[0:00:02] welcome everyone i'm now calling this meeting to order please stand with us uh we'll be led with the invocation by alderman gallagher please remain standing for the pledge of allegiance led by alderman ferguson heavenly father thank you today for letting us meet again lord we thank you for the rain that started the day and for the sunshine that ended it lord lord we would pray that we would have your heart full of patience love and understanding for others in your name we pray amen amen i pledge allegiance to the flag of the united states of america and to the republic for which it stands one nation under god indivisible with liberty and justice for all first on the agenda this evening is the approval of minutes for the february 21 17 meeting mr mayor will be approved in the minutes of the regular meeting of february 21st with any additions deletions or corrections we have emotional arm in pain second alderman brooks is there any discussion mayor i have a question um on the building codes it says international building codes may i ask what that means in relation to us to the city what is international there means international is a standard building code that's used throughout in the united states correct it's a standard um list of guidelines that's used throughout i guess to be international means something different than that that's what i was asking that's a good question whitney i mean is it something that's used throughout the world or is the united states i mean it's it's it's the standard for all building code it's not if it's the general consensus internationally so it's something that's commonly used

[0:02:05] you know in other areas so it's it's common that cities will adopt that and then make amendments to those buildings are in other parts of the world they're totally different than here that's all i was asking for sure that's why yeah there's definitely has to be amendments based on the part of the world or the part of the country obviously there are differences in certain regions sure okay i'll you lost me so we have a um we're approving the minutes proving the minutes we've got a motion and a second is there any other discussion about the minutes hearing none in roll call yes yes okay and that motion carries next on the agenda is invoice for the annual financial report of the i-69 mid-continent highway coalition this is a group that um that is working to make sure that the route of the i-69 does not get moved this is a national thing there are some out there that are trying to lobby for the i-69 tanaka through desoto county so we have a group that is um is working for us in the county to make sure that that does not happen so in doing that there is a cost involved so desoto county has offered to lead that for us and the cost of that divide that by the by the cities and the counties so that's why we're being asked to pay 500. we have a motion bottom in hale second bottom and gallagher is there any discussion and this is something we've done i think we did this the last three years yeah and everybody in the city counties correct everybody else is paying an equal share

[0:04:06] the county has taken the majority of them okay but no other discussion um roll complex yes okay that motion carries next on our agenda is the ghetto road widening project change order request and that of course is our widening of five lanes from goodman to the tennessee state line mr dan cordell thank you um as the mayor said this is for the giveaway road and pro widening project between state line and uh goodman road i don't know if some of y'all noticed but it's been a little bit slow or lacking in construction over the last couple of weeks well as we dug into it they've run into a problem uh the engineer and the contractor the the right side new lanes have been completed and the left lane left side new likings have been completed the existing road in the middle the design group went by plans in hand the stuff the city had on the existing road structure it showed approximately six inches of asphalt being in the existing pavement uh part of the plans were for the contractor to meal two inches some areas got a little more than that something areas got a little less to get a crosswalk well some areas that they kneel two inches they get dark or hit subdrive so it's obvious the road didn't have the six inches that were expected uh what has taken them some time and the reason we got into it mayor wanted to know what was delaying construction and they were going back and forth trying to quantify that that that impact or how much of the road it is and to be honest i don't know that you can without actually doing the work uh we've looked at it with the engineering group there's some existing cracking that that even in areas where they temporarily put some overlay over

[0:06:10] the existing road and have some reflective cracking coming through so we know we don't want that at the end result of the new road so what the contractor has proposed along with the engineering group is to in these areas where we have minimal structural depth of asphalt is they will emit it down to the dirt and then take the dirt out six inches put back in a soil semen or soil substructure and then come back over with at least four inches of asphalt to get their final overlay which would give you six inches the only way i know to keep them going is was to offer them a not to exceed meaning worst case if they took every bit of the road that existing road is exposed now what would it be to do that and then their goal is of course to only do the areas where we have that issue but you can't quantify it until you get to it so the not to exceed number is 411 thousand dollars now the other component of this issue is this is an 80 20 with m-dot through the npo but they're capped at the contract amount that it was bid at it was a seven million dollar plus or minus total contract number that's all in for them so anything above that number is the city if we're under budget in the construction then of course cost share up to that contract amount the problem is at this point they're far enough along in the construction that everything is field measure quantities as as quantities as built and they don't have those numbers and probably won't have those numbers typically takes a month or two to finalize the job to get final quantities so they don't have that information so we really they know that we're plus or minus a percent or so of the contract but that could be 50 000 or so above that could be 50 or 60 000 below we know it's not enough to cover this change order not to exceed change order now there's

