[0:00:02] welcome everyone and now calling this meeting to order please stand with us we'll be led um i'll tell you what we're going to do um just let me get my order straight here we'll have the pledge following this but god will with me before we have our prayer we have pastor bill beavers with us to be our guest and lead us in prayer before that let's have a moment of silence everyone knows that our city was struck with an extremely tragic event last week at our walmart store and uh let's have a moment of silence to honor the lives of anthony brown and brandon gale faster let's train all to god as a community we gather in this place and our thoughts are directed toward the recent shooting taking the life that we experience we as a community would rather make national news in a different way than that but in that tragedy we thank you for the first responders we thank you for the police the officials that took control of that situation and thank you for our mayor for our board who stepped forward to make sure this community remained safe and that all base is recovered lord we pray for the families that lost loved ones be their comfort pray for the perpetrator let his heart be changed we ask you to protect this community our

[0:08:19] bring this in-house as well we can uh that's a great question when we made that decision to bring some of the right-of-way maintenance in-house the reason that we didn't pursue this is because it takes different equipment and skill set like what we're doing now is what we refer to as general right-of-way maintenance which basically means that you're bush honking you know and you're spraying some weak killer to keep the keep the weeds from overlapping the curb lines and in the street what we have under this contract is a manicured right away and also city grounds which are going to require plantings you know you're planting flowers you're maintaining uh you know shrubbery things like that so it's you're getting into a little bit more uh skill set with that but sure we can certainly look at doing it again but that's that was the logic behind not getting into the detail i understand that that makes perfect sense i'm just i mean we we do a pretty good job of mowing it to parks and i think you know bradley does a pretty good job with what we did when we brought the other contract in so it's just it's a million dollars over a 24-month period and maybe we can figure out how we can save something well it's 400 it was close to it's 432 000 a year well and there's some other well an economy we get money back from condemnations about 95 percent yeah i get that i get what you're saying you're saying they're combined with the two contracts yeah exactly so i'm just saying i mean can we not look at it certainly and actually that's that's what i was in 2016 that's what i was pushing and um and uh just to be fair the board kind of backed me down a little bit from that so but that's yeah and we did get it out and they came back all the bids came back so low we were thinking there's no way they can do this for that product yeah and it looked good so we rejected all those days i remember that but maybe now since we got a couple years under our belt can we not look at it at least sure absolutely um yes we can definitely do that and then like you stated earlier the key thing is you know we are in the middle of cutting season right now and uh the company that we're renewing both companies that we're renewing these with

[0:10:21] uh have done an outstanding job i will say that publicly that they they've done an outstanding job so but always i know this board and and i have always tried to um you know do our due diligence with you know what's the most efficient way to spend taxpayer funds so absolutely at any time you know if the board feels like that we want to rfp it and check it again we can certainly do that it may come back more expensive and then so be it you know and if they're doing other work that's not on the contract they need to be paid for that as well certainly and there have been in since 16. you know we've uh had some other changes with other facilities that we are using in different ways so there have been some things that have been tweaked with the contract and added on but yeah again certainly we can do that so i don't i would amend the motion to extend the contract to the end of this year and then we rp it in the fall and see what we get back in december and make a decision okay what was the initial what was the first question until 2021 okay so you're making a motion to amend that to just extend this through the end of the year the end of the cutting scene or the end of the cutting the end of the year and then we're going to revisit it or just produce the same this one because i i don't know we know we have anybody who can spray well let's take special licensing right and so right mowing grass we've done a pretty good job though especially at the parks and bradley's done a great job over the last couple of years but if you're going to do one why wouldn't you do that well you could i mean you could but i think one like like joel said one takes special licensing i don't know if we have anybody on staff to do that but we could bid it absolutely yeah they both have a 10-day cancellation clause for convenience so even if you even if we do it tonight and i mean you you can do everything they want to do so you're saying that let's say a year from now we don't like something six months from now we can always go back and we have 10 day outlaws so when i again said we're not bound even though we could accept the contract two years we're not bound by if we if there's

[0:12:23] something we don't like there's a 10-day termination for convenience falls in both both contracts but i'm assuming and correct me if i'm wrong but i mean that would be in there if you get into a situation where you're getting unsatisfactory performance i would think that's what it's for but if the board knows that they're wanting to seek other prices that's that's a different issue and ours is for convenience it's basically uh same thing we did with our previous contract on the right-of-ways we just can't support convenience because we wanted to do something else so there's no when you have those terminations for convenience clauses there is no either party has no exceptions we can pass the motion then a year from now or six months from now and you want to go back in december we can go back okay if everybody wanted the if they're not sure how they want to do they're not sure they want 21 or 20 or 19. that's however i want to do it's fine with me it's just you've got different options to consider however you want to do it you could do until 19. that's what the board wants to do i would rather go through the end of the year because i don't think it's fair to the evidence yeah just gonna be ten days back it's not but that's what the but even when we even when you approve it again we say before it begins but i have a feeling that contrasts gonna have the same exact loss so it's a client that has a clause now this is not ten days yeah all of the board requested 13 and all clauses have termination for convenience you know who knows what everybody wants to do but it's one of those that's not going to change the i guess different way well i'm not trying to speak for alderman hoots but i think i understand he what he's trying to what he's not trying he did express it but um the thing is with these contracts you have to have an extensive list of equipment it's very very expensive and an account like the city is crucial to their opera i mean if they don't have this counter this account or don't know that they're going to continue with it then it's it is a fair professional courtesy to let them know so they can be prepared accordingly so it would be my recommendation i get what you're saying you're definitely right but i would just say if if this board wants to make a decision tonight that we want to are a pit then i think that it should be the way honor and flores has suggested don't don't give them a two-year contract and

