[0:00:00] before we stand and do the pledge we've got a few aldermen that are remote so i just want to make sure they can hear okay pain can you hear me okay audrey brooks can you hear me okay great okay we're ready to go if everyone will stand with us we'll um have a pleasure allegiance would you believe us in that and then after the pledge alderman gallagher will lead us in prayer so we'll have expression okay we have we have on my back we have a guest uh we're gonna be led uh with the invocation with pastor tim adams from heritage church so after the pledge if you would come forward and lead us in our one invocations and under god indivisible with liberty and justice for all well thank you for the opportunity to be here mayor for the invitation let's pray together lord we love you and we gather together tonight with a heart full of thanksgiving for all that you have done for keeping us safe for giving us help during the middle of this pandemic but i want to thank you for our mayor for each one of our aldermen and for all of our local leaders who work so hard to make our city what it is you have blessed us to live in one of the most beautiful cities in the world and we're very grateful for that we pray that you will continue to keep your hand on our leaders and give them wisdom and knowledge to navigate every problem that would arise especially in the middle of the world that we are in today i know there's a lot of challenging issues that are facing us god
[0:02:02] keep giving us the wisdom that we need to move forward i pray that you'll bless america bless america on this election uh night tonight that your will would be done and we'll give you the glory to praise for everyone said amen first on the agenda this evening is the approval minutes for the october 20th 2020 regular meetings for october 20 seconds we have a motion bottom and gallagher second alderman hoots is there any discussion carrying on yes that motion carries next on the agenda's approval to temporarily close the city street mr nick manley's the attorney this is just approval to close uh maybelle bar um from november on november 12 4 to 8 pm november 13th from 4 to 7 pm november 14th from 10 a.m to 2 00 pm and in accordance with mr cody 21-37-3 for the tyler square events kind of motion modern gallagher second baltimore wheeler is there any discussion nick is that going to require police officers i don't know it may at some point just be in their discretion so tonight just authorizing them to do it and the chief police and the wp police will require the tip of any police officers they need if they are needed they'll um i think they're gonna monitor and see
[0:04:05] a bunch more speed that they're making any contact with miles or has their house today is this one of those things that they take it's just i think it's just closing the boulevard on the this on the um the west side of goodwill where they're shopping and everything uh at that area but they don't they don't have a city usually the city can't charge reimbursements to police don't look like a donation but the city is not legally able to charge to provide police detection or traffic services and this is something that um that will be a big part of southwest where we talk about entertainment district uh entertainment district will involve you know uh street events you know this is all related to christmas you know but there will be a time when south was further developed where you'll see you know you see other things you know you see uh you know a 3k run or uh or you know any kind of christmas or holiday event so it will be something that's not uncommon there but obviously you know we wouldn't allow anything to cause any kind of traffic congestion problem so um chief moore's here chief moore they the question came up silo has reached out probably two or three two guys probably yeah two officers yeah but i mean it's you know not uncommon that we've done other events you know martin luther king walk and we have that in the area so it's not uncommon to have these things these are good things these are pedestrian friendly and get the community out kind of things so can we do we can use some overtime kind of money on rather than pool or car out of services we should need overtime i mean this is just a day a day event okay is there any other discussion hearing none roll call please uh directing the sale of the water and
[0:06:22] sewer system revenue bonds which we series 2020. we've discussed this a few times it went to a bid that chris will since we're answering detailed questions but the uh low did was duncan williams came in at one point eight percent uh tonight the resolution is directing the sale these uh of the bonds do not believe the 1.8 rate uh also the the pay payroll paying agent will be um listed with this as all also in the resolution food once that is online which knights authorizing um the mayor to sign the resolution directing the sale combined suppliers or bond series 2020 but clemson williams being the entity at 1.8 percent interest rate we have motion monitoring wheeler second monitoring kelly is there any discussion yes that motion cares uh next on the agendas award of the term bid for public works and utilities construction projects contracts mr dane cordell this is the term big contract the previous contract had expired for its term limits so we rebid the public works and utilities term contract we only received one bid from tri-firma the existing contractor we did check the pricing fair to the current uh rates there was minimum some decreases some increases no overall adjustment so we recommend awards uh with the new rates for a one year term and expandable up to four

