[0:02:10] is there a motion to um token discussion some move second we got a motion model in the calendar second moment with brooks all in favor say aye aye any opposed they know all right we're ready to discuss as far as the numbers um the packet included the results of the rfp the rfp is broken down into three different uh levels of services one is grounds and manicured right away maintenance second is the actual chemical spring and of the grounds and manicured right-of-ways and then third is the uh the cutting and maintenance of uh for condemned property maintenance so if you look uh the highlights of it bradley wallace collected those he's with us as well but the results of that in our past contract for package one the city was has been paying thirty five thousand five hundred dollars monthly uh the bids that came in american services bid 55250 c4 landscaping which is the same group of people that uh that formerly or some of the same people who were formerly with bearden integrated landscaping uh it's the same group with c4 landscaping their bid was 35 500 and chandler's lawn service is thousand one twenty uh then uh for package two for chemical spraying the rate the city has been paying currently is ten thousand nine hundred and forty dollars monthly the proposals came back the same company green king that's doing it now submitted a proposal of 7 100 monthly american services submitted a monthly proposal 28 250

[0:04:16] and then chandler's loan service submitted a proposal for 3 800 monthly then when you get down to uh condemned property maintenance that's based on hourly services and so the bids i mean the vehicle quotes came in as such american services quoted 133 dollars per hour chandler's loan service came in at 130 an hour and c4 landscaping came in at 90 per hour so for that reason uh and all the information in the packet includes you know proper uh you know llc or corporation formation uh has all the uh applicable uh state licenses that are necessary to qualify for this contract and it's the recommendation based on these proposals that package one the lowest is 25 120 the challenge loan service package two the lowest is 3800 to chandler's loan service and package three the lowest is c4 landscaping for 90 per hour so i welcome any other discussion before a motion is uh made to actually award the contracts well here i got a question yes sir this may be something better for bradley uh we're going down i mean the economy's not changing it costs more to do stuff uh i mean our best 25 is ten thousand less on our main project there did we cut stuff out of what we were having to do or i mean we did adjust like it's an ongoing thing with the city like uh occasionally we may have some areas that are uh not our properties anymore so there could be uh some minor changes to the scope but the scope was given the same for everybody

[0:06:18] all the proposals were given the same stuff right i'm just asking is there a difference between what we had last last year's contract very very minor would you say bradley yes sir adjustments like mayor said for things that have changed either we're doing something ourselves that we weren't doing before or city property or something like that that may have changed since the last time but for the most part it's a very similar step to what it was before so are there more additions or more deletions um there's a little more probably less more deletions outside but it's still a very similar study to what it was before it is i mean it's no doubt the bids the proposal we got are shocking i mean you know there is significantly but i mean the bottom line is it's the free market i mean everybody that uh that quoted had the same information you know they had the opportunity to go do their research and their homework and what their costs are you know that's a you know when we hire a private contractor to perform these services you know that's up to them we don't make their business decisions for them so we give them time obviously to um you know check it out do their due diligence and then submit a price and um it's interesting though it's very interesting the difference in pricing mayor let me ask you this yes sir if we approve these tonight these will be the contractor prices per month no it didn't know the additions to the contract you know they're not going to come back every month and say oh we get this extra this is what it's going to be based on the rfp correct correct yeah and one thing that is important to note is the contract actually the contract the city is using was formulated uh in a board of aldermen committee meeting and then uh further approved by the full board but it does have a clause in there where if the service is not you know to the city's standards that is it 30 days don't forgive me for standing up i can't see anything okay so within 30 days if the city's

[0:08:25] can we dissatisf exit the contract all the all the contracts from this have determination for convenience falls that was put in rsp that would also be included in contracts as well so what was is there a an extended length i mean is it a four year contract or is it just however long it is until we decide to change how many is it two or three years what's our contract the contract we have the problem we have now you can make this contract one two however long you want to make it um that's up to the board how long you want to contract uh obviously because more than one year you don't want to increase for the next year based on cprs along those lines but in essence it's typically a it's a one year contract two year contract time you want to do it but in essence it's a 30-day contract because you have the right to determine whatever you want but as far as the term for it actually expiring that's up to the board and what i'll do is i'll draft the contract however y'all want to do it i'll get everybody to sign it and we're into the [Music] and no addition the contract would be based off their response rfp and that's when we included any of any additions and or deletions for that matter we have to come back and be approved by the board i've got a question uh bradley i don't know i apologize i don't know very much about chandler's home service do they have decent references they've been in business for a while yes sir um i'm sorry i [Music] and he he does have the sufficient

[0:10:34] equipment personnel as well they haven't experienced uh they've worked with the casinos working landers center for the city volley branch so they have experience with this type of work and they have the equipment to do it personnel they have qualifications for spraying and those particular things from the state a big difference from what we've had but i really all i can tell you is that he beats the qualifications and he seems to sincerely went to work i think my concern was because it was so drastically large not only what we paid in the past but the other bids but i just wanted to make sure that this wasn't something brand new that maybe had never done before they just had to work with us so that's why specifically when we talked to me to make sure i could be comfortable getting all the recommendations i only have i'm only [Music] you know we'll be out of it as quickly as we got into it you know anything like that comes over i don't have any reason to feel that's going to be the cash basis in my discussion he seems to have a clear understanding of what he's supposed to be doing and he feels good about his prices and turning been able to do it and it's i mean it's important to note if you look at the math it's the same the other way you know i i don't know i find it very it's kind of interesting how much difference it is in all three it's not normally what we see yeah right and one other thing to note i mean i i know i've said this many times before but the city knows my commitment the beautification in the city the city is going to look good and

