[0:02:14] yes okay that motion carries next on the agenda is a resolution for the restaurant tourism tax for parks mr merman we adopt the resolution to the 1 restaurant tax as presented on the state we have a motion of aldermen brooks second honorary kelly to begin discussion just to do a quick recap this is what we discussed at the last meeting that we've gotten feedback from the legislators that they want a resolution with a new referendum so i don't think it needs any more discussion we all know what this is um cities had it for you know many years until it expired in 2017 but the the current resolution would ask for a 10-year tax one percent tax just like before on restaurant sales anywhere in the city and it would have a new referendum before that is approved any other discussion hearing none roll call michael yes yes waterman yes yes yes yeah that motion carries next on the agenda is a professional service agreement with mid-south sports productions incorporated professor nick manley this is the agreement with uh professional sports or mid-south sports uh scotty baker's group for the hosting of tournaments variety of tournaments at snowden grove i think it's in the past approximately 17 tournaments obviously everyone knows success of those tournaments and the teams i brought in this would extend this contract an additional four years to continue doing that for the city so any questions i can answer or ask the answer as well mermaid we approve the professional

[0:04:15] service agreement between the city of south haven and mid-south sports productions is presented on the state second we have a motion by alderman brooks second alderman payne is there any discussion yes yes okay that motion carries next on the agenda is a resolution for the freeport warehouse tax exemption for henry's shine animal health this is the freeport warehouse exemption for the goods and transit for henry sean health is recommended by the city council to the accounting end city so tonight bringing it for the board for the freeport for a house tax pension for henry shine animal health i'll make that motion second we have a motion of arm and fluoresce second volume of pain is there any discussion hearing none roll call yes alderman kelly yes yes gallagher yes yes okay that motion carries next on the agendas an agreement with britain watson for our comprehensive city plan yeah this the last meeting you recall that we awarded our authorized bridge in watson to proceed forward doing uh help assisting with the conference the plan for the city is required by the statutes for every 20 years so it tonight mean we discussed getting contracts tonight authorizing the mayor to sign the contract which reflects the terms of the rfp which will be that not to exceed 120 000 to assist with with bridging to assist the city by bridging watson for the conference of plan but obviously working with whitney and the mayor real close on this meeting of the plan so tonight authorize the mayor to sign that contract

[0:06:17] so move second we have a motion ballroom and gallagher second volume and wheeler is there any discussion hearing none roll call yes okay that motion carries next on the agenda as a resolution to amend our towing policy uh chief pearl is here with my favorite question from the resolution for the minute towing policy it'll reflect um allowing someone who owns two companies to also be on the detailing room rotation so both companies could be on the rotation provided that they're separate entities separate locations but it will allow for multiple needs or multiple entities who run by the same person participate in that program for that under that uh assistance with the police department but we'll have to meet certain criteria related to separate entities and separate locations so it's uh i'm in the policy that was passed in 2013 so tonight we've amended talk to reflect those changes and everything else to stay the same in the towing policy for the police department a second we have a motion baltimore brook second ballroom and gallagher is there any discussion um just a quick comment i think the um committee minutes did reflect all it was discussed but um just basically um again as nick said g pernal is here to answer any detailed questions but basically in the past from what i understand there were some that attempted to get more spots on the rotation so they would put up a temporary uh sign they would it was almost like it was there were not two companies but they would kind of wear two hats and they would get two spots in the rotation obviously that's kind of working the system uh that's not what this is this is someone that is legitimately

[0:08:21] owning two different companies uh that has two different locations so that's what it's about is there any other discussion hearing none roll call yes yes okay that motion carries next on the agenda is a resolution amending ordinance title 13 chapter 7 section 13 7c this also deals with the uh towing as well this resolution will amend um the ordinance which allows for uh they allow if you're on the towing policy and you provided a sticker or a seal in the city it'll allow you to park at you're out of in the residence neighborhood provided that certain requirements are met um and it's not considered a nuisance by the neighborhood um you'll have if once that happens or there is a complaint or it is a nuisance you'll have 24 hours to move your toe to remove the vehicle from the location or face a fine so it'll it's done for the sole part for the purpose of when you're on the towing when you're on the towing rotation you have to appear at certain accidents of their vehicles or certain accidents that move vehicles or wrecks uh to and equip within 20 minutes so this will allow for those on the toning policy or the toning rotation to do that within the required time and be consistent with the ordinances that will still not allow commercial vehicles certain commercial vehicles in residential areas overnight so this will attempt to address both of those situations it was been discussed and recommended by the mayor and chief hertl any questions obviously they can answer those as well mr mayor i move that we adopt a resolution i'm ending the south and code of ordinances second we have a motion by alderman gallagher