[0:12:33] oh yes our first application is a subjection application for raspberry farms section d this is going to be on the south side of state line road east of corn lake road uh phase contains 14.39 acres it's going to be the west end of the overall pud the lots and rows are a continuation of the existing erin del rio and kimberly dandruff the lines ranging in size from six thousand square feet up to fifteen thousand five hundred and seventy uh seventy three square feet um there's the utilities but running across it uh what we did was look at the overall pud that was submitted uh we have determined it is compliant with that pud the only things that we have um under comments are for the road names to be submitted which we've already sent those over to emergency services additionally we're now requiring all subdivisions to submit their addresses to us in advance of approval because we've had some issues and discrepancies with addressing the properties too the gis of the county they have done that as well everything is compliant with that beauty and all those comments staff recommends approval with us with those comments [Music] how many are involved with these two sections um let me see you've got 69 watts in this one and you have 31 watts in the other so roughly 100 [Music] normally grows two lanes uh have we done any kind of traffic study here that we need for our camping before we look at this container i mean it's whatever you request to do an emotion to do i know we have not done a traffic analysis of this area at this point um there are three subdivisions over there that are to be considered high density residential um
[0:14:36] all of them are not built out this obviously is the largest one there's roughly 600 plus homes in it um there's probably about 400 left to build out i think a traffic analysis may be warranted before we're going any further my argument with these two is that um what we recommend is based on the overall pdb so we've determined it's compliant at this point um it'd be my suggestion to to look at these two go through um then after that put together a request and work with simply to get a traffic analysis done and that way we can determine anything in the future that needs to happen before we approve even further um but that's my connection i'd like to make a motion if we can't uh put this off for 30 days and then reconsider a table for 30 days and cooking and seeing about getting the traffic studies that's just a lot of traffic that we put down down there one question i bring is just in case and i don't know the workloads to the link and i'm not real familiar with the time it takes to go through traffic analysis i think it would have to be all porn lake road as well as state on road um what would happen in the event that it was not completed in the 30 days to just to recycle so we'll just make most of the trucks okay we have a motion to table uh you're this is for one and two i'm going to yes sir a motion almost wheeler i mean excuse me arm and hoots to the table second volume of wheeler um to start the discussion the only thing that i have concerns with is first of all how many whitney are the total in the pud for the and for the total development how many more lines counting the these ones there's probably around 400 more lots after this it's a very or large i mean we can just you know that's the thing is i guess i'm what i'm
[0:16:39] not understanding is why for a hundred lives that have already been approved by your planning commission and already proven in the pd 100 likes is not gonna you know us delano doing a traffic study for a hundred lines it's not gonna change anything i'm looking i'm looking at the master plan in the other off everything plus we have a couple of hundred some divisions like he's in the same area i think we need to stop from the breaks a second and let's look and see what kind of impact it's going to have of the traffic are we going to have to collaborate before lanes or you know what kind of impact is it going to happen in the schools you know i know also with school is packed already so i mean i just have some concerns about just being able to accommodate these people and you know once they feel this stuff out then we're behind america so to speak well and and i'm not certain don't don't misunderstand my questions i'm certainly i get your concern i share your concern my only thing that the thing that concerns me is you have a private business person that's already moved forward with this they've already gone to the planning commission they've been approved and to stop it you know what okay let's let's just say hypothetically that the study comes back and says that it is going to require expansion you and i both know that in our transportation improvement project there is no money allocated for anything over there so to be able to give someone a timeline on hey you've been put table you've been put on hold if i'm them my next question is how long you know because uh the answer to that question is there's nobody just in this room that can answer that question because none of that's funded at this time so are we sure that that's what we want to do do we do we really want to shut some money down you know that's already been approved to the planning commission for 100 lots i mean we built i mean there's many many subdivisions uh in our city now with that with a hundred lots that have two lane roads this is not unusual at all i don't know i just it just seems kind of weird to me could you share some more