[0:12:36] whoever gets the contract uh they don't meet the specifications or the standards that we expect i promise i'm going to be the first person and whoever the board decides who it is but it's going to apply to whomever gets the contract they are going to do an outstanding job because beautification is extremely important in our city and if they are not meeting that standard then i will be the first to uh to appear back before you with a recommendation thank is there any uh any other discussion hearing none i'll entertain a motion uh from the board to tell me your wishes and how you want to award these uh contracts i'll make a commercial accept the bids as president obama okay we have a motion on the brooks to accept the bids as submitted uh as recorded submitted by our public works director secretary wheeler uh is there any if there's no other discussion um do we need one for each controller authorized make a motion to uh accept whoever you want based on the recommendation public works director i think that was changing for packaging one and two and then c4 second okay we have a motion of alderman brooke second law of the wheeler is there any other discussion that will include the mayor signing the contract okay any other discussion hear your name roll call yes that motion carries

[0:16:50] that motion carries next on the agenda is the s-e-s-a-c llc contract with the city yeah this uh entity contacted us a couple months ago it's an entity that requires as part of a license agreement for the music we play at our amphitheater and different venues we need to have an agreement with this entity same thing we have with bmi and it's a contract to allow the use of various music of a license very various music and artists had our venues to be played their fee for the agreement is 1496 so we can compile both copyright laws and pay for the use of those music or that music so my big authorization from there to sign this contract with sc s ac llc through a motion volume kelly second bottom and pain is there any discussion hearing none all in favor say hi any opposed say no eyes have it motion carries next one agenda is a resolution for budget amendment mr chris wilson board to reflect the revenue bond proceeds for the upcoming 15 geo and expensive in the projects as you see i won't make that much second we have most modern fluoresce second modern wheeler is there any discussion mayor i'd like to see if we couldn't break up the pedestrian bridge out of that original mecca two separate folks i'd like to not support the fire station and i support the server but i'm not defending the rest of though i would like to have an opportunity to develop those things that ladies and gentlemen two separate things you i mean you can

[0:20:53] suggesting that we just break it up in two and vote on that tonight so is there any reason that don't excuse me again i'm not attacking anybody but but is there um is there a reason that we can i mean do we have to go back and drop the paperwork differently or no you could you could have two different votes like you could separate it out and have one vote for one one of the others but this is for a budget amendment though this is to make the books but you have the second one would be the two million dollars but it's going to be done at the same time you would have one for 13 one two and it would all reconcile you'd have two resolutions if you into amendments okay they're going they're still they would still go into 7-eleven bond expense and you're going to go like you see them there just on the minutes to reflect two separate votes well that's what i thought i understand it's not changing things just for whatever reason the donor wants to do that i want to respect that if he wants to and if it doesn't change what the board's already stated in previous weeks of that instead of instead of making it one vote it makes it two votes it doesn't change a thing you don't think it changes the procedure it doesn't change funding or anything else does that answer your question yes okay so any other discussion about approving the first one with everything excluding the pedestrian bridge here you know roll call yes okay that motion carries now is there a motion to approve the budget amendment for the pedestrians that wasn't separate right the first one was to take out the bridge approve the all three of the other ones and now is there a motion to do the same exact same thing for the pedestrian bridge to expect the two million dollars of bridge from the bond fund right correct the same thing we just did

[0:24:56] that motion carries next department of technology services agreement allows the citizens to pay for the is for the ecrash site that allows them to pay for uh the crash reports online or basically piggybacking state contract it'll be ten dollars a report just like it's always been but those five dollars for the processing fee if they do it online a little under two to ten dollars uh it's part of a master contract with the state so it's under the safe contract as a work order to get technical uh the contract sign corresponds to the state contract representative in 2010 so tonight's authorization chief board signed this contract as well uh with the mississippi department of technology services for the e-crash site um use of their uh of the processing costs for the fees for those reports second promotion honoring brooke's second model in pain is there any discussion hearing none roll call yes no motion cares next on the agenda is the southaven police radio purchase this agreement is with uh motorola for the um police department radios it is a four year term the lease purchase agreement at zero percent interest uh the cost would be sixty thousand five hundred seventy eight dollars and nine cents per a year it's been uh talked to uh chris wilson the mayor talked about the chief warrant for shelton and it's their final the financing part of it if like i said it is zero interest upon any of the lease we will then own the radios and the agreement it's authorized for chief moore to sign and

[0:26:58] there's a resolution as well that i said yesterday's important of the agreement that we entered into and some paperwork with chris shelton will go out along with the lease so tonight authorization um received the resolution for the secretaries on the contract as required not only uh not be happy to appoint this remember the dr resolution is helping healthy governing authorities approving the lease of motorola solutions for police radios that's presented on this date thank you very much brooks second monitor wheeler is there any discussion [Music] next on the agenda is a resolution to clean private property uh mr mayor with without the resolution draining our clean cover properties presented on the state second we have a motion bomber in brooke's second arm and pain is there any discussion there's no uh in the minutes there's actually no property system so did we have any would i have it so we'll just move past that tonight next on the agenda is our planning agenda miss whitney cook yes we just have one item on the agenda tonight and it is an application for desoto athletic club for an additional use permit allowing for a reader board it's going to be on the north side of goodwin road east of getwell it's actually not on uh athletics property it is located on first tennessee bank property which is going to be on the east corner of that intersection uh there is a sign easement on that site so it has been approved they are black there for some time this is a replacement of the existing one it does fall in line with the specs dimensions and requirements set for the ordinance or the rear board requirements