[0:10:24] second baller and wheeler and i'll start discussion just to go on the record briefly as nick said this was a situation that uh demanded a compromise uh we obviously want to protect the um you know the aesthetic value of our neighborhoods and you know commercial vehicles are not attractive in residential neighborhoods so that's the you know that's the purpose of the ordinance uh however we did have a situation uh you know as nick stated that uh with our towing policy we have a requirement that our record beyond uh the site of an accident within 20 minutes and then you know our city is not big enough as some cities that would keep a record business open 24 hours at a physical location so a lot of these drivers are at home with their own call so that's what leads to a need for them to have access to the wrecker you know to meet the time requirements so basically what we did is you know we weighed the um you know the um the good and bad of having the commercial vehicle in the neighborhood but also we felt like it was important you know for the public safety in our city that records do get to the scene so the scene can be cleared up in a in a timely manner so that's that was the challenge that we're faced with and that's what prompted the need to revise the ordinance is there any other discussion in the past we've had an unwritten agreement where we've kind of followed this this is just basically clarifying it and putting it in writing correctly well we had a situation a few months ago where this was causing an urgent problem so that's when i'm in a prior meeting i brought this to your attention and we had to make a quick decision uh compromise but we wanted this to be correct in the ordinances so yes we did discuss this and and we have been implementing that but we do need to make it official you know how the city is going to interpret that and apply the ordinance and a little further background just real quickly

[0:12:25] in the past there was a an evaluation or a ruling by a previous judge that that vehicles could be in residential areas as long as they were parked in driveways but i'll be very candid with everyone when this was brought to my attention i read the ordinance and that's not what our ordinance says so i did not believe that it should be enforced that way that's what prompted us to bring this back to your attention this also allows for residents if they deemed a nuisance to to gather together and to uh have the the tag removed as well so we didn't leave our citizens out to drive correct yeah we're with this we're trying to again make a compromise and do both you know we're sensitive to the fact that you know some people do not want a commercial vehicle parked in their neighborhood a residential neighborhood but uh we believe this was the the most common sense compromise any other discussion hearing none roll call yes okay and that motion carries next on the agenda is a resolution of support for the mississippi sales tax conversion this is the uh i think it's sent to the organ by other aldermen across the state that is a resolution just in support or requesting for the legislature to increase the amount to give it back to cities of the sales tax that comes from that city i think it requests one percent until 25 is diverted back to the cities i think it's just resolution support for the legislature and it would be used for infrastructure um for each city like i said it's that's not specific legislation for the city of south america i think it's just in general um that people are other cities are looking for support

[0:14:27] and it was sent i think to the alderman and so i think it was recommended by the ford mayor just be on the gym tonight for support so that's what this is tonight mr mayor we adopt a resolution endorsing legislation for mississippi sales tax diversion during the 2018 session of the mississippi legislative legislature for the motion of alderman payne second dollarman kelly and again i'll start discussion real quickly just to recap this is an issue that has been ongoing with heavy discussion in recent years i participated on the governor's council of mayors a few years ago and this was the number one issue that we brought to the governor's attention how this is one thing that would help all the cities you know with uh you know with our infrastructure needs by by bringing this sales tax diversion back to what it used to be years ago the diversion was 20 and at some point i can't recall the year i think it was in the late 70s maybe it was dropped down to 18 and a half percent so it has been 20 before uh so in recent years the uh cities have been trying to you know get that change where it go back to the original uh 20 which would uh you know put more money in the pockets of all the cities where we can improve our infrastructure so i love it because it's something that benefits every city in the state whether you're a small you know whether you're large you know that percent is going to whatever your you know sales tax revenue is generated you're going to get that revenue and it will go a long way in helping all the cities meet their infrastructure needs any other discussion makes a lot of sense i hope that everybody sees it that way okay hearing none roll call yes yes okay that motion carries next on the agenda is a resolution for a sole source purchase in our utilities department

[0:16:30] this is just a resolution for utilities department to purchase mapping equipment for the underground utilities from trumbull equipment and it will allow them that the only triple is the only manufacturer through the that provides equipment i think it gets purchased through navigation electronics inc so moved second we have a motion baltimore brook second bottom in gallagher during discussion hearing none roll call yes okay that motion carries next on our agenda a recommendation of a war to wagner engineering to oversee the nail road extension project and request for the mayor to sign preliminary engineering and design contract and all other documents pertaining to this project that's essentially what we're requesting right there yes if you'll remember this is the nail rod extension from elmore road connecting over to sweeney bike paths you'll have median on the interior it is an mpo project that is an 80 20 split that's being the 20 mpo and they've got funding being 80 um we have awarded that are requesting awards to agro engineering they do a lot of work for the county um and uh basically what we're asking for mdot concurred with their contract so we're asking for permission for the mayor to sign the contract so we can get into design uh details with it and along with that just to save time we're asking that the america is able to sign all the associated documents with the nail board extension so moved we have a motion ballroom in flores second ballroom in pain is there any discussion just quickly as whitney said you know our um our infrastructure improvement our transportation improvement plan uh that we approved a couple years ago