[0:14:24] then come back and they go out and lease or buy equipment and then a midterm even though they're giving you good service but you're just wanting to seek a better price i don't think that's fair too i think that's a good i don't think that's a good one i made the motion my motion to the end of the year okay and then that would give us time like when the the cutting season basically ends i mean there's still stuff that goes on they still do winter furnaces right so i think that uh you wouldn't want to cut it off in october when the grass stops stops growing so i think 12 31 would be good i think and then that way it gives bradley time to get our piece together and send them out and can we visit a separate decision would you make yeah confirm yes yeah that's fine okay we have a motion uh to extend the contract until december 31 of 2019 motion alderman brooks is there a second okay second ballerman hoots any other discussion and then this is on the this is on the integrated beard integrated services right okay is there any other discussion about this contract maybe we should also look at one contract well this is for the one contract but then i do want to discuss that before we move on because like i said i understand that you have to have a license to spray but if your goal is to seek uh check prices that makes no sense that you do one without the other that doesn't make any sense to me i agree i agree with that okay so so this uh to answer your question alderman payne this discussion we're having right now is just for the landscape maintenance contract that deals with the manicured right-of-ways and the grounds as with uh that we're talking about with beard integrated services is there any other discussion about this contract uh hearing now let's do a roll call yes kelly yes yes yes yes okay that motion carries now is our motion to do the same thing

[0:20:42] second holder and wheeler is there any discussion this is the northern section right this is the northern section yes from where now from from nail to good okay and the other half was approved several months ago so now both of them will be released from maintenance other discussion hearing none roll call yes yes yes yes no motion carries thank you dan next on the agenda is a contract with rj young coming this is just a contract with the um sid department or southampton police department for a printer copier and standard contract they made the changes that we requested in the past so authorization um to you to authorize chris shelton to sign this contract and is theta based on the amount of paper that comes out of that office so moved second we have a motion by brooks second bottom of a wheeler is there any discussion yes that motion carries next on the agenda our contracts with this and craft elevator corporation correct yes there's two of these contracts tonight the first one with a testing corp corporation is related to state inspection comments for the elevator and city hall the amount of the contract is uh seven thousand two hundred and something dollars but the uh it's a fifty percent down payment um for the work and based on we need to make a finding based on uh potential corrupts the ability to form the work in the past that we can authorize the down payment

[0:24:46] this is uh the city recently sold the property uh it was a large uh it's almost 11 acres we actually was a little it was it was actually 12.02 acres including the parks maintenance shop but part of it was the vacant land that is just north of the fire station on getwell and so this parcel is between snowden lane and getwell just north of may boulevard 12.02 acres we recently sold that property that purchaser needed the property where the parks made the shop was currently located for years we realized that that maintenance shop was not in the ideal location that building was actually there before snowden park was there so as the park and all the other economic developments have uh developed around there we realize that that's not the ideal location for that maintenance shop so what we're going to do now that we receive the proceeds for the land cell that's what the purpose of this is to go to bid and to build a maintenance shop which will be on it'll be on pine tar alley as you're going towards the tennis center it'll just it'll be just west of the tennis center on pine tar alley it'll be moved back on the property where it's not it's not as visible from pine tar alley that will leave room in front of that for potential tennis expansion in the future but that's the location of it and we're on a timeline as the contract gave us nine months to lease our parks shop where it is now until we moved to a new facility so that's the reason it's on the agenda tonight any other discussion hearing none roll call yes yes that motion carries okay next on the agenda's resolution for our governmental transfer to the columbus police department this resolution will just authorize

[0:26:49] transfer from the south haven police department to the columbus the police department for certain uh important private vests pursuant to mississippi code 31 713 m6 uh these investments are needed by the city of south haven and the cost of storage will actually be greater than the need for them and so the authorizations might be to authorize the transfer allow the mayor to sign the contract uh with columbus to effectuate the transfer for the equipment so i moved second we have a motion volume in florida second bottom of wheeler is there any discussion it's actually the surplus then transfer any discussion yes that motion carries next one agenda's uh resolution for lanes yeah just the condemned properties this is the resolution that allow for certain properties be filed as liens until we can amend that to or transfer those two assessments that way an event is sold um the purchaser will have notice of the lien before it goes to an assessment so tonight authorization for the mayor signed the resolution and the link is to be filed with those condemned properties mr mayor i mentioned the adopt the resolution mayor board of walderman cities how they adjudicated the cost of cleaning property imposing a penalty and posing lean on the same against the same property as presented all throughout you decide we have a motion ballerman brooks second baltimore kelly is there any discussion here you know there's a discussion from anyone in the audience that has a financial interest in any of the properties hearing or seeing none we're yes