[0:18:41] information like what were you just what's this i mean if you go over on stage on the road between three o'clock in the afternoon and seven o'clock at night yeah i mean you know the road backed up for miles you know uh and on the road there i mean it's just getting the traffic there's so much injustice in there to begin with i just think that you know even that you're talking about you know possibly 254 cars a day added to that traffic and it's already longer now i mean i'm sure the people who drive it every day right now you know would be but not want to have to deal with that much more traffic until we can as a city can afford to go ahead and go out in the street i mean you know i know in the past we used to ask such divisions when they came in for them to lighten the streets as part of their you know now they've done a portion in front of their subdivision which is all we require and on their south half of that road they have done the improvements there but that's served no purpose for getting traffic circulation um from my standpoint i i tend to agree with the mayor on this one that these two are already in play i definitely think a traffic analysis is a good idea i mean i agree i think we're going to have to determine what to do with this area before we let anything else go through and i've said that for a while now um and and i i would feel better about being able to send notice because i believe most of these are bank owned properties at this point that came back during recession time i feel better about giving them a notice here's what we're looking into here give them a little bit more warning um these have already been sold to an individual that had nothing to do with that this is simply the builder versus the developer and obviously a little bad about whatever you want to do but he's already gone heavily through the process and already done a lot of the design work and put in a lot of infrastructure there so i i'd feel a little leery about just halting right there with these two sections but if we could make a notice i could send out a notice to anybody who has ownership beyond this and let them know this is where we're at so at least they've got a heads up they don't try to sell it to an individual um they don't try to you know they can work their money around it versus are we gonna have any more problems with sewage and that kind of stuff well talking to the utility director right humphrey um we have them install portions of the
[0:20:43] sewer they are not connected and that is a really big cost to this property owner that has to be done before any new houses can be put in anyhow that's on him not us so that's another hurdle he's going to have to jump over either way to fees the super capacity so there's no additional cost for us on that no no this is not a cost that's a profit that's a private um cost to him and that's my what whitney's touching on is you know and again i'm not you know this is not something that i would disagree with you're concerned about i certainly don't understand to share those concerns but i always hate you know if somebody's gonna give me some bad news if i got money invested i'd like to i think it's fair for the city to give me some heads up before i go and spend money get ready to build and then you're telling me just you know i've gone through the planning commission everything all of a sudden counting boom i you can't build a house there i don't know that we want to send that message in three three our builders that way that's the only thing but like whitney said you know if we sent a heads up that way she knows now she's here to sell the board action and she knows that in the future when they come back if she can tell them right then hey the board has um you know frozen this until we get a traffic study and that way it's just more fair for your business people to know in advance but again i don't i'm not trying to be argumentative with anybody i just this the first i heard about this today so i just i kind of find myself kind of you know feeling for the for the building you know but anyway that's all i got to say so there's a person second is there any other discussion yeah this is this is one of those kind of situations that this stuff was approved a long time ago and everything's been on hold because of
[0:22:46] the economy and now all of a sudden they're popping back up directly you know they're going to go gangbusters so i mean it's like they're working under the old rules but we're having to deal with the rules of today and we we gotta provide the infrastructure for it so we're kind of talking to the rocking the heart race i understand that but uh i mean i just see potential problems going in the future and i don't know if there's any way legally we can stop it you know we probably can't but we need to let you know that you know we do that and just to be clear the pud was approached a long time ago right what's what's before you now has not been that's all recent activity the pud as well as a pretty long time and we have we've discussed that our city attorney has had many discussions with um with whitney and myself because we have so many situations in the city because of the 2008 housing crisis where those were approved and nothing was done for many years just because of housing prices so it's there's it's never been uh communicated to me that the city could stop you know a hud that's already been approved in the past um but again that's just i just want to make sure we're clear on the fact that the pud was afraid a long time ago and not i just want to film [Music] move okay all right is there all right well well said well um we hear you loud and clear as uh anybody else uh there was a motion to table one and two of alderman hoots the second modern wheeler is there any other discussion before we