[0:29:00] so we recommend improvement i'll make that motion we have a motion of honor and wheeler second arm and pain is there any discussion here sorry no problem any other discussion hearing none roll call yes hi motion carries thank you okay next on the agenda uh as mayor's report um first of all i have some business that did not make the agenda the bids were opened on friday the 13th for the central park to snowden grove trail um so we would like to um to move that project forward as you all know that's this uh this is i believe the oldest pending project there's a lot of history with it uh this is the pedestrian trail to connect uh central park and snow grove park and the bid uh bids came in and we're ready to award a bid so it's my uh ask of the board this evening would you have uh 1.371981 so 1 million 371 981 we had it estimated at 1.4 so it came under so coming in just a little bit under the budget amount but but it's um i asked somebody on the board tonight i do think uh for timing it's important for us to go ahead and uh and get this thing moving since it's uh you know we've been through so many different contingencies with that so will someone make a motion to what that did please second you've got a motion by all of your floros second auditing pain is there any discussion hear your none roll call

[0:31:08] yes okay that motion carries tonight um obviously it's no secret uh that our world is facing an unprecedented situation uh city of southaven obviously is facing that like everyone else in the world with the coded 19 threat so i'm going to spend i purposely delayed some of the things we have some other minor updates but just to respect everyone's time and to give me adequate time to discuss some very serious things with the board i would appreciate that we just postponed the other let me focus on this since we first learned uh you know the coronavirus like everyone else you know we watched uh national news you know we're watching what's happening around the globe um very closely uh we want to make sure you know as leaders in our community that we you know that we are timely with decisions we don't you know a lot of people you know y'all see that in the public you hear people armchair quarterbacking the president's decisions the governor's decisions my decisions your decision school superintendent school board that's common but we have a larger responsibility to report facts and to make decisions based on facts not opinions not hysteria and so for that reason you know we waited for the appropriate time to come out and make a public statement every night watching that considering everything else that comes you know available to us from public health experts and last thursday you know after the uh or was it wednesday night i think when the president spoke the information that he revealed you learn when you're in a leadership position to develop a barometer an internal barometer of when things are going to happen and the effects of it and we have to be conscious of hysteria you know we have to be conscious of what's reported and what's factual so i could tell that on thursday morning it was time you know it's time to put some

[0:33:10] information out from a city standpoint which we did uh in five days as you all know many many things have changed you know i feel much differently about this risk today than i did five days ago and for that reason we've stayed on top of it as a city uh we continue to do that but today uh we had we've revisited this situation again uh with the recent cdc updates that were made yesterday and for that reason it's my recommendation to the board that we do several things a lot of these are administrative i do need board approval for two things but if you allow me i just want to i want to read the statement that uh that i want to send out that i think is timely it's appropriate that we make this decision now when we make decisions like that again for the armchair quarterbacks i want to let you know that it's a whole lot different when you're sitting in your recliner with a glass of iced tea and a cold beer uh that when you're on that field running from a 275-pound linebacker that wants to rip your head off and there's bodies moving everywhere and you're trying to throw in lanes and you're trying to hit a receiver okay it's much different so there are things here that are going to affect a lot of other things like obviously we have to consider the financial impacts just like things on a national scale that the president considers a potential recession all the economic impacts of these decisions we're not immune to that either it affects us so the things that we've already done and that we continue to do will affect us financially so we're looking to address all those things as well now when we make decisions like this where i make recommendations to you as a board we consider our priorities and i don't have any doubt that everyone on this board shares even though we have lots of responsibilities it still always has to be with number one being public safety and so all these things are considering financial impacts but it's also you know decisions or recommendations being made with public safety as a

[0:35:12] number one priority so if i may forgive me for reading but i'm going to read this to all of you and then like i said i'm going to request some board action for two things the base of the statement it has not gone out yet this is my plan to update our citizens as follows update for the clv 19 risk management plan as stated in previous updates our world and our city continue to face many unknowns regarding this disease we will continue to make decisions relying on information as it becomes available from public health experts i've again copied the links to the cdc and ms mississippi department of health below and it will continue to encourage all to follow and heed the advice of these experts while i understand that some of our citizens may view some steps as an overreaction we must make decisions that prioritize public health and safety information available today is different than it was just five days ago when my initial statement was released while we must continue with our common sense approach with personal hygiene and social distancing without panic it is important that we take further steps to flatten the curve of a possible pandemic overrun of our health care facilities our general plan is a strategy of statistics to minimize risk of spread by limiting mass gatherings of people again i want to reiterate the fact that there is no perfect science to this there is nobody that 100 knows what's going to shake down but we have to consider statistics and have a strategy that correlates to that so it's my recommendation effective immediately until monday may the 11th and further notice we will incorporate the following changes all park and recreation events including springfest will be cancelled municipal court will continue to follow the gathering limitations of the mississippi supreme court board of aldermen meetings will continue with the request for limited attendance for only those with pending business to be discussed at the meeting all meetings as you all know are streamed live they always are on the city website for remote viewing our

[0:37:16] planning commission meetings will continue with a request for limited attendance using video conferencing water and sanitation service cut off grace periods this is what will need board approval or rejection to give me guidance there it's my recommendation that we extend water and sanitation service cut off grace periods as well as any corresponding late fees until the same date of money may 11. in-person water payments will be limited to existing drop boxes located throughout the city and the drive-through window at city hall all other payment options remain available and encouraged business license renewals are encouraged to be made at dropboxes public records requests they may they may be made online at our website building department portal use is encouraged and it's important to note that all other city facilities and services will remain unchanged i will advise all of our citizens with any questions to contact us by following at 2a city or to use the citizens request tracker on the website with any questions the city is also internally making changes making amendments to our internal operations to minimize risk and also mitigate the financial impacts of these changes um the the key to that i don't want to get into all the details of that publicly but it's important to note that not only are we doing our part to minimize the risk of spread with our operations we're also going to take the common sense approach but we're also going to take steps to mitigate the financial impacts and there's things that we can do budget wise you know operationally you know it will cut some cost we can do the smart thing of suspended travel you know i think it's pretty much an easy decision to suspend travel at this time that will save us some cost city-wide also so we'll take all those steps over time obviously with without the park events uh board you all know

