[0:00:00] this meeting to order please stand with us i will be led in prayer alderman gallagher standing after that for the pledge of allegiance and it will ask honor and pain to lead us father when we come before you tonight to ask you to be here in our presence through this meeting lord we ask you to guide our minds in the right direction so that we can make good decisions more but we don't want to pray for our nation right now that's undergoing so much terminal wall lord i pray that you would uh just bring justice and peace back to our country i pledge allegiance to the flag of the united states of america to the republic for which it stands one nation under god indivisible with liberty and justice for all first on the gen is the approval of minutes for uh three meetings we had one regularly scheduled meeting the first meeting of the month and we had two special budget workshops these so we can i get a motion to approve uh or can we do them all through there yes can i just give one motion to approve the minutes of all three meetings you've got a motion from alderman gallagher second bar with hoots is there any discussion here you know we're all called yes that motion carries next on the agenda will be our budget hearing and first of all before we start the hearing the way we'll do it tonight um we had the two budget workshop meetings and when we left the last budget workshop there's still some information

[0:02:02] the board requested that i provide so i have that information so i'm going to do a quick update on those those things and we're going to ask chris wilson our city administrator to come up and do an overview of our current budget and after that we'll open up the floor to the public for any questions regarding the budget so the update the two things that we've left the last meeting still with questions about the first they were both dealing with uh contributions that the city makes to non-city organizations the first one was about the desoto county museum and the question that arose was are the other desoto county cities also paying a contribution like we are and the answer to that is desoto county gives money to this organization i believe 35 000 then the city of south haven gives 9 000 and then all the other cities in the soviet county gives six well it's actually it's hernando horn lake and olive branch i'll give six and the city of south africa is nine and uh my assumption is that uh that was made i don't think that was made during our entire my time time here but i guess it's geared towards population they just felt like since southam is the biggest city so that's a decision you all need to make do you want to leave it at nine with the others being six or do you think it should be equally done among the cities so we can right now on the budget we have nine like it was in there last year but before we leave this discussion uh we'll need to hear from everybody if we want to change that the second thing was on the contribution to the public library uh last year when we requested budgeting for our financials we were told which is true that the library is part of a regional library so the money that we contribute uh goes into a budget that is uh used for a region not just a south haven location so we specifically want to know how the money the 300 000 that we have so far in this budget how is that allocated to the south haven library not

[0:04:05] the region because we want to know that the money that we give is is going into the south haven migrant so they did comply with that they did come back and give us a breakdown which they broke it all down and it equates to 300 000 uh chris wilson and i did go back to verify that and we feel comfortable that they are using the money in the southern library so again that doesn't change your decision if somebody wants to make a motion and i make an adjustment to the amount of money that the city gives to our library but at this point there is 300 000 in the budget and the library has shown us that that money is is only used at the south dakota location so with that being said uh before chris comes up is there any discussion on uh do we want to make any amendments to uh to either of those two we have reduced it from the previous year uh the line i think was three i think it was three thirty three um did you get in did we get any information about that about their plans to reopen they're doing a lot of online stuff i think they're probably like guidelines yeah yeah no we're not doing it the hearing will follow the chris so yeah right now basically this was just an update to the two budget workshops so i promised the board answers to those questions so uh guess what i'm asking the board now is there any interest in and number one i'd like to change to the 9 000 that's in there for the southern county museum and then does the board will make any changes to the 300 000. do you think the libraries

[0:06:08] operate in the smaller budget they ask for the same thing we gave them last year and that's what's in there as far as to answer your question i i guess i don't know that i don't know that there's a way to yeah i don't know i mean they've asked for 300 and again we did briefly in the workshop to talk about just because an organization may be amending the way they're doing their business doesn't change the fact that they still have payroll you know it's got people that you know that they have to have to keep so i guess i guess my main thing i would report to the board about the library is you know we certainly want to support our library you know there's people our citizens still use it so we certainly want to support them um we would like to feel a little more appreciation a little bit with the fact that that we built a four million dollar building exclusively for the library's use uh and that we pay for all the you know the maintenance of the building and even some of the some of the utilities so but as far as like i'll just be real straightforward i don't think she cut the budget this year based on the breakup yeah and you really are splint hairs if you try to say hey let's cut this because you put the coat of it i mean we don't really know their operation with that much detail to say where we expected to become okay we'll move on uh chris would you come forward just give us an overview and before he starts was it that was only good then was there anything else