[0:08:12] no documentation on this this is me requesting board approval pending them giving us the documentation as they build it so we give them an allowance to go up to that number uh as asking not to exceed dan what what happened i mean as far as the the contractor who did this last time did did they not do it correctly we don't know that apparently that go to court get well road goes back a long time and we're talking about the middle two lanes uh the plans that the city had on file that the engineering group used showed six inches of asphalt it's clearly that's not what's out there now now that's 20 30 40 years ago however long it was when it was first done there's been some overlays in there now i don't know if at some point a contractor milled too much and didn't put an inch or two back i don't have that answer i don't know i do know that when they're milling it out there now there are some areas where they're getting two inches trying to get their overlay amount in and they're ready to overlay that final two inches but we're just not ready i don't want to move forward the way it is now you're gonna have more problems with a finished road than you that you're fighting for are we talking about the entire distance or what area well right now yeah what they estimated was the existing road area now some of you'll see they've already fixed right and that was areas that were already in the plans they had to they knew they would mill too much and was going to have to hit apparently those boundaries are more than what was anticipated so their estimate not to exceed is for the existing road that you see exposed we do not anticipate that being the fact we know there are some areas that are paved right now that they've milled that we won't have to do this on it's just them trying to quantify it was going to take a lot of time and it would require a lot of potholing and that kind of stuff and so basically we're sitting here with an unfinished road because they can't quantify that no this will help alleviate issues in the future that road yes it will give us the

[0:10:15] structure you need in the middle of the road i don't know if you know this but if you're coming southbound um you'll see where some of the new road meets some of the old road they overlay and it's already running that's an experience that's happening because there wasn't enough structure in the existing road the new roads holding up so the new road structure is fine but where it's it's running already is essentially what they're worried about happening in some of the existing road areas now they're going to fix that too those areas that are like that but it's all included in what we're talking about tonight i'll make that motion second we have most modern florence second bottom in ferguson is there any discussion and we will have a formal change order for the board to approve with the actual number bit time is an issue you know we have this is this going to push the time on completion of the extreme they're ready to do this overlay now they're just going to take them approximately i think mayor three weeks is what they told me to do this modification depending on how bad it is i'll do three weeks which essentially my time schedule they should be overlaying now should have been overlaying two weeks ago so it's already cost us two weeks probably gonna cost us another three weeks but then they'd be at a point where they'll be overlaying the final surface and that point should just for everyone that that will go much quicker i mean the stuff they've been doing you know with the inlets and all that is the tedious work so when they get get this project done and get to the uh when they start paving then the rest of us should go very quickly at that point correct yeah and we have just so everyone knows we we don't talk about it every board meeting but there's many many conversations that have gone on with dan and myself and and the contractor so we've we've been pushing this project you know very hard we know you know how important it is for the traffic in that

[0:12:17] area it's a huge project it's going to be great when it's done and uh so there's a lot of discussion that goes on behind the scenes and so we're going to continue to push them and try to get this thing wrapped up for everybody is there any other discussion hearing none we're all calling yes okay that motion carries thank you dan next on the agenda is the police vehicle bid award mr chris wilson mayor board as you recall aboard authorized cities to go out for bids for financing for 12 new police vehicles for their new fleet also on this meeting we're offering the surplus 12. so this will replace those and add these to the fleet we receive two bids one from trustmark for one point five four percent and one from bank before south at 2.04 percent obviously it's a recommendation to select a 12-month financing from trust market 1.54 and these vehicles are on state contract so it loads second we have motion bonderman flores second alderman kelly is there any discussion emotional sign-on documents all resolutions don't follow up they have submitted a form just for the acceptance of a bid so you want me to amend it to approve the bid approve the bid and authorize all documents signed by the mayor i'm in the bid to approve all documents and for the mayor to execute all documents it's is there any discussion