[0:28:54] the motion carries next on the agenda is a revision to the south haven police department record policy basically uh i tell you what before we just uh we'll go ahead and uh keep making more if there any questions that chief you'll come forward can we have a motion motion is to uh accept provisions and then we'll hear to say mr mayor i mean we accept the revisions of the saudi pd record policy as presented in a second got a motion baltimore brook second ballroom gallagher is there any discussion basically it's my chief and i have discussed this it's my understanding that the only thing that's changing is that there there was previously a um an experience requirement of two years in business before you uh would be accepted on the policy we felt like that our chief feels like that this six months is more appropriate and then also the successor part of the policy where in the past uh if a company is on the record rotation and they want to sell their business uh then that would not allow the new owner to automatically be on the rotation and we we've uh and i'm not speaking for chief i'll let him answer questions but we feel like that uh that that that's not the best way to do it if someone has had a proven track record the company companies on the on the record rotation that a successor owner should be allowed what's that put in place because of the you we're worried about one company buying two or three at a time and having a monopoly that was more or less at the time okay so that's that's still an effect that still be in effect where you can't have one company can't own multiple record companies in our rotation correct well it's and i'll let chief answer but there's still those uh the criteria is still in there that it has to be separate companies at different locations and they have to

[0:30:56] have separate staff in a separate building yeah so that should eliminate that and i don't know that may have been why i was done that was before chief you feel like that that we still have protection against that and ultimately it's your discretion anyway basically what's occurred is we're almost down to three services only typically running five to six and this two year restriction before they can be put on rotation new company comes in we're about to go out of record companies geez i only had one question uh about releasing property i mean years ago i owned a record service so i know a lot of times if you know if you let people come get all their stuff out of the car if they have a wreck or something like it they have no incentive to come back and pay the bill or anything like that you're left holding the bag so to speak uh i mean i know we're not trying to be in the you know making manage to micromanage them and that kind of stuff uh do you have any idea why we have that in there once uh once the record service takes custody of the vehicle and they sign the form the property is on the inventory for them it's basically the responsibility of record service they own the properties in the car so if they give it back you know i don't know that we have the latitude to get involved in that after is that something we got we should probably remove from that list i've got a look at that specific policy again yeah apparently you know [Music] once once the record server picks it up and they signed the form stating that property inside the car belongs to the record service and we're not liable or responsible or have any control over so you know i'd have to look at that particular section again okay let's go back to the one owner of multiple companies so they have to have separate books separate locations

[0:32:59] yes so they have several books they have separate tax identification yeah okay if i remember correctly it was put in place because you didn't the idea [Music] if i could add my personnel the ones that they call the records and uh just to answer alderman hoops questions the one of the issues that we run into often is if the record companies don't give the belongings back people have an accident insurance companies don't run over there and pay that tow bill right away so a lot of times it could be an individual's tools they need to go to work the next day it can be that medicine that's in there their cell phones personal belongings things that they need to carry on they don't let them go over strip radios and things like that but they won't get their easy removable personal belongings and in times past we've had some situations where some of the record companies you know you can't even get your purse out of there because you're transported without your person you're medicine unless you pay for the bill a citizen who's now been unfortunate enough to be in an accident and maybe transported to the hospital or something they can't even get their belongings out of the car and the insurance may take you know two weeks eventually they're going to pay their money but the insurance may take two weeks and that's so those people can get their license well you know by me owning a had on the record service i know both sides of it and basically once you pull the you know state law allows you to you put a garage keeper and lean on it basically what it is and state law says you don't have to give them anything until they pay for it i mean i think most director services if it's tremendous and stuff like that they're going to let you have it the problem is it hasn't always been yes i mean i i mean saying that maybe we need to tweak that a little bit where it's not so cut and dry that they have to do everything you know and you say hey look you know we we expect them to work with the people for medication and necessity kinds of things because what happens is they leave it and then you know you've paid your record driver you paid you know you paid all this other stuff and