[0:39:18] this that uh that base or almost all not all but almost all of our overtime is related to um uh recreational events you know events at the lander center uh events at the bankplus amphitheater um uh you know some of our tournaments at the parks uh sporting events things like that so we believe that we can trim our our overtime costs you know to offset uh the damages of these impacts as well but basically that's it um i'm not going to read the previous but basically we're going to encourage everybody to take a common sense approach play the game of statistics let's limit our risk and uh and use that strategy of statistics but i need a motion for the sanitation and also um it was one nic wasn't that one more that we needed we extend the sanitation and water dress period um and like foods and lakesies and cut off grace periods will extend to the delinquent accounts as well as corresponding late jesus presented on the state oh well until monday may 11. we have a motion on brooke second bargaining kelly is there any discussion about that you don't need any of the motion um i mean day-to-day activities i think the state law gives me that pulling in there i guess the only thing we would do at this point is both to send you all springfest contracts are out there just in case do we have any contracts in place it's only the one with the um that's what we do yeah is that the only one okay so we'll need a motion to cancel that contract with springfield let me give you the authorization to do if there are more to go ahead and do it to my central castle but i want to make sure i answer your

[0:41:29] question and again i'm always sensitive and real cautious that i don't uh take any authorities that are not given to me but i it's my understanding state law does give me the authority over all day-to-day activities to protect the public safety of our people so i think that is my decision but i welcome your thoughts and if someone doesn't agree with that certainly that's why we're talking about it tonight well i mean i sent you that question that they're doing that all over the country so they're going to be advanced yeah i'm good with that yeah and i think it it wouldn't make sense if we're going to follow the health experts if we're going to follow uh the latest uh recommendations of the cdc in the health department uh that's certainly not consistent to have public gatherings yeah i mean that's a good point and we discussed that actually that's another good point we we discussed at a department head meeting today about any potential ways that we can do remote work remotely unfortunately when you work for the public you know a lot of our services are city hands-on so you know the things that we've got here are things that we can do to minimize risk but you know i hear what you're saying it's not just it's just not possible in you know public service to limit you know the business of the city has to go on service stuff to go on i guess it's a good time to thank you for putting yourself out there serving the city and again our first responders i mean that goes without saying you know we talked about them as well i know chief moore and chief scoutings have uh already had meetings with all of them uh they are on the front line you know they're coming into contact with uh the most people and there's things that we can do again to minimize risk but we cannot obviously cut off our our city services mayor i'd like to thank you in advance because i know there's going to be some negative you're going to deal with because of this but this is one of those kind of things that you've just got to do yes we appreciate that i want to thank you in advance because you know by taking this bowl and luke well that's very kind of you and i

[0:43:31] really appreciate that it's a big boy job you know but i appreciate you saying that i do have one question that going forward if we have to place curfews at uh we would and that i'm glad you brought that up thank you because i didn't want to address that i did not have this in the statement but among the board uh that's something that and a couple other things would require future board action so i'm we're going to do that that's a great point is there any other discussion about um the motion about extending the grace periods in the uh late fees for the water and sanitation services hearing another roll call yes yes okay that motion carries then we need to make a motion to um uh exit the contract how do we need to try to exit the contract or spring spring rescind all contracts i'll link that motion second we have most modern brooks second bottom and hoops is there any discussion hearing none roll call yes yes that motion cares and then based uh or uh back to what alderman flores mentioned um anything that would deal with um you know adopting some kind of city plan that would alter you know ordinances in the city which would restrict gatherings in private places uh that would be something that would definitely require board action um it's i know that that is happening throughout the country in some places i'm just going to give you my personal opinion and then i'll love to hear your comments um i think that when we encourage uh private business and others to follow the same guidelines that we're following i think that we're sending a good leadership message that it's important

[0:45:34] again to minimize risk it's none of this is a perfect science you can take all these steps there's no guarantee with something like this so again i want to point out it's a minimization of risk but we encourage private business to do the same things that we're doing i think that we've done our job you know as public officials i do not think it's our job unless bait well let me just say based on the the information that's out there today i don't think it's our job to go and start closing down restaurants or other private businesses i think it's their decision you know to make their own decisions you know to change their business like that but that's just that's my opinion now you let you know 10 days go by and we get tremendously drastic information you know that's something that uh maybe we read this but i just don't think at this time i always want to err on the side of letting private business to make private decisions and i just i don't think it's time for that yet but again i'll open up the floor you know for other opinions my only concern was that it becomes that time if it how do we do is i i i don't have the authority to do that it would have to be it would have to be a special call board meeting correct correct yes under 21 1917 um governing authority municipalities have the power to make regulations to sex property health and lives and their wealth regulated by restricting the movements of its citizens through any group thereof when there is in that name their public safety because of the treatment of their own so i think that would give you authority to do these things but i'll say there's other 2193 there's other things as far as foreign infected businesses so there are different um statutes however they all require the governing authorities to make these decisions and so to get a board and well that's another good point i'm glad

[0:47:36] you uh keep that discussion up too some of our citizens not to their fault you know don't understand you know what the roles of everyone right you know they don't understand that a mayor of a city doesn't have the same you know authorities as the governor of the state and obviously not the president united states so when they go out and they declare certain things and the way it changes i don't have all those authorities okay now there are we can declare you know emergency in our city and there's some things that we can uh where we can access other funding and so we're actually look we talked about that today with fire police chiefs we're still considering that um i don't want to be dramatic with it but if it's something that we do need to declare um you know an emergency like that we will take those steps you know to you know to look at ways that we maybe can recoup uh funding you know for our lost revenues that kind of thing um but i don't think we're at that point that we need to take action with that tonight but long way to answer your question we'll need to reconvene if we uh if we decide to uh take a step like that does anyone else have any comments about that or that they want to or just you know share your thoughts if you think that we need to do something that we haven't done or the governing forces right now or the president yeah yeah well and the important thing too you know tracking with the logic of not panicking you know is you got to pay attention to the experts you know i'm not a public health expert i'm not i'm not an infectious disease expert nor are you unless you tell me something i don't know about you we got to listen to people that know this i mean that's why you know when the president does something he's got experts that are advising him you know obviously we have to follow you know federal and state laws and we want to and we need to because they they have access to information that we don't have so you know anything that we've done as a city has been you know consistent you know with what's been done on the federal and state level any other comments about that

