[0:00:06] welcome everyone call this stand [Music] USAG father Lord thank you for the chance to be here yet again Lord I want to pray for uh our friends in the middle e Lord that you would help bring a solution to the conflict that's going over there Lord and that you would uh save the people over there Lord Jesus that uh that are hurting Lord and help them to come to Know You Lord Lord we ask you to bless our meeting tonight and bless our city in your name we pray amen of the United States of America to the indice first on the agenda this evening is the approval of minutes for the April 2nd 2024 meeting moome is there discussion he none roll call pleas that motion carries next on our agenda is an agreement with waste prob for sanitation services Mr C attorney um mayor Bo we discussed at the last meeting with revisions that were requested by the board and was Pro um they did agree to all the revisions so that that the board proposed the first one being that it goes up eight additional onee terms you still have the 9 termination for convenience called for one year though um and the eight additional onee terms after the two initial two-year term um it will be if
[0:02:09] both parties agree so it's essentially you have a two-year contract um with eight oneyear additional options along with 9 termination calls for convenience after one year um the uh there can still petition the board for changes um in the contractor um disposal be up to the board's discretion at that point determ how they want to treat those uh items in the context of the rate um the uh cost will increase by the CPI at a minimum 3% but a maximum 5% um and then like I said they had a nday termination calls as well uh that was agreed to the remainder of the um items in the agreement have been um agreed to and discussed at the last meeting um so tonight we bring this for approval um for the mayor signature Pro so they can begin May one with the uh and then on June I mean May 13 for the recycling we have a motion Flores second wheeler is there any discussion he roll call yes yes yes yes yes that motion carries next on the agenda is a resolution for a sanitation rate adjustment this was we discussed this at a prior meeting as well um we advertised Accord in accordance with the board's request to authorize the resolution to increase rates up to $20 per month that doesn't have to be that was the average over the 3 years is what the $20 is where that number comes from however I think the last time there was some discussion rather not doing it year by year so um tonight we need to make that decision as far as the rates or going implementation sometime next couple weeks that need to
[0:04:11] be pushed out on the facility bill so bringing this tonight to see what is with regard to the rates for the sanitation monthly fee I like that one too moeser discusss says we said up that g me all discretion I think the last time we discussed people to make lower yes so it's up 220 how you want to do lower and then to raise you would have to go through this process a v or if you every time you raise you adver this process I just say that's that's what it's calculated to be based on the threee average what that is again is just it's what the true costs are year one plus the C average it's going to go up it's just doing a threee average and putting that in there so you're not doing this three years you're not going up each year for years you're putting in the amount plus it includes the amount that we pay for our um for our elderly citizen pick up the two trucks that we run in our labor that $20 covers everything that way it just gives you an even three years but if y'all want to do it that way it doesn't matter to me or anybody else the only thing is that you are going to be doing this again next year because it's not if you just do the amount for this year it's that's not going to be enough to cover it for next year you're only talking about do even
[0:06:16] if you did that it's you're going to have you can't do under 19 because that's not going to cover your first year problems so it's either going to be 19 or 20 and so you know again whatever y'all the board do what you want but my suggestion would be it's smoother for the citizens to go ahead and make it keep it keep it the same so we're pretty sure that 20 will cover next years that's the average right the average based on what's in the contract correct but now it's possible in the contract isn't it if inflation was exceeded that it could be high is that correct or not uh the inflation is is cap by% in their contract so it's a minimum of 3% but cap 5% under their contract so the inflation is actually C in the Waste Pro contract so it can't go so if we have like a 7% inflation year they can't get that full 20 is at 5% uh I think 3% based on the current trying to get realistic based on current inflation numbers that we have now it's the $20 is a very U conservative amount like it's I mean it's possible could be that but not but not like and everything above that is account for replac of can any other utility would it be inflation like if that's what Nick saying so like if it went a little bit higher on inflation is possible it could be higher if it want higher than the 4% 4% it possibly could but I think the way it's inflation is done where the average is done I think 20 is is right um but to your it's it's not likely but I don't want to sit here and tell you it's not possible even if it is we could do this over oh yeah you I think you're rather because what I'm what I'm trying let me what I'm trying to explain is that we didn't go like um exorbitant in the average we took the 3% which we know
[0:08:21] we're going to have and just divided that over 3 years and added the rest of it is real cost so there's not a lot of fluff in there it's going to cost $20 a month over 3 years could be a little bit higher but not likely but but that's why I would was discouraging last time going to 19 because that we know if you got a 19 you're going have to come back and do it again but if you do it at 20 it could stay level that could you you'll have a bit extra this may not thought is so honman Flores would you clarify your motion I I'll make a motion okay that's all right so we do so not up to we have a motion Flores to raise it from 12 to20 a month second wheeler is there any other discussion hear none yes yes yes no motion carries okay work here all right next on the agenda is a discussion of proposed ordinances for code enforcement and just to set the stage for this there's no action being requested tonight um occasionally when our code enforcement officers are on the street they see certain things where they suggest that maybe we should tweak an ordinance so they bring that um to our code enforcement uh superintendent who also then notifies Whitney uh since she manages that department and then Whitney brings that to my attention so what we've done is put two things on the agenda for discussion again not requesting action but just two things that have been seen in the field that we want all of you to know about to see if we want to take action this is um this is Whitney obviously our plan director and this is Victor Bird Victor how you doing sir