[0:35:02] you know you can't get 125 bucks for the car to have a scrap metal down so then you're in you know they're in the hope and you know these guys are doing us a favor you know they really are helping us a lot by being available to clear those scenes and stuff for them so it was just something i saw that i thought it would be an opportunity to work and kind of clarify and make it easier for everybody and you know not making so much of ironclad but i mean i think it's the suggestion would be would be better that's what i'm thinking yeah well i mean this is you know it's a it's a um an ongoing thing it can be changed again i mean that's something that we want to give the chief time to go back and evaluate your concerns and if he wants to come back and we can obviously amend it again but tonight we're just trying to fix the problem of uh you know the experience rule and also the uh the successorship i think it's a good idea is there any other discussion okay we had a motion already baltimore brooks and alderman gallagher is there any if there's no other discussion roll call please yes yes yes yes yes that motion carries okay next on the agenda is the sole source of sole source resolutions for our public works department so two resolutions tonight the first sole source purchased is for a cb 1.7 compactor it's the amount of 25 000 american tops of machinery this particular size compactor is only sold that tops the machine near thompson machinery and caterpillar caterpillar and this whole service letter is included so authorization of the mayor to sign that resolution and purchase this cb 1.7 compactor based on the size and sold first layer in the amount of twenty five thousand three hundred ten dollars kelly second ballroom brooks is there any discussion hearing none roll call

[0:37:05] yes sole purchase is from our uh the talon system insulation uh cost amount of ten thousand four hundred and eighteen dollars from ek automation um this has to do with the uh city hall um air systems and our mechanics and security systems uh so tonight authorization for the purchase amount of two 2418 ek automation and authorization for the mayor to sign the sole source resolution and they did revise the contract that we needed it to be as well so um bradley was signed a contract but mayor with some resolution what's that move for the motion monument flores second of all wheeler is there any discussion hearing yes that motion fairies is that all the resolutions yes sir okay next on the agent is a service agreement with spy glass group this agreement is for the audit of the city's telecom services um spyglass will review a deadline but no longer um lines are in use numbers and tax machine or fax lines along with the plumb of the fees and services charged by the charge to the city and they will be paid based on the percentage of savings of the city so they will get paid based on what they can find as far before being built for services we don't use a telecom perspective so authorization for chris wilson the sinus agreement is fine [Music] motion baller mcgallagher second longer than wheeler is there any discussion hearing none all in favor say aye aye

[0:39:08] any opposed say no eyes have it motion carries okay next on the agenda is a the um requested house of grace donation well basically uh it was based on the presentation that was made by supervisor bill russell and supervisor mark gardner at the last meeting whenever they had indicated you know that they were helping house of grace who is having financial problems and there's been some restructuring of their accounting system but they're obviously having some problems so basically what the request was in budget year fy 19 now that we allow a an emergency type donation of nine thousand dollars uh and then they were requesting which will be uh would not require action tonight but they're requesting nine thousand dollars in budget year fy 20 as well but it's the way i understood it that they're requesting an emergency donation of 9 000 and it's contingent upon all the other municipalities and governmental entities that have citizens that have used the services of house of grace so i would think the motion if if the board so chooses to do this i would think the motion would be contingent upon all the other entities also agreeing to provide emergency funds i'll i'll then i'll make that notion that um donates the house of grace um your contention upon the lab just i i mean that that's the llamas actually have a motion uh to that of exactly to

[0:53:32] we were doing some research trying to identify the actual width of that in grass egress so you'll see on your report that there was a discrepancy between 50 feet and 15 feet which is obviously a big discrepancy we backtrack to the original designers with eti they have admitted an error on their part it is not 50 feet it is in fact 15 feet on this side and 15 on the other side so we will have that addressed on the plat before we record it staff has no other comments regarding it it does meet the bulk regulations staff is not going to give a recommendation because it is a civil link member who's actually subdividing this and branching off so since there were our city engineers we didn't want to render a recommendation but planning commission voted unanimously in favor of it okay on item four have a motion model for brooks second volume and flores is there any discussion bearing done roll caller yes approval request to subdivide 2.59 acres of property on the east side of 51 and the trinity lengths development they want to subdivide it into four lots ranging in size from 10 281 square feet up to 35 000. there's also a parcel a proposed on this which is where an existing utility station is so they have subdivided that out and have proposed to keep parcel a uh at a total of twenty four thousand nine hundred forty one square feet it will have direct access off of fifty one there's a thirty foot drainage easement

[0:55:33] showing from sweetwater drive down to lots two and three then crossing along the rear of three and four uh this is deemed to be a public easement uh they do have a continuance of 15-foot landscape buffer along highway 51 and have submitted the wooden fence on the perimeter of the lots along 51. uh it does meet the pud setbacks it meets the lot sizes and the square footages uh however the one recommendation from the planning commission from my office is since there will be a utility station there occupy 24 000. we talked to our utility director he would prefer vinyl coated flat chain link fence with vinyl slats in it for screen purposes so that is going to be one of the contingencies on the subdivision with that recommendation that was approved i'll make a motion that we approve item number five as presented second one out of five have a motion waterman gallagher second and kelly is there any discussion what was that before it looks like it was it wasn't it was an open space that was proposed to be subdivided eventually it actually had a code design in it but when we looked at it and and kind of tried to redesign the code but the straight through like this worked better for the lots it was just the last phase of it the reason why it wasn't developed sooner is because we did have a super compensation or lift station that the city was working on i think that's now been addressed and working on their own parcel so then it sold and was ready to be sucked about it any other discussion hearing none roll call yes no motion carries our last item after speed unit does not require a board motion but it is something we're presenting now 1179 main street which is the infamous old taco bell we do have a tax incentive request