[0:24:48] vote on tabling okay hearing none what we'll do is have a roll call do you feel like it's fair to table this so that's is okay so that motion fails so now uh you want to go are you were you done with the discussion of one another well i i i just would like to are we going into a traffic study well that's a different issue what's on the agenda tonight there was a motion to take that until there was a traffic study that motion just failed so now uh i'm assuming what you're asking for is approval item one yes okay based on the compliance of the pd is there a motion to approve item one on the planning agenda okay we have a motion and kelly's second lawyer in flores is there any discussion hearing none roll call okay i know she cares uh the second application is the following section to it which is going to be uh section e they submitted in section a1 we are having them uh adjust that title block to show that it's the next letter in the alphabet just recording purposes again it is compliant with the overall master plan there is a continuous six foot privacy fence that's required along the gossip and the marshall properties which are going to be
[0:26:49] in the southeast corner of this section additionally we've asked as for the same thing from the last from the previous application which is submit all other street names they're addressing which has been submitted we have sent that over to the emergency services um but again it's compliant with the enrollment and we recommend the approval is submitted all right [Music] yes we were talking under the discussion about their laws about them together is there a motion to improve on them too on the planning agenda mr mayor make a motion okay we have a motion kelly and i couldn't hear i'm sorry was that up to you honoring flores honor second daughter of flores is there any other discussion on item two hearing non-roll calls yes [Music] okay that motion carries now back to the discussion prior that's one and two but they're still concerned about the other 400 lots there you know regarding alderman hoop's concern about the traffic study so how much money are we talking about to do a traffic study would we be hiring civil land or what is your recommendation it would obviously be civil link uh they work with us setting traffic accounts with us um all the time and it's based on hourly work um we've got two stretches of roadway we'll have to look at so i'm sure the pricing would be a little contingent um [Music] estimate from him and i can bring it
[0:28:53] back at the next board let me ask this question since uh to respect alderman who's concerned can we um can we make a motion to make further development here depending upon a traffic study and then on a future board meeting we have the details of the contract that we're going to enter into with the traffic study approve that at a different time or what is it your recommendation to be legally sound do we deal with it together anyway you can make a motion to authorize a civil engineering contract the next meeting in which the next meeting but you got your minutes and nothing else is going to be is there a second second baltimore gallagher is there any discussion about that everybody hear me okay i know i do have a question a little off topic but is there any way to get that into a lower density uh i'm concerned about the density of it all but the height if we could get lower density that would put less traffic on the street the conference comprehensive plan is designated for high density everything you've got in that close proximity is high density uh it's under a pug which is its own zoning um and we have not found a way to go back and reverse decisions on approved holding you to uh previous boards decisions this is now zoning um which was designated for high density so at this time i i don't know but you know when a traffic analysis comes through and says you know additional 400 houses on this one and 120 over on this one um and says you know you shouldn't do anything until it's four lanes i mean that that's going to be your hold for at least a while and then maybe the market changes aspects and it's not conducive to identity at one time i've just never seen it in my time i've never seen us expand we can't even get a
[0:30:56] road expanded for industrial parks i've never seen this we've been trying to expand state line road the whole time i've served as mayor and we have the industrial parks there the spectre labs just open and we're still working on the tulane road there i guess that's what i'm not getting i'm not understanding i've never seen us uh expand a road regard because of a residential subject i like i said this whole area this whole intersection area has got a lot of high density in it and seeing it approved and having two lanes on the ground and seeing it come to fruition now with the traffic on it the concern shows up in your face complaints start showing up um so it's not just a subdivision but it's just because you have too much high concentration obviously at those two at that intersection yeah and neither one of them why they're both two lane not conducive to handling