[0:00:02] welcome everyone I'm now calling this meeting to order please stand with us um we'll we'll have the pledge of allegiance of alderman Ferguson but before that we'll have prayer led by Alderman gallery Gallagher Heavenly Father we thank you for this summer day Lord we thank you for everything that you've done for us Lord we thank you that you lead us and guide us Lord and that you show love to us when we don't deserve it thank you for your mercy in your own uh unending love in your name we pray amen amen I pledge allegiance to the flag of the United States of America and to the Republic for which it stands one nation under God indivisible with liberty and justice of God first on our agenda this evening is approval of minutes for the June 21st 2016 meeting to bring our move we approved the minutes of the regular meeting of June 21st 2016 with any additions deletions or Corrections we have a motion ball to retained on the second Alderman Kelly is there any discussion hearing none we're all call what have been Kelly yes okay and the motion carries next on our agenda is an mou between DeSoto County and the City of Southaven for Employments too and activities of The Advisory Board of the Mr Davis Public Library board this foreign this is just the guys an mou between the county uh South Haven and the public library board to formalize the library board in the process the mou has will be agreed to by each City and signed by the camp has been signed agreed by the county and by the library board at this point it's an

[0:02:05] operating for presentation to Ford as part of the mou is they're redoing the bylaws for the library board so the board this board will have the opportunity to appoint three members to the library board done as well but I think they're trying to right now they're trying to have a more formal process with this um board I talked to the library or a librarian for South Haven for the Davis Library and she will be providing the names in the next couple weeks for the board to consider for employing this good Library board but bylaws require that appointments aren't made within 90 days the library board can make those appointments on behalf of the city so she's aware of that in the process of getting names for the board to recommend for approval so now you just bring the moud for approval and answer any questions you may have so this is just a basically a understanding between us that we're going to appoint people well it's a it's a mou it's not a it's not you between the city in DeSoto County in the first Regional Library board it basically says we agree with you know the library board to adopt some of the bylaws this is just basically allowance and recognizing the city saying they'll all work together part of these bylaws we agree with the process and we understand these bylaws and the city and the county and the Park Library board are I guess trying to have a more formal approach with with this by doing this mou is going to pick the lottery I'll get three appointees before this Four history appointees the southern County Supervisors get three appointees and the library Board gets one of things if you don't pick somebody within 90 days though or have three appointments in the 90 days the library board can put someone in the South Haven slide before them and fill those positions that's just part of the agreement with the moves it's part of the bylaws bylaws okay tell the mayor or you or you do it out of Oregon you need your plan for me

[0:04:07] like you would any position Mr Mayor I moved we approved the library Advisory Board mou along with with DeSoto County in the first Regional Library and allow you to sign second we have a motion development pain and a second the ultimate Flores is there any other discussion hearing none all in favor say aye aye all opposed say no outside of motion carries okay all right next on our agenda is Award of bid and contract for information technology and emergency communications offices renovation project and then Mr Bradley Wallace help us the details so many report we had done some put out some documents for renovating being in a former courtroom in this building it's currently occupied by information technology and emergency communications came back with lotus investment 55. 1000 um we had four beers total and they were closed the best this project we recommend them for that is working we will renovate the old courtroom should be administrative offices for Chris assistant and also provide some other staffer names that meet and this this um it was uh in fy16 budget there were no changes that's right we're not moving dispatch are we no this is just in this building's office and the annex

[0:06:13] so this is going to take that old Board Room I mean that old courtroom and just renovated completely just that whole area back there yes sir is it going to be a large space is going to put in conjunction with what they have now what little they have now well basically we're moving it we're moving it to that end because we had some mold problems that we've eliminated and uh in the the core of that wasn't that area so that they started using that area and then eventually at one time we thought that we may need that space to expand utilities water bring you know bring water and building all together but we realized that we're not going to need that space for that and it was just more conducive and made more sense to allow itech just to expand in that area so yes and it is consistent with the overall plan that the mayor's been working on for the City Hall that's where they were going to be they'll be there that will be their office the whole department not just two people well it's uh their eye their texts are in the print especially they're pretty they move back to the space it's been renovated where they're pretty much the word you know all these all these fourth they had all moved to the old Court the cats are moved back in there and they've reallocated the spaces we're leaving and Chris were that could be storage and other space for some interns administrative this will be like the administrative it does have some awesome storage rooms that could maybe burn into offices that needed that's going to break room for the staff he's got Chris's office he's going to leave his office or area and a large meeting where this is where the previous meetings and things like that would have taken place in Chris's office in the previous space that's been converted into storage room making more convenient for the kicks to get to the the departments and so forth they need and it opens up a better administrative area for Chris and the lead hook to do though so the news will take place in this area now