[0:18:34] this is on that list this is one of those projects and it is um what was slated to be 2020 it was it was slated to be 2000 uh we were trying to get it it was only the next tip actually we actually we went back and asked them to move it to this tip okay and just a couple quick things tracy huffman's with us tonight appreciate him being with us with wagner but um but just two two little issues i want y'all to know what i know um in the design there's two things that uh that need a little more research wagner will be working with mdot to get answers to that but there is a question as to whether or not there is a bridge needed the area between elmore and sweeney there is a low-lying area that you know from an environmental standpoint could possibly need to be elevated i think there's a utility line that runs through there too that we have to be cautious of that could be an issue then also traffic studies going to be done right there at nail in elmore we don't know yet signals will be needed but after the traffic study is done we'll have answers to that but tracy assured me that he'll keep us updated as soon as he knows the answers to those things is there any other discussion hearing none we're all calling otter yes yes and that motion carries next on the agenda while whitney standing is our planning agenda all right uh the first request we've got is from snowden farms llc um you'll see in front of you there is a putt that has been in play for the square mile that is boundaried by goodman road getwell road nail road and tula home road this putt has been in place since 0-5 the owners of the property snowden farms llc has respectively requested to vacate the middle portion approximately 230 acres

[0:20:35] and to give you kind of a reference point as to where that is you have a silo that's sitting on the side a very old silo that's going to be around the south boundary it will be across from our park entrance across from our fire station and uh basically end across the street from where the city property is on get well and it will extend all the way to the west to oklahoma uh vacating this will take it back to agricultural property and just for some future information they do have a prospective buyer uh that is going through the planning commission process at the end of this month to do a pud inside this 230 acres so the request is to vacate it as a pud zoning and bring it back to agricultural this is going to be from that silo north to goodman no it doesn't go up it essentially goes uh all the way north where the 11 acres we own on the east side of the property so it's got a it's got a section of get well road furniture but it goes all the way to the west and then ends to tulum so it's basically the middle the middle portion right okay so moved for item number one on the planning agenda second on item one we have a motion bottom in florida second ballroom in gallagher is there any discussion hearing none all in favor say aye all right all posts say no eyes have it motion carries item number two is the design review uh approval for the new hilton true hotel it is a millennial hotel and it is a new prototype that hilton has pushed out we are the first in this region as you can see it's colorful and it was tabled at the planning commission and the request was to tone down the colors the biggest concern of course was the yellow you'll see three options that they proposed once we got in touch with hilton we had a conference call with them told them the concerns of the planning commission and like i said the yellow was the biggest concern so they did submit the originals which was the

[0:22:39] bright yellow you'll see right if we can go back one you'll see the second option took out the yellow i think we need to go back one one that one took out the yellow completely and then the third option they asked us to look at was to tone down the yellow and all the other colors we brought it back in front of the planning commission in november and it was unanimously approved with the removal of all the yellow everything else was met in design review with it so we were asking for approval of option two with the removable yellow so move second we have a motion by gallagher second bottom and brooks is there any discussion hearing none all in favor say uh hi all posts say no i was having motion carries on too our final application you'll see um on the google map in front of you there's an old building that has been sitting there since late 70s uh it's a commercial building just north of forest drive on highway 51 on the east side a gentleman has purchased this property and is requesting the tax incentive program for the west end district pending his improvements that he will do to the building he has submitted an itemized list of roof repairs inside renovations a new hvac system exterior renovations electrical renovations and plumbing renovations um narrowing in around 75 000. could be more we've asked him to get a little bit more specific when he dives into it we're not requesting an action to do the tax freeze right now we're requesting that he looked at so when the renovations are complete that he can come back and and have the tax incentive program enacted for you just want to make a motion to authorize moving forward and consistent with the proposal right there and then the tax abatement would only be