[0:57:36] proposal put forth in front of us for a new community donuts coffee and donut shop there um you'll see the paperwork they've submitted uh they're somewhere around 600 000 improvements proposed on it there's also a rendering in there as to how we're going to do the improvements this will include uh removing the spanish tile putting pair of walls up and and parapet line along the the top painting the building adding a new driftwood in it new windows new landscaping and renovating the inside as well and for pernic also what we will do is once they complete all these we'll have them resubmit to us to show that they actually divided by what they said they were going to do the costs were in line with where their estimate was and then we'll recommend approval for the tax incentive program after that that we just wanted to put it in front of you tonight just to let you know that they will be applying for it and if you see some construction going on over there that's what they're doing and would you say the old building was still taco bell on site yeah we have another big one that we couldn't get on the agenda in time but next meeting you'll have a really big tax incentive are you still not asking for don't they still want to know um obviously it's contingent upon them doing these things to the building but don't they need to know that don't they want some board approval that they would be approved contingent upon this or tonight you just put it on your minutes and they have to come basically you don't approve anything until it's done and under the statute okay so what are and i'll just add to that again uh for the for those that um that commonly want to talk about the failure of the west end business district and senate it's not failing it's working okay uh it all doesn't change overnight uh 30 years of migration from one part of the city to the other it does not all change in in one in one year or two years or three years or

[0:59:39] whatever but you can see that the incentive is working and we're gradually making some progress in our original business district that's right anything else how much did you say was going to be spent on that uh this one has a breakdown of um there are 268 thousand dollars on the remodeling stuff and yeah it's quite a bit of work on it uh the lady has already got the community donuts um obviously here but she wanted to utilize this site she liked it she's been working on it for months with us um and like the mayor said it's there's been an influx of the tax incentive people coming through right now and so we have a big one coming in front of here that's going to take about five buildings um at the next agenda so it's it's working we've eaten a lot of tacos at that place next door uh bottom line i mean like like i've said numerous times is uh what we're waiting on is there's a pending insurance investigation um it's it's uh very frustrating you know that that collapse happened on december 31st of last year and so i've been in touch i've reached out to them i've talked to state farm as the insurer nick has talked to the attorney involved and the bottom line is they're just really they're telling us it's under investigation i don't know if there are problems between their uh insured and them that's what it appears to be but i can't confirm that i don't know all i can tell you is that they're basically telling us nothing so actually nick and i talked about that today uh we're reviewing our next step you know before we condemn it just so you know as and the full board knows when you condemn it that's on us we'll be paying the calls to tear it down we also want to make sure that we give proper notification to all the lien holders everybody else that would be involved they'll have a

[1:01:41] financial interest in the property before we go and condemn it so it's not just as simple as hey go knock this thing down it's dangerous i know it's dangerous it looks bad i hate it i mean whitney and nick can tell you they're tired of hearing me talk about it uh i hate it but uh but we're gonna do what's proven for the city we're not gonna rush out there and do something that could cause us to have costs later in uh with litigation and other things so uh anyway uh i i don't know what to tell you other than that uh we're wanting to to change now but we're not being given the information to make that decision yet but we're on that we're talking about that weekly is there anything else that you want to add there about that no i mean nothing that um the mayor didn't address i mean the attorney um just ending at this point they they're kind of still under investigation and would not take seven months so there's something going on but we're just not privy to that okay any other questions for whitney here okay thank you okay we'll move on uh next on our agenda is our mayor's report uh just a follow-up i know the gentleman is not here we had a gentleman last meeting that came forward and requested a vfw sign on highway 51 uh just a report we're going to contact him individually just to let the board know we have reached out to mdot we're trying to get a sign but uh hopefully they will allow us to do one of the brown special marker signs and we'll put that both on both sides of the road for north and southbound traffic on highway 51 for our local vfw the next thing i want to talk about you know everyone has heard uh is familiar with what our city went through as we talked about earlier this evening about the walmart situation uh don't need to go through all the details uh some things obviously uh that do not need to be discussed in public we're gonna keep the identity of our officers

