[0:00:15] hello [Music] right front of you your left okay welcome everyone i'm not calling this meeting to order uh before we get started we'll uh we'll have prayer and uh chris when you leave some prayer and then uh autumn and pain you listen to the pledge after that uh but beforehand again just to make sure that we've got we're doing this board meeting remotely to make sure we have all of our board members present i can see some of you on the screen i appreciate that some of you are not hooked up to video capabilities so for that reason we'll just do a quick roll call if you will just say here alderman brooks here alderman kelly you're here hollering deuce is here with us all our main pain is here with us ottoman gallagher here

[0:02:17] alderman wheeler alderman flores here okay we have everybody with us uh well now everybody please stand and uh chris we appreciate you leading us in prayer heavenly father lord god we come to you tonight father we thank you again for this awesome opportunity to come here tonight lord for the business of our city to be conducted father i thank you for our city leaders the lord is they have faced many challenges and big decisions to make during this time lord i pray you just continue to bless them with wisdom and discernment the lord help them to make the right decisions lord i pray you just use them tonight as instruments in your hand to carry out what needs to be done father we do thank you for your protection upon our nation upon our community lord although we've faced diversity during this time where we've known we can turn to you father again we just ask that you just be with us and lead us to this time of this meeting tonight in jesus name amen okay first on the agenda this evening is approval of minutes for two meetings um we take one motion deal both this is a satisfactory day so someone will make a motion to approve both the regular meeting on april 7th 2020 in the special meeting on april 17 so 2020. i would appreciate that this is moving for the minutes of the regular meeting on april 7th and this special meeting on april 17th with any additional second we have a motion while retaining second margaret hoots is there any discussion hearing none roll call

[0:04:25] beer yes next on the agenda is a repeal of the civil emergency ordinance that went into effect on march 22 2020 just so everyone knows we're going to get into a discussion later on in the mayor's report uh as uh for an update for the code 19 comeback plan uh what this is doing tonight since we've had lots of activities since march the 22nd the city voted to implement the civil emergency plan on march 22nd then after that is when governor reeves came in with the shelter in place order so for that reason it's not necessary for us to have the civil emergency ordinance we'll just abide by the governor's shelter and place order until we have the leniency as a city uh to revise our combat plan so someone will make a motion to repeal that ordinance please i'll make that list we have motion monument pain second baltimore hoots is there any discussions everyone understand that the city attorney was just saying that the penalties for the ordinance will still stay in effect for enforcement reasons it's just the ordinance itself

[0:06:28] is not necessarily longer because it's been replaced there is another there's another valid order in place to enforce so it's not necessary to have the march 22nd any discussion hearing none roll call yes yeah that motion carries next on the agendas are fiscal year 19 um audit presentation mr crystal wilson mayor board um principal emailed the reports to you hard copies releasing your boxes this is what we do manually perhaps the lord has to adopt and agree to the audit as i said the major findings were an undersigned fund balance of 11.9 million the city's debt is decreased by 9.5 million and again as we said there were unmodified report no material weaknesses no significant deficiencies no non-compliance of the financial statements no non-compliance or efficiencies and federal awards [Music] yeah you know she obviously does financial reporting auditors come in and they're out being able to submit the report to the gfoa for recognition about it again this year [Music] and just to recap again uh i echo alderman payne's comments so very appreciative of our uh finance

[0:08:31] administration department that chris wilson supervisors eddie michael wayne and tish cox do an incredible job you know with our with our books and chris does a great job with that too so to have these incredible audience that many years in a row is not the norm so uh it's definitely uh you know going way above and beyond where the normal accounting standards are so the citizens in our city should be very proud and feel very comfortable uh that we have these tight uh practices in place and that we're our department is able to do this so well so thank you chris and again testimony's work this has turned around 180 days after the end of this year we've already submitted it to the state auditors for the full board again back to us on fund balance it's important to note as chris stated that our unassigned fund balance is 11.9 million uh in the preparation budget preparations we estimated that it would be 11.8 so we're spot on with that so just to let you know all the calculations in the planning that we've done from a capital improvement situation we're good with that our estimate of 11.8 definitely was confirmed as it came [Music] just in the minutes or what board action do we need okay is there a motion to accept and adopt the uh thank you we have a motion of aldermen pain second alderman flores is there any discussion hearing none roll call yes