[0:49:38] okay and then uh last thing is um nick about that as far as like you know uh i'm still waiting on information on what funding could be available like if we declare an emergency in our city um i know the chief scoutings and uh chief moore uh shared some information today but before we do that i'd like to know exactly what they will pay us for like there's no need for us just to you know for a dollar and pony show to stand up and say i'm declaring mercy we need to know how that affects the city i don't have all that information yet so i i would like to uh get that information before you do anything like that is it do you see any property any harm in waiting on that okay okay and that is all uh that i have tonight about that again i would just leave everyone um with the uh the request to you know help communicate this in the city help uh let's help communicate this and encourage everyone you know to take every step that they can to minimize risk and again you know uh like ottoman hoops said i know there's those out there that say you know this is an overreaction and i i welcome that but the only thing i know is that i'm 52 and a half years old i've never seen anything like this in my lifetime and my parents have never seen anything like this and i think probably just about everybody in this room would have to admit that some of the things that have been stated by experts the last five days we've never heard that before and i hope that this is an overreaction i hope that within the next five days we find out that you know that the news is much more positive but again i just think that we have to err on the side of caution and protect uh protect the public health and safety of our people okay i'll move on from that uh next on our agenda is our citizens agenda and we have uh mr darren maxwell and uh and the lewis family property owners requested to speak if you would please come to the public

[0:51:58] uh if you would i'm going to um uh if you don't mind i'll uh just kind of want to go just gotta kind of read through it i know mary and i have been talking about this uh off and on for a couple years and olivia wheeler we've been talking uh my niece as well i've been talking to austin williams but we do have some of the residents here tonight and uh i would like them to stand up i know y'all you know i've been hearing from me a lot so uh if you don't mind there okay i'll address some of your concerns about the road if they would like to i mean i i know we may want to keep our distance but if everyone uh wants to go and just come where you're able to step up and answer questions or speak or what uh you're welcome to do that as well or if all right well if you don't mind i'll just uh kind of read through some of the points that uh but first off uh west vance road west banks road thanks rose has got two sides he's got east banks and west banks east banks road is the site that i live on which is uh right now considered a private road uh now i'll talk about more a little bit later here but uh east i mean west bank road is actually a city road that was being developed and mostly residents that just stood they live on west bank road and the developer mr cole he had developed the property uh

[0:54:00] paid the role initially but did not complete the road and mary and i talked about you know the city calling the bond on that and on that portion of the road you get that broke down so that's on west bank's road we also talked to number two point number two it will cost approximately and this was he grabbing it from wrong where it was approximately about ten thousand dollars to pay the roads about probably 800 feet of road so i mean i figured that since we're taxpayers you know ten thousand dollars we've been paying taxes in 12 years there mostly well i know me and tangela and uh some of the other residents been paying 12 years of taxes point number three east banks road will legally sign over ingress egress rights to the city we had done that prior before with mayor day when mayor davies was in the office now we uh we had signed over here ingress egress and jones davis had you know did all the paperwork and everything on it for some reason you know i went back to him we couldn't find him he couldn't find the paperwork i didn't keep a copy of the paperwork but on our east bank's roadside we had legally signed that over to the city and uh matter of fact my niece had an email this is one of the emails that at the time davis was in office but they had agreed to do duty uh to do the road to take over the road uh ron smith was uh he was on the roads at that time and you know that came out we did everything legally and was given the road over the east bank rose to the city

[0:56:05] 204 i talked to miss hudson at the attorney general's office and verified that the jurisdiction of this road is a factual is a indeed a city so it would be up to from my understanding to the board of austin to change any ordinance or anything of nature clerk verified banks road was in the city road taxpayer funding there's the portion of banks road north and south about 300 feet that the city took over just took over that road uh not sure the year probably was like early so they took over the road in the early 2000s uh and of course uh you know like i said the other east and west bank road um was developed by the mr coleman okay i'm just gonna read the rest of uh number six approximately 400 feet of banks road north and south is already a city road was taken over by the city one of them 70 city and county collected approximately 35 000 of taxes from the golden residents in the in our neighborhood 108 the condition of our world is just not as good as the city a lot of times you have uh especially during a fourth year live celebration even on our private road we have uh you know people come down and they want to look at fireworks we got one of the best uh views in the city when it comes to that they come down we don't you know say hey it's a private road you can't come down there we don't do that they come down and they you know look at the fireworks they don't get on the grass you know

[0:58:09] uh not drought or anything we don't have a problem with it and we've had residents you know a lot of times we get residents from across snow walking their dogs [Music] it's being utilized as a city road right now and you got residents from across the street you know it's a good community we don't have any problems with people coming on our roads uh we're treating like a city road and going back to what mayor davis and the previous administration is going to do you know we're not you know you know we know we're not asking for anything real wild or anything we just want the world back and we feel like with the fact that angela and the lord mr lewis myself and mr please on our end of banks road in the last uh 12 years that's over uh parking 150 thousand dollars in taxpayer dollars that we've paid oh maybe a little bit more but uh i don't know what goes to see what goes in the county uh you know we basically just uh you know just asked for a road you know uh i'm going to finish up i know y'all have to get out of here point them right uh the point number nine the joggers come by they dodge the potholes walking their dogs and things like that uh he will talk about the condition of the road what's wrong with our road the other safety issue uh the main thing the safety is the school bus you know often you know it drops our kids off in the evening hours uh school bus is hitting westbound i mean eastbound on air road and the children have to cross our kids have to cross

