the mayor to sign agreement with wildcats cheer to assist with the vending services at the south haven springfest they've done it in the in the past since we're just putting the token to a contractual form um for payment to them for those services we have a motion ballroom pain section of alderman gallagher is there any discussion hearing none all in favor say aye aye any opposed say no eyes have it motion cares uh next item is the uh we have on the sanitation fee there was a couple of addresses or a couple of landlords who owned property in the city um and as part of the sanitation charge they received the invoice i mean the landlord did not receive the invoices we went to the tenant there's issues with the tenant the landlord's getting notice and so that i've talked to the public works department what it was was there was notice of the um of the act they were receiving the service and there was notice of the bill to the tenant of the landlord who under the law was jointly reliable as jointly liable for that

[0:14:24] sanitation charge was not receiving the notice to pay it and let people accumulating so looking at it it doesn't the request tonight would be to waive the late fees for um 605 tuscany way 856 grant drive 903 tuscany weighs 647 tuscany way 588 hayden hill coke 15 11 a state drive 554 giving no code 526 a milk vg 895 state drive because those they're run by landlords um and like i said they weren't getting the they're getting the service no one was getting the actual bill from the tenant the landlord will start to pay for the actual bill the 12 month charge but there will be a waiver if the board approves of the actual late charges through the fact they weren't aware of the bill to pay in a timely manner so later wouldn't occur i like that question second i do have some questions though we have emotional growth second uh discussion by alderman payne so who does the normally on a rental does the the tenant of the house pay the water bill in the sanitation fee correct i mean usually i guess that address and i'll refer to browser than that but usually it goes to the individual and the ten don't usually pay but under state law it says the landlord is responsible if the tenant doesn't pay it's not south haven's rules state law horrible that requires that okay by any chance for all the there were a lot on like tusk anyway and was just multiple owners that was one owner one owner yes one owner so the one owner had that many tenants that yes wow or he's paying for it he just wasn't getting billed it's stipulated in the rental contract so the notices were off the house and not atlanta tenant not the landlord how do we solve that in the future well now what we're doing now we're talking about bradley is the note when you ever have a late notice it will go to the chancellor clark record and find out

[0:16:25] where it and send it directly to the landlord and find that address instead of just going to the tenant with it these are these were all in the beginning when their kings were even worked out and i think in talking probably it's never going to be a perfect system but i think there's a they've identified a way to start minimizing it are you asking us to wait the late fees just the latest they can't you can't waive the actual charge yeah did we get the actual address situation corrected are the bills now going to the yes yes if they're working on that plan but i mean they're he can set the bill to be sent to wherever they need it to be sent correct it's going yes sir so the landlord the landlord once they became aware now or taking care of is just going to the landlord is in my understanding i know i i get a copy of the bill i either get the original and the tenant gets the copy or they get the original i get a copy so is that correct yeah i don't i can't speak to the link toronto um the issue with these particular addresses and most ones we have this problem with they're in they're not in our water district so we don't know that they're tenants versus landlords until we get to the problem of the billing and we send it to the address that we know and of course these are tenants that didn't meet their responsibilities and are no longer available to pursue so as nick said it goes to the landlord but in the ensuing time the landlord wasn't aware that their tenant was running this bill up because we didn't know the landlord was there so usually what happens is they come in to set up a new service and then we're aware that there's a landlord involved and we notify them and get the information notify them make them aware in these circumstances nick said they weren't allowed the opportunity to know about the late fees so we're asking that they'd be waived and they just pay the bill that they're

[0:18:27] obligated to pay by state law and when we do get the landlords we're keeping a list we're making every effort with the county to find as many as we can when we find them like this we're trying to work with them to help them because we're not trying to punish the landlord we're trying we prefer the tenant to pay if they ran up the bill but when they're not available it falls to the landlord we're trying to work with them to make it as painless as possible i guess you'd say given the laws that what they allow us to do but generally speaking we know the landlords from then on were able to work out with them and they do get notice and everything just like the tenants do like you said there's a deal notice we have to know that they're there first that's that's our problem is when it's outside of our water district we don't know if it's a attendant or a landlord until something happens and then we find out that so we're trying to correct it as we go but it's kept it on the back side and set it on the front and we've had uh bradley and i've had many conversations since we started this yes sir uh it's got we've we've gotten better with the project so it's a very few now we work that now most of these is nick said also they happened earlier on when we first started this we were giving them multiple opportunities we were hoping people would work with us and pay their bills we gave them multiple opportunities we've stopped doing that because it's proven to be a problem with people who just didn't want to pay it so they didn't pay it so now we give them one notice and one opportunity for them to come to a couple of meetings talk to y'all and so forth that kind of thing and then we go straight to the county so the process is shorter the opportunity to when we do catch a landlord like this the notification is shorter now so the bills don't accrue as much as we stop charging as soon as we pick up the card and so forth so the bill doesn't amass quite as large as some of these are because the whole process is a lot more it's just a shorter process now so there's not as much opportunity to build up a bigger bill these are ones that have been going on for over a year more while we were working through the system and figuring out the best way to do it and that's why the bills get larger like that because the fees just keep recruiting uh as they go along so how much are the total late fees

[0:20:31] something like five dollars somewhere sixty dollars i mean it's not we're not talking about a bunch of money it's the majority of the the cost is the uh the actual service the twelve dollar a month charge okay and the reason i did again brother and i discussed is the reason that i was an advocate for bringing before the board to ask for to wait that is i just didn't feel like it's fair if somebody doesn't know i mean i hate to penalize somebody they didn't know about it because then they would have had the opportunity to resolve the issue before they incurred the late fees so just you know in all fairness i just didn't feel like it was fair that they paid the late fee when they didn't know yeah and then i think i agree i think there's a big process issue than not being able to review something that was in being fine so is that's any other discussion carrying on roll call yes conor mckelly yes yes yes yes yes okay now motion carries things and one last item is the the thing we deal with about once or twice a year it's a property you know once we went to assessments on the uh condom didn't lots under 21 1911 some of those assessments are filed and the lien is filed in between a purchase and closing date and while we try to eliminate those as much as possible this is just one at 8265 chesterfield that slipped through the cracks the assessment was the work was done the assessment was filed but in the meantime between that november and february the property sold so uh tonight just authorization to refund the assessment 8265 chesterfield in the amount of 1 356 dollars and the vast majority of that is penalties but like i said they the owner did not have notice of that assessment and the observation to seek the appropriate property for reimbursement to the city i'll make that motion second