[0:08:11] with any other questions um request um hey chris let me let me interrupt you there excuse me just a minute i did want to update y'all that was the last thing i felt like i was missing something we did talk about we left we're going to go back and come through and see if we can find a way to add more beliefs you know everybody you know we understand the need to have as many police officers on the streets we can so we did go through and come to a few things we did cut a few things down we did cut facility maintenance to 850 000. it was at a million last year and then uh we kind of again come to everything chris realized that uh there was a couple things that we already had in there so that that freed up a little bit of money there so we went from uh what we felt like we had enough for four on uh at the last workshop now we've got six in there so we did find uh room for two more financially if the ten vehicles on their body cameras huge deal i think everybody's in agreement in today's world we gotta have body cameras so we got that done and then the building department that's another thing that it's tough to plan that when you have you know you have downturns in your

[0:10:12] building market but the building market has been so heavy this year we've got to have another build inspector and our cars need some help we've got to have another mark so we did we do have those in there so i think those things mentioned there will help us a lot i think that's extremely important sorry um any questions for chris christie there's texas there's no rollover money balances at this point um you know be cautious again absolutely is

[0:12:32] this gets swept back into general funds so during the audit and be part of your finances just another kind of important tax increase you know being on the humble line there is extremely important and soccer moving forward like chris said you know we have a new director coming on so those are those are all important issues we stay committed to our infrastructure improvement we spent this year in this budget is three million dollars a year for um street improvement a million dollars for drainage maintenance and drainage improvement that's a total of four million in 2012 the city allocated 1 million from that so we've gone from one to four in the infrastructure so it just reiterates the strength of our commitment to improving our infrastructure majority all size and we're at 50 that we're just only getting fifty percent any other questions or comments are we open up to here okay is there a motion let's open the budget here we've got a motion modern brook second longer than kelly i don't better say all right can you say no i just haven't motion carries is there anyone in the audience like to speak any questions about fiscal year 21 cities highlighting budget anyone have any questions at all about anything

[0:20:56] like a single one type designation i should just fall in love with that in terms of character of the neighborhood your two north um corners are both under pvds that have office and commercial uses so there's no character with surrounding neighborhood um additionally during this rezoning we did ask them as we're working with with all of those situations and requirements being met we asked for approval or flourish who's coming the same audrey kelly's second motion it uh um like there may be some uh small office buildings and some possible lot of retail on the front uh they're kind of designing it to go with that nailing that look what bank goes right um any other questions for the board we'll need to open up a quick summary hearing to allow discussion for that but first of all any other discussion hearing now we'll get a motion to open a zoning hearing regardless go to motion flooring second order from brooks call back or say hi hi can you post say no i just have legend carries is anyone would like to speak in the

[0:25:01] he requested a variance on two portions of our code uh one has to be elected alcohol in the arcade is an accessory used with a local recreational facility of the um that i'm looking at um what we based uh the various i guess approval on you are recommending approval um accessories commercial maintenance of the property our ordinance act in about 2005 was changed to um as the state that we're rounding over towns or be located in west end districts for whatever reason that has stayed put we are looking at possibly uh revising that or we're going to say that as of right now a lounge pattern or spell uh our variance is based on the fact that we don't feel this is a guard out of the lounge this is a recreational use it's an arcade base nostalgic arcade that he is trying to grow the secondary use of it is to serve food and alcohol so we think that the largest therapist should allow the serving of the alcohol so our recommendation on that portion of the variance is to um the sprinkler system fire that's going to be a separate thing so they combined it as one variant so um i don't know if you want to do two parts all right is there a motion to approve

[0:27:12] the zoning variance for a game of mushroom and kelly the second one for the second year okay is there any other discussion about that hearing none roll call yes [Music] yes okay that motion carries all right now the second the second part of the issue and we have um chief scallions uh we have tim rowland our fire marshal here as well the second part is going to be when it goes from an arcade to a restaurant bar it does it does require a sprinkler system with our current current guidelines so the discussion is about that would we would we waive that but again being an arcade is one thing but when it turns into a restaurant farm it does require sprinkler system i would just say this i've said it previously we want to do things that incentivize the revitalization of our original business district i've told terry many times i love his idea i want to see it happen i love it i think it's good but i also have some heartburn i really want to listen to our fire personnel talk about it because a life is no less important in the west end district as it is anywhere else in the city and so we want to be careful when you have a large assembly like that uh obviously when you turn into a restaurant bar uh you're gonna have a more dense gathering and so it becomes a more serious issue as far as having a sprinkler system for the safety of people so um chief scallions how do you want to handle addressing into the town you want to send 101 yes sir or in full 35 yeah jim was our expert it was our