[1:03:44] private that's very important the only thing i want to say about that is again is just as a city to all the board members to all the residents of the city you should be extremely proud of your first responders as chief moore indicated uh last week in his press press conference there was training for an active shooter event that happened within two weeks of when that happened and i was present i went there and uh listened walked the halls just so i could get a grip on what actually happens so to see that as a training event and then to see it happen in real life uh just it makes you proud of your people because everyone did their job they all worked in unison together everyone was just true professionals in a very very scary a very very tough situation and when i tell you uh the courage of our people and it starts with all of them you know you got you got your uh dispatchers that get that call and and they they do their job they do it perfectly uh you have our fire and ems responders on the scene that are chomping at the bit to get in the building um you know even knowing uh that there's danger in the building and then obviously you have your police uh that are there in three minutes and just uh you know the help that we got from other agencies as well uh some of the horn lake officers were some of the first ones on the scene uh never did they hesitate to help the city of south haven and and you had all the other agencies um you know that they were on site as well so we had great uh great coordination it was just just a real you know terrible moment for our city but you got to be proud of the way our people responded and the last thing i want to say about that is without getting into detail i just want you to know that that your officers uh your south haven officers um one was between shifts uh could have easily ignored that call but chose to be the first one on the scene and so he's a true hero and then the other

[1:05:46] uh you know knowing uh when you're an officer and you know what's already on the radio you know what's already happened there but that doesn't stop at all you continue to charge for it in an extremely dangerous situation uh that's a true hero right there and that's what happened with your southeast police uh last week and then the last thing about that is make no mistake there was intent to do more harm it's sad that that we lost brandon and anthony it's terribly sad but i can assure you that the intent was to do much more damage and your police officers stopped that from happening so we had some true heroic performances so when you get a chance to uh know the identity of those i would just encourage the board to reach out to them and give them a pat on the back and thank them for their bravery and chief moore we appreciate your efforts too you did an outstanding job chief scallions thank you chris shelton uh mercy communications outstanding effort by all okay thank you and then moving forward speaking of which i understand that there's going to be a partial reopening of walmart tomorrow with the fire in the building you know part of it's going to be sectioned off some of the inventory is not you know was damaged so but there's going to be a partial the way i understand it the grocery and pharmacy is going to be open tomorrow and so um i just ask everyone to rally behind thursday okay thank you so thursday there will be a partial reopening i just want to encourage everyone you know let's help walmart's a key business in our city and have been has been for a long time so i just encourage everyone uh to help you know get let's get back on that pony and ride let's go back there and shop there again let's go buy our groceries there it is safe you know it's it's time to support them and so when they have their grand

[1:07:49] opening i'm just encouraging the city you know to get behind them and help them with their reopening to get back to a state of normalcy again and then last thing that i have this evening is um we do have two special meetings that are coming up with a budget workshops uh chris wilson and i have uh prepared after meeting with all the department heads initially we have prepared a balanced budget for you and so we'll lay that before you tomorrow and again just to make sure everybody understands that's in no way suggesting that that it's a final product okay all that we're doing is trying to save the board time to go ahead and help us move forward so we're going to present a balanced budget to you we're prepared to tell you what's in the budget what's not in the budget that may have been requested by department head you'll get to talk to the department heads and hear their priorities as well but i just want you to know that um that we have that that preliminary work is done and i will go move forward with two meetings uh both tomorrow and thursday and we'll do we'll do the same format we'll have each department head come forward we've asked them to limit their presentation to 10 minutes so we have time for questions and answers after that but again if there's something about the budget you are the board of aldermen you are the ultimate deciders on how the money is spent in this city so don't let anything that i've done um i don't want you to misperceive that if there's something you don't like about it tomorrow and thursday is the time to speak okay and i think that's it so we'll move past mayor's report next on the agenda is our citizens agenda we did have mr pirro hit please come forward thank you mayor thank you board i just wanted to request the leniency i have developed several hotels in desoto county this is the first time we got ticketed for having been storage bins on our renovation site that we are renovating the hotel and we are trying to remedy the situation and get rid of those bins as fast as we can it costs us money it doesn't look very good for our guests

[1:09:52] also being part of the hotel requirement for renovations we have to have some storage capacity at the site and my i was ticketed because we did not move those bins and i requested the officer i want some leniency of time where we can finish this job how what what is actually going on what are the beer what are you doing it's furniture light fixtures like mirrors uh headboards everything that goes into our room it's a new scheme that hilton has come up with and we have to take the whole furniture out and put in a new one and it's just a tedious job and you have a running hotel you can only do certain rooms at certain times not work like a 24-hour situation how long has that uh renovation process been going on for five six months now okay when is it for jen would you expect it'll be finished i would say about four or four months four more months that's a pretty lengthy renovation unfortunately it's a lot of this stuff doesn't get manufactured here it all comes from different ports you cannot start the construction until everything is there before you take a room down and it's it's just that situation the economy is so good it's hard to find it but it's hard to find a lot of things that are against us working at the same time which is good for us and unless as you mentioned you know for your own um you know corporate damage and your customers coming there you don't like the look of it and the same reason you don't like it our citizens don't like it either it's a high profile location where the bins are faces i-55 so it's almost like when people are you know coming into the city from the south side they see those or they pass those bins all the time it's so visible that's what the concern is from the citizens and i'm trying to get rid of this as much as possible as fast as possible let's be honest about it i mean if i'm paying very high right for these things and i want to get rid of that and austin would you come forward just tell us like kind of what the process is on what's been done you know from a code enforcement standpoint thus far yes sir well the bins showed up on over a year ago i believe and they said that for a while before anything was done obviously we were getting calls on them