[0:08:17] rather than having to be in his previous office and I'm sure he'll also do emergency and I did verify we that this would not uh conflict with any future plans to renovate the entire building so it's nothing yeah we're not going to do anything and then come back later and have to redo it so this would be money that would be well spent it's not it would not be duplicated later and as I mentioned it to y'all in the near future I'll bring some information to you you know as far as running back the entire building that's something that we you know talk about uh but never really had a formal plan and I've been working on that so in the near future I'll have some information to present to the full board you know with future plans for that but anyway long way to say this uh this project will not uh have to be duplicated anyway so it'd be efficient use of the money to go ahead and correct their part of it yeah is this going to free up a office at the police department that he now occupies government has any impact on that or not we'll let Chris into that one I don't currently uh occupy an officer there there is a one office space that's reserved for chaplain duties that I shared with the other police department chaplains but I do not have an office oh okay so it was my understanding that that you had moved over there since all of this was going on an open space like this for the last year with the rest of my staff and up really appreciate your consideration of this and looking forward to getting back to having an office where we have meetings and has some malls and walls yeah they have been sitting in a one big wide open running yeah they have I've been over there it's been lots of good bonding going on yeah thank you yes sir Mr Mayor I moved me approved Builders as the lowest investment uh for the I.T office renovation project second we have motion moderate pain the second Alderman Ferguson is there any other

[0:10:20] discussion contract and allow the makers sign that contract again we have a motion and a second any other discussion hearing none roll call yes yes yes that motion carries thank you and then I think Bradley you had those uh next on the list is our award for bid for a new backhoe for Public Works yes sir we have um we're in construction cases of I apologize we had um thank you pricing for a new backhoe it was um you recall last meeting it was included in the budget revision that Chris Wilson presented some Monday so there's budgetary symbol of additional funds for that which is officially we had three quotes of John Deere equipment SUV equipment and a cat and caterpillar the John they're all very common with a thousand dollars of each other very comparable bids the John Deere was the lowest invest equipment that would recommended that okay privileges I think my apologies it's kind of been in court before the Lord's drafting course or whatever but we just want to get everything back in order and she brought about were foreign John Deere was the lowest

[0:12:26] they were yes sir I get I get more competitive now they are yes sir a little surprised the staff is supposed to try for that day but but they're very pleased to see that so very good okay we'll entertain a motion to award the bid we have a much smaller McKnight second Army Gallagher is any other discussion hearing another yes yes okay and that motion carries next on our agenda thank you a resolution for sanitation accounts Nick it's just the resolution for the delinquent sanitation accounts allow the the place the same as you've done before I'll make that motion a second we have most modern employees second Alderman Ferguson is there any discussion appearing on the roll call yes and that motion carries next on our agenda is a resolution for the lanes resolution to follow liens associated with cuttings for Compton genots that would be it'll be then converted to assessments um the fall but this resolution will allow for the liens to be filed and assess the payment and the penalty I'll make that motion as well for a second the most modern fluores second modern Ferguson is there any discussion figuring none we're all called yes

[0:14:34] okay that motion carries next on our agenda is a resolution granting Authority into claiming private property and make provision for collection at 1676 Custer Drive Ms Whitney cook yes basically this is um permission for us to proceed forward with the removal of the earned home it's been burned since 0-9 we've done all the official notifications got all the documentation necessary submitted info to the one family member we could track down regarding the hearing we did speak to that it was actually the mother of the deceased owner she's aware of it says you know there's nothing she can do at this point she's hospitalized herself and elderly so at this point we're asking to do is have the permission to actually fully condone the property and remove the house after a 10-day waiting period seconds we have a motion monitoring time a second Alderman Kelly is there any discussion hearing none we're all call me yes yes okay that motion carries and then same thing next on our agenda resolution granting Authority claim private property make provision for collection at 526 Christie book Christy Brook uh yes sir same situation we've um officially notified we did track down the property on this elderly Chapman has not lived in the house for some time actually reside somewhere else in South Haven um does not have money nor does he have any um feels like he has any responsibility to tear it down basically can't afford it he can't do anything with the property we have cleaned the property up in terms of the exterior we've condemned the property already to that extent this one is in a very dilapidated State and it's quite dangerous to the neighboring