[0:29:15] kim roll is our fireman good how are you all right whenever they first applied for the business it was stated that it was going to be an arcade which time the output load was listed at about 290 according to the architectural drawings that they gave i basically approved it as an arcade but after approving it the discussion that was prepared he stated that he wanted to also serve food and alcohol which an arcane is considered what they call a three assembly three um it has a document load of 300 that's your arcade your museums and churches once you go to an a2 which is restaurants bars night clubs it goes to an a2 which takes a third code that will knock the globe 100 you have to sprinkle that's the reason chick-fil-a the new chick-fil-a and get one of the sprinklers they knew uh ladies on goodness of sprinkler because they're occupied and he provided the last seven of drawings even his architect listed it as an 18. so i have

[0:31:18] preliminarily approved it based on getting sprinkler drawings fire alarm drawings and commercial good forms [Music] i think we pretty much know what the issue is and so i think i can kind of direct this into a decision with the board so basically what the what the request is are you going to allow it to open uh without its preferences because according to your the building code ordinances it has to happen with that it's going to be a restaurant bar it does happen so i would make one suggestion again in the spirit of trying to incentivize you know revitalization our original business district my recommendation would be again i've stated that i think it's a good thing i'd like to see you know the revitalization i think it's a good good business idea my recommendation would be that we that we do uh hold tight to the recommendations of our fire marshal uh but then we give some landscape on time on when those things can be done so my recommendation is to allow them to open with a either an 18 month or a 24 month period to get those items in place but that's tim that this is the parking is a different issue altogether yeah we're trying to talk about the sprinkler system right now that's the third thing that you should discuss you have the information about the

[0:33:20] number of parking spots what we'll do is bring whitney up after this well right now what we're uh what we need to make a decision on this uh is the uh sprinkler system and the drawings for the benefit what else tim code requires a sprinkler system a fire alarm system and a glitch system and all of that but you're gonna have that on day one if you're gonna be cooking food right you gotta have the boost system on day one if you're gonna be cooking measuring okay so the delay let me clarify my recommendation is to give some leniency on the time of the sprinkler system but the ventivated system would have to be in place my recommendation is 18 months um you know i'd say 18 to 24 months but uh i think 18 months is a fair amount of time to use your fee and i throw in there also and this may be better aimed for as of right now it's an empty vacant building the cost is probably going to be [Music] half to double for a retro as it would be for now as an empty vacant building right which that's important for him to know but just as a city we want to give him the flexibility of making that call but you know you know see i would recommend giving him the flexibility of 18 months but like like tim is saying it may be more cost effective cost effective can we go and do it it's going to be 0.35 i mean 35 to 60 thousand 70 000 [Music] uh

[0:36:00] uh western business district uh yes i think one of them and we are talking uh fortunately the hydra is within all within 100 feet of the building but he'll still attack these what improvements are going to be done together we'll make that determination that we can make now here it may be more uh cost effective for you to do it now right at the front end why the building is yeah otherwise i would have to bring two trailers or pods depending on the building why the building shut down let's say we went to a seat right 70 today for example have you had a price or retrofit to give some flexibility on the uh to allow game over to open without a sprinkler

[0:38:05] system for 18 months and a second uh brooks uh it's just finding time to get in uh generate revenue okay i mean what so we're going on in 18 months correct day one have the benefit of your cooking on day one for that and right correct just sprinkles this is our retirement costs more than i mean it's like a nice hunger obviously the building will be so there are certain businesses that can operate in there without a particular system depending on the hospitals that are just used um to your advantage to eventually have

[0:40:24] that anyway it's kind of for your protection of the people in your building so we have a common interest in public safety okay is there any discussion about that 39 roll call yes okay that motion carries now whitney would you address explain the parking situation that's enough that's another food that we've got to find a way uh well i think we've got some options here and we weren't really taking this process at this point in time but the building enterprise that we've heard about are working on i know you can't see that there but if you can look here there's an existing drive and there's additional spacing on the back side a lot uh there's also some concrete padding and some decking on the side um so what we've found is you know we've got to get that parking ratio board and then we can take off like he's thinking we're going to be working but what we will do is work to find some additional spaces back here originally possibly pleasing the space next door and adding the parking lot there that may take care of itself um but if not i've got the debt on the back side of the property and accessories in place for security access to this project we'll do that through my office administratively but we'll make sure that they meet here how many i'll scale it out of my office to see how many i can get in this place and then meantime as the accessories will start talking to people adjacent to the state a lot uh see if you're leasing a biomat as an option and we can add proceeds like an outdoor patio type area