[1:11:54] so we went over there um probably back in march or i can't remember the exact date but uh we were talking to them we were given a timeline of like you know a couple more months whatever the code states that they're you know they can have them but they're they're supposed to come in and get the work permitted and get the storage fence permitted that was never done so since that was never done we we went over there and did an investigation of the violations not only were the bins a big problem but they were also doing work in the parking lot that was causing trash and debris accumulation there was evidence of stormwater violations uh where they were washing their paint down in the storm drains and i got pictures of um and it was just it was unsightly obviously for i mean like the mayor said it's a high profile area so not only are the bins a big concern but uh the trash debris and accumulation which is what he got ticketed on what not only were the bins a problem but the attraction grant accumulation was an issue too and our uh i guess our department stance was we have to come up with a day that these things have to be moved we've been speaking with you ever since they were dropped off you know we were kind of given the run around there's no permits pulled the building department had stopped the work because there was faulty wiring being done and it's my understanding that when we finally put give the guy tickets and put a hard deadline of july 1st on him and we went to court for tickets and the building department shut him down because faulty work was being done that's when he came in and started applying for permits and the necessary paperwork to do the work you know do the things the right way by the city and we do have more help now and there is definitely more manpower being put in this situation and like i said some of this stuff we cannot start with construction till everything is in-house and that's where he said that yes that has some

[1:13:56] principle not there but the work was not going how long have you been in this business many many years yes it's a while i'm assuming and i could be why was there no permits full to begin with like people like also saying wow why was it done after the fact well i did not realize that there was light fixture that had to be rewired i thought they were just getting replaced okay and that's where the problem came and i did not realize it till till the fact was done and then i was told and then i stepped in and i said well the contractor or subcontractor you hire someone yeah yes the contractor that we have so awesome the contractor first but for putting the paint down the drain or yeah uh i mean after the surely they got to have a better time right you know in a situation like that um we didn't see we just assumed it was them that was doing it uh so you know we talked to we talked to them about it but the paint's on the drain i mean you can see i got one of a couple of the pictures in there um i got pictures of the storage bins when we wrote the tickets most of the pictures i took from today are just the work and the trash and debris and accumulation that's still in the parking lot but there's still 22 storage bins over there right now and those 22 storage bins in my opinion i don't think any of them have been taken away or moved i think when we started talking to them about it there was probably a little over 10 maybe 15 and since we asked them to move them they dropped off more so it was my understanding that instead of going you know helping us out or we they started increasing the amount of storage spins that were over there and when that happened with the work combined and the problems that we were having with them we just put our foot down and said hey we got to get these things moved i understand that go ahead i'm sorry well i understand it logistically it is a nightmare

[1:15:58] he you know it takes some money to do the work in the parking lot all that i don't know i mean if the city is okay with him doing the work over there me not you know but i personally don't don't agree with what the type of work that's going on i agree with you austin uh i think that a year is plenty of time from the from the from the time that they bought those things in i am uh interested in a solution is there any way we could uh put the storage units all together in one area and then build something around them with looks yes sir i was recommending to put a fence around it like with the fabric on that so it will not be an eyesore because most of the work is done inside the rooms i mean maybe the guy just watched his brush and not realized that she should not do that well ultimately that's your responsibility uh i realized that your contractor did it and everything or may have done it but ultimately it goes back to you you've got to oversee that you need you need to be doing it anyway it's your hotel you want to oversee what your contractor does make sure that you're getting charged correctly and that the work is is completed properly so we again i understand that this stuff went down the drain from the contractor but in my opinion that falls back to you i agree i'll take the responsibility of that and i'll make sure that he doesn't do that again how many groups have you got done so far for 35 to 40 rooms then you have any more here seven total ropes we have i want to take you to do this we were giving them five rooms a week to ten days to finish and then you will give them get them back and then we will give them five to ten more but now we have decided to give him 10 rooms at a time so he can speed up his building so your estimation is done so another 90 90 rooms so another 10 10 per week so another 9 weeks 10 weeks so and

[1:18:00] like i was saying it's very hard for him to have all the people working at the same time with the hotel running he cannot make any noises till 10 30 in the morning till everybody is gone and then he has to shut off at five so it's very limited to do it uh hours that he works also okay we'll understand too the leniency you're asking for is the storage spots because we want to allow leniency on trash and debris accumulation and that's correct wait is the ticket been issued yes sir so that mean the correct form would be the courts and i think i mean the the board will mean morgan authorized austin to um tell the judge you know this is the city's position but it says a ticket's been issued had to come to a judicial officer at this point the remedy and or punishment well he's been to court we're going to and i wanted to make sure that i don't get another ticket because work has to go on we would have already issued more tickets but i'll just i don't have a i don't know how y'all feel i don't have an issue with it if you can get something built around them get them in one area get it built around them where it looks good where we can't see the bins and everything i don't i don't have an issue with giving you uh the extra two and a half months but again i think a year has been plenty of time so that's on you if you can get that built quick enough and the rest of the board if they agree with me or disagree that would help having some time that i would at least make a lot of improvement in that time i don't know can he build something like a fence around us and close them in i don't know that's a tall i was going to ask the same question that's a tall fence to hide those bins fabric that goes around these fences i think instructions