[0:14:35] hearing none all in favor say aye aye all posts say no eyes have it motion carries thank you chris next on our agenda's resolution for approval of isle of branches local and private yeah this is a interesting one all branches getting local and private legislation to allow them to serve outside of their certificated area for gas the five miles and as part of that local and private they need a resolution from the city of south haven the city of hernando and desoto county saying that we have no objection to it i've talked with their attorney i talked with mayor talk with chris looked into it we don't even provide gas as a city it's not coming within our certificated area i didn't see any issue with it i don't think the county facility county had an issue with it and i don't think the speaker ninja had an issue with it as well in addition language was added to the resolution which are into the local and private not to resolution to local private legislation they're getting which basically noticed that the um click on product will not be used as uh an annexation tool in the future by submitting to this that will be noted in the resolution or in the local private which it i think affects other institutions more than it affects us but that will be included in the local improv legislation so tonight's bringing this before the board to authorize the mayor to sign the resolution um basically saying the city has no objection to all of ranches local and private allowing them to serve the areas beyond the five miles for their gas service i think what brought this up that's a great question it was going not getting too many details about other it was something this kind of clean up item um that all branches just kind of uh had noticed and they were wanting to um uh remedy it uh if you will so that's what uh it's been going on and they just said

[0:16:38] they were trying to get everything um squared away from their end so we uh they're getting legislation to allow for it to occur and because they just it's part of that the state legislation attorney is requiring this from entities that board are olive branch so we're talking about natural gas right yeah it's a gas and the city will have its own natural gas all branch has a natural gas so they provide gas so they don't use that i don't know i don't know the whole city how the whole city works but i do know that they do have some natural gas customers um so i'm not sure what the breakdown is so we have a motion bottom in pain second alderman brooks is there any discussion hearing none roll call yes okay that motion carries is that all for that one new yes sir okay the next on the agenda is a resolution for surplus for our southampton police department yeah we have i think there should be two resolutions tonight the first one is uh and they get a different time that's why we have two resolutions the first one's the radio surplus request uh just authorizing the uh southeastern police surplus the radios in accordance with 17-25-25 second we have a motion baltimore brooks second ballroom flores is there any discussion about the radios hearing none roll call yes yes that motion carries

[0:18:44] and the next resolution as chris alluded to earlier is for vehicles uh each vehicle will be treated individually and some of these vehicles will be below one thousand dollars which will allow for a private sale of the vehicle um under the seventeen twenty five twenty five i think it's subsection six or five i can't remember my head but um that will uh the resolution will note that so each will be surplus in the vehicles and be treating them individually and the police will the police department will determine how each will be treated based on how those requirements and regulations under the code we can do this as one motion yeah mr mayor move we uh surplus the police vehicles and according to state law what's that we have a motion bottom in pain second volume and hail is there any discussion hearing none roll call yes kelly yes yes yes yes yes yeah that motion carries next on the agenda is amendment to city ordinance title 13 chapter 6. this will just amend the city ordinance under the puddle in title 13 chapter 6 section is 13-6 b5 and 13-6 c7 and bring us tonight for the board for approval still moved exactly we have motion baller in florida sacramento ferguson is there any discussion hearing none roll call next on our agenda is our planning

[0:20:47] agenda miss whitney cook uh yes sir we just have two items on the agenda the first one is a subdivision application for rasco farms section c there's your master plan for the overall development this portion is in the northwest corner it's 9.358 acres it will contain 44 lots minimum 6000 square foot lots it does it's adjacent to section b which we approved a couple of four meetings ago that actually had a secondary entrance on to state line road we asked them to provide a communication subdivision sign a community sign we asked them to clean up responsibility for the alleyways to determine if it was public or private they clean that up and they're going to put that on every plat so we don't come into an issue if it's a public or private road it will all stay private we did have a table to the planning commission for one month because there was an error on the square footages of the lot the applicant did comply and correct that situation so the last meeting we did approve it unanimously yeah i'll make that motion second okay on item one of the planning agenda we have a motion by alderman hill second baltimore brooks is there any discussion just one question uh i think i think i have additional lighting in there like we've talked about in the past uh not so far as far as street lights and that's probably gonna be a question that you can um speak to bradley about our standard is every eight lots these are pretty tight lots they're narrow so normally this type of subdivision you don't run into the problem it's the one that is wider and more spaced apart and you go eight lots down and get a little bit less lighted but we can certainly ask is there any other discussion none on item one all in favor say uh i'll post say no i just have it motion carries on one item number two is a design review uh