[1:00:12] homecoming traffic now we know that you know to ensure the safety of our children the school bus could come down bank road go down metro east provided there was adequate pavement of turnaround this will help ensure the safety of the kids and our neighbors our kids ensure the safety of the kids in the neighborhood and it will uh also prevent god to be of another unnecessary liability for the city so those are some issues that we want to present to y'all uh just uh you know let y'all know i'm concerned you know and i don't know maybe i should ask this question i don't know what uh constitutes uh you know or how many how many private citizens that have private roads come to you all said hey look i would uh will give all the rights to the road to the city do y'all get a lot of that or not uh not a lot of it i mean the issue does come up occasionally um no no i'll expand on that but i don't uh i'd say the answer to that is no it's not it's not common all right but that's uh pretty much what we're asking for we're just asking for the city would vote on uh you know we would legally as he was gonna do before sign the uh ingress he was right over the city already got the mural truck coming down we got a garbage truck coming down which is fine no we want that uh you got people uh you guys know where that's in city road and on west banks i'm just asking that you know y'all call in the bond on that i know in order for a builder to build homes he built how many houses down about four well he doesn't work but it's about seven

[1:02:14] it's totally about seven houses mr cole's built on that end of um and i know in order for the city to allow something like that to be done a bond has to be uh issued if the legal bond was not good that would be a liability that would be something the city would have to take care of so uh you know that's what we ask i just have a quick introduction if you don't mind the only thing that i would like to think about this is maybe you need to know the location it's really where you're trying to beautify it's right at that stone grove section and all the other neighborhoods that's how this private jobs make sense because one side the left side is city and the other is private well we want the blockchain we bought there almost two years ago otherwise we you know we love the city but that is the biggest feature when we tell people to come to our house like hey you got our house we live near the empire hold up your city this is really bad so that is our point is that this is the section that you're trying to do to we see all these other fantastic things i think they're doing a fantastic job um but that is the section that we bought thinking oh this is a great area and we've really been surprised that the road hasn't been maintained so very well presented and thank you for interjecting that as well and i want to make sure if i may um i have uh after talking to darren i mean i've i've driven down the street numerous times looking for a way that this makes sense and uh if i may just so i can kind of explain to the board the situation a little better um exactly where this is located is on nail road just east of uh getwell uh when you pass southern park and like darren said uh he's got the ideal driveway if you want to watch fireworks let's call darren we're gonna hang out at his house it's perfect but you um when you go east on nail um

[1:04:17] you take a left on banks road which is a northbound road so what they're talking about it's like the shape of the t so when you go north on banks road it tees up and then you have the code on on like dead ends on both sides and so like he's saying i don't know the history that was long before us but but the the road is a city road and then uh where darren lives is on the the uh east part of the t and then the pogue development was on the west side of the team and so first of all whitney would you update us was there what's the status of a previous bond for the code this is whitney cook our planning director there is a there's an ongoing bond with mr code we did have trouble trying to retrieve it from him but we actually had a review that we can look into the bond for the west side um and either have impala or have him do it or us call it and do it ourselves but we've not caught a bone okay so there's a bond in place for the for the west end of the team okay if y'all let me call the t just talking visualize um so basically the the the east end of the t is there is no bond no there's no there's no bonds um i think i've talked to angela and everybody uh associated with it and you know i i cannot attest to what blonde smith and mayor davis did in terms of agreeing for it to be a rogue every documentation that we have um shows an english equest which is not a city broadway they're identified differently on flat and on easements so every documentation because we've searched but we've looked as best i can do to find some place that gives me an idea that it could be a road um and to put that in practical terms whitney's a professional planner but to put that in practical terms what that means is like when you apply for something you have the choice then you know is this going to be a public road do you want to build it out to specifications of the city or not and um uh contrary to this situation there are a lot of people that don't want that

[1:06:18] like they want to have a private drive so that's why you have the the option to make it a private ingress egress instead of requesting to become a public product be dedicated um or it's going to show ingressive easement and it'll have a deed associated with these man yeah just to give you a background on that east side of the road i built my house in 2002 and before i could build the house the city at the time told me that i had to make it a private drive so basically that's my long drive i paid for that section of the road to get to my house and years later darren and mr cleveland moved in so i it initially was supposed to be just my private drive okay for a private road to get to my house because then either i could build a big world or i could get something just against my house and that's right okay and that would be correct that's what we require for minor subdivisions versus major subdivisions like we talked about um at the last four meetings um the problem is i think what was supposed to happen afterwards the conversion over to a city right-of-way uh that agreement uh when that one got plotted never came to fruition and there's no documentation that we've got that shows you coming out like the previous things like this if it was a private drive we would call just that that's that's what we have still in motion without a plaque if it converts to a right of way like when darren came into section e of banks road subdivision it would come in as public right-of-way and we would convert it it would be looked at inspected built and such and there just may have been some miscommunication after you built yours and what it transitioned into but we can find our documentation where it transitioned into a right of way okay and and as far as the road um you know this work uh we'll kind of advance this conversation a little quicker

