[0:00:00] this meeting to order please stand with us we'll be led prayer of alderman gallagher please remain standing for the pledge of allegiance that will be led by alderman scott ferguson heavenly father thank you for allowing us to be here today lord we uh ask for prayer for the people on the gulf coast lord jesus that you'd watch over them as the tropical storm is riding over lord we ask you that you watch over our children as they're here thank you for your blessings to south pledge america to the land of the united states of america and to the republic for which it stands one nation under god indivisible with liberty and justice for all before we get into the agenda this evening i'd like to turn the floor over for just a few minutes to uh alderman scott ferguson before he does that i have a few words i'd like to say this is um alderman ferguson's last meeting and i just want to just personally tell you that it's been a pleasure to work with you i've admired your your love for south haven and all the efforts that you've given us over the last four years you've you've done a great job for the city of south haven and i just want to personally tell you that i've enjoyed working with you and i appreciate all that you've done for the city of south haven thank you mayor it has been truly an honor and a privilege to serve this mayor and board and the people of ward 5 and the city of south haven four years have gone by fast very fast i think looking back it will show that more was done in this four years than any other time in the history of south haven i was asked the other day why i would even show up at the last two meetings that answer was simple

[0:02:03] we all took an oath to serve the people of south haven and i will do so until my last day in office as i have most of my adult life whether it was to protect as a police officer or to bring integrity and financial accountability back to city hall i want to thank each one of you for your unwavering support for the projects not only in ward 5 but city-wide i would like to personally thank all the departments directors and all the people who have helped move this city forward some of you have heard me say this but it is worth repeating elections and politicians are temporary but the friendships i've made will last a long time thank you okay first on our agenda this evening is the approval of minutes for the june 6 2017 meeting mr mayor move we approve the minutes of the regular meeting of june the 6th 2017 with any additions deletions or corrections we have a motion by alderman payne second alderman hale is there any discussion hearing none roll call yes okay that motion carries next on our agenda is an agreement with the sutton county convention and visitors bureau mr nick manley is this agreement with the convention bureau to allow the city to do uh in-kind work in a mountain that big c ten thousand

[0:04:04] dollars uh and it will end up assisting or will assist with the um veterans park that they're doing at that location the authorities under the 1717-1 code missing code the county has approved it is participating as well and the city would also participate the agreement between the city and the southern county commissions and your visitors bureau so moved second go to the motion monitoring flores second ballroom in pain is there any discussion hearing none roll call yes okay that motion carries next one agenda is a resolution for a donation request of the south haven arena can i say something absolutely me and the wife came up here tonight just to thank y'all for really helping us on this park we appreciate you so much thank you to william he is um one of the board members he is the president of our board and it's been a long process but it has been done with much much love for all of our veterans and we're really looking forward to the completion of it and we appreciate y'all and everything the city has done so we can get forward with this we're looking hopefully maybe at the outset we're thinking maybe three months okay we could be open you know we'd like to go ahead and open her and then maybe have a grand opening on veterans day okay and uh but we still appreciate everything you guys have done thanks william we'll check you on a meeting thank you and uh we appreciate you thank you thank you thanks for all that both of you have done y'all bled this project it has been a labor of love it's been frustrating at times but it's been well worth it well we're excited about it i know the board was prepared for this night you know since we've talked about it a lot but we appreciate all that you've done and we're equally excited about the opening of it and you know we did

[0:06:07] mention in one of the prior board meetings the hope that we would um coordinate that with christy faulkner as we in the city as we do the veterans day luncheon so please be in touch with us about that as we get closer to november and let's try to uh maybe we can incorporate that all together and be special and veterans be glad too thank you thanks mayor appreciate it thank y'all okay next on the agenda's resolution for a donation request of the south haven arena by the mississippi department of employment services rltc desoto county and the hope center these are for three separate entities but we can do it under one under one motion in a second in both because there's be for three resolutions but the governor's therapy is requesting it for the department of employment services rotc the center county is the high school rotc uh was requesting it for their banquet that they've had and the hope center is a 501c3 requesting it for a fundraiser for saint jude mr mayor i move the adoptive resolution donating this city arena to the governor's job fair of the horn lake high school rotc and the hope center we have a motion volume and pain second bottom inhale is there any discussion what's the variance for the hope center those are alcohol big strengths any discussion any other discussion hearing non-roll call yes okay now motion carries for all those next on the agenda is future electronics personal property tax exemption this is the uh property tax exemption our future electronics it was it's been recommended by the desoto economic council and was