[0:22:49] request for a c store or convenience store with two retail bays attached to it on the southeast corner of dorchester and highway 51. they made some changes to their landscape plan and made some significant changes to the building per the planning commission's request we did not have time to get that design elevation in for the docket but i believe it does have a um attachment with that change on it or not um i sent it off and i apologize i can pass this around basically it was an episode brick building you'll see you should see the elevation in there and had a staggered roofline um we did ask them to incorporate some of the stacked stone and to provide some uniformity to the polyester columns they did have the columns in uh well okay go back one i'm sorry i just saw it michael anyhow we asked him to add a stack stone and we asked him to add the decorative acorn lighting in we had to get them to adjust the landscape and they submitted their colors for the canopies in the e-fis it was all compliant with what we've been looking for down that area uh turned out to be a really pretty building uh they've made all the changes requested and with that we asked for approval and i do have if you want to see just a smaller copy i just got in the final changes today so i don't have the materials over there just remove we approve item number two on planning agenda in a motion by alderman payne second alderman hale is there any discussion hearing none all in favor say aye aye all opposed say no eyes have it motion carries on too thank you whitney our next one agenda is the uh our mayor's report just tonight i would like to report to everyone that um our greenbrick park arson case from the fire in 14 or 15 we did recently get an indictment on that so that's that's big for our city uh we will pursue that to try to you know recover loss funds whether it be subrogation of insurance or or whatever

[0:24:53] options we will exhaust all those to try to recruit the money but we did get an indictment so i'd like to thank our police department and all the people that played a big part in that that was huge it was a great job by all moving on to a more positive note we have our mayor's youth council with us tonight i'd like to acknowledge them and we also have the superintendent of education's youth leadership council led by jeff shans and ann goss and our mayor's youth council is led by tim gardner they're all in attendance tonight so can we give them a round of applause one other thing uh tim gardner is with us he is our director of our mayor's youth council and i just uh like to mention that he was recently selected teacher of the month so we'd like to also give him a round of time you know we're very blessed in the southern county with our school system we have great leaders in our school system and it's very important for our community we appreciate all that you do that's all i have under the mayor's report next on the agenda is our citizens agenda and we're going to actually get an update from our mayor's youth council um i stand before you on behalf of the mayor's youth council to say thank you for allowing us to go to delta state and be a part of the youth municipal league conference while there we connected with other councils from cities like hernando horn lake hattiesburg and greenville we also as a council learn how to properly dress in professional situations classy yet chic how to effectively lead and about the state of the youth address which is a way for the council to learn about the problems that the youth face every day and to figure out the best way to alleviate them it is given after the state of the city address which has led to significant positive changes in ocean springs where it was first implemented

[0:26:54] for the first time in the state of mississippi outside of attending the mayor's municipal league conference the city excuse me the council has been very active in the community together we have collected pet supplies for and worked at the humane society hosted a booth at the earth day festival participated the veterans day luncheon cleaned up the sides of the road collected collected cans for hunger to hope and planned to do a dress drive at both south haven high school and desoto central high school for the non-profit the glass slipper project i personally would like to say thank you again to the board for giving me and everyone else the opportunity the past four years to experience this conference and to be a part of something bigger than ourselves and find new ways to better our county thank thank you again from the mayor's youth council and have a nice night [Applause] we appreciate all that you do and uh and we appreciate you coming forward with the report you did a great job our next on our agenda is our personnel docket mr mayor i knew that we approved the personnel documents presented on this date second we have a motion alderman brooke second baltimore kelly is there any discussion harry now we're all calling yes yes okay now motion carries next on our agenda the city attorney's legal update okay it's already done uh next on our agenda is our claims adopted mr mayor i'm moving across the claims docket in the amount of four million seven hundred twenty four thousand five hundred and sixty dollars and forty one cents including demand jacks second we have a motion volume and pain second volume and fluoresce is there any discussion yes