[1:22:23] my concern just knowing what that looks like with a temporary fence it would look i don't know that that helps to look i mean it's going to look like a construction zone even more so but um but what are the gallagher's talking about is if you did whitney's suggestion if you move the uh the containers uh to the other parking lot where they're naturally shielded from the interstate with the trees uh that would be more aesthetically pleasing what do you think he's the general manager okay so uh basically like all the containers are already have stuff in them already so some are like glass and uh like the the stuff of the bathroom they're in the container so moving all the containers to the other side they're not going to fit over there and so what can be containers might be done and if you don't know they're not going to be updated they're new items all new items so it's not trash it's storage yeah hotel right now once we move those out those of us into one container and we have a liquidation they kind of pick that that the dog is out of that container and take that then we put another set of items in there all right so are you saying that what whitney suggested there's not enough room to move there's not enough room to move all those containers over there plus they're just like they're like warehouses they got all their stuff warehousing and stuff and if he moves it it can break everything like all the mirrors and all the stuff they've got in it so they're kind of like stuck with the stuff there that they get through right i mean we're trying to provide a compromise here i understand and you know it's and like even like some of those stuff like the for the bathroom the tub like the tub like especially like all of those are on the property as well so with containers we got to move back there as well and it just wouldn't be enough space i know it's an eyesore bundle it's about

[1:26:28] not bringing any out we're just increasing them so that's when we were like okay well yeah we had to bring two more containers in because of the new items we checked with that just came like refrigerators and box springs but those containers it'll be gone soon are there any that are can be made now um as right now no because we've stopped renovation so right now no why have you stopped renovation because we have to get the permits and everything that wasn't done they're the building department stopped yeah for the level when will we start renovation again absolutely i don't need to start now i talked to james this morning about it i believe he said that they were good to go again but um i hadn't seen anybody when i took pictures today nobody was over there working so i don't know that's i expected people to be over there asap just because of the nature of it but we have the electrician he's already started in coming in during the wiring and we had good weather today but it's supposed to rain the rest this week so soon well i think we can wrap this up i'll make a suggestion for us to wrap it up i mean obviously just so we can know that for the record you're about six months late having this conversation we've been very helpful we've known that but since they've been there so long it is an eyesore it looks bad it's a violation our code enforcement supervisor is doing his job he's done that properly so we'll need board action tonight the board wants to give an extension and hold off on any teacher violations they have the right the board has the right to do that right now the board has a right to tell our credit enforcement supervisor to halt uh enforcing our ordinance for two and a half months variance for the variance of variance i guess what is the ass tonight i mean i understand my ass but you're asking our code enforcement to stop issuing violations for two and a half months that i understand that right i mean yeah i mean in granting a marriage it's a formal application we have watch grant the variance so i don't know we're gonna have to how that works

[1:34:35] the uh hotel rooms have to be shipped there initially like when you open a new hotel you have to have beds and furniture in the rooms uh dresser drawers and and uh you know pictures of the wall lamps whatever else mirrors that's all shipped there when you put it there well i i guess what i'm wondering is why if there's a way to transport when it's new it has to come from the manufacturer to get to your hotel why couldn't you pack it up and move it off location that way it's not a nuisance to anybody and then you're not on the timeline this just never happened before and we always renovated these hotels with the container with the bins like we're doing now but you you said when you first spoke that it's never been taken this long because of temporary labor situations and that kind of thing that's unfortunate part right now that we are going through is that people that i hired have not been able to produce fast enough at the same time we are running into summer we could not give them more rooms yeah and the stuff is all coming from china sometimes it doesn't come on time and tariff is going on it was too much of a chaos this time otherwise it never had so much situation before i just i mean of course the board board sets or changes the ordinance but i just know from like listening to citizens and what as a citizen myself what i would say is it's uh it's aesthetically very very pleasing it's not a good thing i mean we know that businesses have to do renovations at times but it just that's a long time that's a long time to have that many storage bins out there that's the purpose of the ordinance whoever wrote the ordinance they had a goal at that time to stop you know this type of thing from uh having that negative impact on the city this summer is over i think and as you go along you get speed built up i think you'll see a lot more movement now okay well if uh nick what you're saying it could be considered permanent instead of temporary maybe well no tonight based on the um i want to say testimony based on the discussion um it is they are uh claiming that the hilton garden is claiming they're not permanent and they'll be removed by