[0:12:22] everything yeah i mean that's just going to be the stop sign yeah i mean if you're blocking traffic can be blocking a uh and right away and it's blocking that that's something to do with but to answer your question as far as going through and cutting someone's yard you have to go through the process no i mean but is the was the was the mistake made based on time or somewhere else i mean was the notice given in time for us to go ahead and get this on tonight all right you'll have to want us to add it to me i don't know 1734 it's got a big bush around the mailbox and it's growing so tall melvin says they're still we can do that immediately i can talk to bradley and uh we can get public works to go there and get around the mailbox they're on the stop sign right now meantime i'll shoot you an email more in front of what happened it may have just been having been working the property owner it may have been elapsed between when our co-enforcement supervisor left and didn't finish this resolution i don't know but we'll find out for you yeah cause i mean the tag was the tag was on the house quite a while back so that's why i was trying to figure out what happened with that sounds like we did make a mistake yeah well it's like yeah is it over july 5th list is it only this year that's i'm getting hammered on that one can we vote upon an emergency condemnation here now tonight well yeah i don't know what the emergency would be

[0:14:24] on the private property i mean that's i don't think there's such a thing where you see on the private property we'll take care of the mailbox we'll go ahead and do that wow okay the hearing date for july 5th for the notice that's the hearing that's what i was wondering about so is there a backhand is anyone left but if you have a hearing date that's been set by july 5th you can't i'm not trying to give everybody you can't then go change the hearing date after it's been set according to that 21 19 11. on the hearing date i don't know the first time it was set and it goes for july 5th yeah we'll explore tomorrow we'll explore any other options that may be possible but as of tonight looks like there's not a way that we've been connected we will address the uh the uh right away the public right-of-way will take care of that bradley will you help us with that that's it did you get the address would you give gravity yeah okay okay thank you okay so there are no other properties no other action is needed on uh on that one next on the agenda is our planning agenda sweden cook yes sir we just have one application it's a request to vacate an existing pud known as the villages of magnolia gardens it originally took m1 light industrial zoning and made it into 378 lots of small small lots small heated square footage residential at that point in time and 03 to 05 we didn't know how it's going to play out down there residential or industrial

[0:16:25] there was a lot of development going on um it has remained in the light industrial design and therefore the property owner and staff both agree that this is not conducive to residential no dirt's been turned for five years on it so by ordinance we are allowed to reverse back to its original zoning which would take it back to m1 i'll make that motion second we have a motion ballroom in hell second bottom and brooks is there any discussion planning for that yes it i don't feel that it ever should have been planned out this way that's how it needs to go back how could you even get to it off of state line tulane ralston staulton all the way through the industrial area and back to the residential all the way down yes it's not conducive to residential whatsoever is any other discussion hearing none roll call yes okay that motion carries thank you whitney next on agenda's mayor's report i've got several things to review tonight i'll try to move quickly the first thing is we did get our renewal for our property casualty insurance from travelers chris mr chris wilson would you come forward i did not bring the packet here but the the numbers it's a very very small rate increase which we're extremely uh proud to see with our loss history in the city of south haven we expected much worse news so we feel like we're very fortunate to have an offer from travelers to renew the policy they've expressed that they value the account they value their relationship with the city of southaven the rate increase shows that very happy about that and chris if you will tell the specifics on the prices yes sir keep