[0:16:39] properties but we're requesting to do the same uh condemn it even further have the property or the actual building removed from the property after a 10-day waiting period build a motion ball Army Kelly and a second Army Gallagher is there any discussion Blue Ridge Drive we did have one that was tabled and brought back to the board at the last board meeting did speak to the owners of that property and spoke to the gentleman who was going to buy to rehab the house and flip it he has opted not to do that because the damage is that extensive but back to the property owners so we will be moving forward with removal of that one as well but we already have approval for that one I'm sure we're getting good feedback bringing the right response the neighbor's actually a Christie group when we cleaned up the property actually brought their lawn chairs out and sat and watched it get cleaned up at Blue Ridge Parkway one we've had many neighbors call us uh excited about it we've actually had a builder call and ask who the owner was so he could buy the lot and rebuild on it so we had a very good response to it so far we've made a lot of progress in that there for a while we had some um Hang-Ups you know in the process and we've at Whitney and I met Fire Chief Matt and we looked for some different ways to get in touch with the owners and that process is much better so we were able to take action on many that have been sitting for you mentioned 2009 on one of them right and I think the Blue Ridge location was about 11. it was 2011 on that one we've got some sitting there in numer between 2009 and 2013 or where the majority of these are coming from so they've been sitting for years and they're dangerous you know the houses like that you know the neighboring kids you know it's hard to keep the kids out of there so it's uh not only an eyesore and uh today just for our property values but it's actually public safety risk so it's it's nice and I think that people are very happy that they're seeing action there right is there any other discussion

[0:18:44] hearing non-roll call yes that motion carries all right next on our agenda's resolution granting authority to clean private property Mr Megan will be approved when uh The Authority that we give to the authority to clean private property is present in the state we have a motion volume in pain a second dollar mankind is there any discussion among the board hearing none is there anyone in the audience that would like to speak regarding any of the properties on the list heating or hearing or seeing none roll call plays yes yes okay and that motion carries next on our agenda is our planning agenda okay so we have two applications on our planning agenda tonight the first one is subdivision application for 5.25 Acres of property on the north side of State Line Road West of Millbranch uh there are some existing structures on um the site you have HVAC training facility there it used to be the assimilation Hall was once a church there's essentially four buildings on site right now the applicant is requesting to subdivide it into five Lots provide access Ingress egress on both sides with existing drives are and provide a new commercial lot along the front where that large Hill is in front of the buildings and then separate each one of those buildings into their own individual site share parking actually works out quite well we're going to consider an infield development because there's some of the criteria it can't be like the 50 Foot Ingress seagrass it's a tight spot we're willing to accept

[0:20:45] two-way access and 24 foot dry valves we did ask for the 53 feet of ride-of-way which is one of the right of ways we were going to have to go and get for The Pedestrian pass that worked on our paper for that but it does meet all the remaining criteria for commercial subdivision and we're recommending approval Court of emotion kind and the second Alderman Kelly is there any discussion I would just like to say I'm happy it's a subdivision at this point but their plan is to you know right now we approved a development to go in one of those buildings but it was all one lot so at that point we couldn't allow anybody else to occupy the other buildings on site this will allow them to take vacant buildings and occupy those and then you actually provide one very ideal lot on it which will be right there in the front cut that Hill down and provide a good commercial lot along that Frontage we see lot two right there um they designed it to have that out parcel bottle on the front which more than likely will be sold very quickly you have a developer that bought the entire piece of property and that's his plan so it's still activity on the site you're not I can't say that it's an occupied or a you know commercialized use at this point but it's the first step towards it commercial buildings yes it's already sounds Marshall and like I said you do have existing structures on some of these lots and otherwise you've provided a vacant lot for new development so it's what we call an infield development um it's nicely into the neighborhood right there and it will produce the activity that we're looking for on them so they'll raise the old the Christ the King Church and I don't know that one's in pretty good shape and the one next to it's in good shape there is one building we've spoke of uh before that's in the very back it is a very dilapidated building Fire Marshals have looked at building officials have looked at it I don't know that that one's going to be something that can be occupied uh there