[1:08:19] where it gets into what i can do as a as mayor you know when darren brought this to my attention you know we explained to him that uh that currently the current ordinance specifies how the road has to be before the city takes over the road like has to have a certain width and uh and then a sub uh uh has a thickness that's required that kind of thing when it's done as a private drive obviously we don't expect it we don't know how that was done because it was built by you for you know for private purposes so there is an ordinance that specifies you know the specifications that have to be met for the city to adopt the record to take the road and so that's why i've explained to darren um and again like whitney said you know when it's planted it's planted as either a private road or a public road and then you know these obviously these specifications would apply there too so bottom line is it was built as a private road um nobody in this room would like to say let's spend ten thousand dollars and go pay that's right i i just i've told darren this i'm gonna be honest with everybody i would love to say hey let's put that on a street appointment schedule and go knock out that uh 800 foot section make it a public raid um but it's my understanding state law doesn't give me that authority and so nick manley is with us and nick i'd like you to speak to the board and just tell them what they could potentially do at this point or what i could do i mean my goal is to put a smile on my citizen's faces and like you said beautification you know if someone thinks that it's a public stream it looks bad they think that's us just not paving it that kind of thing so there's nobody in the room that would like to put a smile on your face more than i would but nick will you please uh inform the board on what could possibly be done uh well and stay in compliance with the state law yeah um i think and with you about this and just so i'm clear it was planted that's a private road a private drive obviously and that's what we talked about i think everybody acknowledged that i think you

[1:10:21] know under that under that um theory the board could take it but our own ordinance required before we take it that it must meet certain guidelines so obviously the you're always free to dedicate basically say um here i'll give it to the city and that's fine but the the action of the city actually takes for the city to take it so the city board most of time does this via adoption of a plaque when they adopt a flat we adopt it the flat then has the road specified tells you what the public was private that type thing in this situation their ordinance requires the road to meet certain specs before the city will take it so the board could obviously at that point revise your ordinance and if they revise your ordinance to say extra enough to meet certain qualifications they could do that and that ordinance would be revised and the board could then say erodes that meet this the board will take um i'm going to be honestly i'm not an engineer obviously um i can't really do math but all that being said is if you had the road being if the road was there to begin with and it doesn't need those specs right now the fourth hand can be tied due to its own ordinance into the state law saying you can't we can't accept public pro we can't accept a road that's private just because someone wants us to because it doesn't expect the board could say all right well we can't accept private roads unless they meet x y and z then we need to change what x y and z is between to coordinates and so the ordinance scene would come into play by saying once it meets these specs whatever the specs are on the current row we'll then take it now it didn't apply city flight obviously that you can't just apply to one individual road so in this instance i don't know that i'm be honest with you i live right now i live south from get well but i'm not i'm not 100 sure we're talking about i know the area i have on the road do you never feel serious yeah directly behind it is it jason okay so i'm going through so the board that in that situation is

[1:12:24] right now there are certain requirements that say you must have this width the latest point this this these qualifications for the city to accept that road and here in talking with the mayor and whitney at this juncture we do not that row does not meet those qualifications pursuant to the ordinance the board could revise the ordinance to say hey we'll accept roads anywhere in the city as long as they need x y and z and those in your road would then qualify under the under that revision i don't know exactly what that revision would look like if we sit here right now tonight because i don't know what the boards want to do and looking at roads like that across the city in the context of beautification in these type situations so there is ways to to to do it it would just require an ordinance revision that would also not only affect this road but in advance the board and affects the whole city and the whole uh whole entire area but the board that the fact that says private on the flat would need to be addressed via the fact it'd be coming to a standard of whatever the city declares it as so in fact you have it saying it's private right now no i guess my question is how do other houses come to be built later yeah because ours is actually city yeah like hours are different there are differences i think a different section of the flat is what i look at let's see one flat on the um one side of banks are in my truck on sale banks from the west side west side of next road actually that notices or their state said hey this is a public right-of-way right the east the other side of banks road flat says private thank for all attention processes private and in fact it says private a city legally is prohibited from doing work on private property except in certain circumstances when you have maybe or you have drainage for issues but when it comes to a private road the city is prohibited from doing it on that road unless the city accepts it as a dedication can i actually do this yes sir with the fact that like i said before the fact that we're going to give it over to

[1:14:27] mayor when mary davis and his administration said yes you know it's okay as long as you can legally give this road over to us then you start saying hey we'll give it over to you we illegally signed all the documents of uh ron smith they did all that jones david drew everything up and i didn't keep the fight but uh all that was illegally done and also what i want to point out um the first part of banks road is uh north and south it was uh taken over by the city i used to ride my bike up and down that road without a little boy you know it was just a little rock road but i guess i don't know miyamira talked about whether the city took it over when it became the county road kind of the city or what have you but my thing is this um with the fact that we're willing to legally get over east bank's road and with the fact that from me talking to the uh attorney general it's really up to the board of all of them to make that board change that's that's and with the fact that y'all make the ordinance change uh i don't think you have and i could be wrong i don't think you have a lot of private people that's saying hey look i want y'all to change my role to the city most people that do private roads and you probably only gonna have maybe one or two at home most of them want wanted pride we want our road to be a city well it's already tree like city road we are utilizing it out of the city road and of course i know they're gonna they should have a problem getting married but on our end we want to give it over to the city we've been talking about this for a while and i know mayor he's been working with me i've been trying to get something done but legally the board of aldermen y'all have the authority to do that at one point and it wasn't even a house

[1:16:34] it was only one house on that road y'all took it over wiring it out all we're saying is just could y'all do that all right that was that done with i think he's talking about the south south i think there was an annexation at one point when we it was a narrow little room do you remember when it was annexed do you remember what it was when it was in when when that air because you were in the county did that uh 2000 but that's what would be interesting to know is what was it was it a private or a public road when it was in the county and uh was at the end of the road the mailbox garbage and all that and she was like 90 years old so i think that's why davis fixed the goal so that she could get her services right here that's that could be right i think we had the right to do that one though because we looked at that plot as well and the north south identified it as public road and then it even had a note to the side that said to be built to county specifications as a county road on that plaque and like i said for whatever reason i've never seen this is your plot right there and you see highlighted in there it specifically just identifies it as a private drive a private aggressive grass and i don't know why um that's that's not normal on the flats anyway is it just everything documented as such is because we've i've lived with aaron as many times i can to find something that shows road so we can so we can go that route with it but all the other flats associated with the west and with the north south road identified it like we would normally see on a plaque and even know that they would be built into county specifications because at that time you know when they recorded that it was done in county i just can't find anything on this side that would allow us to just