[0:24:43] for the amount that is it increases the value not the entire property so the 75 thousand dollars in improvements and that's receipts he brings in the board if you're back on the board again the board would then improve approve actual tax payment at that time for the 75 000 improvement not the entire property so we don't do a tax freeze you're tax free approved by an approved portion of it i'll make that motion second that's nick stated well it was just the proving the plans to be implemented with the understanding that any tax freeze would have to come back up on the board for final approval showing that consistent with what would be proposed tonight with those calls and improvements okay this is actually west of the western district right now it's in the western district um with the intersection of state line 51 uh just go due north to it uh at eight miles from the national intersection right there jimmy glands uh yeah the sealed heritage it is it's the old heritage nursery okay so we have a motion ballroom in florida second ballroom and kelly and i'll continue discussion do we know how it's going to be occupied he is intending to use it as a um three-bay retail and it's kind of conducive to that um you know a lot of the exterior it's a long building it does have some storage capabilities in the back so if one of the commercial entities he wants to utilize it for has storage they'll be you know they'll use that area he is thinking about possibly using it for a nursery again um he has come in and requested i have spoken to bradley about it uh the ditch that's next to it he has a portion of the property on the other side of the ditch so we can't utilize apparently there used to be a bridge where you could walk across it everybody who's from here remembers that obviously that can't happen anymore there's a lot of debris that's been dumped into the ditches um we do have the rights it's a it's a drainage easement that we can go through and work

[0:26:45] on on his portion and jimmy bland's uh once you get past that we've actually condemned that property so we kind of stalled it until we knew that he was serious about it and once he came back in i told him to be back in contact with bradley and we could see about trying to start getting the ditch cleaned out for him so he could utilize both portions of the property um and that would be where he'd want to come for the nursery stuff kind of like it used to be apparently yeah is it is it vacant now it is very dilapidated it is uh it's an and it's going to where it's going to be a very positive impact when he does improvements well that's a good example that's why the western district was i think any other discussion hearing none all in favor say aye aye all of us say no motion carries on three thank you whitney next on the agendas our mayor my mayor's report just a few things to update you just as a reminder of the christmas schedule for the city christmas is on a monday so the city offices will be closed on christmas day the 25th and tuesday the 26th they'll also be closed for new year's day which is monday january you all know that each year the elected officials throughout the southern county go to washington d.c in april for a congressional briefing trip we've been a lot of progress made over the years about getting some one-on-one time uh getting to make presentations to our legislators and that trip will be coming up again so uh we we just need to know they they reserve enough uh space for three aldermen to go uh we don't have to take three but um whoever wants to go they are asking that we let them know who's going so if you will let christy faulkner know as soon as you can who wants to go and it's the week of unfortunately it is the week of spring fest this year and that was

[0:28:48] uh not intentional but the washington court hotel that was the only week that they could get rooms there so it's the wednesday thursday and friday of the spring fest week do you know the days christy the congressional briefing trip is the 25th and 27th which is wednesday through friday spring fest is tuesday through saturday 24-28 so it is the wednesday through friday of our tuesday through saturday okay which friday is the competition and no one has to go i mean anyway so you can just let um please let chrissy know uh so we can let the director of the uh for the travel arrangements know we'll just approve the travel whenever they'll get a privilege okay okay that's good and then the last thing just to let you know we did have an exciting day in desoto county today something that's been worked on for 25 years occurred today i-269 between highway 305 back east to 302 right before you leave mississippi and go into the into the state of tennessee that was open today so there there were several speakers that were involved uh from the beginning and it was very encouraging i'll say as as frustrating as i get sometimes watching how long it takes road projects to become reality it was nice to see something that's been in the works for 25 years happened today so um they opened the road again that section uh i understand the tennessee section there's three sections the tennessee section is done uh then this section will go from the highway 302 to 305 and then the last section that's going to be closer to us we'll go from 305 back west interstate 55 and then it will be complete and that way you'll be able to leave it'll connect

[0:30:49] excuse me it'll connect i-40 and i-55 so that'll be huge for our county and for our city too uh with economic development and obviously you know it'll give some release to relief to i-55 you know the problems that we have in the church road area that will relieve some of the traffic in both ways because they'll be able to bypass that area by hitting 269 and going to 40. you know the traffic that's going east will be able to miss miss that part of our city entirely so it's a big deal it's really really a big deal but anyway the other section i will be complete it's projected still to be on schedule for the fall of 2018. so anyway that was um that's a big deal for us and that's that's all i have this evening next on the agenda um is our citizens agenda we did not have anyone that signed up to speak but is there anyone in the audience that would like to speak tonight okay seeing your hearing none i'm gonna move on to the next thing on our agenda uh which is our personnel document mr mayor remove that we approve the personnel documents present on the state we have second motion balderman brooks second ballroom in pain is there any discussion hearing none we're all called yes okay that motion carries next on the agenda is our city attorney's legal update just got one item and this tonight uh the contract with real meat is uh that's our our person who does our bush hogging and we know we're going in-house with that next year uh when by personal equipment and hiring the personnel so we'll need to officially cancel that contract with attending notice under the contract provision such as my interesting authorization to move forward with that for public works to move forward with canceling that contract that said they noticed since we are going in-house with that