[0:10:50] yeah i can't hear her i'm sorry you want to try to can you play uh maybe just when you're doing the roll call maybe come up to the podium yeah next on the agenda is the um rj young's agreement uh for a copier in our parks department mr nick manon this agreement is just for the parks department of copying change the standard agreement we go with rj young the language that we've requested to pass so authorization for either the mayor or west brown to sign that agreement i'm sorry who made the second wait i have motion baller in pain second ballroom and brooks is there any discussion hearing none all in favor say hi all right any opposed say no i was having motion cares based on the agenda as a resolution for ratification of emergency expenditures if this ratification will uh i mean this resolution will ratify the emergency expenditures for dj's cleaning service and overall chemical uh due to the pandemic and cobia 19 the current cleaning company who will be starting may 1st could not get here until not you know especially starting april 1st could not start from may 1st so during that time we had to have someone clean the building in the city facility so uh these two companies have done that and so this resolution plan will just expand uh ratify those expenditures if you weren't under contract with them but due to the situation of the painting that we had to have those cleaned and disinfected um so this uh this resolution right by those expenditures

[0:12:54] are now three thousand four hundred twenty six dollars eighty five cents and it'll also write up on the remaining expenditures for the rest of the month of april um so tonight's general authorization for the mayor's assignment resolution will prove those expenditures as an emergency based on the need for cleaning less and disinfection during this time [Music] we have a motion by honor of pain second monitoring gallagher is there any discussion hearing none or alcohol [Music] yeah other mckelly yeah yes yes ottoman gallagher yeah that motion carries next on the agenda's resolution for surplus this was just authorized equation for surplus of the oval furniture in city hall room in their mouth or in the city hall boardroom before now on that wholesale city hall boardroom in accordance with mississippi 17 25-25 we have motion monument pain second alderman hoots is there any discussion hearing none roll call alderman yeah the motion carries

[0:15:00] next on the agenda is the residential auto sales ordinance um this was table at the last meeting it's old business and again this is an issue that that the ordinance committee discussed heavily and wanted to bring before the full board to make an adjustment to it evidently we've learned that the city of south haven is the only city minnesota county that does not have this ordinance which limits the number of vehicles that may be sold from a personal residence obviously the purpose of this is to clearly define a commercial auto lot and a residential dwelling or property and that seems to get kind of abused at times in the city so that's the purpose of it so is there a is there a is there a wish from the board to go ahead and pass this tonight or table and i'll take your direction i'll make the most money gallagher is there any discussion hearing another roll call other members [Music] yeah honorary kelly okay next on the agenda is our planning agenda this whitney cook oh yes sir we have two items on the agenda tonight uh our first item is a request for a conditional use permit at 905 county country drives cf the applicant is proposing a motor vehicle repair facility in an existing multi-bay building uh the suite that he is specifically asking and requesting approval for has overhead roll-up doors

[0:17:03] in the west end uh there was previously a motor vehicles shop in this location uh so he is asking to locate in the same bay which was already designed for this type of use there is proper drainage and fiber storage on site as well as drive-in bays to have all the storage materials on the interior of the site uh behind the fenced-in area um obviously we've got the code that allows only two cars to be exposed at any one time however we put in this conditional use permit that he could not have any exposed cars at any one time on site so with that stipulation planning commission did vote unanimously for a one-year conditional use permit and a four-year extension to be renewed on item one we have a motion bottom and hoots and a second volume of pain is there any discussion hearing item number two we have a request to rezone 6.3 acres of property on the north side of state line road just west of airways right now the entire piece of property is some general commercial or c3 there are three parcels associated with this area to have frontage on state line road in this rezoning to a pub the applicant would like to keep the c3 zoning as an underlying use for those two partials the back of the property is the larger piece of the property uh 5.4 acres it is actually adjacent to the memphis border uh behind the uh i believe the tiger mart exxon right there on the heart corner uh it's been vacant