[0:22:47] is an HVAC building that is already being occupied on site so you'll have some buildings that are going to need a lot of work I have to cut down others that don't and then you're going to have lots that are going to have just completely new development all the way around right okay maybe I'm just wait for me I guess but isn't there the convenience stores right there at that corner State Line we're not we're not actually on the corner um you see the lot that's showing right there the the hard corner is where your um okay so we're talking a lot more right next to that right and it is safe to say too that the uh incentives for the West End District have been effective it's gotten the attention we've had a lot of people that have uh inquired about that so that was that's been effective okay is there any other discussion for item one appearing on Roll Call yes yes yes yes okay now motion cares item number two is a request for a minor subdivision uh it's kind of out there in the middle of nowhere it's hard to explain to you where it is it's on the south side of Starling Road and it's east of Sweeney it's a large polishable property 11.23 Acres family owned property the fathers wanted to break it down to provide lots for his children to be classified as a minor subdivision has to be found Agricultural and it can only have three lots so that's what you have submitted here that he has provided an Ingress egress from Star Landing down that narrow part all the way to the back end so there is provided access to that rear lot otherwise not there are over one acre apiece which makes them compliant with a minor subdivision application and we recommend approval the second Alderman pain is there any

[0:24:54] discussion I do have one question there with some of the other issues that we run into with Ingress egress on streets that are not public streets are not dedicated are they building these streets to the requirements of a official City street if they did want to dedicate it to the city in the future at this point now it's a minor subdivision so they have opted to to I mean that's one of the criteria to go to a major subdivision they've opted to not do that so at this point it will be a private road if they do decide to try to dedicate it to the city they'll have to prove that they have built it up to city code it will work with civil link when they do design the road to at least have some as builts to see how it was built if they decide to request it if they don't build enough to Specs we just deny you know is it possible that we could have a document for them to sign that they understand that because what we run into it just update the board what we run into in the past is situations like this where there's a development in in the beginning it maybe it's a family you know it's all family so the so the uh the road going in the Ingress egress is not a public Street and so they know that and then as the years develop and then maybe as second homeowners come in they sell the house then people don't understand that so then there they come to the city and they're expecting us to maintain the road you know just treat the road this and that and and uh we're having to break the news to them that hey it's not a city street you know a lot of times they have difficulty understanding that right and it would be nice if maybe we could something that could be very informal but just something that would have a signature alternative to produce lighter just in front of them if they choose to do it that way you know that it's not a public city straight the city will not be maintained in the streets again and they are choosing to record it minor subdivisions aren't required to be recorded at the county level but they are choosing to record that so we can't actually place a note on the Plaid as well so that just kind of formalizes it even more okay good thank this is like that street that you and I have talked about yeah we've been talked about a lot we've had

[0:27:00] some had some some with uh multiple meetings trying to explain that it's been difficult for some to understand okay is there any other discussion about uh item two hearing non-roll College yes yes okay yes yes expensive okay next on our agenda stairs report just an update everyone on a few things before I do that we do have one issue that does require board action nrcs is a federal agency that provides Co-op funding for drainage Improvement and we just found out recently that we were approved for funding through nrcs for the State Line Road North project it's in the North Creek area you know we've talked about that I know Alderman kite has fielded many questions about that so we made application for that and got approved so uh there's some upcoming documents that are time sensitive that they're going to want to sign basically the way that works it's a 75-25 Co-op plan we do have our money in our drainage Improvement fund and uh and that was our priority to you know leverage our money and take advantage of any federal monies that are out there and this is one of them so it starts out at 70 by 25 uh Mr Cordell was telling me it is possible sometimes that they will up that 85-15 so it's possible that we could have this one done uh with 85 Federal money to the nrcs but they've approved it and uh quickly they're going to want some documents signed we didn't know that until after the deadline Friday that's why I'm depending on the mayor's report but if y'all will for me if y'all approve make a motion and I'm asking you to approve giving me authorization to sign the nrcs contract so we can move forward with the State Line Road Drainage Supply too

[0:29:01] like and just quickly uh for those that just to remind you this is the ditch that's on the north side of State Line Road um across from North Creek subdivision that uh ties in almost to uh North uh and it's had we've had problems for the road actually uh was was eroding so it's it's a high priority item so we're happy that we got you know Co-op funding for that so second Alderman pain is there any discussion hearing none all in favor say hi all opposed say no I just haven't motion carries thank you all right the next thing just speaking of drainage just update everyone y'all know that um in 2014 we started allocating a half a million dollars every year to improve drainage in our city uh last budget Year we're able to do nine projects with that money this year we've done the same thing we're steadily working we had one that was a significant drainage problem on Char Stone which is the subdivision that's behind just north of Kohl's the department store okay it's for you you know these y'all want to talk about it's off of uh it's just east of Sweeney it's kind of behind coals but they had a major drainage problem that was causing eight to ten homes to have water in the home so it's a pretty serious one and as you all know when we set our drainage policy we did it based on you know cost benefit ratio the money we spend how many citizens in the city we can help well this is a good one you know because we knew that we could help about 10 people keep water at their home and so we've been working on that and um so finally I'm just here to report to tell you that the Charleston project is done so yeah we got that done the only thing that's left and uh Mr Cordell correct me if I'm wrong I think the only thing left is maybe doing some uh repairing the