[0:10:24] he's our enforcement superintendent so I'm just going to do a quick down Victor uh there's two items in our discussion today and it's two items that they U officers as the feel like uh need to be at least discussed reviewed and possibly amended uh the first one is we've had some situations with items such as trampolines and things of that nature in the front yards um unsecured by fence um able to be accessed from anybody everybody walking down the streets um from a liability standpoint we view it very what you have a pool your pool's required to be behind a fence behind a log gate it requires liability insurance on your home um this could cause just as much injury to some walk by so the suggestion by The Code Enforcement Officers was to make it seem as as consistent as backyard need to be behind an enclosed fenced area that can be monitored and maintained solely by Property Owners trampoline um that was our first one under discussion the second one under discussion is um for several years the I think we've discussed this with this board as well as previous boards but uh the definition and requirements that we're putting forward with um permanent services for extensions of driveways uh right now it reads as impervious surface which can be anything fres Limestone gravel type situations they interpreted differently at the at the Municipal Court sometimes with papers and things like that uh the request by the code enforement officers this is to have matching materials use for what is existing and what is expanding into um so that's the we like would like to discuss with you and again Victor's here he has oper question she basically discredited everything in a nutshell almost thought she might have been reading my notes no no I'm joking she she she had everything
[0:12:26] down that uh we had discussed the concerns that they could have understand as far as the um the the wording as far as the imperious Foundation um I know it's not supposed to be anything where water can Le through um we're just making sure that gravel was going to be okay obviously asphalt and conf be with the Cod officers were wanting something a little more it's it's easier to enfor e to see matchings aesthetically it's a big thing but easy to go a drive foration comp I know it's a little bit effective for a lot of people so it's a point contention a lot of times but um from an aesthetic and enfor standpoint um it works better for so we're just here to see what your thoughts are and this is just going to be affecting the front of the house the driveway the driveway not the backyard well I guess Al Hoots could be both um because I know that in the code that they're allowed to park a vehicle in the backyard so long it's on an imperious imperious uh surface such as right now such as blacktop concrete gra backyard I agree with that though lat not mainbody I'm guil of it yeah but when I had my what I had Gra in front of my gate I
[0:14:31] did change to because of what how I interpreted the ordinance well vict here was big discussion with MP as it can you know can go through it so then it was looked at as a crush Limestone type because you set it forms up to be an Sur now to the point of okay but is that street value or is it well you know if it's in my backyard I don't mind I'm kind of like Charlie whatever's in front of the gate is what I'm concern as a neighbor yeah that's the phone calls I've had is hey why does that person have to have gravel and the next person get conquer you know if it's visible you're again if it's visible from the street if it's from the gate you know I'm I'm okay you know right now I will say okay let's do what we consider impervious as it do have to match because I'm okay with having concrete and then asphalt side driveway or vice versa but as long as this imperious of the does the excuse me does the ordinance say it must be an imper imp then the ordinance is now yeah what they're asking for now is to go A Step Beyond it from aint it's to provide it where it's matching atically matching but if you look up again look up the defition impious it says a material where fluid can't pass through that disqualifies gravel and anything
[0:16:34] other than concrete or or something so what I'm saying is the wording that's in the ordinance now requires there not to be Grabel requires it what they're requesting now is to kind of go A step above and make sure that like you have exting Drive you know you don't mix concrete you're not mixing you don't have hge Podge surfaces display throughout your front more aesthetic I agree that I agree with that but also agree with in the backyard you can't see back problem the only issue I have is with the backyard is you have an iron an iron gate that you can see through and then it goes from concrete to gravel I've seen a house like that they have those iron gate they you can see' forgive me ask it again the definition of impervious I'm just Googling it says a material where fluid cannot pass through so my point is if you've already got that the surface must be imp is that currently disqualifies gravel and anything other than concrete or asphal so what do why do we need to change anything we're just changing how it reads from the a if they match oh you're saying that it could be too so you're not saying that you would allow like I'm getting a little confused so you're not saying you would allow gravel in the backyard in an impervious surface in the front you're saying that they have to match so like if you have an asphalt driveway material okay I youal aesthe and it's also

[0:27:34] building that answer a quick question I don't know if um if it goes into the same dimensions as far as a pool I'm still new I'm still learning that to my understanding the pool in the backyard has to be so many feet from a house or from a a stor building or anything like that I don't know part of that is so kids don't jump off the roof to the pool yeah I know a guy whose children did I don't know if that's liability reasons or not but if it is I don't know if we might want to consider the trampolines to be the same distance as a pool would be from a fix from a fixed building I look they got parents if those parents have got enough sins to move that trampoline away from the house that's not our place to tell them that's my opinion okay I'll just say that I mean that's a good point though thank you appreciate question questions you want you want to report yourself or for anything other violation all right thank you'all all right next on the agenda is amendment to the between the citya county and County Convention and V um this amendment is talk about in the past but it's just the amendment regarding the project with land Center expansion and the hotel the N knows that the S County will issue additional 15 million for the project and the dccb will issue additional 6 million for the project um based on the timing of the construction and a timing of each of their obligations so tonight nothing theity um but since we're party to the overall incentives that are being ran also required signing so that's the just when you get down to it as far as