[0:19:05] for years and he wants to try and occupy this for rv for rv parking area um and also for some little cabins very similar what you see on highway 51 with the yogi bear rv park without the mini storage um we feel that that's a good use because it has that they hit for a long time and there's really no commercial use conducive to that actual location and without the visibility needed comprehensive plan does call for this area to be mixed use so it is compliant with the comprehensive plan and the c3 up front is conducive with the character of the surrounding neighborhoods so uh planning commission did vote unanimously to accept the rezoning to ped um mr mayor make a motion to approve on number on item two we have a motion alderman kelly uh second alderman payne is there any discussion landscaping around the same room and all of that um well both of those two parcels on state on road will have required 20-foot landscape buffers while on the frontage anything that goes there we'll have to go through this underground site plan just like we can see here for whatever building goes there um we will also have the decorative fencing the landscaping going on nearly as well any other discussion among the board here you know is there anyone in the audience who would like to speak regarding the property hearing or seeing none roll call yeah yes yes autumn and gallagher yeah the motion carries okay next on the agenda is our mayor's report um as i mentioned earlier i am going to give an

[0:21:07] update regarding the code 19 comeback plan uh before i get into that i'd like to go ahead and take care of some business that was not ready at the deadline to go on the agenda and just discuss a few things with you the first thing is our engineering consultant civil link we've had discussions about our asphalt contract and i just want the board just a quick update to let you know that i will be asking uh civil link to um to amend the contract for street resurfacing to give more accountability to the thickness of the asphalt that's applied a lot of the stuff that we're doing now we're having our own engineering consultants team uh inspect that to verify that you know basically we're getting more paid for i think that is a waste of resources i think that we can be more efficient financially with that and so what i'm going to request going to the contract is that we have with the contract that we have teeth we have accountability to the contractor that we don't have to stand over them and watch the thickness so they could be held accountable to come back and resurfacing the road if we start to have any road failures prematurely with that i've noticed that over my years of overseeing that that that is a problem and uh and i think it's one that needs to be corrected uh so mainly just on the board to know it's not technically you know the time for the contract okay i was thinking it was this summer sometime so we will get into that later but just want to put that on your radar on the board members to know that any questions about that next of all we had a recent request and a great idea alderman wheeler uh brought an idea to my attention uh which my heart has broken you know for the seniors the high school and college seniors um of 2020 you know that this virus and pandemic

[0:23:09] has uh you know just you know unprecedentedly uh affected their senior year it's just it's a terrible thing and so with this coming on in the spring some of your spring sports your baseball softball uh specifically uh they had their seasons canceled i mean they barely even started you know and for um for the seniors it's just such a tragic thing you know if they didn't get to finish their senior season so for that reason the idea was that we would uh try to throw a little happy their way you know that we would honor them you know by putting up some kind of banner in the city uh for these athletes i think it's a great idea as i told audra wheeler i'm 100 behind that however there are some concerns how we would do that we looked at possibly changing district banners and putting them up in place of those we realized that that's a massive undertaking it would take a large amount of city resources uh you know used to tie up the city's trucks you know that need to be used for other purposes so that's going to be a tough thing to do but um another good idea was to place them not at the intersections but it only wooden poles near their schools so i think that's a good idea as well but in order for us to do that we do have to have board approval to use public resources to hang those banners we communicate our automobile wheelers communicate to the schools uh that they will you know have to pay for the banners and the brackets themselves uh but the city would provide the resources to actually hang them the other thing that's contingent upon that that i've explained to otter audra wheeler just to make sure that you know that we followed the school's request and that everyone knows that the last thing i would want to do is disrespect any other athlete or any other student that's a senior so i need some type of verification from the school principals exactly which teams or which banners we're going to put up so as soon as we have that information hopefully we can move forward but tonight i do need board authorization for us to use city

[0:25:14] resources to hang the banners i like that much but actually i'd like to go a step further i i like to see the city do something to honor all those secrets i mean the best part of their senior year for the last couple months you know uh if there was any way for south asian central maybe south plenty africa banner you know somewhere on the state line road or something you know somewhere on the get-go just saying southaven loves and supports you know their class of 2020 i think would be just a great message from the city and uh um i love to see us do something sure and i appreciate that idea i agree with you and nick as far as the city doing something like that i know that state law does restrict us in some some ways in and buying things like that like i said we can donate some resources uh but as far as actually buying it uh do you see any issues with that nick i think what you can do tonight is not the right the tonight i think what you could do is pass up a motion pursuant to mr code 21 1965 mr code 1731. because 1733 would just cite the language requiring that it shows opportunities possibilities uh resources of the city promoting school and school uh seniors in this time right now and then you would that would allow you to use your uh allow you personnel and cso desires to hang the banners and to purchase one or two bad you know banners for certain schools because i think that's all it did uh i think it would allow you to do that with under those statutes so i think you could do it from that standpoint um if so the same thing that we were going to pass to authorize use of resources to hang them that would allow us if we can come up with something like our pain is