[0:31:03] street you know where we had to do replace the size of some culverts and things but anyway this is one that the people have been very patient it's been a very bad one you know the the big storms that we had in 2013 and 14 that had water in their homes so I'm happy to record that Char stone is now is now complete mayor I'd like to personally thank Dan Cordell and his people in that life that worked on that project this was over my award and I got constant calls from flooded homes and this is this is going to happen quick and I just wanted to personally thank you thank you for saying that um and then we will continue on with our list but uh since that was that was one of our biggest ones about 200 000 on a project but again I benefited many homes and we're very happy that we could get that um just another quick update uh Street Improvement schedule uh that works as you all know we approved the schedule the work should be uh beginning you should see contractors on the street in the next two or three weeks so we'll get started and we'll have plenty of time and good weather to finish all the streets on our list um one other reminder too the um uh get well South which is south of Church Road to College Road has been uh resurfaced and that's not the city doing that that is County the county applied for money to a state aid program and they received that money so that's been allocated to the city of South Haven right there so that's not to be confused with a future widening project that will be in the same area this could be three or four years down the road this is just a resurfacing there's no Lane changing or widening it's just going to be a resurface of get well south from excuse me Church Road to College Road so you probably noticed the trucks down there now there are busy working on that we did request that they get that project done before the school starts so we're hoping and they told us that they have it done before school starts

[0:33:07] but anyway just wanted you to know if you see what's going on that is the that's funded by state aid money through the county and that's underway now one quick last thing I want to update everyone y'all know that when we set the budget we had a beautification budget line item and this year what we had planned to do with the beautification money is to add City entrance signs you know we talked about putting something on Interstate 55 to you know real nice brick based sign that when you when you enter South Haven both on the North side and the south end of our city on Interstate 55 where you would know that you're in Southaven we still have plans of doing that we ran into some Hangouts the Federal Transportation has some strict guidelines on where you can put a brick based sign like that for safety reasons so it has to be on a private land it can't be on the Federal Highway right away so we run into a few snags there then we start designing the sign and to make a real long story short Whitney we um we did not have good success getting the design done so we've shifted gears a little bit so this year I just wanted y'all know here's what we're going to do with the money we're going to wait until some things are a little more clear on the interstate signs I'm still going to do that but this year this budget money the reason you've not seen any expenditures yet is we've shifted gears from doing the I-55 science to just general city into the Sun so in all the city arterial streets coming into the city we're going to put a less expensive sign but it's going to be decorated we've got a design company working on it now I will have like a you know decorative wrought iron pole and it's not just your typical green city limit sign it'll be nice you know when you come in it'll have a black wrought iron pole and um and have a decorative sign basically it says Southaven top of Mississippi you know to be consistent with our own so that's being designed now and uh we plan to use that money that budget line item for that but uh I just I didn't know I

[0:35:09] thought maybe I had some questions on why you have not seen anything come out of that and that's that's the reason we've had a delay you know you know getting those signs designed we'll be able to have more of those signs now oh yeah we'll be able to have more of them because they're much less expensive than doing a brick based sign and the more that we researched it and I started running into problems with uh right away and laying it's much more practical and uh efficient I think to have a sign that's a metal sign with with wrought iron they're trying to do a brick base you know because think about it somebody hits it you know you got some safety issues there then cost to repair it you know they didn't get hurt so I mean if it did get damaged so um and plus we can do more with less money so I think that we will you know put the entrance signs there with this year this year's money and then next year the following year we'll focus on the I-55 but just an update and that's all I have uh on the mayor's report next on our agenda is our citizens agenda and we did not have anyone sign up to speak on the citizens agenda based on our agendas our Personnel document this may remove we approved the Personnel document is presented on the state we have a motion volume pain a second by ottoman Kelly is there any discussion appearing on Roll Call yes okay and that motion carries next on our agendas our city attorney's legal update Mr a couple hours tonight uh the first item is uh authorizing Professional Service agreements with a parks department for West Brown to sign Professional Service agreements for those individuals who do our services for the senior citizens and this is yoga Services aerobics exercise Services it will be a contract I'll just