[0:29:38] the actual funding requests or funding additions by both entities T authorization for the mayor seconder only thing I would add to that just so everybody knows the the key difference is part of this change is El garage the the other um development proposal had a garage this one to make the numbers work they have remove the garage's any other discussion none roll call please yes yes yes yes that MO carries next on our agenda is the resolution of intent to issue General obligation bonds an amount not to exceed $12 million this was discussed at the last meeting the bond is just auth authorizing the advertisement put re resolution of intent and am noted full Milli does not mean it will be full million not exceed full million this will then be advertised um in the in the paper also sent to the Missippi Development Bank um for their records as well so that that the bonds can you have a hearing and second meeting May regarding issu and then after that the bonds can be Unwritten and then issued the money begin so tonight it's just the first step of authoring the resolution int to isss for ad for theing at the second meeting that have a motion Flores second wheeler is discussion pleas yes yes yes yes that motion carries the next on the

[0:33:53] our agenda is our planning agenda yes sir we have one item on the agenda tonight and it is a request uh to move forward uh with a new tax Inc program for a project at 201 St Road um if you will remember years ago a tornado TI down and Mall name Mall there's still is a slab which you see in the aial photo up there uh there's still a slab on the ground uh no building hasn't been there since I believe like 200 N somewhere around there what you have in your package is uh the application and a description of what the proposal is it's a climate control self storage facility about 62,000 ft it also has some exterior access RB and Boat Storage um you have a cost estimate for the project um you can see it itemized on the page submitted um construction cost alone is estimated at 5.54 million uh in addition to the indoor facility that see there on the screen they have also indicated that they will be taking the remainder of that retail multitenant Center and painting it to match the materials of the indoor facility uh so it's cohesive um I have also talked with them about um the condition of their parking lot to make sure they understand that it's you know they're going to be doing some work out there to get some construction it's already a little torn up it's it's probably going to get a little bit more torn up as they go under construction so um they're aware of the need for probably a thin of v on the top of it um other than that we have Mr Bob Rogers here in the audience he's here for any questions or any additional information you would like um but it is an infill development um on the revitalization area of town so tax incentive request has form sub I'd like to see more landscaping and you know improved over there
[0:35:57] for a long time to [Music] be we don't allow the metal building so out there there's notal buildings over there what you have yeah what you have proposed right now is heavy glass window lines got a modern appeal to it but you also have l Scot area which going be your knall area that's going to be a Bas a brick um and then above that you have an e material stuck material um but yes I do understand what you're saying have to Mr Rogers that there may be some requests for additional things he's here to answer any of those questions and accept or say can't do it or whatever happens with that discussion more than happy to bring him up or we could actually talk to him over there he he had a horse accident and he had on crutches so I can actually bring are you okay way to go Charlie you just couldn't leave it alone could you don't put gra just to see opportunity I think a little more putp that's a.3 million beautiful build just at would call anyway I guess just questions about lighting I'm sure they want security at their place to right I mean these state of art you know in New York 40 years ago when I was practi he was app been he's oral surgeon he's also real estateel um 14 of these facilities Florida Alabama Tennessee Mississippi
[0:38:01] and they their first place and this is not a ground up you know this is this is dealing with Asphalt in place slab in place but as far as Landscaping across the front of the building um it's going to be integrated into the shoing C the shoing C will be repainted so that you got a white and gray CIT all the way across the sidewalkers in front of the shopping center now it'll be a common wall L shape and that that service drive engress all that but the parking lot will Beed topc and there will be along the front of the building I think and we don't have lands yeah this is just a tax is just so you're not have to redo the slab at all structural engineer so no it Mega Market trust me no it was a Mega Market tax aspect of Pro
[0:40:54] [Music] and let me just say this we we kind of skipped over thank you and your client or your your team for helping us redevelop original South aen so I think it's a beautiful building I don't see any reason why the Planning Commission wouldn't support that uh that slab has been vacant for many many years and I even think the old grocery store was building was vacant for a long times became a second use anque store so this a great use of the property so please uh relay my appreciation for the reinv so do we we have we need a motion to approve this so we're not we're not proving sounds good thank you next on our agenda is our mayor's report the only thing just want to update everybody uh Springfest is next week so um City out we celebrating our 44th uh anniversary as an incorporated city and we'll do that by celebrating big like we always do at Spring Fest we have the carnival as we always do we have a hoser is a sellout for Thursday night so I had a Google posture I've never heard of them but evidently a lot of people have and so a lot of people love that event so expecting over 10,000 people there on Thursday night uh we've got all that coordinated with our team to be able to