[0:42:26] out there we could also provide some additional space in there so we'll just monitor make sure we get the compliant number at first and finally and in the department of the rear he does understand that it has to be an asphalt part yes so um [Music] uh it will be a responsibility to ensure that his patrons are in this parking area um and i said we'll continue to monitor if we see that it's increasing uh again it's popular if he hopes we know if it does we're gonna find some alternative parking i'm not and you're right about the 18 wheelers i was involved in that um the key is that we don't have an interruption like if you're if you're uh your patrons are you know like literally said if they're they're parking their interference business on the street somebody else that's going to be an issue and the bigger issue i just want to make sure i was going to say this for you before you left to make sure whatever the board signs in the parking issue is to understand that a variance does give us the right things aren't done the way that you have to comply with that variance but the city does have the ability to come change what's discussed tonight so you do understand that yeah and i know i feel like you you have to you have a good business plan i feel like that you want to be a good corporate citizen so i appreciate that you think we want that big problem

[0:44:30] you know we want we want to have so many cars there that they that means you've got the finances to you know fix the situation yeah the 1926 would be happening there you took the building back up yourself again so get and if there were parking on the street we're talking about first-person drivers um okay but that's something that has changed since our last meeting so yeah right now when when it went from rna to pending changes a little bit of the sound into it so the parking changed but we started that is done as well so what you're saying whitney is that

[0:46:43] before he gets the co that you would verify the department exterior okay so there's nothing there's no variance so with uh i would say ceo well we have a fire marshal to go back can we go back and reinspect somebody's doing their job tim we appreciate you sam and michael atkins but again just face to face everybody in the same room wrong agreement we understand what's being required of you you understand what the city is allowing you to do thank you okay all right we'll move on this on the agenda's mayor's report and just a few things to update everyone on the ordinance committee meeting that was scheduled for tomorrow at 9am uh has been canceled there's not going to be an ordinance committee meeting tomorrow uh we will reschedule that about in two weeks that's very important uh we kind of pencils are trying to create a little bit of flexibility two weeks from now we've got a lot of things we need to talk about in an ordinance committee meeting uh but it's not gonna happen tomorrow we'll be rescheduling uh in a couple weeks we'll send out an invite on that um thursday we won't have the

[0:48:46] second public hearing about our 2018 uh building code adoption and that will be thursday in this room at 10 am 10 to 12. then we'll go ahead and hear from the builders and wrap up that before we officially adopt that the two big issues that we left the january 9 meeting with were the square footage amount that we felt was appropriate to require a sprinkle system on a residential property that's we'll try to hammer that down thursday the other thing is the women's seismic plan the wind assessment plan that's in the code is we feel like is way too stringent for this geographical area and so we feel like we need to uh simplify that some make it more appropriate james gentry has laid out a plan on uh what he thinks is easy to communicate and we want to review that more time with the builders and get that hammer down then we should be ready to adopt that so the leading is 10 to 12 on thursday right here exciting news central snowden multi-use trail 2011 is when the city and m9 the city applied for a alternative transportation grant i don't think they have that name anymore would you do it so nine years ago the city applied for this money to build a 10 foot wide multi-use trail and connect central and southern grove park through this nine years there's been a lot of changes just to summarize it real quickly getting right away for the trail was an issue there were some private property owners that didn't agree to that so the trail had to be redirected uh when you redirect something that has it's almost like starting over you have to go back to mdot you can approve the route and so that's all been done uh but anyway ground broke yesterday on this so it's pretty pretty big deal we've been working and talking about it for a long time i'm excited about it it's great for our city making our city more pedestrian friendly so now you have a 10 foot trail coming out of central park on tulahoma that you