[1:18:37] go forward unless there's a motion obviously like they're requesting that well i mean i know this is the first time we present this to the board of honor i said we presented to you all um you know i can understand you know i need to leave it on i don't know i didn't expect a vote today but i would be happy to get a vote today but you know we need to revisit it you know i understand but we we need something done to a course on on west bank road i don't see an issue with that to make sure that the bond should be should take care of that but on our side you know we got no more hours taken care of as well with the fact that the bond will be called in on that you know i mean i know mr wheeler he's a builder himself i mean i don't think he'll while you're paying that side we're not even an action that you you have to get it real wide we just just come down and pay you the road you know and i know the mayor talked about you know ten thousand dollars for we can fix our end of the road but you know we're paying taxes just like everybody else we want the road that's not the issue at all like i said it's you know and i gave darren that just just from what i know about learned about haiti streets i gave him a ballpark estimate of what it would be just to go and put a new layer of asphalt on it and that's an estimation but it should be pretty accurate um but no it's not an issue of that you're not paying enough taxes nothing like that i mean like i said there's nobody in this room that'd like to put a smile on your face more than me just it just becomes an issue of what impact does it have for us to change the ordinance and darren makes a great point and it's not the norm that people are coming to us and say i want to give you my streak but it is an issue that we we have to

[1:20:39] require that with new streets like if we did that then what if somebody came in and said i want to build a new development but i don't want to build the streets wide enough where you can get a fire truck down there i want to just build them and save some money and make them small well then you can't say well well we let you know we let banks be a city road with this wit but then we're requiring you to build this it just that's what the attorney is talking about it becomes an issue of how do we have a consistent ordinance with the street you know well we don't i mean as far as like uh it wouldn't be flat like whitney if it's not a planet subdivision you're probably gonna have division um in that zoning three lots or less can have a private drive which is like the same thing we kind of discussed like anything over that amount that becomes a major subdivision yeah um without making a decision tonight i'm just trying to go through and i've thought about as many times as i can many times we've talked about it and i don't know if it's even possible i i i would shy away from a change in the ordinance but maybe we can go and do some research on possibly looking out of variance a hardship on the specs um i mean obviously we'd have to agree to take the road in but then after that maybe look at a variance to the specs um and the subsurface stuff to see if we can fix it without requiring the massive major subdivision roads yeah that's an idea and then darren reminded me one thing he's coming right in his bike the way it used to be well if we took that road like the the north south and the two um not the top of the north south banks road we took that at some point um we took that i mean is there not a way that that it could be considered all as one i mean because you know you're going to talk about 800 feet and i think that's the biggest thing is like the left side you actually own it that's a good point so if you own an l but it makes a t it looks dumb if you were to have to take half but then the other section just left and i think that

[1:22:41] was definitely the intention i just think there was that when it when it planted with your life i think there was a misstep somewhere back then i mean i agree i don't think that was ever the intention it was tangelous the house went in we're there and everyone else came in i think the intention was probably to go into a road concept there's just no documentation right now showing it who planned to do it that john it might be robbie jones if that that one note is what's so it is it's i mean it's not only on a platform and all the other ones fall asleep yeah it's just interesting i mean uh flexible if you will that note right there is almost like i want to make a point that's what i'm gonna put this on the flat and then file it and it's just points every aldeplex reference your deed which just has the private interest in yourself it's the best documentation but it's against you're so confident because i was a stable private builder and they were just trying to get me back there and i don't know what to do it did a great job of getting back there with them one quick question then i will recommend a follow-up discussion on this if this engineer submitted this with those notes would a follow-up documentation to this change that uh i mean i'd be a revision to the people if you're writing to the platinum and the city would have to accept the revisions um i mean revision that would be approved i guess what we're saying is let's say this like say this is basically how these work i don't want it it's the equivalent of this is you know somebody has a problem with their um and i'm not saying this one's going on you've got to think about in equivalencies someone has a problem with some property um i don't want to do it

[1:24:44] anymore i'll just be in the city well that's not the city has to accept it before it just becomes a city's problem so revision to the plat would be the same exact uh concept when if you had a client come inside and revise and apply i we'll see what's up with this okay we agree that revision will accept it i do think that would help the standpoint of happy context possible possible variants of what was meant to be and how it's supposed to be um but it would be more of a very a variance type issue if that's if that's even feasible as opposed to a um reception revision type issue that makes it's getting highly technical i think you would almost stood in a two-step or if we if we could revise the plaque and say okay yes we're willing to look at dedication as of this as a road then after that instead of amending the ordinance and changing specs on roads which is a pretty severe thing is looking into a variance at that point saying okay we understand this is 12 foot wide we can put live whatever it is and we're willing to accept this road as it stands and that way we can do repairs because the variance is based on hardship i mean and it's based on a piece of properties hardship and i think there's probably some pretty good hardship on that road but i mean i just i was thinking about that sitting here in a text nick and i mean it may be a little you know somewhere we can find to work with it may not but i just kind of threw it out there as an idea that just came through what we're talking about it's application processes yeah there's a variance application process and we can walk through that i mean but it would have to be something we could we could not do it until this board made a decision that we would even look at accepting the road and then revise the class and we can do the variance without having to change the ordinance i would yes because like i said i really air away from that because then that that takes our whole two-way road concept away and emergency services away so it would have to be like a case-by-case basis and that's what a variance looks at is a hardship on a case-by-case basis yeah i think there's i think there's definitely a hardship here but i just want to make sure we don't run into a domino effect and put in the organs and then everybody coming in trying to shrink the roadways and save costs and it just i just don't see that as the best option i think most of us on this board probably agree that i'm not speaking for anybody else but myself that