[0:18:29] in mind the board last year we also brought workers comp in under the traveler's umbrella to try to um what i could generate more business for them but it also brought us all in the same umbrella of insurance so our previous year premium total including workers comp was 1.387 million dollars the renewal for 1718 is 1.463 which is a difference of 76 000 approximately basically we're looking at a two and a half percent premium increase which you know you look over that's like you said given mayor said given our loss history and our exposure um we're working on our brokers didn't have who all he spoke to and to shop it out which he does every year except to say that there's some companies that simply won't quote us when you talk about the amount of vehicles that we have and the amount of law enforcement officers that we have that's a great exposure as as you know if you break down and actually those two areas are our business are our auto and our general liability law enforcement which do areas of the greatest increase workers comp actually increased less than two thousand dollars in premium on a five hundred twenty thousand dollar policy um and that that's um we work the trial to be very proactive in the workers comp uh get people back to work as soon as possible and to try to avoid the appearance of fraud or any fraud workers comp um our cyber liability did not change it's 10 900 and again this is a 76 000 increase and like i said it's a nice strong recommendation given our working relationship with travelers and the uh really the way they've worked on behalf of the city and mayor and board on our claims to uh adopt his policy moving forward for fy 17 and 18. i'll make that motion that authorizes the mayor to sign those documents one more comment just about that specifically from an insurance perspective to make sure everyone understands

[0:20:31] a lot of the risk when i say that we've had a poor loss history that's not a negative reflection on the city of south haven or our police department a lot of it the biggest negative the biggest challenge to insure us is obviously our police exposure but again that's nothing negative against our guys is just a it's indicative of the climate of frivolous lawsuits against our police department right now we have a motion by alderman flores and second baltimore gallagher is there any other discussion and this again is just authorizing me to sign the renewal and accept the renewal from traffic uh this is renewal date of july first that's right so it cuts mid-year the money for this is budgeted in our fy 17 budget any other discussion hearing none all in favor say aye aye all posts say no i just have a motion carries thank you chris all right um recently we received our public works department and mr bradley wallace received a combination from our mississippi national guard and this is basically um it's an award expressing uh evidence of of our support of men and women in the national guard and their military service so i'd like to thank mr bradley wallace and our public works department for uh for doing an excellent job in supporting our our service people as it relates their employment with the city of south haven thank you bradley tennis is open our tennis facility opened we had the grand opening saturday morning so our new tennis facility to eight new courts are now in use i would encourage everyone if you do play tennis to use those although we expect to have tournaments on weekends upcoming there will be public public courts available at all times so if you want to play tennis we encourage you and um you know to uh to use these facilities very excited about it on uh july 6th we have a special event um alderman william brooks played a big

[0:22:35] part of this um we're gonna have an event at the snowden house seniors i'm up at the senior center on july 6th it's going to be an honor for mr hal guthrie who's a local south haven resident who served in vietnam and he earned multiple purple hearts with his service combat service in vietnam and for whatever reason he only received one of those so for all these years he's never received his second purple heart so thanks to alderman william brooks and congressman trent kelly who will be present in south haven that day there will be a ceremony to honor uh mr hal guthrie as he gets his purple heart presentation on the 6th yeah thursday night every everybody's welcome i'll be sending out an email uh to all especially all of you and all of our local elected officials and we'll probably press release out of our office the congressman's office to let everybody know it'll be uh two weeks from thursday so thursday night six o'clock in the senior center everybody's welcome awesome okay and then um the board knows just for everyone to know on june 27th at 11 a.m at sochet park right here behind city hall there will be will be a small swearing-in ceremony for the new mayor and board and then also just to update the board i've mentioned to y'all that we will have a city planned budget workshop type meeting we plan to do that here at the board room and trying to the earlier we can do that the better basically this is what i want to share with you my plan the things that i see are important for the city over the next four years i want to welcome your input i want everyone to have the chance to share their goals for their specific awards and just get everybody in one room so we can develop a plan i learned over the last four years that although we were able to achieve a lot it would make us more efficient if we all get together and lay everything out initially that way it's clear when