that much traffic um and you know i don't know how i don't even know in the past how that could have been fixed at that point in time because each development is in charge of doing the improvements in front of their area which they've done or they paid in lula um and this one did do the widening but it serves no purpose unless the entire area gets widened so does the city take that on do we forget property ownership north you can't do that um and you also can't see its development so it's just a big catch-22 all the way around and it's just now coming to fruition and it's in our face and the concerns are coming in yeah maybe the planning and no disrespect to you but maybe the planning could have been done better years past all right so we have a motion by alderman hoots uh to halt the other development nebraska farms so the traffic study is complete and then we'll expect a traffic study with details uh contract to be brought later and so is there a second for that i'm starting i'd say second automatic gallagher and did you did was your question did you have any questions okay is there any other discussion about the traffic study halt in the development there hearing down raw complex yes
[0:33:12] okay that motion carries so we'll rely on your office from now on to make sure that uh anyone with a development interest there is put an alert about that yeah also not notice i believe there's only like three or four entities that ride in their in their bank or corporations so we'll send those to them okay can we move on 9-3 item number three is a request to uh revise the existing part of garden subdivision specifically lots 15 and 16. uh we have a property owner wanting to build a house that will not fit on one of these single lots so they're asking to merge the two lots cabinets allow that do not allow you to cut the lot further down to make it smaller but they do allow the merger we have two lots what you see the red right there is where the two lives are uh it's compliant with hoa as well uh we have stated that to revise the subdivision all property owners adjacent across the street must sign the flag before recording and we have asked them to remove the middle line and the utilities that may be there and vacate that easement prior to building it was all agreed upon by property owner and planning commission we recommend approval okay we have for my ultimate remotely i know we all can't hear well so um uh when i hear the motion formal uh note the motion was made first so arnold wheeler actually made the motion and then all of the floors are you okay with the second in that motion i'm assuming okay thank you we have a motion armor wheeler second bomber and flores is there any discussion about item three hearing none roll call yes okay that motion carries our final application is another subdivision approval uh we've kind of seen 2.76 acres of property on the other side of goodman road just east of greenberg parkway it's
[0:35:14] going to be just past that strip center you have in the hearth corner um where the dart work has been done previously it's in between those two areas uh the requesting is subdivided into two lots one consisting of 1.4 acres and the other with 1.72 acres to provide access to the rear they have extended an ingress ingress which is already parted by ndot uh off of goodman road so it won't land lock the rear property that is staying in place it's compliant with commercial regulations for subdivision we recommend approval where where exactly is this uh there should be an ariel this is going to be you know where the strip center is on the hard northeast corner and then there's that house that sits behind it that's got the driveway that's directly adjacent to back east right there close to ground but no no no no no no no this is down at greenbrick parkway and the real estate office is a good house yeah they're kind of between there there's a big excavated dirt area that everybody has looked at for years right in greenville park just barely on the east side of greenwood parkway on the north side to approve item four and a second dollar and kelly is there any more discussion yes that motion carries okay next on our agenda is mayor's report i'm going to be real short tonight a lot of the projects that i've updated you on recently we've got so many things going on in 2020 they're all moving well and so there's not any specifics they're all moving forward i'll continue to give updates in future meetings
[0:37:15] the main thing i want to update everyone is we did initiate an employee survey this is our last meeting that's gone well it's in process right now that survey as of today has received 178 responses from our employees we sent out 469 of those we're going to leave that open and try to you know improve the resp to get more responses so we can get good feedback we're already getting good feedback just like we did in 2019 and so we'll keep that open and as soon as we get the survey completed uh we'll tally those results and give us something to compare you know with our numbers in 19 just kind of see how our departments are doing you know again continue to listen to our employees i've had meetings since i've met with you with some of our departments and just explain to them that there's no trick here i mean we wouldn't take the time to do a survey if we didn't really want to hear what you got to say and just assure everyone that it is truly an anonymous survey which it is but anyway that data will come in and hopefully we can use that like we did in 19 a positive