[0:27:16] talking about it would give us the authority to do that as well yes sir i think you could i mean as far as bringing people notice to the city and opportunities and everything within the city and those statutes and that would be i think these statues and this is it in this time i'm going to apply every year but i think under this circumstances and this year could apply based off of everything that's going on okay thank you all right so we have a motion bottom and pain is there any armored wheel or you second that is okay while he's working on that we do have emotions altering pain uh autumn wheeler did the second promotion is there any other discussion he was talking about doing something not just for you know the banners that the schools asked us to do he was talking about the city doing something in general for all of our high schools like maybe putting up like uh you know just some kind of banner that honored all the students not just athletes or any specific ones um maybe putting that up somewhere in the city to honor all the seniors this year just something generic you know southaven loves our class of 2020. you know something you know maybe one that's orange and uh you know all these seniors are having a tough year they're having a tough time you know their problems with cancer their last couple months in new hampshire uh i mean greater things can be worse i

[0:29:18] know but i just even have support i think you look good from the city just saying hey guys and i did ask nick previously uh this motion or this action would include authorization from north point christian school that's our third high school in the city uh yeah this action would give us the authority to do all like to do the general all right yeah it would allow us to do the general banners that alderman payne's talking about and the specific ones that um that the schools have requested thank you any other discussion hearing none roll call i'll remember yeah pardoned wheeler yes okay that motion carries in the last issue in a previous board meeting we had a discussion about a private ingress egress road in the city banks cove east we had some local property owners come present to us that that it was never their intent for that to be a private drive this uh just to remind everyone this is an area that's off of nail road just north of nail where we have a public street banks road that ends in a t and then we have banks cove west and then banks co east well banks code west and banks road are all public streets but the the uh the t side of banks cove east is not so they brought up a good question we've talked about this uh in the past how the city didn't have the authority

[0:31:21] to go in and repave the road of the cove because it was a private road and so they've expressed over and over that that was not their intent even though the documents back when it was planted it was planted as a private road so that's the reason that we've not done anything to this point however at the last meeting when we discussed this our planning director whitney cook did make a suggestion that there is a way for us to go back and accept the road it's not that we would be doing any work on a private road it would be their request is that we take that private road as a city road and they're willing to give that road to the city let it be a public road for public use and then we would have the authority to maintain it just like we do other public streets and whitney's suggestion is and also confirmed by nick manley is that if they're willing to do that if they're willing to give us that then we can make a they can apply they can go through a variance application uh and apply for that to happen and that we can do that the cost to overlay that cove has been estimated in the previous meeting i mentioned that i thought it would be about ten thousand dollars uh we did have it estimated and it's twelve thousand six hundred dollars so it's pretty right on to what i estimated and uh so anyway the the issue tonight uh is will the board um will we before we send them through the variance application basically it's going to save our staff time there's no need for them to go through that if the board's not willing to make that decision so the ask tonight is will you agree to accept uh banks cove east as a public city street [Music] to tons is acceptance

[0:33:26] accepted um so it's not just the very first thing you can accept and so tonight the authorizing the expenditure of funds and the final acceptance of the variance right basically what i and we'll change the power you recommend i was basically we wanted to know if they're willing to accept it at that time so what what nick is saying uh board is that um basically what we need to know it's still contingent upon them going through the variance application process but we just want to save time we don't want to go through that process because ultimately it's going to be placed in your lap to make a decision at that time would you be willing to accept this three and so is that still your motion uh arnold wheeler that's still your second pain in greece the second that any other discussion hearing none wrong home [Music] yes you will relay them to them that we need to go ahead and move forward with the variance applications okay thank you okay that's all um [Music] they didn't really understand the dynamics [Music] i don't think it was an honest just misunderstanding so okay