[0:24:39] things come up on the agenda or you see you know things that i'm sending emails about or that i'm discussing here is not the first time you heard it you know you're aware of like the order in which we plan to do these things also how we plan to fund it it's no secret that as i've mentioned several times with my department heads we're going to have to be a little more creative budget-wise obviously we lost our tourism revenue you know when you take you know 1.9 million out of a budget it's not it's not a minor thing we're going to have to look for other ways to move our city forward but i will tell you that i'm not a do-nothing kind of guy i'm not going to sit on my hands and wait for people in jackson mississippi to do what they should do i'm going to do what i got to do to make south haven a better place to live and so on at this meeting i will lay that out i'll explain to you what i think is important how we're going to fund it and also if you will for me between now and then please prepare goals to send to me and be prepared to discuss your goals at that same meeting this will not replace uh the budget workshop that we'll do in august you know where we bring the department heads forward they'll be able to take a few minutes to share their priorities with you from a budget perspective this is more along the lines of the bigger picture as a city you know what we need to accomplish and how we're going to get there financially and how that ties into the budget i would ask all the board members to look at july 6 during the day maybe a 10 to 12 a.m or 10 am meeting last about two hours we could do 19 or 20 in july but if y'all will look at your look at your schedules and the earlier the better we can make it on july 6th it would help us a lot but be planning accordingly for that please and i believe that is that's all i have to say next on our agenda is the citizens agenda we did not have anyone that signed up to speak on the citizen's agenda

[0:26:44] wow y'all are really throwing me for a late tonight just a joke i'm sorry come forward ms king i did not have the information hi my name is cynthia keane i'm a resident of south haven since 2007. my husband is a truck driver and there's a problem in south haven that when truck drivers come off the road there's nowhere for them to park without being cited a code code enforcement ticket so what is it that can happen for the truck drivers because once they you know have earned an earnest key where should they park because our taxes don't hear ten stop taking so where is it that drug drivers can park and that was one of the things i was trying to ask the gentleman that called enforcement they kept putting the citations on my house three in five days and i asked him was i the target of your code enforcement because the truck has been here four days and you've left three citations i came to south to southhaven to the city first and asked them told them my husband's going to move this truck in 10 days when he come home off the road i spoke to someone named johnny there what i told him in court yesterday the other day he said it wasn't his ward i said i'm unsure of what word i live in i just know i've been in this house here for five years i'm not a troublemaker i keep this house clean i help my neighbors all i want to know is where is it that my husband can park when he's did three weeks on the road and come home for a week to his family where where am i supposed to park his vehicle that's all i'm asking i'm not asking for us you know special favors or anything just help us out and let us know where we're supposed to do this because this is where you live this is where you've been living for 10 years is that a corporate truck or is it a private truck is it private shop commercial vehicles are prohibited in residential zones i don't know uh what happened in the past but i can just tell you based on what the ordinances are now right the commercial vehicles are prohibited in residential zones i will tell you that i get a lot of calls about that a lot of them not

[0:28:46] not you but i'm just saying in general there's a lot of calls from the citizens expressing complaints about commercial vehicles being parked in residential areas so that's nothing new it's prohibited but to answer your question on where you park i'm not in the trucking business myself but i know that a lot of people will have a certain designated area where they'll drive their personal vehicle to that spot and leave the vehicle there while they're on the road while they're in the commercial vehicle and they come back and they drive home and they're in the residential i mean to the residential zone in their personal private vehicle but at this point the city of south haven you all are also attacking the businesses that are allowing it because we usually leave that truck at at big lots and the corporate office let us leave that truck there and then we was contacted from the corporate office last year that it was no longer you didn't want it on main street so what i'm saying is if you're eventually phasing out the the company's american pocket just i mean this is where we make a living it has south state and mississippi on this is where i pay my taxes my heavy growth taxes so what is it does it because i'm not the only one i got 20 photos in my in my purse of people that i know have parked there for years in this community because i've been here 10 years i've parked in big lots or in their yards and on the street and on the street and that's what i was trying to tell the gentleman in court here today and he said well it sounds like to me when i started showing him the photos he said you have an attitude i said no sir i just want a resolution right and that's a that's a valid point i'm glad you brought that up because i think in the past it may have been a situation where and again i'm not i don't want to get into my predecessor but maybe there were some ordinances that weren't enforced for whatever reason but um um what i do is enforce all the ordinances it's not my you know it's a board's job to change the ordinances but until then i enforce the ordinances so it may have just been something where well not may it was it's been on the books before me it just may have been something that the city was not because they never do i