[0:50:49] go southbound to oklahoma we've still got some issues we're working out for them not obviously if a pedestrian is going to cross goodman road we've got we've still got some work to do there but the trail will extend further south past goodman to maine boulevard uh then when it gets to may it will uh it will go eastbound towards solid square into getwell with the plant eventually connected with the pedestrian bridge and connecting with the current snow and growth pedestrian trail that's in place now in stunsbury park with this plant also there is a stretch for the soda central high school that goes from central parkway to citizen or northbound to now so it'll allow the students that are now walking through the business parking lots there they'll have a a walkway where they can safely travel from school back up to uh snowden grove park in the business district there as well so really excited about that ground broke yesterday it's a great day for that we're continuing to move on with our plan to be more pedestrian apparently as i mentioned the other projects don't grow adding bike lanes on on collector streets through neighborhoods we'll continue working with that inconsistency with our green trend 2040 plant good news everybody's sick of hearing about covet code is real we still got to deal with it unfortunately the bad news is we shut down economically for a long time we had three months this year chris told you about it really affected our sales tax revenue in the city uh when we had the major economic shutdowns it has caused serious economic damage throughout our country to hear daily companies that just are not going to be able to rebound and make it back we're not immune to that in south haven either but the good news is the general economy is good a lot of factors are really good and um and again not to say i told you so i told you so we rebounded strongly in june and july

[0:52:52] we had big kind of sales tax numbers in june july so really positive news for our city our parks maintenance shop is almost done what is done just a few punch list items and when we get our parks uh all our parks are quickly moved over there uh i would encourage all of you to go check that out it's really uh i know you may say we don't get excited about a magnet shop but it is something to get excited about it's a it's a uh awesome awesome shop it's laid out perfectly for our needs are and if we're going to continue to expand our parts work we need to be able to service them so it has a lot of features that our other shop didn't have so it's uh really something for someone to be excited about here check it out it's just just west of the tennis center between the tennis center and our current uh baseball complex at stone grove park and then i think that is it let me scan my list that's all i have to say so i'll move on any questions for me before we move on about anything i've said or anything else okay we'll move on next on our agenda is our citizens agenda would anyone in the audience like to speak please come forward to the podium anyone want to speak hi i didn't plan to be here but i am so glad i get an opportunity i'm going to found the theater and it's my pleasure for you telling you that we really appreciate what you've done for us last year we hope to help you help this community rebound and continue to grow we're doing something things we're now planning to do in december which is a big event we're trying to make sure that our funding matches our ability to do that and your support every year helps us accomplish that we have um we opened up our auditions we have over 100 people wanting not to do the show because the only theater that's operating in this africa and we're trying to state that playing we're trying to help high schools we're trying to do i reached out before we were trying to do a high school event a

[0:54:55] cabaret celebrity show celebration and find other ways to provide entertainment facilities and community support i even want to see all people and ask them and help us to be a part of what we're doing and spread the good news um and we appreciate the fact that you've helped me be able to do that and if anything we can do now in the things that city uh in other venues we do that here we want to do that so what we want to do is be a part of that uplifting spirit come back for come back to the community build our businesses and uh if we can help you in any way we training which is a key part of a lot of the actors learning how to do that so i appreciate your support if there's any questions for us that i can provide you with i'd be glad to answer it and hopefully the landers center will open up so we can do um any questions for david said we're talking about they said well we are holding on to mandate for what uh because if there's

[0:57:05] we have that show is a big show it takes 30 people in the gas tank at least another 10 to 12 to help us capture that but there's so many people who want to be on stage i can't imagine the responsibility of the community you know it's a part of our new show it's a fun show we're opening we're planning and moving in on november 2nd to set up the set and develop incidents well the short answer to that is you know the restrictions now are replaced by the governor so you know in many as we all know that's changed very frequently so between now and november there could be other changes so my advice would be let's wait for you a little bit closer and then the city will help walk you through that so but we can definitely give you a clear answer like there's a if there's a 25 limit it would be based on the building code documents to that facility so we can easily do the math on that but yeah we can get you an exact number but again i'll just i can't go without saying that what i'm about to say is we all got to use a little bit of common sense like you know we're going to get you that number uh but we all got to use a little common sense about how we manage the crowd how we separate and social business and that kind of thing some of the government uh the mandates by the governor they're impossible to enforce because there's no way it doesn't make any sense like how do you how do you enforce that and so we will as a city uh we will do all we can to respect the governor's orders and also give you a clear answer investment as best as can help us with possible and we want to support you coming back to life in this community india i know i've seen a lot of small businesses from the chamber side they've got one of the three size employees 55 universities we've lost yeah keep trying