[0:35:27] all right we'll move on and uh so last thing on uh my mayor's report this evening is on update the board and the public uh with our kobe 19 uh proposed comeback plan uh we call this the 335100 plan uh because of the gradual process that it will be to implement it so what i'd like to do tonight is just remind everyone first of all that this is contingent upon governor reeves allowing us his leniency so after friday i said that friday i communicated that but i know it's a lengthy thing and it's hard to you know have a policy like that without it being very comprehensive because as soon as you try to be sure and leave something out you know here comes the other questions with that so i apologize to the public that sometimes the communication is very lengthy but that's the reason it has to be and i know that people don't have time to read everything all the time so for that reason tonight i'm going to try to clarify some of the most frequently asked questions but the first thing again for everybody please listen to me it's a proposed plan it has not been implemented the dates that i have on there are subject to change it is contingent upon governor reeves giving us the leniency to do that i've reached out to his office i've explained that big cities like south haven need a reasonable amount of turnaround time to communicate that to our public his office has been really receptive to that so i'm hoping that he will um update the state sooner than later this week that way we'll immediately start working on amending what he does with our plan and have that something ready for the board on a special meeting either thursday or friday but we can get together and we can officially implement the plan so first thing first answer is proposed it's contingent on the governor the second thing is the reason you may ask well why would you go ahead and do that if it can change well the first thing is

[0:37:31] um it takes a large amount of time to do what i just said to like take one order and then integrate it in with what the city already has and and then also make tweaks to it to make it an effective plan so it takes time to do that so the reason we went ahead and released that is to give number one like i said friday to give people hope you know that we're not just sitting you know waiting on the governor we're not just sitting waiting on some miraculous vaccine we are considered all risk daily and we're putting a plan in place the frameworks where we can we're ready when the governor gives us the ability to do that the second thing is i have a lot of people on both sides of the issue i understand that you're concerned i understand that this has been a very scary virus it's something that none of us have experienced before i understand your concern so i want everyone to know that that this is no plan to where we're going to wake up one day and say hey hallelujah let's hit the road again all our worries are gone let's all go back a hundred percent we understand that it's a very dangerous thing and as i stated friday we're not in the clear yet we've got to be very careful we do understand our proximity to memphis we understand that that we face uh challenges that other mississippi cities do not have because of our proximity to the densely populated memphis metro we're aware of that we're taking all that into account the other thing is we're aware do we have the second most positive cases but i'll let everybody know that's nothing that's no surprise i mean sometimes people say you know how can you be thinking about a comeback when you have the second most positive cases in the state well that's no surprise to us i mean we're the we're one of the most densely populated areas and if you add memphis to the equation we you could arguably say uh we are the number one most densely populated area in mississippi so the fact that we had the most cases that's not a surprise we knew that we factored that into every decision that we made all along

[0:39:34] the other thing i would add and i try not to get into statistics too much and the reason i don't because if you turn on the national news tonight you'll see the biggest experts in our country some in the world that still have question marks they're scratching their head about the numbers a lot of that has to do with the fact that there is a delay in the reporting process so when you when we get a number like um i've been tracking this since the actual count since they started tracking since we had our first case on march 17th every day like you may have 10 new positives one day and you may have won the next and a lot of that is not because uh there's a true trend it's because there's a delay in reporting so that's that's the reason that you can't always just go on those numbers and so anything that i propose to to this board and to the people of south haven is not just with that information i have much other information that i'm gathering every day and so it's not just limited to that so when you say hey mayor did you think about this the answer tonight is yes i did think about that you can still ask me questions i welcome that but i will assure you that i do not sleep much i will assure you that we are looking at every statistic we know where we are with memphis we know where we are of mississippi we watched what happened in new york we understand that we're not the same as new york all these things are taken into account uh the next thing that i alluded to just briefly that i want to elaborate on is are we just one day going to say hey you know what we're all good there's nothing to be afraid of anymore let's all go back to let's go flood the restaurants that's all i know everybody's missing our restaurants i know they are i hate i i hate it myself i mean um but no the answer is no we're not going to flick a switch and i'll rush back and start flooding places again we know that it's still a dangerous thing that we're going to gradually work our way in that's the 3350 plan and so i would encourage you if you don't read anything else at least read the statistics or the percentages