[0:30:47] really deliver some time for laws when they're in a in a crunch and so they've always let us leave our tractor trailer there but this was a 28 foot truck and like i said i tried to do the right thing i came here i spoke to someone that told enforcement told me it would be ten days and five days later i got two tickets that same day on the 10th and then the uh 11th when i came back from the hospital it was the third one there and i'm like my god i mean i thought i did the right thing because when i went there if it was i know i understand that but just tell me yes and i still get the citations what are we supposed to do right i can tell just by listening to you that you you have a legitimate concern you're trying to do what's right you're just trying to find out what the rules are whitney where are where where does someone in the city where is the zone that they can uh obviously you have truck stops but where where is a an area that you can park and i'm assuming this is a tractor right no like i said i love that yeah no it's like a box truck it's a we've run into it numerous times in in your industrial zones a lot of them have gated in areas where their truckers that work for a corporate system can leave their vehicles pair their trucks bring them back the privatized side of it is where we run into problems there's really nothing we've investigated whether cities have got what they call commercial drop yards a private person will come and develop a gated guard shack commercial parking area where they pay on a monthly basis to keep their vehicles there and things like that we don't have anything here i mean there's no there's no right answer to tell her she can park anywhere i mean right now our ordinances say nowhere and like i said we've run into it a number of times that it's come up twice since i've been here in 15 years wanted to change the ordinance but then the other side the residential side comes in so hard not wanting them there um and unless somebody comes up with just a generic commercial truck yard that somebody wants to invest the money in an industrial zone we really don't have a legitimate place for them to park and she's correct but that's what

[0:32:48] happens when he's on the road even though he feels that the ta or the pilot or whatever my husband seemed to pay 15 that night when he finished building up and 15 dollars for a shower he says to pay 15 to park there that night so even if it's somewhere where they have to pay but somewhere because right now we're saying what do we do the legal way because i live here and i pay my taxes here no now just personally i know there's a couple places on goodman road actually in the horn lake area right there close to the interstate the trucks park behind the field station there so that may be an option i don't know which uh next to a waffle house right here as well so yeah every time you get there it's already full so i can say no sledding park is large store up there because when they are in a crunch my husband delivered for him but if not i mean just not for my husband the other truckers that that make out honestly what are they supposed to do that's a good question is it a semi or is it a box truck this is a box shop we have a semi in the box but this is a box shop i'm talking about where does it park the semi low sledge pocket there because we like i said we delivered your sometimes okay i got it i got you anyway you get your name or number okay okay well and the other thing is um again as it relates to the to the city i understand you're concerned that the city has an order you know the current ordinance does not allow you know those type of commercial vehicles or residential areas so it have to be some type of commercial area where you have permission to do that or or what about what about the other truck stops i mean are there are there other than the one that uh don't have anything the walmart's used to allow them to do it but truckers that don't go by the roof like today i picked up a tire at the back of those mother my husband's higher i just don't want it to burn out my connection with lobes and i picked it up put it in my car and you know but well i think that's what becomes the biggest problem if one or two it's not looked on negatively