way to make our city a better place to work so that's all i have tonight next on the agenda is our citizens agenda mr brian baines uh requesting to be on the agenda come forward please and if i may just uh out of respect for everyone's time uh when when there's a request made and i really appreciate the way uh you handled your business you made a request to the city and so a lot of times we can go ahead and take the ball and run with that and get answers for you so we've we've done a lot of that so what i'd like to do just again to save our time and to kind of speak the language that our board's going to understand i want to summarize that because i've had discussions with a utilities director i'm very familiar with what's going on but it's in no way to take your chance to speak i think it would just help to let me summarize it and then we'll open the floor for you to speak and then hopefully we can get some type of resolution done tonight basically the
[0:39:17] issue we have a a strip center on state line road where there was an undetected water leak and this water leak is it's not the normal water leak it's a big one so the water leak is 18 807 and seven cents and it was undetected and so uh we the request for mr baines is since they were not aware of that you know would the city grant uh you know lengthy and not charge them you know for that leak and so basically what the issue is here uh this was a leak where the water was going into a storm drain so it's not something where your tenants would walk out the front door and say look at all that water going across the parking lot i'm gonna call them a landlord so so it's not obvious where they would know about it so i think that um you know it's truly a situation they've been put in and that's a that's a big that's a big leap and so they didn't they were not aware of it and so our city has had a policy uh that we will give a leak adjustment one time a month for a citizen a year excuse me a year and the reason we've done it that way is because it can be um believe it or not some people will abuse that you know every time they'll come in and ask for that so we have to have it's very important that we stick to that policy so we don't want to jeopardize the entirety of our policy because it's there for a valid reason however we our utilities director and after listening i also feel like you know mr baines has a has a hardship here and something that put him in a put the property on a tough situation and so what the suggestion is from our utilities director is that we keep our policy and we do um we waive this fee for this adjustment but this would be the adjustment for the year 2000 the month 2021. so um so we would allow them almost like to go ahead and use that token in advance so to speak and so we wouldn't change our policy but they would be able
[0:41:21] to use it but then it would put you know more responsibility on them you know for next year you know to be careful that there's not another leak because the second recommendation for next year would be that we not adjust it because we're going to go in advance and award that adjustment to you to help you with this obvious hardship right now so so it's my rate it's our utilities director's recommendation ray humphries in the crowd if you have questions for him it's his recommendation he's briefed me on the issue uh i agree with his recommendation and it would be my recommendation too uh that we help these business owners out and that we uh we give them that adjustment for the leak amount not their normal amount so their total amount was 1807.07 their average bill for the last 21 months legitimate for the services they received with water is 563.65 cents a month so it'd be my recommendation the board that we give them at an adjustment of 18 243 442 and so that's a summary of it did i say that do i understand the issue yes okay is there anything else you'd like to share with the board we would certainly appreciate it and the plumber did come out he fixed the smaller leak but didn't see it okay and you're comfortable that things are okay it's been directed now yeah okay and do you have a way of just knowing that you have this massive this is a big deal that's a problem do you have a way like a property manager on site that you can like be extra cautious in 2021 you know to make sure something like this doesn't happen we have somebody that wanted to introduce it okay so mr mayor i i like the idea of everything but my opinion i think we should uh give him the 18 243 but retroactively go back and ask him to pay the the february of 449 that way he's got one leak adjustment

[0:45:28] something happened again the leak on the first one was uh 9 13 24. and then the adjusted adjusted amount was 449.48 which led left an adjusted bill you know 463.76 so right right yes this month was february and that means your promotion would be authorized whatever that full number is not good at math and then the motion is through the fact that the customer did not receive the benefit of the water because it was a leak obviously and i think you have an illegal authority in that in that instance we do exactly what he's saying hang on just say i'm about to give you the numbers so the way it would work is if you um the 563 65 is a true water expense that you had right and then what you were waived earlier this year was 449.48 so you would owe 1013 to 13 cents so the true waiver of that would be 17793.94 that would be great that's good news for you right yes okay is that is the motion clear is that the