[0:41:38] and timelines that we're requiring we're going to wait when we get the go-ahead from the governor we're still going to monitor the statistics before i recommend make a recommendation to the board but there will still be at least a two to three week period where we limit the capacity to 33 so and then after that again another two weeks after that where we're still limiting the capacity of 50 before we get to that 100 number and then with that being said um the other thing that i'm amazed by i get a lot of questions about well i'm afraid well if you're afraid anything that your local government does we're going to make recommendations uh we're going to pass laws to keep our people safe that's our number one priority but that doesn't take the place of private businesses and citizens using your own good judgment you know if you if you have a health issue um that every expert has told you you're at higher risk then you shouldn't jump back into this thing just because we have a comeback plan that doesn't mean it's okay for you to do that it's still important that you know your own situation and make your own decisions to keep yourself safe so same thing with businesses i've had some businesses that said well if you implement this how am i going to do this well it's not my role to tell you how to run your business it's my role to tell you how you can safely get started but anything that you want to do in addition to that for more safety we welcome that that's that's your business so i would encourage that but again the plan is is a plan is a gradual plan uh that will bring us back cautiously safely and effectively and when i tell people we're watching the statistics like a hawk we're watching all the statistics like a hawk so please be assured of that the last thing moving in uh would be what this is this is not just you know to the question mayor you care more about the city's economy than you do the city's health first of all let me explain something to

[0:43:40] you before we even get into the economy which is a very serious concern and which is a job that you hired me to do i take that very seriously our economy affects everything that we do in this city and your economy eventually is going to affect your personal health your livelihood so they all do go together but just let me address the first issue first and i'm not the first person that's told you this there's no doubt that the virus is dangerous but when you take extreme measures like your governments have the state of mississippi many state governments the things that president trump and his experts have recommended these are drastic measures i mean none of us have ever been told to stay away from something this is america so this is drastic this is something that none of us have faced before but it's important to understand that that's only geared for a short term it's not practical or even possible that you can keep people in these current situations indefinitely people have got to know hey what's the timeline when is there going to be some relief to this where is my hope and so eventually as the days go by it's not just the exclude economic health it's talking about just physical health it's not just about the danger that this virus can do to you or your family it's also the other uh health risk i mean when you start you know keeping people locked up i mean are not locked up but when you're people are forced to stay home or to not go do the things that are you know healthy for them both mentally and physically you start to have mental health issues you have it's a documented fact that you have problems with drugs and alcohol you have domestic domestic abuse issues so there's other health risks it's not like you're choosing one either to be safe or to be not safe you face health risks on both uh both ways with every decision so i just want to point that out everybody that's watching or they may come back and watch i want you to hear that i'm pouring my heart

[0:45:42] out to you i want you to understand that i that i have the responsibility of not being one-sided or or hindsighted i don't have that luxury we have to make decisions considering all the risks our feet and so the last thing i would say is when you talk about um this comeback plan it's it's a rehabilitation plan that's what it is just like if you had a physical ailment uh that that knocks you down that you're trying to recover from you don't just one day wake up and get out of bed and you're 100 i mean there with any kind of um issue it requires a rehabilitation period so that's what this is i mean this is this is a period to where um we're not getting out of bed and gonna be well on day one um but we can't lay in the bed i mean eventually you've got to get out of the bed and put your feet on the floor and check it and start working your way towards recovery so again this is not we don't expect to get out of bed one day and be 100 of the next but i'm just telling you from the bottom of my heart to my board members and to the citizens of south haven we got to get up we have got to get up and start working our way back we can't lay around in fear you know we've been terrified by the things that were uh the information was given to us 30 days ago we've learned locally that all that we were told 30 days ago is not proven to be true here and again we're not out of the woods yet but we've got to make decisions based on our own statistics and the bottom line is we cannot continue to lay in bed we have got to get up and start working our way back to recovery but that's my message tonight and uh again last thing along with that is people have got to use common sense and business sense you know we've done our best to try to steer our city in the right direction to keep us safe but people have got to continue using common sense and businesses so i'll end it with where we go from here as i started this discussion it is a proposed plan it has not been