[0:34:51] if there's permission granted to trackers say lows or big lots or something it tends to grow and you know we've had the parking lot of where the old mcdonald's was that was one that was kind of just you know giving a little nod to and then the next thing you know there's 15 20 of them and it becomes a commercial yard we need somebody to invest in essentially a commercial yard form so we have something appropriately where you tell them here's exactly where you go right now in the city we have no place and we don't because we deliver for digitalize pier one uh kirklands and sam's when they have things for their customers because they don't have uh delivery service so we deliver all those for them but they're it but i have to take my truck on brooks road and if i have a goal sometimes the people i'll say well that's okay so that's money that we also lose and like i say we live here so i just need to you know see what kind of resolution is there here because we were at the big lot for a while and then when they said that we can park there so now we have to you know just play hot potato with the truck so when people call for their loads we can be there to you know where would something like that need to be zoned you'd be an industrial you know just essentially where we just i know crows has a lot crow's tripping has i mean awg has got a huge lot but it's for the people that only deliver it it can be a private truck or it can be a corporate truck but they allow their people to park on their on their truck yard um when you've got a lot of industrial space the problem we've got is you have to find a private developer to essentially grow it and make it happen it's not something the city could do and we've actually tried to encourage a few people to do it um it's got a little overhead cost and it doesn't have a lot of manpower involved with it it's paving its fencing it's putting the guard shack up and it's finding the property it's not a lot of development side to it but um we just hadn't found anybody interested but we were pressured for there are a lot of drop lots around the area of homes and lamar

[0:36:54] in that area they're called drop lots and i mean they charge a small fee or you can work out a fee with those people until we can get a resolve here at southeastern for this problem i would check with them and see what they charge to put like your truck there just a it may not be very much uh most of those lots are for these big semi-drop trailers that they drop and they're gonna leave for a week or two weeks you know and they rent out just a place to drop it um like i said over lamar and homes that's not too far you know it's cause i used to park at the uh pilot on shipping driving lamar they stole that truck so we had to get a new oh well these these drop lots over there they're locked and gated you know where people can they they have their own key to get in and out okay so i would definitely check on that until south haven can find a result okay and i hope that's helpful but in the um in the meantime you know this board can review the ordinance to see if they want to make changes one thing i will share is that there is a reason the ordinance is there again there's a lot of people in residential areas that do not want commercial vehicles there so that's when you sit in my seat i mean i'm listening to you and i know you have a valid concern but i'm also i'm hearing it from the other people you know in the neighborhoods that do not want commercial vehicles there so that's what we have to consider you know what's best what's you know what's right for the city as a whole but well i understand that in the neighborhood i understand can something else yeah sounds like there are some options and that's just a suggestion i would have to some of your biggest clients you know you may want to talk to them they'll know the trucking business better than i do uh they would they have some options some recommendations on on a safe yard you know where you could leave it that is safe or it's not stolen or vandalized so that's what i would encourage you to do in the meantime no i will tell you this uh i'm not trying to promote anybody but uh throws drop lot over there they actually have a guard that stays on yeah i noticed that

[0:38:56] they've done some repairs on one of my trucks before there is one i want to back up for just a second there's one thing i meant to update everyone on the mayor's report that i overlooked since i had so many items on there tonight and obviously got the wrong copy but uh the rubbish update obviously we spent a lot of hours in the last few weeks collecting rubbish the windstorm was a major problem it's probably the probably the third worst wind storm we've had other than hurricane elvis and then you know as far as storms the ice storm of 94. those are probably two biggest events in the history of the city uh this one was pretty bad so uh we're behind we have had public works crews working overtime waste pro has come in brought other resources in to help us get caught up the latest report indicates we will be back on a normal schedule this week i do want to point out the fact that when we not just with rubbish but in all things when we contract services out we don't do them ourselves that limits what i can do what our public works crews can do because we do we do not have the resources we don't have the people and then when you reach out to other people in strange situations like this to help they they only plant resources for their routes so we found out that even reaching out just for an emergency type situation that we were limited on the new trucks or new uh personnel that we could bring in so it's not it's not an easy situation i know it's inconvenient when everyone's had the limbs in their yard you know for a three week period we did not want it like this uh it did not work out for able to get it cleaned up but we are uh we are should be back to normal this week i do want to thank bradley wallace and the public works crews they worked overtime on the weekends um for the last three weeks trying to help us get caught up but anyway we should be close to being out of the woods now okay that's it and then back to um
